PROVIDING FOR AUTHORIZATION, IMPLEMENTATION,
CORRECTIONS, AND AN EFFECTIVE DATE.
WHEREAS, Section 7. "Amendments," of Article VI, "General Provisions," of the City
Charter of the City of South Miami ("City") provides that the Charter may be amended as provided
by the Home Rule Charter of Miami-Dade County and Florida Statutes; and
WHEREAS, the City Commission recognizes the importance of periodically amending
and updating the City Charter to serve the needs of the City and its residents; and
WHEREAS, the City Commission wishes to submit a ballot question referendum to the
City's electors concerning an amendment to subsection H of Section 5, "Powers and Duties,'7 of
Article III, "City Manager," of the City Charter to allow the City Commission to ~et purchasing
limitations by Ordinance at a public hearing for the purchase of goods and services; and
WHEREAS, in accordance with provisions of the Charter of the City and the general laws
of the State of Florid, a Special Election is hereby called and directed to be held in the City of
South Miami, Florida, from 7:00 am. to 7:00 p.m. on Tuesday, November 5, 2024, for the purpose

of submitting to the electorate the proposed amendment to the City Charter which is set forth
herein; and
WHEREAS, the appropriate and proper Miami-Dade ColDlty election officials shall
conduct the said Special Election hereby called, with acceptance of the certification of the results
of said Special Election to be performed by the City Commission; and
WHEREAS, the official returns shall be furnished to the City Clerk as soon as the ballots
from the precind have been tabulated and in accordance with applicable laws; and
WHEREAS, not less than thirty (30) days' notice of the ~option of this Resolution and
of its provisions calling this Special Election shall be given by publication in the Miami Herald, a
newspaper of general circulation in South Miami, Miami-Dade County, Florida, and such
publication shall be made once in the fifth week before the election and once in the third week
before the election in accordance with the provisions of Section 100.342, Florida Statutes; and
WHEREAS, the City Commission finds that this Resolution is in the best interest and
welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CI1Y OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Special Election Called; Notice of Election. That a special election is
hereby called, to be held on Tuesday, November 5, 2024, to present to the qualified electors of the
City of South Miami, the ballot question provided in this Resolution. Notice of said election shall
be published in accordance with Section 100.342, Florida Statutes, in the Miami Herald, a
newspaper of general circulation in South Miami, Miami-Dade County, Florida, at least thirty (30)

days prior to said election, the first publication to be in the fifth week prior to the election (to-wit:
during the week Sunday, September 29, 2024), commencing and the second publication to be in
the third week prior to the election (to-wit: during the week commencing Sunday, October 13,
2024), and shall be in substantially the following form:

Section 3. Form of Ballot; Ballot Question. That the official ballot to be used in the
Special Election to be held on Tuesday, November 5, 2024, as hereby called, shall be in

Section 4. Balloting. That balloting shall be conducted between the hours of7:00 am.

authorized by law. All qualified City electors who are timely registered in accordance with law
shall be entitled to vote.
Section S. Charter Amendment Text: Effectiveness. The text of the proposed
Charter amendment (the "Charter Amendment'') is set forth in Exhibit "A", which is attached
hereto and incorporated herein. The Charter Amendment shall become effective if the majority of
the qualified electors of the City voting on the Charter Amendment vote for its adoption, and it
shall be considered adopted and effective upon the certification of the Special Election results.
Following the adoption of the Charter Amendment, the City Clerk shall file the adopt~ Charter
Amendment with the Clerk of the Circuit Court of Miami-Dade County, Florida
Section 6. Available for Public Inspection; City Clerk to Utilize the Services of
Miami-Dade County Supervisor of Elections. Copies of this Resolution providing for the
special election referendum are on file in the Office of the City Clerk located at City of South
Miami, 6130 Sunset Drive, South Miami, Florida 33143, and are available for public inspection
during regular business hours. Furthermore, the City Clerk is authorized to utilize the services of
Miami-Dade County Supervisor of Elections for any assistance required in the administration of
the election. The City shall pay all expenses for conducting this Special Election and will pay such
expenses to Miami-Dade County upon receipt of an invoice or statement approved by the
Supervisor of Elections of Miami-Dade County, Florida
Section 7. Authorization of City Officials. The City Manager, City Attomey and City
Clerk are hereby authorized to take all steps necessary to complete the execution and
implementation of the tenns and purposes of this Resolution, and the Special Election Referendum
if adopted and effective.

The accompanying Resolution was prepared and placed on the agenda at the
request of Mayor Fernández and the City Commission.
As established or adopted in 2000, Subsection H of Section 5, “Powers and
Duties,” of Article III, “City Manager,” of the City Charter currently provides that that the
purchase of goods or services by the City Manager for any department in excess of
$5,000.00 must be approved by the Commission. At the time of adoption in 2000, the
$5,000 threshold may not have been as burdensome, but as the costs of goods and
services continue to rise, it requires a resolution to be approved by the City Commission
for most expenditures and purchases of goods and services over $5,000.
It is proposed that the Charter be amended to allow the City Commission to set
purchasing limitations by Ordinance at a public hearing for the purchase of goods and
services. This would enable the City Commission to ascertain proper purchasing
limitations for the City Manager in line with other municipalities and cost of living and
market conditions. The proposed amendment would also streamline the City’s purchasing
procedures to enable more expeditious and efficient purchasing of necessary goods and
services.
The attached Resolution calls a special election to be held concurrently with the
General Election on November 5, 2024, for the purpose of submitting to the voters the 2

The Board of Supervisors of the Hem-
ingway Point Community Development
District will hold a special meeting and
a public hearing on July 24, 2024, at
10:00 am at the Waterstone Bay Club-
house, 1355 Waterstone Way, Home-
stead, FL 33033, for the purpose of
hearing comments and objections on
the adoption of the budget(s) for the
operation and maintenance of District
facilities for Fiscal Year 2025. In addi-
tion, the Board will hear public com-
ment and objections relative to the levy
of a non-ad valorem assessment pur-
suant to Florida Law for the purpose of
funding operations and maintenance
and principal and interest expenses of
the District. The District may also fund
various facilities through the collection
of certain rates, fees and charges,
which are identified within the bud-
get(s). A copy of the budget(s) may
be obtained at the offices of the Dis-
trict Manager, 5385 N. Nob Hill Road,
Sunrise, Florida 33351, during normal
business hours. At the Special Meet-
ing, the Board is expected to consider
and discuss the meeting minutes from
the meeting of May 22, 2024, resolu-
tions adopting the budget and levying
non-ad valorem assessments, staff
reports, the monthly financial reports
of the District, and any other business
which may lawfully and properly come
before the Board. This Notice is given
in accordance with the requirements
of Sections 189.417 and 190.008,
Florida Statutes. The meeting is open
to the public and will be conducted
in accordance with the provisions of
Florida Law for Community Develop-
ment Districts.

more Supervisors will participate by
telephone. At the above location there
will be present a speaker telephone so
that any interested person can attend
the meeting at the above location and
be fully informed of the discussions
taking place either in person or by

AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF

PROVIDING FOR CORRECTIONS; SEVERABILITY; CONFLICTS; IMPLEMENTA-
TION; AND AN EFFECTIVE DATE.
