KENDALL DRIVE AND THE RESIDENTIAL ESTATE MODIFIED ESTATE (EU-M) ZONING DISTRICT OF THE VILLAGE OF PINECREST, FLORIDA, LOCATED AT 5865 SW 88 STREET; PROVIDING FOR CONDITIONS; CORRECTIONS; IMPLEMENTATION; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the Applicant, ALL 50 Investments, LLC, as the owner of the property located at 5865 N. Kendall Drive and 5865 SW 88 Street (Folio Nos. 09-4036-000-0950 and 20- 5001-001-0410) and legally described in Exhibit "A" attached hereto (the "Property"), submitted Application No. PB-24-014 (the "Application") requesting approval of a Tentative Plat seeking to subdivide the Property pursuant to Section 20-4.2 of the Land Development Code (the "LDC"); and WHEREAS, the portion of the Property known as 5865 SW 88 Street is located in the Village of Pinecrest, Florida (the "Village"); and WHEREAS, pursuant to an Interlocal Agreement between the City of South Miami (the "City") and the Village dated April 15, 2022, and approved by the City's Ordinance No. 06-22- 2427, applications affecting the Property are to be reviewed and approved by the City, after consultation with the Village; and WHEREAS, the City solicited and obtained comments from the Village regarding the Application prior to Planning Board, and again notified the Village prior to this hearing; and WHEREAS, the City received correspondence from the Village's Planning Director, that the Village has no objection to the City's approval of the Application; and WHEREAS, the Application requests a subdivision of the Property into two (2) lots in the Low-Density Single Family Residential (RS-3) zoning district, so that each of the two (2) buildable single-family lots can be developed with a new single-family residence; and WHEREAS, at a Public Hearing on July 9, 2024, the Planning Board recommend approval of the Application, subject to conditions; and WHEREAS, the Mayor and City Commission of the City of South Miami, having considered each of the guidelines listed in Section 20-4.2(8) of the LDC and having found that those conditions have been met, desire to approve the Tentative Plat application. Page 1 of 4 Res. No. 125-24-16230 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Recitals and Findings. The recitals set forth in this resolution and in the Tentative Plat Approval are true and correct, and are supported by competent substantial evidence, and they are incorporated into this resolution by reference as if set forth in full herein. The City Commission finds that the Tentative Plat requested in the Application meets the requirements of Section 20-4.2(B) of the LDC. Section 2. Tentative Plat Approval. The Application submitted by the Applicant, ALL 50 Investments, LLC, requesting approval of a proposed Tentative Plat subdividing the Property into two (2) lots located at 5865 N. Kendall Drive and 5865 SW 88 th Street, and legally described in Exhibit "A" attached hereto, pursuant to the Land Subdivision Regulations outlined in LDC Section 20-4.2, is hereby approved. Section 3. Conditions of Approval. The Tentative Plat is hereby approved subject to the following terms and conditions, as well as all applicable City ordinances, codes, rules, and regulations: I. All encroachments must be addressed prior to Final Plat approval; 2. Once approved by Miami-Dade County, it will be required that the plat be reviewed by the City Commission for Final Plat approval; 3. Execute and record in the public records of Miami-Dade County, a restrictive covenant, in a form approved by and subject to the review and approval of the City Manager and City Attorney, which contains all commitments made and conditions imposed as part of the approval of the approved waiver of plat, tentative and/or final plat; 4. Ensure the retention of specimen trees for six (6) years and permanently maintain fifty (50) percent of existing protected tree canopy, but in no event shall the condition be less restrictive than what is required by the City's and County's tree ordinance; 5. Provide V-Shaped swale along ROW/Parkway section for Stormwater; 6. If any Pavement Cuts are required during construction, paving limits shall be Width of Property Limits frontage; and 7. The plat must comply with all of the regulations outlined in Section 20-4.2 of the LDC. Section 4. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Page 2 of 4 Res. The project must comply with all the regulations outlined in Section 20-4.2 of the LDC. 2 SoutOOiami THE CITY OF PLEASANT LIVING BACKGROUND: On May 5, 2023, an application for Tentative Plat was filed by the applicant/property owner, ALL 50 INVESTMENTS, LLC (“Applicant”), in order to plat the existing vacant parcel located at 5865 N. Kendall Drive into two (2) parcels so that new single-family homes can be built. The parcel in question sits along North Kendall Drive (SW 88th Street) at the southern border of the City, with a portion of it residing in the Village of Pinecrestand is in the Village’s Residential Estate Modified Estate (EU-M) zoning district. That portion, which consists of approximately 1,789 square feet, is vacant as well and is not a part of this request. The piece of the parcel that is in the Village of Pinecrest is identified only by the folio number which is #20-5001-001-0410. It is important to note that on March 15, 2022, the City Commission adopted Ordinance #06-22-2427 which approved an Interlocal Agreement between the City of South Miami and the Village of Pinecrest regarding administration of land use, zoning, and other regulations for those properties along Kendall Drive that are located in the boundaries of both municipalities. Per that agreement, the review of this application for the subject property falls under the jurisdiction of the City of South Miami. REQUEST: The applicant is requesting approval through the Tentative Plat process as provided in Section 20-4.2 of the City’s Land Development Code (LDC) to plat and subdivide the existing parcel of land into two (2) individual parcels so that they can be redeveloped into two (2) single-family residential properties. LEGAL DESCRIPTION: The legal description for the subject property can be found on the attached Boundary & Topographic Survey of Tentative Plat “All50 Subdivision.” ANALYSIS: Located in the Low Density Single-Family Residential (RS-3) zoning district, the intent of the proposed Tentative Plat application is to subdivide the parcel of land located at 5865 N. Kendall Drive (SW 88th Street) into two (2) separate parcels (Lot “1,” and Lot “2”). Pursuant to the City’s subdivision regulations listed in Section 20-4.2(B) of the LDC, prior to approving a waiver of plat, tentative or final plat, the City Commission shall use the following guidelines to review the project: 1. Section 20-4.2(B)(2)(a)(i): The building site created by the proposed waiver of plat, tentative or final plat, should be equal to or larger than the median of the existing building sites in the Surrounding area (this shall be demonstrated using copies of the official plat maps for the subject property and surrounding neighborhood), unless otherwise permitted by this ordinance. Surrounding area is defined as all lots within the same zoning district and within five hundred (500) feet from the exterior boundaries of the subject property. Staff Response: A review of the lot sizes and frontages of the surrounding area was performed and is provided in the table below: 3 Final Plat Median Analysis Table Surrounding Area Lot 1 Lot 2 Net Lot Area/ Buildable Site (SF)11,496 15,734 15,734 Lot Frontage (Ft.)95 133.310 133.310 When looking at the neighborhood surrounding the proposed subdivision, it was found that the proposed lots exceeded both the median lot size and the median frontage of the surrounding area. For more information on the median buildable site/lot size and the median frontage for the surrounding area, please refer to the attached exhibit, Tentative Plat Median Analysis for 5865 N. Kendall Drive. 2. Section 20-4.2(B)(2)(b): The building site created by the proposed waiver of plat, tentative or final plat, will not result in existing structures becoming nonconforming as they relate to setbacks, lot area, lot width and depth, ground coverage and other applicable regulations of the City's Land Development Code and/or City's Code of Ordinances, except as permitted by this ordinance. Compliance with this provision may occur by demolition or relocation of existing structures. Staff Response: The project will comply with the aforementioned LDC section as the parcel is currently vacant. A single-family structure previously resided on the parcel but has since been demolished via Building Permit #BRB21-1402 which was issued on January 25, 2022, and closed. 3.Section 20-4.2(B)(2)(c): The building site created by the proposed waiver of plat, tentative or final plat, will be free of encroachments from abutting building sites. Staff Response: The survey and t-plat maps provided show a C.B.S. wall that encroaches at least one (1) foot into the property along the western property line. Additionally, a portion of the chain link fence that runs along the eastern property line encroaches into the right- of-way. These encroachments will need to be addressed prior to final plat approval by the City Commission. 4. Section 20-4.2(B)(2)(d): The building site created by the proposed waiver of plat, tentative or final plat, is free of any declarations of restrictive covenants, unity of title, easements, or the like, which would prevent the separation of the site. However, this provision may be 4 satisfied if existing covenants, unity of title, easements, or similar instruments, which conflict with the proposed subdivision, are released or modified to accommodate the proposed building site. Staff Response: The applicant has provided an owner’s affidavit dated April 4, 2024, stating that the property is free of restrictive covenants, unity of title, easements or the like which would prevent a separation or partition of the land. 5. Section 20-4.2(B)(2)(e): The scale of any proposed new construction shall be compatible with the as-built character of the surrounding area and shall not create adverse impacts on the surrounding area; but if so, the applicant shall provide satisfactory commitments as to how the adverse impacts will be mitigated. An example of an adverse impact includes visual impacts arising from a proposed two-story structure in an area built out with single-story homes; mitigation could include adding a condition to the approval of the waiver of plat, tentative plat or final plat, for landscape buffers, or adjusting second-story setbacks or building facades to reduce the visual impact. Staff Response: Nestled between the Snapper Creek Canal to the north and Temple Beth Am Jewish Center to the south, the proposed project will create two (2) two-story single-family residences that will be similar to those found to the east and north of the subject parcel. Currently, a two-story single-family residence is located directly to the east (5855 SW 88 Street) of the subject parcel, whereas a one-story residence is located directly to the west (5931 SW 88 Street). Additionally, a mixture of one-story and two-story homes are located immediately north of the Snapper Creek canal along SW 87th Street. While there may not be any adverse impacts to the north and east, there may be an impact due to the size of the proposed structures and their close proximity to the existing one-story structure on the western property. That said, it was recommended that landscape buffers be added along the western property line so that any adverse impacts caused by the placement of a two- story structure next to an existing one-story structure would be mitigated. In response to this comment, the applicant has revised the Conceptual Plan for the project to show a new opaque landscape buffer that will be added along the western property line. 6. Sec. 20-4.2(B)(2)(f): The building site(s), lot(s) or parcel(s) of land that would be created are divided in such a manner that they are in compliance with the regulations of the City's Land Development Code. Lot area and street frontage calculations shall exclude abutting public rights-of-way. Staff Response:The proposed plat complies with the LDC section above. Sec. 20-4.2(B)(2)(g): The building site or sites created by the proposed waiver of plat, tentative or final plat cannot constitute an irregular parcel (one that has more than four (4) corners or that has any curved or jagged lot line), unless the City Commission by a four- fifths (⅘) vote determines that the irregularity arises from irregularity in the original parcel and cannot be corrected, or the Commission by such vote determines the irregularity is compatible with the parcels in the Surrounding area. Staff Response:While the lots created by the plat will each consist of four (4) corners, a portion of the proposed Lot 2 resides in the Village of Pinecrest which can give the impression that the plat will create an irregular parcel that cannot be corrected. Because of that, it is recommended that a four-fifths (⅘) vote by the City Commission be required to approve the request. 8. Sec. 20-4.2(B)(3)(a) Ensure the retention of specimen trees for six (6) years and permanently maintain fifty (50) percent of existing protected tree canopy, but in no event shall the condition be less restrictive than what is required by the City's and County's tree ordinance. Staff Response:Per the survey provided by the applicant, the following trees have been identified as specimen sized trees and must be retained for at least six (6) years: Tree (Tree #168) Tree (Tree #175) It is important to note that both trees are located outside of the property line of the proposed lots and will not be affected by the redevelopment of the site. 9. Sec. 20-4.2(B)(3)(c) 6 Execute and record in the public records of Miami-Dade County, a restrictive covenant, in a form approved by and subject to the review and approval of the City Manager and City Attorney, which contains all commitments made and conditions imposed as part of the approval of the approved waiver of plat, tentative and/or final plat. Staff Response:Pursuant to the LDC section above, the Applicant will be required to execute and record in the public records of Miami-Dade County, a restrictive covenant that contains all commitments made and conditions imposed as part of the approval of the final plat. 10. Sec. 20-4.2(B)(4)(a & b) Additional Application Requirements. As part of the required tentative or final plat or waiver of plat application, applicants, other than the City, shall be required to submit a proposed conceptual site plan drawn to scale, and indicating the following information for the entire subject property to be subdivided: (a) Building footprints; (b) Setbacks, yard requirements and easements. For purposes of this section, a conceptual site plan means a plan that is drawn at the schematic design phase, showing parcel lot lines, land uses, general building location, general driveway and parking arrangements, and major site features. Future construction may not exceed by more than four (4) percent the size of the building, or floor area, gross, shown on the conceptual plan, unless approved by the City Commission by a four-fifths (⅘) vote, and as long as the setbacks and yard requirements are in accord with the Code existing at the time of such future construction. The conceptual site plan shall be reviewed by the Planning Board and approved by resolution of the City Commission under the provisions for applications requiring a public hearing of Section 20-5.5. Staff Response:The applicant has provided the City with a proposed site plan, sheet A0.1, that details the building footprints, setbacks, yard requirements, and any easements. Staff has reviewed the conceptual site plan against the dimensional requirements for the RS-3 zoning district that are listed in Section 20-3.5(H) of the LDC. That review can be found in the tables below. Pursuant to Section 20-3.5(H) of the LDC, the cumulative width of both side yards shall be not less than 20 percent (20%) of the total lot width. The applicant is also proposing balconies that will be located at the front of each of the residences. Pursuant to Section 20-3.6(B)(3) of the LDC, they may project up to thirty-six (36) inches into required yard setback areas. Dimensions for those balconies have been provided to show that they will comply with Section 20-3.6(B)(3) of the LDC. 11. Sec. 20-4.2(B)(4)(c) (c) A certified tree survey overlaid directly upon the site plan, as required by Section 20-4.5. The tree survey must include the canopy measurements. Once an application for a waiver of plat or tentative plat is filed, no tree may be removed until after final waiver of plat or final plat approval is issued (Tree Removal Moratorium). The applicant may appeal to the City Commission to waive the Tree Removal Moratorium for good cause. 8 Staff Response:Per the survey provided by the applicant, a list of the trees on the site was provided. The Ground Floor Site Plan, sheet A0.1, was provided which details all existing trees on the property in relation to the conceptual design of the two (2) structures. After reviewing it, none of the existing trees will be affected by the placement of the structures. 12. Sec. 20-4.2(C)(1) Sidewalks, curbs, gutters, drainage and paving shall be installed by the owner or developer of the abutting parcel in accordance with Chapter 28 of the County Code and other applicable city requirements, unless such can be and are waived or deferred by the city commission. Staff Response:To comply with the subsection listed above, the conceptual site plan was reviewed by representatives of the Public Works Department. As indicated in the email dated August 12, 2024, from Mr. Nelson Gomez, the following comments were made regarding the project: 1. Provide V-Shaped swale along ROW/Parkway section for Stormwater (see attached Detail) 2. If any Pavement Cuts are required during Construction Paving limits shall be Width of Property Limits frontage. Because of its close proximity to the Snapper Creek Canal, the plans for the project were forwarded to the South Florida Water Management District for review. Per the email from Mr. Stanley Pry, dated June 26, 2024, they provided the City with the comment that the width of the Snapper Creek Canal shown on the Tentative Plat Map must be corrected. The applicant has revised the plans to address this comment. Per the email from Ms. Marcy Zehnder dated August 5, 2024, the requested correction was made and there are no further comments. 9 Interlocal Agreement Notification As required by the Interlocal Agreement between the City of South Miami and the Village of Pinecrest, the application was forwarded to the Village Manager for review on July 3, 2024. The application was reviewed by the Village Planning Director, Mr. Stephen Olmsted, AICP, who informed the City of the following: Good afternoon. The Village of Pinecrest has received the information you provided regarding the proposed division of property located at 5865 N. Kendall Drive. The proposed plat will result in the creation of 2 lots, each over 15,000 square feet in area. The proposed lot sizes are consistent with the minimum lot area requirement of 15,000 square feet for the portion of the property located in the Village of Pinecrest, zoned EU-M, Residential Modified Estate. The Village of Pinecrest is not opposed to the proposed division of the property. The Parties agree that pursuant to Section 468.617, Florida Statutes, the Vi11age's building code inspector may serve as the building inspector for the Village Properties and the City's building code inspector may serve as the building inspector for the City Properties. 2 21 7. The Village and the City acknowledge and agree that the Miami-Dade County Property Appraiser and Tax Collector's offices will continue to appraise the Properties, certify the annual tax roll, and collect real property ad valorem tax revenues for the Village Properties and City Properties and allocate the tax revenues in the same manner in which it has done so in the years prior to the execution of this Agreement. 8. The term of this Agreement is for an initial period of five (5) years from the Effective Date. The Agreement will automatically renew for additional five-year terms unless terminated as provided for in this Agreement. 9. Either party may terminate this Agreement for good cause, which is any cause found by a majority vote of either the Village Council or the City Commission to be in the interests of the public health, safety, and general welfare to require termination at any time by giving the other party three hundred sixty-five (365) days advance written notice of such tennination. The Village building official has the responsibility for the issuance of all Certificates of Occupancy or Certificates of Completion for those properties shown as the Village Properties. 4. The City has the responsibility for the review, process, and approve zoning, building and code compliance matters for those properties shown as the City Properties. Accordingly, it may charge for and receive any and all process, permit, impact fees or other fees normal)y charged by the City in the development and construction of any portion of the City Properties. The City building officia) has the responsibility for the issuance of all Certificates of Occupancy or Certificates of Completion for those properties shown as the City Propenies. 5. In the instance in which the Village is issuing a permit, the Village's Zoning Code and other land development regulations shall be applied with respect to the review and approval of development on the Properties. Likewise, in the instance in which the City is issuing a permit, the City's Zoning Code and other land development regulations shall be applied with respect to the review and approval of development on the Properties. The City agrees that the Village may approve plat(s) for the Village Properties pursuant to Section 177 .07 I, Florida Statutes. Likewise, the Village agrees that the City may approve plat(s) for the City Properties pursuant to Section 177 .071, Florida Statutes. 6. The Parties agree that pursuant to Section 468.617, Florida Statutes, the Village's building code inspector may serve as the building inspector for the Village Properties and the City's building code inspector may serve as the building inspector for the City Properties. 2 357. The Village and the City acknowledge and agree that the Miami-Dade County Property Appraiser and Tax Collector's offices will continue to appraise the Properties, certify the annual tax roll, and collect real property ad valorem tax revenues for the Village Properties and City Properties and allocate the tax revenues in the same manner in which it has done so in the years prior to the execution of this Agreement. 8. The term of this Agreement is for an initial period of five (5) years from the Effective Date. The Agreement will automatically renew for additional five-year terms unless tenninated as provided for in this Agreement. 9. Either party may terminate this Agreement for good cause, which is any cause found by a majority vote of either the Village Council or the City Commission to be in the interests of the public health, safety, and general welfare to require termination at any time by giving the other party three hundred sixty-five (365) days advance written notice of such tennination. l 0.
