FLORIDA, APPROVING AND AUTHORIZING THE
WAIVER OF CERTAIN EVENT-RELATED FEES AND
COSTS IN THE AMOUNT OF $2,472.75 PURSUANT TO

PRESENTED BY THE KEY BISCAYNE COMMUNITY
FOUNDATION, INC., TO BE HELD ON SATURDAY,
OCTOBER 12, 2024; PROVIDING FOR APPLICABILITY OF
OTHER CODE REQUIREMENTS; PROVIDING FOR
IMPLEMENTATION, CORRECTIONS, AND AN
EFFECTIVE DATE.
WHEREAS, the Key Biscayne Community Foundation, Inc. (the "Applicant"), a Florida
not for profit corporation, has submitted a special event application to the City of South Miami
(the "City") to host its annual SoMi Kid's Marketplace on Saturday, October 12, 2024 from 10:30
am. to 1:30 p.m at SW 58th Avenue between SW 73rd and 74th Street (the "Event"); and
WHEREAS, the application for the Event is currently under review and subject to
approval by the City Manager pursuant to Section 15B-6 of the City Code; and
WHEREAS, a request has been made for a fee waiver in the amount of $2,472.75,
inclusive of application and admin ($160), Police Dept. ($869), Public Works ($740), street closure
and MOT ($278. 75), and parking meter rental ($425). The applicable Event fees are as follows:

WHEREAS, pursuant to Section 15B-6(11) of the City Code, the City Commission may
waive event-related fees and costs imposed pursuant to Section I SB-6; and
WHEREAS, the City Commission desires to approve the waiver of Event-related fees and
costs for the Event as set forth herein; and

WHEREAS, the City Commission finds that this Resolution is in the best interest and
welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Waiver of Fee. Pursuant to Section 158-6(11) of the City Code, the City
Commission hereby waives event-related fees and costs for the Event in the amount of $2,472.75,
provided and conditioned upon the City Manager approving the application for the Event and the
Applicant's compliance with all requirements under Section 15B of the City Code
Section 3. Applicability of All Other Reguir-ements. Except as waived and provided
for herein, all other requirements of the Code remain applicable to the Event, and the City Manager
shall ensure compliance wi th all Code requirements.
Section 4. Implementation. The City Manager is authorized to take any and all
actions necessary lo implement the purposes of this Resolution.
Section 5. Corrections. Conforming lang uage or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.

Marketplace Event
RECOMMENDATION:The accompanying Resolution was prepared and placed on the agenda at
the request of Commissioner Calle for the consideration of a fee waiver
totaling $2,472.75 for the Key Biscayne Community Foundation, Inc. to
host their SoMi Kid’s Marketplace Event on Saturday, October 12, 2024, at
SW 58th Ave, between SW 73rd and 74th Street.
BACKGROUND:The Key Biscayne Community Foundation, Inc., a Florida not for profit
organization, ("the applicant"), has submitted a special event application to
host the SoMi Kid’s Marketplace Event (the “event”) on Saturday, October
12, 2024, from 10:30 a.m. to 1:30 p.m., at SW 58
th Ave, between SW 73rd
and 74th Street.
The applicant expects up to 1,000 attendees over the course of the event and
highlights that this event is specifically designed to provide a hands-on
experience for young entrepreneurs aged 8 to 16. The goal is to inspire
participants to realize the potential of their ideas and take actionable steps.
They will have the opportunity to develop a product, create a marketing
strategy, hone their social skills in a real-world setting, and launch their
businesses at the SoMi Kid’s Marketplace.
The registration fee per business participating is $35.00, while the event is
free for the public. A total of 50 businesses will participate, with tents and
chairs provided by the applicant. The applicant’s event budget is reported
at $18,400, with an estimated total event cost of $20,872.75. The applicant
has collected $14,972.75 in sponsorships at the time of this writing,
including the proposed waiver amount of $2,472.75, leaving a remaining
balance of $5,900 to be covered. Refer to the attached “Budget-SoMi Kids
Marketplace ’24,” which the applicant has provided as requested by staff.

The applicant has reached out to schools within the city to encourage
student participation. Additionally, they are requesting the rental of 17
parking meters for the duration of the event at a rate of $25 per space. There
will be no food vendors. The applicant will utilize the existing stage and
sound equipment, which will be available later for SoMi Second Saturdays.
Public Works staff will be on-site to assist with maintenance and provide
barricades, while police officers will provide security throughout the event.
The applicant is responsible for submitting a Certificate of Insurance that
meets the City’s standard requirements and names the City of South Miami
as an additional insured prior to the event.
FEES TO BE WAIVED:The applicant is requesting to waive all estimated event service fees in the
amount of $2,472.75 as illustrated in the table below:

INDEMINIFATION AGREEMENT
THIS AGREEMENT ("Agreement"} Is entered lnto by and between Key Biscayne Communlly Foundation
("Applicant"), and the City of South Miami ("City") on the date on which the last of the Parties executes this Agreement.
RECITALS
WHEREAS, the Applicant has submitted a Special Event Permit Application to the City for {event title)

agreement protecting the City from claims which may arise out of the Special Event.
Now, THEREFORE, In consideration of the matters recited above, the mutual covenants set forth herein, and other
good consideration the receipt and sufficiency of which Is hereby acknowledged, the Parties hereby agree as
follows:
1. The above recitals are true and correct.
2. Applicant agrees to indemnify, defend and hold the City, Its officers, affiliates, employees, successors and
assigns ( collectively "lndemnitees") harmless from and against any and all such claims, suits, actions,
damages, or causes of action arising as result of the Special Event, or of the condition of the site on which
the Special Event ls held including any personal Injury or loss of life, or damage to or loss of property, and
from and against any costs, attorney's fees, expenses or liabllities included in and about the defense or settlement of any clams, and the Investigation thereof, except to the extent caused by lndemnltees
negligence of willful misconduct.
3. No Street shall be closed without approval from the City Commission.
4. Traffic shall be maintained in accordance with Florida Department of Transportation (FD0T), Miami-Dade
County standards and any additional requirements by the City of South Miami Public Works Department
and Police Department.
5. Event areas shall be restored to equal or better condition than they were before the event started.
6. Any damage to private property shall be restored to its original condition or better and as accepted by the
owner caused by applicant or any of its agents, servants or employees, invitees and onlookers.
7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public
Works Department may restore the event area and charge the applicant for the cost of restoration and
additional Incidental fees.
8. Applicant must pay all fees prior to the date of their event(s).

Fee Waiver Request for SoMi Kid's Marketplace 2024
Dear Commissioner Calle,
We are writing to request a fee waiver for the SoMi Kid's Marketplace 2024, scheduled to take
place on Saturday, October 12th, 2024, at the intersection of SW 73rd Street and SW 58th
Avenue in South Miami. The total amount for which we are requesting a fee waiver is
$2,472.75. This amount includes the following fees:
The SoMi Kid's Marketplace aims to inspire and motivate young entrepreneurs aged 8 to 16 by
providing them with an opportunity to understand the value of their ideas and transform them
into action in a one-day marketplace event.
We would be honored to have the City of South Miami support this initiative, which is designed
to encourage and empower the next generation of innovators and business leaders. We also
extend an invitation for city officials and staff to attend the event and witness firsthand the
impact of this unique experience on our young participants.
