A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH
MIAMI,FLORIDA,APPROVING AND ADOPTING A SPECIAL EVENTS
FEE WAIVER POLICY TO ADDRESS REQUESTS TO WAIVE SPECIAL
EVENT FEES PURSUANT TO SECTION 15B-6(11)OF THE CITY CODE
OF ORDINANCES;PROVIDING FOR IMPLEMENTATION;
CORRECTIONS;SEVERABILITY;AND AN EFFECTIVE DATE.
WHEREAS,Section 15B-6 of the City of South Miami (the “City”)Code of Ordinances
(the “Code”)provides a procedure for authorization of a special event which includes the
requirement that a person presenting the special event (the “Event-holder”)reimburse the City for
all of the City’s revenue losses and expenditures incurred by the City in the provision of City
services and resources to a special event (the “Special Event Fees”);and
WHEREAS,upon the request of an Event-holder,the City Commission may consider
waiving all or a portion of the Special Event Fees pursuant to Section 15B-6(11)of the Code;and
WHEREAS,a waiver of Special Event Fees does not eliminate the costs of providing
services and resources to the City,rather it shifts the burden of those costs from the Event -holder
to the City’s general fund;and
WHEREAS,the City Commission does not currently rely on a formal policy to govern
consideration of such requests;and
WHEREAS,the City Commission desires to consider and adopt a policy to govern future
requests seeking waiver of all or a portion of Special Event Fees in order to standardize its
evaluation of such requests;and
WHEREAS,a Special Events Fee Waiver Policy,attached hereto as Exhibit “A,”has been
created to establish guidelines to be used to evaluate requests for fee waivers;and
WHEREAS,among other things,the policy provides that the City Commission as a whole
can waive up to $25,000 per fiscal year towards Special Event Fees for one or more special events
through sponsoring a resolution pursuant to Section 15B-6(11)of the Code,together with
suggested guidelines for considering fee waiver requests;and
WHEREAS,the proposed Special Events Fee Waiver Policy was presented to the Town
Center Advisory Board and discussed on August 14,2023,and September 6,2023,resulting in no
proposed revisions to the policy;and
WHEREAS,the proposed Special Events Fee Waiver Policy was presented and discussed
by members of the City Commission on September 19,2023,resulting in revisions to the policy
as detailed in Exhibit A -Special Events Fee Waiver Policy;and
WHEREAS,the City Commission finds that this Resolution is in the best interest and
welfare of the City.

NOW THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Recitals Adopted.The above-stated recitals arc true and correct and are
incorporated herein by this reference.
Section 2.Approval and Adoption of Special Events Fee Waiver Policy.The City
Commission hereby approves and adopts the Special Events Fee Waiver Policy set forth in Exhibit
“A”attached hereto.
Section 3.Implementation.The City Manager is hereby authorized to take any and
all action necessary to implement the Special Events Fee Waiver Policy and the purposes of this
Resolution.
Section 4.Corrections.Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature,or to the Special Events Fee Waiver Policy.
Section 5.Severability.If any section,clause,sentence,or phrase of this Resolution
is for any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding
shall not affect the validity of the remaining portions of this Resolution.
Section 6.Effective Date.This Resolution shall become effective immediately upon
adoption.

SUBJECT:Special Events Fee Waiver Policy.
RECOMMENDATION:At the request of Commissioner Bonich, the above-referenced subject is
submitted for consideration by the City Commission to support the
creation of a Special Events Fee Waiver Policy (the “Policy”). The goal of
this Policy is to establish guidelines for evaluating fee waiver requests.
BACKGROUND:The event fee waiver policy was updated to align with the guidance
provided by the Mayor and Commission during the City Commission
meeting on September 19, 2023. The resolution was later withdrawn on
December 5, 2023.
This item has appeared on multiple previous agendas and has been
rescheduled for consideration on January 7, 2025.
The changes to the policy have been highlighted for easy reference.

I.PURPOSE2
The purpose of this policy is to establish guidelines to be used to evaluate requests for fee waivers 3
and to implement a structure and process through which consistent information for fee waiver 4
requests will be collected and evaluated.5

Eligibility for fee waivers or reductions largely depends on the event sponsor and the nature of 7
the event. Events that provide public benefits (i.e., increased business activity, recreation, 8
community activity, or destination point improvement)to the entire city are best suited for a fee 9
waiver.Furthermore, the number of special events that are eligible for fee waivers or reductions 10
will depend on budget and operating impacts and will vary annually. 11

II.BACKGROUND13
Fee waivers are an expense to the City’s General Fund. Fees are established to pay for the cost 14
of a service provided by the City. When a fee waiver is granted, the city bears the cost out of the 15
general fund. Only the City Commission may grant a fee waiver request. 16

III.POLICY18
The City Commission, may, at its sole discretion, approve or disapprove fee waiver requests per 19
Sec. 15B-6 (11) of the City Code.Per this policy,the City Commission as a whole can waive up to 20
$25,000 each member of the City Commission is allocated $5,000 per fiscal year that he/she can 21
apply towards special event fees of one or more special events. The A Commissioner may will22
sponsor a Resolution for fee waiver subject to Commission approval. 23

Fees associated with street closure(s) and maintenance of traffic may be waived, or alternatively, 25
an Ordinance may be adopted noting that said fees no longer apply to Special Events (they will26
apply to construction and right-of-way work related service only).27

The City Commission, in its sole discretion, may decide to increase or reduce the annual amount29
the City Commission can waive. The City’s Parks and Recreation Department will maintain records 30
and provide fee waiver data to the City Commission as needed.Staff reserves the right to present 31
an unsponsored fee waiver request to the City Commission.32

Fee waivers do not relieve the applicant from payments and obligation for 34
insurance/indemnification requirements, security deposits (501(c)(3) non-profit organizations 35
are exempt), other financial obligations associated with events,activity,or other conditions of 36
approval that may be required. 37

The following general guidelines will be used to assist in the determination of whether a 39
requested fee waiver is eligible or ineligible. 40

VI.ELIGIBLE ACTIVITIES THAT SHOULD BE CONSIDERED62
Event, program, or activity for which a community/public good can be 63
demonstrated that is free of charge and open to the public.64
Event, program, or activity that create revenue generating opportunities for local 65
businesses. 66
Event, program, activity, or improvement is of public benefit to the City of South 67
Miami and/or surrounding community, or a significant portion of its residents.68
Fundraising activities/events only when a portion of the funds raised will be 69
directed back to the City or service in an amount equivalent to the waiver.70
Intergovernmental cooperation, where there is a public benefit to a significant 71
portion of the residents of the City of South Miami and/or the event or temporary 72
use does not have a significant impact on city services, operations, or activities. 73
City sponsored or co-sponsored events, programs, or activities. 74
Event, program, or activity held and organized by non-profit organizations, as 75
defined by the Internal Revenue Service (IRS), having IRS approved tax exempt 76
status, formed for civic or educational purposes.77

I.FEE WAIVER APPLICATION PROCEDURE 86
Applicant must review the Special Events Handbook, Fee Waiver Policy, and 87
submit a completed Special Events Application, including payment of the 88
application, administrative fee, and a fee waiver letter from the business or 89
organization. 90
The application process can begin twelve (12) months in advance and a minimum 91
of sixty (60) days prior to the event date. Please note that all applications 92
submitted with less than thirty (30) days prior to a requested event date may not 93
receive the necessary approvals from the required City Departments and/or City 94
Commission and may be rejected.95

Sec.15B-6.-Use of city property for organized activity.
Purpose.The City of South Miami must ensure that public property and public street locations within the city
are used properly and are regulated to ensure the safety of pedestrians,vehicles and general public and to
secure reimbursement to the city for the cost of such activities.Special events and the use of city's rights-of-way,
parks and recreational facilities that require city services and resources to be expended including but not limited
to administrative,security,clean up,banner hanging,street blocking,covering of parking meters.
(1)Definitions:
City means the city manager or the manager's designee,or the City of South Miami,depending on the
context in which the word is used.
Person means any individual,firm,legal entity joint adventure,organization,syndicate,or other group or
combination acting as a unit,association,estate,trust,business trust,trustee,executor,administrator,
receiver,or other fiduciary,and includes the plural as well as the singular.
Presenter as used in this section shall include the person who organizes the activity.
(2)Permits and cost reimbursement:All persons presenting a special event using public property or
public streets or who use the public rights-of-way,parks and recreational facilities within the city
when such use requires city services and resources to be expended must complete a permit
application and shall reimburse the city for all city revenue losses and city expenditures associated
with the approved uses.Approval of all special events and use of city's rights-of-way,parks and
recreational facilities,shall be in compliance with this section,after administrative review of all
complete special event permit applications.All special event permit applications must be received,
at a minimum,thirty (30)days prior to the proposed special event,unless specifically waived by
the city manager.
(3)All persons presenting an approved special event,which closes a public street,must provide,in
advance,a petition,approving of the road closure,signed by a majority of the businesses or
homeowners facing the street affected by the approved special event road closure,unless this
requirement is previously waived by resolution of the city commission.
(4)All persons presenting approved special events using public property or public streets within the
city must agree in writing to pay the actual amount of city revenue losses and final city
expenditures associated with the approved special event,which may include,but not be limited to:
road closure costs,barricades,public works staff,lost parking revenue,police services and clean
up services.If a city right-of-way,park or recreational facility is being used that requires city
services and resources to be expended,the organizer shall be responsible for paying a city park
rental fee in accordance with the city's park rental fee schedule,a security deposit,and any fees
associated with producing the permit.

All persons presenting approved special events using public property or public streets within the city which have
been allocated monetary grants in the city budget,shall be required to pay for the required reimbursement from
the designated monetary grant unless otherwise prohibited by the grant.
(6)Compliance with all laws.The person presenting the special event or using city's rights-of-way,
parks and/or recreational facilities shall comply with section 20-4.3(N)[of the Land Development
Code]relating to banners over the right-of-way.Additionally,the presenters of the special event or
who organizes an activity using city's rights-of-way,parks and/or recreational facilities shall comply
with all city policies and state and federal laws relating to Americans with Disabilities Act,including
ensuring sufficient and appropriate bathroom facilities,proper location of displays and exhibits,
and parking requirements;and ensuring compliance with the Florida Division of Hotels and
Restaurants,Department of Business and Professional Regulation requirements relating to food
establishments and public food service for temporary event vending.Additionally,each special
event presenter shall obtain a South Miami Public Works Permit application for work within the
right-of-way,and pay any fees associated with producing the permit.All special event presenters
and all persons who organize an activity using city's rights-of-wav,parks and/or recreational
facilities shall also pay,if applicable,a clean-up deposit as well as any additional costs associated
with police or other department off-duty employment to the city prior to the permit being issued.If
the presenters or organizers meet the terms for a refund of the clean-up deposit,the city shall
issue a refund of same after inspection of the area used to insure compliance with this section.
(7)Policies,procedures and insurance.The city shall establish policies and procedures for the
implementation of special events and for the use of the city's rights-of-way,parks and/or
recreational facilities,which policies and procedures shall include:a permit application requiring
the disclosure of the name of the person(s)presenting the event,the address,telephone number
of the presenter,the names of principals and officers of any presenter who is a legal entity,the
delivery of an insurance policy and endorsements that comply with the city's standard insurance
requirements then in effect,including the naming of the City of South Miami as an additional
named insured and providing ten (10)days advanced notification to the city before the policy can
be cancelled or modified,the delivery of an indemnification agreement that complies with the city's
standard indemnification requirements then in effect for the event or activity as well as other
certificates,documents and information that the city manager deems appropriate for all applicants.
Each policy shall provide coverage for the event or activity,including set up and dismantling of the
event.Organizer shall ensure that the policy limits in accordance with the insurance policies of the
city as set forth in the city manager's administrative procedures.The city shall not be held liable or
responsible for any claims which may results from acts,errors or,omissions of the presenter,its
contractors or its subcontractors,suppliers or laborers.In reviewing,approving or rejecting any
submissions or acts of the organizer,the city in no way assumes responsibility or liability for the
acts,errors or omissions of presenters,or their contractor or subcontractors.

(8)Failure to adhere to the provisions of this section shall result in the issuance of the daily running
civil infraction fine of five hundred dollars ($500.00)per day,plus any and all actual costs incurred
by the city until such time as the person complies with this section.Appeal of any civil infraction
shall be to the special master or magistrate pursuant to section 2-25 or as otherwise provided in
the City's Code of Ordinances.
(9)Each application shall be accompanied by the permit fee as delineated in the city's fee schedule.
(10)The city manager may issue a sound permit as set forth in section 15-97.
(11)The city commission may waive the fees and costs required by this section.
(12)Revocation of permit.The city manager or designee shall have the authority to revoke a permit
upon a finding of violation of any federal,state,county or city law,rule or regulation or finding that
any of the facts contained in the permit application are false in any manner.The city police
department shall have the authority to order termination of the event and to evict the participants in
the event that the permit is revoked or should the continuance of such event contribute to public
disorder or endanger life or property.
(13)Display of permits.All persons required to have a permit for reservation of a park or park facility
shall produce and exhibit said permit upon request of the city manager or designee or any city law
enforcement officer who shall desire to inspect the same for the purpose of enforcing compliance
with any ordinance,resolution,or rule.Failure to produce and exhibit such a permit shall be
grounds for the removal of such participants,or event,including any associated equipment.

Special Event Fee Waivers
Coral Gables
Certain fees have the opportunity to be waived. Fees are
waived via Commission. The Manager or Commission
reserves the right to not place on the agenda if they deem
appropriate. Usually non-profit or worthy cause. Fees
such as staffing, police, fire, electrical are NOT considered
to be waived. Fee waivers are generally given to a few
events. We usually permit about 75 events per year and
maybe 10 - 12 get some sort of waiver. They are all non-
profits or have a connection to the City like our Chamber
of Commerce
Cutler Bay Planning and Zoning: Morelia - Do not waive fees
Doral
Planning and Zoning -Stephanie Publia -305-593-6630
ext.3003 Events that are approved to be waived become
City sponsored events - each event gets a $5,000 limit
unless the city council in its sole discretion decides to
increase the amount.
Miami Gardens
Craig -Any requests for fee waivers must come from a
Councilmember. An agenda item must be approved for a
waiver of fees for the use of the facility and any
equipment and/or staff needed to do the event. Usually
fees are not fully waived, just reduce rates for non-profit
for facility rentals, etc.
North Miami Beach Planning and Zoning - Raymond - (305) 354-4456 Free,
there are no fees for a special events.
Palmetto Bay Planning and Zoning: Free, there are no fees for a special
events.
Pinecrest Daniel Alberty, Events Manager- 305-284-0900: Council
waives fees - Non-Profit: 50%. Only heard of 1 event in 11
years that got waived.
Fort Lauderdale No limitations; at the discretion of the Commission.
Overall waivers are rarely approved.
