The existing use at this location is an automotive repair shop. The restaurant is proposed to be a small cafeteria which will serve ready-to-consume food and drink such as cuban coffee, hot and cold sandwiches, sodas and pastries. The service will be solely for take out. The proposed restaurant is 150 square feet and will not contain any tables and chairs. The proposed floor plan is presented as part of this application. The restaurant will be open for both breakfast and lunch. ANALYSIS The proposed restaurant is located in the intensive use district and directly across the street from the Metrorail station. Staff believes that the use will mostly attract employees and visitors to other uses in the vicinity and therefore does not impact the area significantly. In addition, staff believes that the requested special use: 1) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; 2) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and 3) Complies with all other applicable Code provisions. COMPREHENSIVE PLAN This requested Special Use Permit does not conflict with the adopted Comprehensive Plan of the City of South Miami. The City Manager may revoke this approval upon a determination that any other property is being utilized for restaurant purposes, and such use is related to the subject property, but such use has not been authorized and licensed by the City of South Miami, including storage, food preparation, deliveries or any other services related to this restaurant use . Shall mean an establishment where the principal business is the sale of food and beverages to the customer in a ready-to-consume state and where the design or principal method of operation is that of a fast-food or drive-in restaurant offering quick food service, where orders are generally not taken at the customer's table, where food is Qenerally served in disposable wrapping or containers, and where food and beverages may be served directly to the customer in a motor vehicle. (2) All such uses shall be determined to be of a compatible and complementary nature with any or planned surrounding uses. ANALYSIS: Staff believes that the requested special use complies with the overall requirements stated under Section 20-5.8 of the Land Development Code [found on page 111], regarding the required conditions for special use approval by the City Commission. I. Call to order and the Pledge of Allegiance to the Flag of the United States of America. Mr. Subrata Basu, Chairperson, called the meeting to order at 7:30 p.m. II. Roll Call. Present: Absent: S. Staff gave their presentation, noting that the application is for a "convenience' restaurant, in which the food will be prepared for take out only, as tables and chairs will not be provided on the premises. Staff explained that they recommended approval. inclusive of the two conditions outlined in their memorandum dated January 9, 1997 and provided to the Board. Public hearing was opened. PB Min 01/14/97 1 Mr. Juan Toral, owner of Toral Auto Care, spoke before the Board; however, he did not sign in for the record. Mr. Toral stated that his proposal is for a small, cafeteria-type establishment in which food and drink, such as sandwiches and Cuban coffee, will be sold solely for takeout. Mr. Toral explained that he would like to provide a "special of the day" in addition to regular menu items at the restaurant. Staff noted that a clarification for the record was in order. Staff explained that the proposal calls for a convenience restaurant only and not a convenience store. Staff further explained that for this property, only ready-to-consume foods are to be sold, as opposed to where goods are to be marketed. The Board and Mr. Toral briefly discussed the size of the restaurant, which will be small and likely incapable of accommodating a throng of customers. Mr. Toral responded that he does not anticipate a multitude of patrons, particularly at one time, due to the surrounding uses that the facility will serve. In regard to the Board's inquiries regarding cooking on the premises, Mr. Toral maintained that such preparation of food will be minimal and "limited". Ms. Linda Tobin, a citizen of South Miami, signed in to speak before the Board. Ms Tobin asked the City to be aware of the need to consider economic concerns, in addition to zoning determinations, in matters such as these where a business is attempting to diversify its offerings. Ms. Tobin related that the City may need to be less "rigid" in its zoning decisions, particularly as they involve its businesses. Public hearing was closed, and Mr. Basu called the question.
