The Pledge of Allegiance to the Flag of the United States of America was followed by the roll call. PRESENT: Pat Masters, Chairman Harvey Pierce Edward H. Coburn James Bowman Jacques S. Fleischer Bernard Michelson Mr. Gilbert A. Russe, Building Official, was present. (Eva Longbrake has moved out of South Miami and tendered her resignation effective August 12, 1976. ) Approval of Minutes of Meeting of August 10, 1976, was deferred until the Executive Session. Public Hearing #76-19 L.P. Antonacci Request: Approval of Tentative Plat of REPLAT OF TRACT K, Tranquility Estates. Legal Description: Tract "K" , TRANQUILITY ESTATES , PB 78/64. Address : S.W. 69th Avenue and S.W. 62nd Terrace Mr. Antonacci appeared before the Board to get a tentative approval to subdivide this property. He does not intend to build at this time, at least within the next 2-3 months. Also, Mr. Antonacci stated that Dade County has given tentative approval, subject to certain improvements and approval by the City of South Miami; that if mandatory now to make improvements, he will withdraw the request. He has an income from the property of approximately $8 , 000 annually, and will tear down the existing buildings when ready to build anew. Gross and net lot area figures have been submitted to Mr. Russe prior to the hearing. Mr. Antonacci stated that if approved by the City, he will request the County to withdraw their request for public sidewalks to be put in. There are no other side- walks anywheres in the area. Meeting of August 31, ,1976 -2- PUBLIC HEARING #76-19 (Cont. ) Mr. Paul Young, of 6825 S .W. 64th St. , appeared before the Board. Noting that the hearing notice referred to "variance" , Mr. Young inquired as to what type of buildings will go on this property. Mr. Antonacci stated there will be single family residences , and he intends to give ownership to each of the 5 homes to be builtfor each of his children, or possibly sellthem. The 3 existing buildings would be torn down. The value of the homes would be consistent with homes in the area. Mr. Michelson clarified the request; that Mr. Antonacci was not requesting a variance, as the notice erroneously stated. Mr. Adam Taft, of 6860 S.W. 63rd St. , appeared before the Board. He noted that :at least one of the lots would have less front footage than other plots in that area and directed the Board' s attention to the Covenant of Tranquility" in the plat. He stated his concern for the neighborhood. Mr. Michelson noted that the property is zoned RS3. The Code requires minimum frontage of 75 feet, and the parcel which is the smallest of the group is 93 feet frontage. Address: 5897 Commerce Lane. 5887 S.W. 70th Street Alan Dale Mobley, of 3300 Rice Street, #4, Miami, appeared before the Board. He stated he has developed several tracts in this area, basically all 1-story CBS warehouses. This property is presently zoned for down- town commercial although the uses are predominately automotive services, and light warehousing operations. Mr. Mobely stated that he was not aware of the change in zoning regarding the Master Plan in 1971. Mr. Michelson stated that the public hearings for the Plan were well advertised. Mr. Mobley submitted the necessary signatures to the Planning Board. MOTION: By Mr. Pierce, seconded by Mr. Bowman, that the request to change zoning from C-2 to Intensive be approved. VOTE IN FAVOR: Yes - 5 No - 1 (Fleischer) . MOTION CARRIED. Executive Session: The matter of Tropical South Roller Skating Rink, 6600 S.W. Red Road was discussed. Mr. W.L. Cox, of 2323 S.W. 67th Avenue, and Jacob J. Friedman, representing Anthony Abraham Enterprises, appeared before the Board. Mr. Russe stated that there is no category specifically for roller rinks in our zoning ordinances. The closest permitted use would be billard parlors and bowling. (recreation) . He suggested this be considered in C-3 zoning. The Board recommended that this be placed in C-3 under special use, in the same category as the bowling alleys. Section 5-14-3. 04 of the Code. MOTION: By Mr.- Pierce, seconded by Mr. Fleischer, that Section 5-14-3. 04 of the Code have the words "and/or skating rink" inserted after the words "bowling alley" , thereby having the same requirements apply to the roller skating rink. y Meeting of August 31, 1976 -4- Executive Session (Cont.) Page 2, second paragraph from bottom, change to: "Mr. Fleischer stated that all non-conforming uses must meet the criteria of the next most restrictive zoning classification each time the use to which the property is put ceases." Page 2, last paragraph, change to: "Mr. Michelson stated that the present RD zoning for the Minnix . property appears to be the best zoning for the property, and that if he is having trouble getting f inanc ing, it is probably due to the lack of need for office space in the area." Discussion followed regarding the recommendations of the Planning Board to the Council concerning a re-evaluation of the Master Plan and how they would implement getting current information on which to make any recommendations. It was concluded that inventor- ies be made, starting with small, key areas that need immediate attention, that being from Red Road west to 62nd Avenue, and the railroad tracks north to 66th Street. Every building in that area would be surveyed by address, lot and block, and the use it is being put to currently. Mr. Russe will contact the City Manager in regard to getting this accomplished. This would be one of four target areas to be considered for inventory. Mr. Russe will confer with Mr. Moore to see if zoning in Progress should be invoked during the re-evaluation. VOTE IN FAVOR: Yes - 5 (Unanimous) MOTION CARRIED. . Public Hearing #76-16 W.H. Minnix Request: Change of zoning from RO (Residential Office) to C-3 (Arterial Commercial). Legal Description: 1/2 of lot 12, all of lot 13 and 10 feet of lot 14, block 3, OAK HEIGHTS SUBDIVISION, PB 46/64. Location: 6330 Manor Lane. This request was deferred from the last Planning Board meeting of July 27, 1976. Mr. Minnix, owner of the property, appeared before the Board. He stated he is seeking "justice" as stated in the foregoing Pledge of Allegiance. He noted that the property is along the railroad tracks and was changed from commercial to townhouse zoning; that the property is inbetween 2 warehouses, adjoins a railroad and a 6 lane highway. He did not know of the change in zoning until he applied for a permit to build a warehouse. Mr. Minnix asked the Board to undo a wrong and change the zoning back to commercial as it was when he purchased the property. He has been maintaining the property for 5 years, cutting the grass, paying taxes, etc. and feels the property has been put in "limbo". He stated that he is appealing to the Planning Board' s sense of fair play and justice. He noted that he has 3 children approaching college education and that he needs this property to become income producing and useful to him. Public H:wring #76-17 (Cont. ) 2. He is asking the Board to restore the property to the zoning it was when he purchased the property. He is having difficulty getting financing for anything but commercial use. Mrs. Masters asked if anyone was present to speak against the request. Mr. Don Campbell, owner of the property directly across from the Minnix property on Manor Lane, appeared before the Board. He stated that he is in sympathy with Mr., Minnix' s dilemma. He was in favor (in the past) of having the property changed to office zoning. He has lived in this area for 25 years and is well aware of the neighborhood. He stated when the warehouses came in 5 years ago there was a constant flow of diesel-powered busses, followed by Land Cruiser vehicles years later. He stated he feels that if the request is granted, the land will be used for recreation vehicles, bringing more traffic into the neighborhood. If the hearing request is granted, Mr. Campbell stated he might be coming in years later asking to change his own zoning to commercial. He wants his neighborhood to stay residential. Dr. Ron Wellins, who lives diagonal to the Minnix property, appeared before the Board. He wished to correct the misconceptions as presented. He stated that the property does not have access from the 6 lane highway; that the entrance is on Manor Lane which is a narrow 2-lane, winding street. He stated the purpose of townhouse zoning was to provide low density housing and a buffer between residential and commercial uses; that to grant C-3 zoning would violate the definition of the zoning use as defined in the City Code. Mr. Robert Werk of 7610 SW 63rd Court, appeared before the Board. He stated that he is very much in agreement with Dr. Wellins as. he lives close to the Minnix property and wishes the neighborhood to stay residential. Mrs. Wellins, wife of Dr. Wellins, appeared before the Board and stated that it is apparent that land has no value if it has no use; that she empathizes with Mr. Minnix. She wishes to use her land to live on and wants to maintain the integrity of the area. She stated that there are other uses for the land available to Mr. Minnix other than C-3; that the land use should be compatible with surrounding use of land. The hearing was closed by Mrs. Masters. MOTION: By Mr. Fleischer, seconded by Mr. Bowman, to deny the request by Mr. Minnix to change the zoning from RO to C-3, as it does not meet the criteria for C-3. VOTE: Yes - 5 (Unanimous) MOTION CARRIED. h�ief discussion followed. Mr. Michelson asked when the zoning was changed. Mr. Fleischer answered it was done when the hearings were held on the Master Land Use plan. Everyone was notified, and it was incumbent upon owners of property to look at the use of their, own property. Mr. Fleischer also stated that the meeting was well publicized. Mrs. Masters asked Mr. Bowman, a long-time resident of South Miami, if he was aware oP the hearings when they were being held. He stated yes, however attendance was poor. Vice-Mayor McCann appeared before the Planning Board. She informed the Board that according to the Florida Comprehensive Planning Act of 1975, the Planning Board now has the responsibility of making any large or minor changes in zoning. For their additional information, the members were given a copy of Resolution #9-76-8eq the Overview publication, and will receive a copy of a booklet defining the Act, from Mr. Russe. Discussion followed regarding the Planned Unit Development (PUD) that the City of Miami has, and how a PUD would be beneficial to the City of South Miami. The Board will review the information given out at the meeting tonight and make recommendations to the Council and possibly request any aid needed to facilitate their functions as a Planning Board.
