WHEREAS, the Key Biscayne Community Foundation, Inc. (the "Applicant"), a Florida not for profit corporation, has submitted a special event application to the City of South Miami (the "City") to host its annual SoMi Kid's Marketplace on Saturday, October 12, 2024 from 10:30 am. to 1:30 p.m at SW 58th Avenue between SW 73rd and 74th Street (the "Event"); and WHEREAS, the application for the Event is currently under review and subject to approval by the City Manager pursuant to Section 15B-6 of the City Code; and WHEREAS, a request has been made for a fee waiver in the amount of $2,472.75, inclusive of application and admin ($160), Police Dept. ($869), Public Works ($740), street closure and MOT ($278. 75), and parking meter rental ($425). NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. Recitals. The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2. Waiver of Fee. Pursuant to Section 158-6(11) of the City Code, the City Commission hereby waives event-related fees and costs for the Event in the amount of $2,472.75, provided and conditioned upon the City Manager approving the application for the Event and the Applicant's compliance with all requirements under Section 15B of the City Code Section 3. Applicability of All Other Reguir-ements. Except as waived and provided for herein, all other requirements of the Code remain applicable to the Event, and the City Manager shall ensure compliance wi th all Code requirements. Section 4. Implementation. The City Manager is authorized to take any and all actions necessary lo implement the purposes of this Resolution. Section 5. Corrections. Conforming lang uage or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. BACKGROUND:The Key Biscayne Community Foundation, Inc., a Florida not for profit organization, ("the applicant"), has submitted a special event application to host the SoMi Kid’s Marketplace Event (the “event”) on Saturday, October 12, 2024, from 10:30 a.m. to 1:30 p.m., at SW 58 th Ave, between SW 73rd and 74th Street. The applicant expects up to 1,000 attendees over the course of the event and highlights that this event is specifically designed to provide a hands-on experience for young entrepreneurs aged 8 to 16. The goal is to inspire participants to realize the potential of their ideas and take actionable steps. They will have the opportunity to develop a product, create a marketing strategy, hone their social skills in a real-world setting, and launch their businesses at the SoMi Kid’s Marketplace. The registration fee per business participating is $35.00, while the event is free for the public. A total of 50 businesses will participate, with tents and chairs provided by the applicant. The applicant’s event budget is reported at $18,400, with an estimated total event cost of $20,872.75. The applicant has collected $14,972.75 in sponsorships at the time of this writing, including the proposed waiver amount of $2,472.75, leaving a remaining balance of $5,900 to be covered. Public Works staff will be on-site to assist with maintenance and provide barricades, while police officers will provide security throughout the event. The applicant is responsible for submitting a Certificate of Insurance that meets the City’s standard requirements and names the City of South Miami as an additional insured prior to the event. Traffic shall be maintained in accordance with Florida Department of Transportation (FD0T), Miami-Dade County standards and any additional requirements by the City of South Miami Public Works Department and Police Department. 5. Event areas shall be restored to equal or better condition than they were before the event started. 6. Any damage to private property shall be restored to its original condition or better and as accepted by the owner caused by applicant or any of its agents, servants or employees, invitees and onlookers. 7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public Works Department may restore the event area and charge the applicant for the cost of restoration and additional Incidental fees. 8.
