Ord No 20-24-2505ORDINANCE NO. 20-24-2.505 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, ADOPTING A PROPOSED MILLAGE RATE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2024 THROUGH SEPTEMBER 30, 2025 ("FISCAL YEAR 2024/2025"), WHICH RATE MAY BE AMENDED AT FIRST OR SECOND READING; AND ADOPTING THE FINAL MILLAGE RATE ON SECOND READING; PROVIDING FOR CORRECTIONS; CONFLICTS; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, pursuant to section 200.065, Florida Statutes, the Miami-Dade County Property Appraiser has certified the taxable value of real property within the City of South Miami ("City") for the year 2024; and WHEREAS, the City's proposed millage rate is 3.9500 and the rolled-back rate for the Fiscal Year 202412025 is 3.6351; and WHEREAS, the City Commission wishes to adopt the proposed millage rate of3.9500 to be levied for the Fiscal Year 202412025, which rate is an 8.66% increase over the rolled back rate of3.6351 mills; and WHEREAS, pursuant to section 200.065, Florida Statutes, the Mayor and City Commission are required to adopt a proposed millage rate and, thereafter, a final millage rate for the City of South Miami. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2. Adoption of Proposed Millage Rate; Announcing Percentage Increase. The proposed millage rate of3.9500 is hereby adopted and shall be and hereby is levied upon real property in the City, a tax of 3.9500 mills on the dollar for the operational expenses of the government of the City for the Fiscal Year beginning October 1, 2024, and ending September 30, 2025. The proposed millage rate of3.9500 exceeds the roll back rate of3.6351 by 8.66%, which is statutorily characterized as an increase in property tax. Section 3. Adoption of Final Millage Rate; Announcing Percentage Increase. The final millage rate of3.9500 is hereby adopted and shall be and hereby is levied upon real property in the City, a tax of 3.9500 mills on the dollar for the operational expenses of the government of the City for the Fiscal Year beginning October 1, 2024 and ending September 30, 2025. The final millage rate to be levied of 3.9500 exceeds the roll back rate of 3.6351 by 8.66%, which is statutorily characterized as an increase in property tax. Page 1 of2 Section 4. Corrections. Confonning language or technical scrivener-type corrections may be made by the City Attorney for any confonning amendments to be incorporated into the final ordinance for signature. Section 5. Conflicts. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 6. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding will not affect the validity of the remaining portions of this ordinance. Section 7. second reading. Effective Date. This ordinance is effective immediately upon adoption at PASSED on first reading on the 3rd day of September, 2024.
