FESTIVAL" PRESENTED BY ROTARY FOUNDATION OF
SOUTH MIAMI TO BE HELD ON SATURDAY, FEBRUARY
22nd AND SUNDAY, FEBRUARY 23rd, 2025; PROVIDING
FOR APPLICABILITY OF OTHER FEES AND CODE
REQUIREMENTS; IMPLEMENTATION; CORRECTIONS;
SEVERABILITY; AND AN EFFECTIVE DATE.
WHEREAS, the Rotaiy Foundation of South Miami (the "Applicant''), a not for profit
corporation, has submitted an application to host its annual SOMI Art Festival on Saturday,
February 22nd, and Sunday, February 23 rd, 2025, from 9:00 am to 6:00 p.m on 72nd Street (Sunset
Drive) from 57 th Avenue to USI (the "Event''); and
WHEREAS, the application for the Event is still in progress and will be reviewed and
subject to approval by the City Manager pursuant to Section 15B-6 of the City Code; and
WHEREAS, applicable event-related service fees are as follows:

WHEREAS, under the requested fee waiver, the Applicant would pay 50% of direct Event
related fees, estimated at $11,225 (i.e. Police and Public Works), which is subject to change based
on actual Event activity and City services required; and
WHEREAS, pursuant to Section 15B-6(1 I) of the City Code, the City Commission may
waive event-related fees and costs imposed pur~uant to Section 15B-6; and
WHEREAS, the City Commission wishes to support the Event by waiving a portion of
the special Event-related fees and costs as set forth herein and finds that such waiver is in the best
interests of the City.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF soum MIAMI, FLORIDA:
Section 1. Recitals Adopted. The foregoing recitals are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution upon adoption
hereof.
Section 2. Waiver of Fees. Pursuant to Section l 5B-6(11) of the City Code, the City
Commission hereby waives $19,450 in event-related fees and costs associated with the Event as
required under the Code, provided and conditioned upon the City Manager approving the
application for the Event and the Applicant's compliance with all requirements under Section 15B
of the City Code.
Section 3. Applicability of All Other Fees and Requirements. Except as waived and
provided for herein, all other fees and costs and requirements of the Code remain applicable to the
Event, and the City Manager shall ensure compliance with all Code requirements.
Section 4. Implementation. The City Manager is hereby authorized to take any and
all necessary action to implement the purposes of this Resolution.
Section 5. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.
Section 6. Severability. If any section, clause, sentence, or phrase of this Resolution
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding

shaII not affect the validity of the remaining portions of this Resolution.
Section 7. Effective Date. This Resolution shall become effective immediately upon
adoption.

RECOMMENDATION:This item is submitted for consideration of a fee waiver approval in the
amount of $19,450 for the Rotary Foundation of South Miami, Inc. to host
its annual SOMI Art Festival event on Saturday, February 22nd, and
Sunday, February 23rd, 2025.
BACKGROUND:The Rotary Foundation of South Miami, Inc. (“the applicant”), a 501(c)(3)
organization, has submitted a special event application to host its SOMI Art
Festival (“the festival”) on Saturday, February 22nd, and Sunday, February
23rd, 2025, from 9:00 a.m. to 6:00 p.m. on 72nd Street (Sunset Drive) from
57th Avenue to US1.
The festival is a free public event that will transform Sunset Drive into an
open-air gallery, showcasing paintings, sculptures, photography, and
handcrafted goods. Attendees can engage with artists, purchase unique
pieces, and enjoy live music and food.
As in previous years, the applicant is requesting to use City Hall’s parking
lot for vendor parking, five (5) additional parking spaces on SW 57th Court
for event staff parking, and the City’s parking lot located at 5818 SW 71st
Street to accommodate a restroom trailer for event participants.
Upon approval of the event, the applicant is responsible for submitting the
necessary notification/petition approval form signed by businesses
affected by the requested street closure one week prior to the event date.
Additionally, the applicant must provide the City with the required
Certificate of Liability Insurance that complies with the City’s standard

insurance requirements, including naming the City of South Miami as an
additional insured prior to the event.

We request that in the Resolution drafted for the Commission, you please include waivers from the following sections of Ordinance 158 if it is still in effect: 6.4 Those provisions pertaining to road closure costs and lost parking revenue. 6.6 The reduction in costs for Public Works and Police incurred by the Festival. All of the waivers that we request are in keeping with the current year requests between the City of South Miami and the SOMI Art Festival. We bring approximately 24,000 visitors to the city over a two day period. Many of whom return throughout the year to spend money in the downtown area. Furthermore, being the weekend after President's Day when the Coconut Grove Art Festival and the St. Stephen's Art Festival take place, a number of those artists remain in hotels and motels to participate in our festival. Profits from our festival are used to fund annual college scholarships for students from South Miami High School as well as local arts and children's organizations that serve the South Miami population. The city has always recognized the value of our art festival and the return of visitors to South Miami raising awareness of all that the city has to offer.
