You have asked for our opinion concerning the following
"restriction, limitation and condition" which the City of
Miami has placed upon its approval of the captioned plat of
land within the rapid transit zone:
" [I] n conformance with the South Miami
Comprehensive Plan, any proposal for
development on the South Miami Transit
Station site shall be subject to site plan
review and approval or disapproval by the
City Commission pursuant to the Planned
Development provisions of the Official
Zoning Ordinance of the City of South Miami. "
(Sec. 2, Resolution No. 80-82-4080)
s The foregoing provision is in conflict with Chapter.:,33C
of the Code of Metropolitan Dade County, Florida. This
Chapter provides for a "coordinated review and analysis
of. . .mass transit facilities" through "a uniform plan of
regulation applicable to the County as a whole. Section 33C-
1.
Section 33C-2 vests jurisdiction in the County "for
purposes of building and zoning approvals (including, but not
limited to, site plan approvals. . . ) . . . regardless of any
municipal code, charter or ordinance provision to the
contrary. " Section 33C-2 (C) . (emphasis supplied)
With regard to certain commercial uses B33C-2 (D) (9) (a) ) ,
other than the -usual transit facilities, within portions of
the rapid transit zone passing through municipalities, Section
33C-2 (D) (9) (d) of the Code establishes a special procedure for
building and zoning approvals. This procedure includes the
preparation of proposed master plan development standards by a
joint municipal--county program and further provides for the
adoption by the municipality of a master land use plan for
such commercial uses. The County, however, retains final
administrative jurisdiction for building and zoning approvals,
subject to the right of the municipality to seek judicial
review.
It should be noted that municipalities retain certain
durisdiction over zoning within the larger rapid transit
evelopmental impact zone subject to the County 's right to
seek judicial review. Section 33C-4.
