Res No 095-24-16200RESOLUTION NO. 095-24-16200 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO THE 2024 GENERAL ELECTION FOR THE MAYOR AND CITY COMMISSIONERS GROUPS II AND Ill TO BE HELD ON NOVEMBER 5, 2024; ESTABLISHING QUALIFYING DATES FOR THE CITY'S GENERAL ELECTION ON NOVEMBERS, 2024; PROVIDING FOR THE CITY CLERK TO UTILIZE THE SERVICES OF THE MIAMI-DADE COUNTY SUPERVISOR OF ELECTIONS FOR THE GENERAL ELECTION, INCLUDING THE ISSUANCE OF THE APPROPRIATE BALLOT AND ADHERENCE TO ELECTION PROCEDURES IN ACCORDANCE WITH APPLICABLE AND STATE LAW; PROVIDING FOR AUTHORIZATION, IMPLEMENTATION, CORRECTIONS AND AN EFFECTIVE DATE. WHEREAS, Article V. (Elections), Section 2.A. of the Charter provides that the City's General Election for the Commission will be held on the same day as the national general election, at which time the mayor will be elected to a tenn of two years and two commissioners will be elected to tenns of four years; and WHEREAS, accordingly, the City's general election will be held on November 5, 2024 for the mayor and City commissioners Groups II and III; and WHEREAS, Article V. (Elections), Section 5. (Procedures) of the City's Charter provides that the City Commission shall provide by ordinance for the procedures of elections not inconsistent with state law; and WHEREAS, Section 9-5 of the City's Code provides for election procedures, including election dates for the general election, publication notices and official ballot; and WHEREAS, the City Commission wishes to provide for the general election on November 5, 2024, be held on the same day as the national general election, for election of the mayor and City commissioners for Groups II and III, and to establish qualifying dates for the election and provide for the City Clerk to utilize the services of the Maimi-Dade County Supervisor of Elections, including the issuance of the appropriate ballot and adherence to election procedures in accordance with applicable and State law; and WHEREAS, the City Commission finds that this Resolution is in the best interest and welfare of the City. Page I ofJ Res. No. 095-24-16200 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. Recitals. The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2. General Election; Notice of Election. That a general election will be held on Tuesday, November 5, 2024, for election of the Mayor and City Commissioners for Groups II and III . Section 3. Establishing Qualifying Period. A qualifying period is hereby established to commence on Monday, August 12, 2024 at 9:00 am. and end on Thursday, August 22, 2024 at 5:00 p.m. Candidates must qualify at the office of the City Clerk, 6130 Sunset Drive, South Miami, Florida Section 4. City Clerk to Use Services of the Miami-Dade County Supervisor of Elections for the General Election; Election Procedures. The City Clerk shall utilize the services of the Maimi-Dade County Supervisor of Elections for any assistance required in the administration of the election, including the issuance of the appropriate ballot, voting precincts and adherence to election procedures in accordance with applicable and State law. Section 5. Notice. The City Clerk will public notice of such general election once a week for four consecutive weeks preceding the general election in a newspaper of general circulation in South Miami. The notice will contain the date, time and place of the general election and identify the mayor and City commission groups for election. Section 6. Authorization to City Officials. The City Manager, City Attorney and City Clerk are hereby authorized to take all steps necessary to complete the execution and implementation of the terms and purposes of this Resolution, and the General Election. Section 7. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature.
