RESOLUTION NO. 132-23-1606S A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA APPROVING AN APPLICATION FOR TENTATIVE PLAT APPROVAL PURSUANT TO SECTION 20-4.2 OF THE LAND DEVELOPMENT CODESEEKING TO PLAT THE PROPERTIES LOCATED AT 6201 SUNSET DRIVE, 6233 SUNSET DRIVE, AND 71S0 SW 62 AVENUE; PROVIDING FOR CONDITIONS; ENFORCEMENT OF CONDITIONS; CORRECTIONS; IMPLEMENTATION; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the applicant, South Miami Hospital, Inc., submitted Application No. PB-23-014 (the "Application"), requesting approval of a Tentative Plat to combine the parcels identified as 6201 Sunset Drive, 6233 Sunset Drive, and 7150 SW 62 Avenue (Folio Numbers 09-4025-000-06 l 0, 09-4025-000- 0680, and 09-4025-000-0650), pursuant to Section 20-4.2 of the Land Development Code (the "LDC"); and WHEREAS, the Tentative Plat application requests a combination of the three previously unplatted parcels into one (1) lot in the Transit-Oriented Development District-MU-5 (TODD (MU-5)) Zoning District; and WHEREAS, the one combined lot will be developed with a new 96,877 square foot medical rehabilitation facility that is the subject of an application for large scale development approval; and WHEREAS, the owner has submitted a conceptual Site Plan, Tree Disposition Plan, and Landscape Plan for the project in connection with the large scale development approval application, which has been reviewed by the Planning Board; and WHEREAS, the lot created by the proposed Tentative Plat is in strict compliance in that the frontage and size of the combined lot proposes a buildable site that is greater than the median of the surrounding area; and WHEREAS, the lot created by the proposed plat otherwise complies with the requirements of Section 20-4.2(8} of the LDC; and WHEREAS, at a Public Hearing on September 12, 2023, the Planning Board voted seven (7) to zero (0) to recommend approval of the Tentative Plat application, subject to the Conditions of Approval; and WHEREAS, the Mayor and City Commission of the City of South Miami, having considered each of the guidelines listed in Section 20-4.2(B) of the LDC and having found that those conditions have been met, desire to approve the Tentative Plat application. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1: Recitals and Findings. The recitals set forth in this resolution are true and correct, and are supported by competent substantial evidence, and they are incorporated into this resolution by reference as if set forth in full herein. The City Commission finds that the Tentative Plat requested in the Application meets the requirements of Section 20-4.2(B) of the LDC. Page 1 of 3 Res. No. 132-23-16065 Section 2: Approval. The application submitted by South Miami Hospital, Inc., requesting approval of the proposed Tentative Plat, pursuant to the Land Subdivision Regulations outlined in LDC Section 20-4.2, to combine the three (3) previously unplatted parcels located at the northwest corner of the intersection of Sunset Drive and SW 62nd Avenue into one ( 1) lot, is hereby approved. Section 3: Conditions .. The Tentative Plat is hereby approved subject to the following terms and conditions, as well as all applicable City ordinances, codes, rules, and regulations: a. Submittal of an owner's affidavit that there are no documents that provide restrictions, reservations and/or covenants applicable to the parcel of land being considered other than those that were submitted with the owner's Tentative Plat application and that the parcel is free of any declarations of restrictive covenants, unities of title, easements, 01· the like, which would prevent the combination of the site. b. The applicant shall adhere to the Landscape Plan submitted and approved as part of the Large-Scale Development and the Mitigation requirements of the LDC. c. As a part of the application for a Building Permit, the applicant shall make all reasonable efforts to coordinate with the property owner of the property located to the north regarding the trees which extend over and encroach the subject property so that the property owner can mitigate the encroachment as allowed by the Land Development Code. Reasonable efforts shall include proof of notice to the property owner by Certified Mail. d. The applicant shall provide a corrected Tree Disposition Plan prior to review of the T-Plat by the City Commission. Section 4. Enforcement of Conditions. The Owner of the Property understands and acknowledges that they must comply with these conditions and all other applicable requirements of the LDC and City Code before they may commence construction or occupancy, and that the foregoing approval in this Resolution may be revoked by the City at any time upon a detennination by the City Commission, following a public hearing, that the Owner is in non-compliance with the LDC, the City Code and/or the conditions of this Approval and have failed to cure, or to provide an acceptable plan to timely cure, the non- compliance. Section S. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 6. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining p011ions of this l'esolution. BACKGROUND: On May 5, 2023, an application for Tentative Plat was filed by the applicant/property owner, Baptist South, LLC., in order to combine three (3) separate meets and bounds parcels into one (1) single non-residential parcel so that a new 96,877 square foot health rehabilitation facility may be constructed on the site. The property is located at the northwest corner of the intersection of Sunset Drive and SW 62nd Avenue,having addresses of 6201 Sunset Drive, 6233 Sunset Drive, and 7150 SW 62 Avenue (Folio Numbers 09-4025-000- 0610, 09-4025-000-0680, and 09-4025-000-0650). The sites are currently vacant and contain vegetation. Combined, the three (3) parcels total 105,679 square feet, or 2.42 acres. All three parcels are designated Transit-Oriented Development District Mixed-Use 5 (TODD (MU-5)) on the City’s Zoning Map with a Future Land Use Map designation of Transit-Oriented Development District). There is a concurrent application 2 for a Special Exception of a Large-Scale Development. Location Map of Property REQUEST: The applicant is requesting approval through the Tentative Plat process as provided in Section 20-4.2 of the City’s Land Development Code (LDC), to unify the existing parcels into one (1) parcel of land with the intent of constructing a new non-residential building. ANALYSIS: Section 20-4.2(B)(2) of the Land Development Code (LDC)provides the seven specific guidelines the City Commission shall use in evaluating a T-plat application. The applicant’s proposed tentative plat has been evaluated using these guidelines. Each guideline is described below along with Staff’s analysis of how the application satisfies them. 1.Section 20-4.2(B)(2)(a)(i): The building site created by the proposed waiver of plat, tentative or final plat, should be equal to or larger than the median of the existing building sites in the Surrounding area (this shall be demonstrated using copies of the official plat maps for the subject property and surrounding neighborhood), unless otherwise permitted by this ordinance. Surrounding area is defined as all lots within the same zoning district and within five hundred (500) feet from the exterior boundaries of the subject property. Staff Response: A review of the lot sizes and frontages of the surrounding area was performed and is provided in the table below, as well as the Tentative Plat Median Analysis (attached). 3 Tentative Plat Median Analysis Table Surrounding Area Subject Parcel Net Lot Area/ Buildable Site (SF)24,739.38 105,679 Lot Frontage (Ft.)119.00 306.00 In summary, the three combined lots are larger in size than the median size of the surrounding lots within the same zoning district, within 500 feet of the properties and exceed the median frontage of similarly zoned parcels. 2.Section 20-4.2(B)(2)(b): The building site created by the proposed waiver of plat, tentative or final plat, will not result in existing structures becoming nonconforming as they relate to setbacks, lot area, lot width and depth, ground coverage and other applicable regulations of the City's Land Development Code and/or City's Code of Ordinances, except as permitted by this ordinance. Compliance with this provision may occur by demolition or relocation of existing structures. Staff Response: Complies. The property is vacant as the buildings that were located onsite were previously demolished. 3.Section 20-4.2(B)(2)(c):The building site created will be free of encroachments from abutting building sites. Staff Response: Complies. 4.Section 20-4.2(B)(2)(d):The building site created is free of any declarations of restrictive covenants, unit of title, easements, or the like, which would prevent the separation of the site. Staff Response: Complies. 5.Section 20-4.2(B)(2)(e): The scale of any proposed new construction shall be compatible with the as-built character of the surrounding area and shall not create adverse impacts on the surrounding area; but if so, the applicant shall provide satisfactory commitments as to how the adverse impacts will be mitigated. An example of an adverse impact includes visual impacts arising from a proposed two-story structure in an area built out with single-story homes; mitigation could include adding a condition to the approval of the waiver of plat, tentative plat or final plat, for landscape buffers, or adjusting second-story setbacks or building facades to reduce the visual impact. Staff Response: Complies. The project is immediately south of a seven (7) story medical building. To the south across Sunset Drive is a hospital complex with the main building located on the southwest corner of Sunset Drive being seven (7) stories in height. No adverse impacts are expected with the construction of the proposed building. 6.Sec. 20-4.2(B)(2)(f): The building site(s), lot(s) or parcel(s) created comply with the regulations of the LDC. 4 Staff Response:Not applicable. The TODD MU-5 doesn’t require minimum lot size or frontage dimensions. The proposed site plan has been reviewed and found to comply with the TODD MU- 5 regulating plan. 7.Sec. 20-4.2(B)(2)(g): The building site(s) created cannot constitute an irregular parcel (one that has more than four (4) corners) unless the City Commission determines by a 4/5th vote that the irregularity arises from irregularity in the original parcel and cannot be corrected, or that the irregularity is compatible with the surrounding area. Staff Response:There are no irregularities in the boundary of the property. OTHER LAND DEVELOPMENT CODE REQUIREMENTS: As amended by the City Commission on December 21, 2021, Section 20-4.2(B)(3)(a) provides that: Additional conditions mayensure the retention of specimen trees for six (6) years and permanently maintain fifty (50) percent of existing protected tree canopy, but in no event shall the condition be less restrictive than what is required by the City's and County's tree ordinance. The applicant has supplied staff with the Tree Disposition Plan, Sheet L100, which indicates the existing trees that will be affected by the redevelopment of the site. Based on this Plan, 11 Live Oak Trees (#’s 1 through 9, 13, and 14) have been identified as specimen trees Of these trees, all have been determined to be High Quality Species and require a Tree Removal Permit and Mitigation. The plans call for the removal of all 11 trees and their 11,129.09 square feet of canopy with the planting of trees that will provide mitigation in the amount of 23,300.00 square feet of canopy, which is required by the LDC. The proposed mitigation will exceed the currently existing canopy. Staff recommends that the applicant adhere to the Landscape Plan submitted and approved as part of the Large-Scale Development and the Mitigation requirements of the LDC. Pursuant to Section 20-4.2(C)(1) of the LDC, Sidewalks, curbs, gutters, drainage, and paving shall be installed by the owner or developer of the abutting parcel in accordance with Chapter 28 of the County Code and other applicable city requirements, unless such can be and are waived or deferred by the city commission. Because of the nature of the project, the developer will comply with the requirements listed in Section 20-4.2(C)(1) of the LDC. PREVIOUS ACTION: On September 12, 2023, the Planning Board (PB) held a Public Hearing on the item and voted six (6)/seven (7) to zero (0) to recommend approval of the request. This request is being submitted concurrently with the request to approve a special exception for a proposed large scale development of a rehabilitation facility of less than four stories and in excess of 40,000 square feet pursuant to Section 20-8.9 of the City's Land Development Regulations. Accompanying this application for tentative plat approval is the boundary survey/tentative plat entitled, "Tentative Plat of Baptist Health Rehabilitation Hospital", as prepared by Pulice Land Surveyors, Inc., consisting of two (2) sheets (the "Tentative Plat"). The Sick and Shut Down List comprises restaurants in Miami-Dade,Broward, Palm Beach and Monroe counties that failed state inspection.That means they were closed until they passed a return inspection. Here are two from this week’s list:. Bubby’s Fish N’Chips, 1129 NE 163rd St.,North Miami Beach:Routine inspection,30 total vio- lations,six High Priority violations. Dismayed as Bubby’s owner Schneur Borenstein was over an inspection covered in Stop Sales and rodent poop,he really had a problem with the in- spectors claiming they were obstructed and “Operator requested for the inspector to leave the premises and refused to have the em- ployees in the location to sign the paper work and inspection.” Borenstein said to the Miami Herald Wednesday, “I contest that part.There was no manager on duty at the time.I inquired about removing that because it wasn’t accurate.Nobody wanted to sign when there was nobody with that au- thority.” “Even the next day when they reopened us,we re- quested a supervising in- spector,”Borenstein said. “I did speak with them when they came back the next day.We’ve never had a rodent issue.We’ve never had these types of things ever.We obviously care about the cleanliness of the store.But,to say we’re obstructionist,I don’t think that’s correct.” Clearly,the inspectors moved freely enough through the restaurant next door to Mikado 31 (see below)to find a plethora of violations. Such as Bubby’s being a literal “hole in the wall” restaurant by having a “hole in the wall under the hand washing sink in the bathroom closest to the back door.” Bags of onions were stored on the back storage area floor. Hole in the wall plus food on the floor often equals the skritch-skritch of little claws from the furry, four-legged vermin.And you know they had a good time at their Bubby’s mini- beast feast from the 2 70 pieces of rodent regularity they left behind,most prominently “120-plus rodent droppings on the top of table by two bags of rice. Cases of sweet potatoes, cooking oil,and bags of onions were on the same table.” They left over 30 poop pieces on paper bags,over 50 under a paper storage shelf,over 30 along walls and behind two reach-in coolers. All that rodent action and you don’t need to ask why the inspector advised they throw out the cases of plastic spoons and forks on the floor at the front coun- ter,the pizza boxes stored on the floor in the back and some single service bags. Inspectors found tuna prepared 15 days earlier and salmon prepared 16 days earlier,which means they were in the coolers over a week after they should’ve been in the gar- bage. Four coolers,which had the job of keeping food under 41 degrees,had ambient temperatures of 50,57,58 and 60 degrees. That led to a late sum- mer rain of Stop Sales on raw fish,cod fish,salmon, butter,cream cheese,milk, as well as the aforemen- tioned tuna and salmon. There’s no way to take moldy lemons,a box of which got hit with Stop Sales,and make lemonade and Stop Sales also came down on a box of moldy lemons,which,hopefully, were not used to make lemonade. “Ceiling/ceiling tiles/ vents soiled with accumu- lated food debris,grease, dust,or mold-like sub- stance.”Where?“Through- out the establishment.”Ew. Two fries cutters,last used two days previous, had “old food debris.” Also,“All food storage containers soiled.” During the follow-up inspection,inspectors found tomatoes and sweet peppers with “mold-like growth.” Bubby’s is back open. Merkado 31,1127 NE 163rd St.,North Miami Beach:Complaint in- spection,45 total vio- lations,nine High Priority violations. Could there be a more prototypical Sick and Shut Down List inspection than Bubby’s next door neighbor provided last week? There’s our old friend, the ice machine mold. “Accumulation of black/ green mold-like substance in the interior of the ice machine/bin.” “In-use knife/knives stored in cracks between pieces of equipment”as in a “knife between equip- ment in the front counter.” Warewashing and dish- washing seemed to be a pointless process,what with an “accumulation of debris inside warewashing machine”and clean uten- sils and equipment being “stored in dirty drawer or rack.” Other kinds of washing seemed to be effortless,as in no effort was made at washing. “Floor soiled/has accu- mulation of debris”de- scribed the walk-in cooler and walk-in freezer.There was “grease buildup on the cookline and equipment, underneath the prep tables and all drains.” “Interiors of oven and microwaves have accumu- lation of black substance/ grease/food debris.” The prep table can open- er was “heavily soiled with grease.” On the kitchen prep table,“sweet potatoes, potatoes,and onions were stored inside soiled con- tainers.” “Food stored in a loca- tion that is exposed to splash/dust.”In the walk-in cooler,a bucket with purple corn juice (chicha)sat on the floor underneath boxes of marinated chicken.“Liq- uid from the marinated chicken is dripping into the hole on top of the contain- er.”Stop sale on the chicha. Other Stop Sales came down on heavy cream,at a morning balcony temper- ature of 80 degrees;cream cheese;cooked chicken; mashed potatoes;and cooked pasta thick noodles, none of which were at or under 41 degrees. Over eight flies landed on unpeeled onions and potatoes. Over 15 live roaches “crawling inside and out- side drawers”and four other live roaches out- numbered three dead roaches. Neither of the two hand- wash sinks had any way to dry hands. At the next day’s re- inspection,the inspector saw a roach crawling on the side of a stove and one under the grill.The manag- er killed both live roaches just as the roaches killed the chances they had of getting open again.
