PLANNING AND ZONING BOARD
UNDER THE ZONING ORDINANCE OF THE CITY OF SOUTH MIAMI, THE BOARD CONSISTS
OF ELEVEN APPOINTED MEMBERS INCLUDING THE CHAIRMAN AND VICE-CHAIRMAN.

Re: Application for sign variance - Rohan Associates, Inc.
d/b/a Busy Bee Speedy Car Wash
Gentlemen:
Please find enclosed herewith our application in duplicate for the re-
quired variance to enable us to add the name "Busy Bee" and the trade-
mark of this establishment to our rooftop sign on the Busy Bee Car Wash
located at 5810 S. W. 70th Street, Miami.
Also enclosed please find the required check for $30. 00, as well as a
certified survey containing the correct legal description of the property
in question. Mr. Wood of Acolite Sign Company has, I believe, by this
time furnished you with the required drawings of the actual sign improve-
ments in question.
One of the questions under Item 12 of the enclosed application calls for a
11statement of reasons or conditions justifying the requested change. " I
am sure you recall that originally we had planned the existing sign with
the copy indicating the trademark and name of this establishment, however,
we were advised by your office that this would exceed height limitations
and would require a variance. At that time, since we were just opening
this business, I did not wish to delay the erection if the sign itself, and so
we went ahead with what now exists. What we are now attempting to do
is to simply complete the upper portion of the sign which was omitted
originally for the sake of expediency. However, since the erection of the
original sign which now exists, it has become evident that. additional height
is most certainly required; the reason being that visibility of this sign at
its present height is considerably impaired by its distance from the highway

frontage itself and its exposure to the highway. To further complicate
the problem of height in regards to this specific sign, I call your atten-
tion to the fact that the boxcars of the Florida East Coast Railroad are
practically always parked along their sidings south and east of 70th
Street, resulting in the visibility of our place of business being reduced
to a considerable extent. This has caused us a great deal of concern
and apparently the only way to properly expose our sign is to add the
additional panel at the top which is being requested at this time. This
will expose this sign to the vehicular traffic southbound on U.S. No. 1
in spite of the conjestion of railroad boxcars which seem to permanently
exist in front of the Holsum Bakery storage bins. You may be familiar
with the Renuart-Bailey-Cheely Lumber Company immediately south
and west of our property and with their sign which exceeds in height
that which we are attempting to obtain the right to construct by this
variance. . Due to the aforementioned visibility problems created by the
railroad boxcars and the distance of our establishment from the highway,
we believe that to deny this application would simply perpetuate a hard-
ship which presently exists regarding this place of business.
Accordingly, we appeal to your Department, as well as the City Govern-
ment to grant this appeal and allow us to correct the problem now existing
regarding this sign.
We understand that this hearing will be held on June 14th.and request that
we be notified by mail as to the time and place of said hearing, so that we
may be present to plead this matter.

DENYING WITHOUT PREJUDICE APPLICATION OF
ROHAN ASSOCIATES, INC. , D/B/A BUSY BEE SPEEDY
CAR WASH FOR A VARIANCE TO PERMIT ERECTION OF
NON-CONFORMING SIGN AT PREMISES KNOWN AS
5810 SW 70 STREET.

WHEREAS, ROHAN ASSOCIATES, INC., duly made application
for a variance so as to permit the erection of a non-conforming
sign at 5810 SW 70 Street, and
WHEREAS, the Planning and Zoning Bca rd of the City duly
held a public hearing on sakd application and recommends- that
the application be denied,' and
WHEREAS, the City Council, after the hearing of interested
parties, finds that the existing regulations do not constitute
practical difficulty or hardship as applied to the particular
property; .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY
OF SOUTH MIAMI, FLORIDA:
That the application of Rohan Associates,. Inc. , for a
variance so as to permit the construction of a non-conforming
roof sign on premises known as 5810 SW 70 Street
is hereby DENIED.
