Ord No 22-24-2507ORDINANCE NO. 22-24-2507 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING ARTICLE III "ZONING REGULATIONS," SECTION 20-3.3(D) "PERMITTED USE SCHEDULE" OF THE LAND DEVELOPMENT CODE, TO ALLOW USED MERCHANDISE ESTABLISHMENTS WITHIN THE LOW-INTENSITY OFFICE DISTRICT; PROVIDING FOR CORRECTIONS; SEVERABILITY; CONFLICTS; IMPLEMENTATION; AND AN EFFECTIVE DATE. WHEREAS, Article VIII, Section 2 of the Florida Constitution, and Chapter 166, Florida Statutes, provides municipalities with the authority to exercise any power for municipal purposes, except where prohibited by law, and to adopt ordinances in furtherance ofsuch authority; and WHEREAS, the City Commission of the City of South Miami ("City") finds it periodically necessary to amend its Land Development Code (the "LDC") to update regulations and procedures to maintain consistency with state law, implement municipal goals and objectives, clarify regulations, and address specific issues and needs that may arise; and WHEREAS, the City desires to allow establishments that sell used merchandise, including antiques, consignment goods, and secondhand goods, in the Low-Intensity Office District {"LO District"); and WHEREAS, uses permitted by right or as a special use in each district are determined from the Pennitted Use Schedule in Section 20-3.3(D) of the LDC; and WHEREAS, establishments that sell used merchandise, including antiques, consignment goods, and secondhand goods, are currently not permitted in the LO District ("LO District"); and WHEREAS, the purpose of the LO District is to permit low-intensity office development and redevelopment; and WHEREAS, limited retail uses that do not result in large concentrations of people at any one time, such as secondhand goods stores, are compatible with low intensity office development; and WHEREAS, the City Commission finds it in the best interest of the City and its residents to amend the Permitted Use Schedule in Section 20-3.3(D) of the LDC to allow establishments that sell used merchandise, including antiques, consignment goods, and secondhand goods in the LO District; and Page 1 of 4 Ord. No. 22-24-2507 WHEREAS, on June 18, 2024, the City Commission discussed allowing sales of secondhand goods in LO and directed City staff and the City Attorney to prepare this Ordinance; and WHEREAS, on August 13, 2024, the Planning Board, sitting in its capacity as the Local Planning Agency, reviewed this Ordinance and voted unanimously to recommend adoption to the City Commission; and WHEREAS, on September 3, 2024, the City Commission approved the ordinance on first reading; and WHEREAS, on September I 7, 2024, the City Commission conducted a duly noticed public hearing as required by law and approved the ordinance on second reading; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:1 Section 1. BACKGROUND:Currently, establishments that sell used merchandise, including antiques, consignment goods, and secondhand goods, are not permitted in the City’s Low Intensity Office District (“LO District”). Typically, limited retail uses that do not result in large concentrations of people at any one time, such as secondhand good stores, are compatible with low intensity office development. Because of this unique situation, the City desires to permit these types of establishments in the LO District. Pursuant to Section 20-3.1 of the City’s Land Development Code (“LDC”), the purpose of the LO District is to permit low-intensity office development and redevelopment which is appropriate on areas designated "Commercial Retail and Office", "Mixed Use Commercial/Residential", and "Business Office (Low Intensity and Volume)" on the City's adopted Comprehensive Plan which are intended to provide for a mixture of retail, office, and residential uses. Because of that, the City Commission has found that it is in the best interest of the City and its residents to amend the Permitted Use Schedule in Section 20-3.3(D) of the LDC to allow establishments that sell used merchandise, including antiques, consignment goods, and secondhand goods in the LO District. On June 18, 2024, the City Commission held a discussion on the item and discussed allowing sales of secondhand goods in the LO District. At that time, the Commission directed City staff and the City Attorney to prepare this Ordinance. ANALYSIS:Currently, uses permitted by right or as a special use in each district are determined from the Permitted Use Schedule in Section 20-3.3(D) of the LDC. While these uses are permitted in other zoning districts in the City, they are currently not permitted in the LO District. Periodically, the City finds it necessary to amend the LDC to update regulations and procedures to maintain consistency with state law, implement municipal goals and objectives, clarify regulations, and address specific issues and needs that may arise. By making this change, the Permitted Use Schedule will be more in line with the vision that the Commission has for the City. Shy at first,Sullivan didn’t talk to anyone for the first week of his hike. But then he started meet- ing people at the hostels he stayed at,and he ended up doing about 25 interviews in two months. “What I found was there are a wide variety of rea- sons why people make that hike,”Sullivan said.“I talked to college students who are taking a gap year.I talked to 80-year-old reti- rees and everything in between.” Ransom cross-country coach Don Kappelman raves about Sullivan. “Ethan is an outgoing, strong-willed kid,”Kappel- man said.“He’s fascinating to talk to on a range of subjects.” Ransom swimming coach Franz Huggins said he has “nothing but the utmost respect”for Sulli- van. “His aspiration to hike that trail was appropriate because he is the right person,”Huggins said.“I couldn’t be prouder of him.” Added cross-country teammate Nelson Man- stein:“Ethan is amazing.It can’t be easy to hike that trail.You have to have a mindset to endure.” Sullivan has a brilliant mind —he’s a straight-A student whose parents are both emergency-room physicians. In college,Sullivan will likely focus on academics only,and he said his major figures to be neuroscience or anthropology. Sullivan started as a competitive swimmer at the age of 5.At 6,he start- ed competing in local 5K runs with his mother. The next year,he started doing triathlons.By age 13, Sullivan was competing in triathlons nationally,be- coming a three-time All- American.In all,he com- peted in seven triathlon national championships, traveling to states such as Utah,Iowa and Ohio. At Ransom,Sullivan has split his time between swimming and cross-coun- try —which are both fall sports. But all those miles —in the pool and on grass/ pavement —caught up to Sullivan last track season, when he missed four months due to a stress fracture in his left hip. In the past,Sullivan swam 500-yard races.This year,in an attempt to stay away from injuries,he is swimming shorter dis- tances. “At some point,”Sullivan said,“I have to listen to my body.” He did a lot of that along the Appalachian Trail,as conditions were often diffi- cult.There were hot days in Virginia where temper- atures soared into the 90s, and Sullivan had to make sure he had enough water in his backpack. Then there were days in Maine when it got down to 40 degrees with 30-mph winds. The Appalachian Trail is relatively safe,but it can be a dangerous place. Many animals live along the trail,including bears, snakes,wild boars and raccoons.Mice that invade backpacks and sleeping bags are a dangerous ha- zard,and so are deer ticks carrying Lyme disease. Fortunately for Sullivan, nothing bad happened, although he did see a bear. As for navigation,the trail is marked by white paint blazes,and blue blaz- es lead to shelters and viewpoints. For food,Sullivan had freeze-dried meals as a foundation. “A big staple was Nutella on tortilla chips,”Sullivan said.“I also had a lot of candy bars.” At some point in the coming years,Sullivan wants to go back and do the entire Trail.
