AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING
ARTICLE II "DEFINITIONS," ARTICLE In "ZONING
REGULATIONS," AND ARTICLE IV "OTHER
REGULATIONS," TO PERMIT URGENT CARE FACILITIES
AND PROVIDE APPLICABLE REGULATIONS; PROVIDING
FOR CORRECTIONS; SEVERABILITY; CONFLICTS;
IMPLEMENTATION; AND AN EFFECTIVE DATE
WHEREAS, Article VIII, Section 2 of the Florida Constitution, and Chapter 166,
Florida Statutes, provides municipalities with the authority to exercise any power for'
municipal purposes, except where prohibited by law, and to adopt ordinances in furtherance
of such authority; and
WHEREAS, the City of South Miami (the "City") has adopted a Land Development
Code (the "LDC") to promote the health, safety, community acceptable standard of morals
and general welfare of the residents of the City of South Miami through the stated regulations
of this LDC; and
WHEREAS, the City Commission fmds it periodically necessary to amend the LDC
in order to update regulations and procedures to implement planning goals and objectives;
and
WHEREAS, the LDC does not recognize urgent care facilities or provide regulations for
their siting, development, and operation separately from medical office uses; and
WHEREAS, the City Commission finds that urgent care facilities are different from
medical office uses, offering non-emergent, but nevertheless urgent, care opportunities in a retail
medical setting that serves the community service best when in close proximity to residential and
local business neighborhoods and accessible via major roadways; and
WHEREAS, Article ITI, Section 20-3.1 (15) of the LDC establishes that the purpose of the
General Retail District ("GR") is "to delineate areas which permit a broad range of retail uses; and
WHEREAS, Article III, Section 20-3.1(15) of the LDC also states that the GR district is
appropriate in areas designated "Commercial Retail and Office" on the City's adopted
Comprehensive Plan, which provides that the "Commercial Retail and Office land use category is

intended to provide for retail and retail service office use and office services that are characteristic
of commercial development"; and
WHEREAS, urgent care facilities are customarily located within small scale shopping
centers and retail strips in other municipalities in South Florida within zoning districts that are
similar to the City's OR District ; and
WHEREAS, OR Districts within the City are located along major roadways such as US1
and Bird Road , that are in close prox imity to residential and local business neighborhoods ; and
WHEREAS, the City Commission fmds that urgent care facilities will be best located
within the OR District subject to appropriate regulations that limit the impact to nearby residential
neighborhoods ; and
WHEREAS , on June 11 , 2024, the Planning Board , sitting in its capacity as the Local
Planning Agency, reviewed this Ordinance and recommended approval with changes ; and
WHEREAS, this Ordinance was considered by the City Commission on first reading on
July 18, 2024, following which reading , on August 20, 2024, the Mayor and City Commission
conducted a duly noticed public hearing as required by law and adopted this ordinance on second
reading.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:'
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Amending Article II. Article II. "Definitions" of the LDC , specifically
Section 20-2 .3 "Definitions," is hereby amended to read as follows :

Urgent Care Facility. An outpatient. walk-in medical office/clinic that is staffed and
capable of treating minor to moderate illnesses and injuries and is licensed under a
sponsoring hospital. Urgent care facilities shall be staffed by physicians, nurses and other
medical professional needed to treat patients on an urgent. but not emergency,
basis. Typical services provided in urgent care facilities may include evaluation,
management. and treatment of non-emergent illnesses and injuries, including diagnostic
imaging such as x-ray, cat scan, and basic lab tests in a medical treatment setting. Urgent
care facilities shall not be equipped to handle medical emergencies that are critical or life
threatening, that may result in serious impairment of health, or that. because of the danger
to life or health, reguire hospital facilities.
Section 3. Amending Article III. Article III. Zoning Regulations of the LDC,
specifically Section 20-3.3 "Permitted use schedule," is hereby amended to read as set forth in
Exhibit "A" attached hereto.
Section 4. Amending Article IV. Article IV. Other Regulations of the LDC,
specifically Section 20-4.4 "Offstreet parking requirements," is hereby amended to read as
follows:

Section 6. Severability. If any section, clause, sentence, or phrase of this Ordinance
is for an y reason held invalid or uncon s titutional by a court of competent juris diction, the holding
shall not affect the validity of th e remaining portions of this Ordinance.
Section 7. Conflicts. That all ordinances or parts of ordinances, resolutions or parts
of resolutions , in conflict herewith , are repealed to the extent of such conflict.
Section 8. Implementation. The City Manag e r is hereby authorized to take any and
all necessary action to implement the purposes o f thi s Ordinance.
Section 9 . Effective Date . This Ordinance shall becom e effective immediately upon
adoption.

SUBJECT:An ordinance amending Article II “Definitions,” Article III “Zoning Regulations,”
and Article IV “Other Regulations” to permit urgent care facilities.
RECOMMENDATION:Approval of the proposed ordinance permitting urgent care
facilities and providing for applicable regulations.
BACKGROUND:Currently, the Land Development Code (“LDC”) does not recognize
urgent care facilities or provide regulations for their siting,
development, and operation separately from medical office uses.
Urgent care facilities are different from medical office uses,
offering non-emergent, but nevertheless urgent, care
opportunities in a retail medical setting that can serve the
community service best when in close proximity to residential and
local business neighborhoods and accessible via major roadways.
The General Retail (GR) district provides local retail business
settings on major roadways in close proximity to residential areas.
Accordingly, the proposed legislation is intended to amend the LDC
to permit urgent care facilities in the City in the GR district, subject
to regulations addressing potential impacts to residential areas.
ANALYSIS:Article III, Section 20-3.1(15) of the LDC establishes that the
purpose of the General Retail District (“GR”) is “to delineate areas
which permit a broad range of retail uses and which is appropriate
in areas designated "Commercial Retail and Office" on the City's
adopted Comprehensive Plan. Furthermore, the “Commercial
Retail and Office” land use category is intended to provide for retail
and retail service office use and office services that are
characteristic of commercial development.
Typically, urgent care facilities are located in small scale shopping
centers and retail strips in other South Florida municipalities where
the zoning districts are similar to the City’s GR District. Additionally,
the shopping centers are located along major roadways such as
US1 and Bird Road, which are in close proximity to residential and

local business neighborhoods. After a discussion on the topic, the
City Commission found that urgent care facilities would best serve
the community by being located in the GR District, but it would
need to be subject to appropriate regulations that limit the impact
to nearby residential neighborhoods. That said, the draft
legislation includes a definition for the proposed use that is
narrowly tailored so as to not be misconstrued to be a hospital in a
retail setting but provide services for non-emergent illnesses and
injuries that are typically seen in other urgent care facilities. These
services include evaluations and basic lab tests by medical
professionals as well as diagnostic imaging such as x-rays and cat
scans. It is important to note that while the “Medical Office” use is
permitted in a majority of the City’s zoning districts, it is not
permitted in the GR zoning district. That said, the proposed use
will be permitted in the GR district with the caveat that it meets the
following requirements:
Urgent care facilities shall not exceed 6,500 square
feet in gross floor area, and shall not be designed to
accept transport of patients from ambulances, or
provide beds for overnight stays or ongoing
treatment. A condition of Certificate of Occupancy
shall require communication by the operator to any
ambulance service charged with transporting
patients from the urgent care facility to not operate
sirens or any other plainly audible attention
attracting devices within the property where the
urgent care facility is located.

PREVIOUS ACTION:On June 11, 2024, the Planning Board (PB) held a Public Hearing
on the item and voted 6 to 0 to unanimously recommend approval
of the proposed legislation.

NOTICE OF RULE-MAKING FOR CLUB RULES AND
CLUB SCHEDULE BY THE
PALM GLADES COMMUNITY DEVELOPMENT DISTRICT
AND PUBLIC HEARING THEREON
In accordance with Chapters 120 and 190,Florida Statutes,the Palm Glades
Community Development District (the “District”)hereby gives notice of its intent
to amend its Club Silver Palms Rules and Regulations (the “Club Rules”)and
the Club Silver Palms Club Schedule of Hours of Operation,Dues,Fees and
Charges,Areas and Fees for Rental,Rental Policies,Procedures and Regula-
tions (the “Club Schedule”)governing the operations,usage,and rental of the
District’s clubhouse facilities known as Club Silver Palms.
Specific legal authority for the Club Rules and Club Schedule,and amendments
thereto,includes Sections 190.035,190.011(5),120.54 and 120.81 Florida Stat-
utes.A copy of the proposed revisions to the Club Rules and Club Schedule
may be obtained by contacting the District Manager,Juliana Duque,Govern-
mental Management Services,c/o Palm Glades Community Development Dis-
trict,5385 N.Nob Hill Road,Sunrise,Florida 33351 or by telephone at (954)
721-8681.
The Board of Supervisors of the District will hold a public hearing on September
10,2024 at 6:30 PM at the Club Silver Palms,located at 23770 SW 115,Avenue,
Miami,FL 33032,to receive public comment on the adoption of the revised Club
Rules and Club Schedule.The public hearing will provide an opportunity for the
public to address and comment upon the proposed changes to the Club Rules
and Club Schedule.The proposed changes to the Club Rules and Club Sched-
ule may be adjusted at the public hearing pursuant to discussion by the Board
of Supervisors and public comment.
The proposed changes to the Club Rules are as follows:(1)minor revisions to
certain verbiage;(2)clarifying that guest passes are daily passes and who may
purchase them;(3)providing that a total of four (4)membership cards will be
issued to each home or annual membership at no additional charge,regardless
of the time such membership cards are issued;(4)providing that the Club Man-
ager (as well as the District Manager)shall have reasonable discretion to police
the Club Facilities to maintain proper order and the safe and healthy use of the
Club Facilities,including the immediate expulsion of an individual from the Club
Facilities;(5)providing that the Club Manager (as well as the District Manager)
shall have reasonable discretion to temporarily vary Club hours of operation
(including hours of use at the Pools)as necessary from time to time;(6)adding
as bases for suspension of Club privileges:(a)permitting the unauthorized use
of a membership card or guest pass;(b)treating the Club Manager,Club staff,
personnel,employees,or other patrons of the Club Facilities in an unreasonable
or abusive manner;(c)committing,engaging,or in any way participating in any
illegal drug use,criminal,illicit,or inappropriate activity or any act(s)of inde-
cency within or at the Club Facilities;(d)engaging in conduct that is improper
or likely to endanger the welfare,safety,or reputation of the Club Facilities,its
management personnel,or other patrons of the Club Facilities;and (e)failing
to pay the District for any monies due the District,for past due assessments,
fees,charges,or damages caused by such person or his or her guest(s);and
(7)providing that the Club Manager (as well as the District Manager)shall have
discretion to grant relief to one or more persons from the application of specific
Rules and Regulations upon a written request and showing of good cause.
The proposed changes to the Club Schedule are as follows:(1)effective Octo-
ber 1,2024,the Annual Member Club Dues for residents will be increased from
$895.05 to $951.60 and the Annual Member Club Dues for non-residents will
be increased from $980.00 to $1,380.00;(2)the language in the Clubhouse
Rental Pricing for the South Terrace will be revised to clarify that the $100 Rental
Fee is non-refundable;and (3)the language underneath the Clubhouse Rental
Pricing will be revised to provide that for rental events that last beyond 8:00 p.m.
(instead of 6:00 p.m.),a guard must present from 8:00 p.m.(instead of 6:00 p.m.)
until the event ends.

The Department of Environmental Protection gives notice of its intent to issue
an Environmental Resource Permit (File No.MMR_175273-022)to Vecellio &
Grogan,Inc.,for a permit/water quality certification to add an additional par-
cel and continue existing limestone mining operations.The application is an
Environmental Resource Permit to modify an existing Limestone mining plan to
include an additional 6.7 acre outparcel in Section 5 to the overall White Rock
Quarries permitted mining footprint,which is now approximately 4,137 acres in
total,covering lands within Section 5 Township 52 South,and Range 40 East,as
shown on the attached plan-set
The estimated life of the mine,including reclamation,will be May 20,2030.
Overall,approximately 6.7 acres of wetlands will be disturbed or mined through
the completion of mining authorized by this permit.The entirety of this outparcel
is densely covered by melaleuca (Melaleuca quinquenervia.)To provide for the
mitigation of wetland resources lost to mining,section 373.4149,F.S.,establish-
es a per-ton wetland mitigation fee assessment on limestone sold from the Lake
Belt Area.Under the direction of an interagency committee,the fee will be used
to acquire,restore,and manage lands within the Pennsuco wetlands and other
locations as provided in paragraphs 373.41492(6)(a)and (b),F.S.Subsection
373.41492(7),F.S.,provides that payment of the mitigation fee satisfies the mit-
igation requirements for the loss of the value and function from mining of wet-
lands within the permit application area.The Department will issue the environ-
mental resource permit unless a timely petition for an administrative proceeding
(hearing)is filed under sections 120.569 and 120.57,F.S.,before the deadline for
filing a petition.On the filing of a timely and sufficient petition,this action will not
be final and effective until further order of the Department.Because the adminis-
trative hearing process is designed to formulate final agency action,the hearing
process may result in a modification of the agency action or even denial of the
application.Therefore,on the filing of a timely and sufficient petition,this action
will not be final and effective until further order of the Department.

Petition for Administrative Hearing
A person whose substantial interests are affected by the Department’s action
may petition for an administrative proceeding (hearing)under sections 120.569

Time Period for Filing a Petition
