Res No 128-24-16233RESOLUTION NO. 128-24-16233 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA APPROVING AN APPLICATION FOR WAIVER OF PLAT PURSUANT TO SECTION 20-4.2 OF THE LAND DEVELOPMENT CODE SEEKING TO SUBDIVIDE A PROPERTY WITHIN THE SEMI-ESTATE RESIDENTIAL (RS-2) ZONING DISTRICT LOCATED AT 5400 SW 63 AVENUE; PROVIDING FOR CONDITIONS; CORRECTIONS; IMPLEMENTATION; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the Applicant, Robert Kramer as the owner of the property located at 5400 SW 63 Avenue (Folio No. 09-4024-026-0050) and legally described in Exhibit "A" attached hereto (the "Property,,), submitted Application No. PB-24-016 (the "Application") requesting approval of a. Waiver of Plat seeking to subdivide the Property pursuant to Section 20-4.2 of the Land Development Code (the "LDC"); and WHEREAS, the Application requests a subdivision of the Property into two (2) lots ("Lot I" and "Lot 2" as shown on the Waiver of Plat Survey) in the Semi-Estate Residential (RS-2) zoning district, so that one (I) of the two (2) buildable single-family lots can be developed with a new single-family residence; and WHEREAS, at a Public Hearing on August 13, 2024, the Planning Board recommended approval of the Application, subject to conditions; and WHEREAS, the Mayor and City Commission of the City of South Miami, having considered each of the guidelines listed in Section 20-4.2(B) of the LDC and having found that those conditions have been met, desire to approve the Waiver of Plat application. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Recitals and Findings. The recitals set forth in this resolution and in the Waiver of Plat Approval are true and correct, and are supported by competent substantial evidence, and they are incorporated into this resolution by reference as if set forth in full herein. The City Commission finds that the Waiver of Plat requested in the Application meets the requirements of Section 20-4.2(8) of the LDC. Section 2. Waive1· of Plat App1·oval. The Application submitted by the Applicant, Robert Kramer, requesting approval of a proposed Waiver of Plat subdividing the Property into two (2) lots located at 5400 SW 63 Avenue and legally described in Exhibit "A" attached hereto,· pursuant to the Land Subdivision Regulations outlined in LDC Section 20-4.2, is hereby approved. Section 3. Conditions of Approval. The Waiver of Plat is hereby approved subject to the following terms and conditions, as well as all applicable City ordinances, codes, rules, and regulations: Page 1 of 4 Res. No. 128-24-16233 1. The design of the new single-family residence on Lot 2 is subject to the review and approval of the Design Review Board; 2. All architectural plans submitted to the City as part of the building permits for the Property must be signed and sealed by a Florida Registered Architect; 3. All landscape plans submitted to the City as part of the building pennit for the Property must be signed and sealed by a Florida Registered Landscape Architect. 4. The wooden shed on the Property will need to be either removed or relocated; 5. Ensure the retention of specimen trees for six (6) years and permanently maintain fifty (50) percent of existing protected tree canopy, but in no event shall the condition be • less restrictive than what is required by the City's and County's tree ordinance; 6. A tree removal permit is required prior to the removal/relocation of any trees on the Property; 7. When developed, each lot on the Property must retain the stormwater within its property line; 8. For any new Utility connections that require connection on the roadway, the paving resurfacing limits shall be Edge to Edge and Property Line to Property Line; 9. Execute and record in the public records of Miami-Dade County, a restrictive covenant, in a form approved by and subject to the review and approval of the City Manager and City Attorney~ which contains all commitments made and conditions imposed as part of the approval of the approved waiver of plat; and IO. The Property must comply with all of the regulations outlined in Section 20-4.2 of the LDC. Section 4. Co...-ections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 5. Sevel'ability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. BACKGROUND: On May 10, 2024, an application for Waiver of Plat was filed by the applicant/property owner, Mr. Robert Kramer (“Applicant”), in order to subdivide the parcel located at 5400 SW 63rd Avenue into two (2) parcels so that a new single-family home can be built. The parcel in question is a double frontage lot that fronts both SW 63rd Avenue and SW 63rd Court. Currently, there is an existing one-story single-family structure, wooden deck, concrete driveway, concrete patio area, and an accessory structure (wooden shed) on the site. Based on the plans provided, the site will be divided in such a way that the existing single-family structure will remain. REQUEST: The Applicant is requesting approval through the Waiver of Plat process as provided in Section 20-4.2 of the City’s Land Development Code (“LDC”) to subdivide the existing platted parcel of land into two (2) individual parcels so that the western parcel can be redeveloped into a single- family residential property. LEGAL DESCRIPTION: LOT 4, BLOCK 1, LA HAMACA, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 51, PAGE 25 OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. ANALYSIS: Located in the Semi-Estate Residential (RS-2) zoning district, the intent of the proposed Waiver of Plat application is to subdivide the parcel of land located at 5400 SW 63rd Avenue into two (2) separate parcels (Lot “1,” and Lot “2”). As required by the LDC, the Applicant has provided a conceptual site plan for the City to review. Pursuant to Section 20-4.2 of the LDC, the proposed subdivision must meet the minimum requirements for the RS-2 zoning district. Additionally, pursuant to the City’s subdivision regulations listed in Section 20-4.2(B) of the LDC, prior to approving a waiver of plat, tentative or final plat, the City Commission shall use the following guidelines to review the project: 1. Section 20-4.2(B)(2)(a)(i): The building site created by the proposed waiver of plat, tentative or final plat, should be equal to or larger than the median of the existing building sites in the Surrounding area (this shall be demonstrated using copies of the official plat maps for the subject property and surrounding neighborhood), unless otherwise permitted by this ordinance. Surrounding area is defined as all lots within the same 3 zoning district and within five hundred (500) feet from the exterior boundaries of the subject property. Staff Response: A review of the lot sizes and frontages of the surrounding area was performed and is provided in the table below: Waiver of Plat Median Analysis Table Surrounding Area Lot 1 Lot 2 Net Lot Area/ Buildable Site (SF)21,649.0 28,057 15,235 Lot Frontage (Ft.)138.500 138.5 138.5 When looking at the neighborhood surrounding the proposed subdivision, it was found that Lot 1 met the median frontage and exceeded the median lot area for the surrounding area. However, Lot 2 only met the median lot frontage for the surrounding area. It did not meet or exceed the median lot area. Pursuant to Section 20-4.2(B)(2)(a)(ii) of the LDC, The City Commission may, in its discretion, approve a subdivision of land into lots that are included as part of a waiver of plat, tentative or final plat and that have lot frontage or lot area that is less than the Surrounding area median, provided it is approved by four votes of the City Commission and provided that at least the minimum requirements of the Land Development Code are satisfied. As long as the project meets the minimum requirements of the RS-2 zoning district, the City Commission may approve the project even though it does not meet the surrounding area median. For more information on the median buildable site/lot size and the median frontage for the surrounding area, please refer to the attached exhibit, Waiver of Plat Median Analysis for 5400 SW 63rd Avenue. 2. Section 20-4.2(B)(2)(b): The building site created by the proposed waiver of plat, tentative or final plat, will not result in existing structures becoming nonconforming as they relate to setbacks, lot area, lot width and depth, ground coverage and other applicable regulations of the City's Land Development Code and/or City's Code of Ordinances, except as permitted by this ordinance. Compliance with this provision may occur by demolition or relocation of existing structures. Staff Response: Per the boundary survey provided, an existing one-story single-family structure, accessory structure (wooden shed), wooden deck, concrete driveway and concrete patio area are shown to be currently on the site. The Applicant is proposing to 4 divide the site in such a way that the single-family structure will be preserved and will be in full compliance with the City’s dimensional requirements. The applicant is also proposing to renovate the house, remove both the concrete patio area and the wooden deck, and replace it with a new swimming pool and deck area that will be in compliance as well. However, because of its location in relation to the proposed subdivision, the wooden shed will need to be either removed or relocated as its current location will cause it to encroach into the new parcel once it has been created. 3.Section 20-4.2(B)(2)(c): The building site created by the proposed waiver of plat, tentative or final plat, will be free of encroachments from abutting building sites. Staff Response: Other than the encroachment of the wooden shed once the lot is subdivided, there are no other encroachments from abutting sites. 4. Section 20-4.2(B)(2)(d): The building site created by the proposed waiver of plat, tentative or final plat, is free of any declarations of restrictive covenants, unity of title, easements, or the like, which would prevent the separation of the site. However, this provision may be satisfied if existing covenants, unity of title, easements, or similar instruments, which conflictwith the proposed subdivision, are released or modified to accommodate the proposed building site. Staff Response: The Applicant has provided an owner’s affidavit dated May 9, 2024, stating that the property is free of restrictive covenants, unity of title, easements or the like which would prevent a separation or partition of the land. 5. Section 20-4.2(B)(2)(e): The scale of any proposed new construction shall be compatible with the as-built character of the surrounding area and shall not create adverse impacts on the surrounding area; but if so, the applicant shall provide satisfactory commitments as to how the adverse impacts will be mitigated. An example of an adverse impact includes visual impacts arising from a proposed two-story structure in an area built out with single-story homes; mitigation could include adding a condition to the approval of the waiver of plat, tentative plat or final plat, for landscape buffers, or adjusting second-story setbacks or building facades to reduce the visual impact. Staff Response: Fronting both SW 63rd Avenue and SW 63rd Court, the Applicant’s intent is to subdivide the lot so that each lot will face their respective street. By doing so, the lot will 5 be divided in half with Lot 1 facing east and Lot 2 facing west. The existing one-story single- family structure on Lot 1 will remain but will be renovated. The Applicant is also proposing to demolish both the existing wooden deck and concrete patio area sothat a new swimming pool and deck area can be built in their place. To complement the neighborhood and surrounding area, a one-story single-family residence with swimming pool and deck area are also proposed for Lot 2. When looking at the neighborhood, it was found that the subject parcel is surrounded by a mixture of one-story and two-story homes with a majority of them being one-story in height. Four (4) single-family structures immediately abut the subject parcel with three (3) of them being one-story in height. The remaining structure is two-story in height and is located to the north (5330 SW 63 Avenue). Based on the existing configuration of the neighborhood and what is proposed by the Applicant, there does not appear to be any adverse impacts projected for the neighborhood. It is important to note that the conceptual site plan that was provided was prepared by the Professional Land Surveyor for the project. For purposes of this application that is acceptable as the site plan is only conceptual in nature. However, if approved, all plans submitted to the City for the redevelopment of the site must be signed and sealed by a Florida Registered Architect. Additionally, any landscape plans prepared in connection with the redevelopment must be signed and sealed by a Florida registered Landscape Architect as well. 6. Sec. 20-4.2(B)(2)(f): The building site(s), lot(s) or parcel(s) of land that would be created are divided in such a manner that they are in compliance with the regulations of the City's Land Development Code. Lot area and street frontage calculations shall exclude abutting public rights-of-way. Staff Response:The proposed plat complies with the LDC section above. As shown in the table below, the two (2) proposed parcels are consistent with the minimum lot size and minimum frontage requirements for the RS-2 zoning district. Sec. 20-4.2(B)(2)(g): The building site or sites created by the proposed waiver of plat, tentative or final plat cannot constitute an irregular parcel (one that has more than four (4) corners 6 or that has any curved or jagged lot line), unless the City Commission by a four- fifths (⅘) vote determines that the irregularity arises from irregularity in the original parcel and cannot be corrected, or the Commission by such vote determines the irregularity is compatible with the parcels in the Surrounding area. Staff Response:The proposed plat complies with the LDC section above. The proposed plat will not create any irregular sized parcels as all parcels will have four (4) corners. 8. Sec. 20-4.2(B)(3)(a) Ensure the retention of specimen trees for six (6) years and permanently maintain fifty (50) percent of existing protected tree canopy, but in no event shall the condition be less restrictive than what is required by the City's and County's tree ordinance. Staff Response:Per the Waiver of Plat survey provided by the Applicant, the following trees have been identified as specimen sized trees and must be retained for at least six (6) years: Oak Tree (Tree #1) Oak Tree (Tree #2) Oak Tree (Tree #5) Oak Tree (Tree #6) It is important to note that these trees are all located on the proposed Lot 1 and will not be affected by the redevelopment of Lot 2. 9. Sec. 20-4.2(B)(3)(c) Execute and record in the public records of Miami-Dade County, a restrictive covenant, in a form approved by and subject to the review and approval of the City Manager and City Attorney, which contains all commitments made and conditions imposed as part of the approval of the approved waiver of plat, tentative and/or final plat. Staff Response:Pursuant to the LDC section above, the Applicant will be required to execute and record in the public records of Miami-Dade County, a restrictive covenant that contains all commitments made and conditions imposed as part of the approval of the waiver of plat. 10. Sec. 20-4.2(B)(4)(a & b) Additional Application Requirements. As part of the required tentative or final plat or waiver of plat application, applicants, other than the City, shall be required to submit a proposed conceptual site plan drawn to scale, and 7 indicating the following information for the entire subject property to be subdivided: (a) Building footprints; (b) Setbacks, yard requirements and easements. For purposes of this section, a conceptual site plan means a plan that is drawn at the schematic design phase, showing parcel lot lines, land uses, general building location, general driveway and parking arrangements, and major site features. Future construction may not exceed by more than four (4) percent the size of the building, or floor area, gross, shown on the conceptual plan, unless approved by the City Commission by a four-fifths (⅘) vote, and as long as the setbacks and yard requirements are in accord with the Code existing at the time of such future construction. The conceptual site plan shall be reviewed by the Planning Board and approved by resolution of the City Commission under the provisions for applications requiring a public hearing of Section 20-5.5. Staff Response:The Applicant has provided the City with a conceptual site plan that details the building footprints, setbacks, yard requirements, and any easements. Staff has reviewed the conceptual site plan against the dimensional requirements for the RS-2 zoning district that are listed in Section 20-3.5(E) of the LDC. That review can be found in the tables below. Pursuant to Section 20-3.5(E) of the LDC, the cumulative width of both side yards shall be not less than 20 percent (20%) of the total lot width. Sec. 20-4.2(B)(4)(c) (c) A certified tree survey overlaid directly upon the site plan, as required by Section 20-4.5. The tree survey must include the canopy measurements. Once an application for a waiver of plat or tentative plat is filed, no tree may be removed until after final waiver of plat or final plat approval is issued (Tree Removal Moratorium). The applicant may appeal to the City Commission to waive the Tree Removal Moratorium for good cause. Staff Response:Per the Waiver of Plat survey provided by the Applicant, a list of the trees on the site was provided. The Conceptual Site Plan was provided which details all existing trees on the property in relation to the conceptual design of the two (2) structures. After reviewing it, it was determined that the following trees will be affected by the redevelopment of Lot 2: Tree #27 Tree #35 Because of its close proximity to the wooden shed that will need to be relocated/removed, Tree #42 will be affected as well. A tree removal permit will be required prior to the removal/relocation of any trees on the site. Because redevelopment is not proposed for Lot 1, none of the trees shown on Lot will be affected. 12. Sec. 20-4.2(C)(1) Sidewalks, curbs, gutters, drainage and paving shall be installed by the owner or developer of the abutting parcel in accordance with Chapter 28 of the County Code and other applicable city requirements, unless such can be and are waived or deferred by the city commission. Staff Response:To comply with the subsection listed above, the conceptual site plan was reviewed by representatives of the Public Works Department. As indicated in the email dated July 3, 2024, from Mr. Nelson Gomez, The neighborhood does NOT have existing sidewalks. Therefore, sidewalks are not required. Additionally, each property must retain the stormwater within the property line. For any new Utilities connection that requires connection on the roadway the paving resurfacing limits shall be Edge to Edge and PL to PL. Mr. Gomez’ comments have been made conditions of approval for this project. 10 PREVIOUS ACTION: On August 13, 2024, the Planning Board (PB) held a Public Hearing on the item and voted 6 to 0 to unanimously recommend approval of the Waiver of Plat application with staff’s recommendations.
