Res No 077-24-16182RESOLUTION NO. 077-24-16182 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA GRANTING APPROVAL OF A REQUEST TO RELEASE A UNITY OF TITLE PURSUANT TO SECTION 20-5.16 OF THE LAND DEVELOPMENT CODE FOR THE PROPERTY LOCATED AT 6167 SW 64TH STREET, SOUTH MIAMI, FLORIDA; PROVIDING FOR CONDITIONS; CORRECTIONS; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, Los Andes Development, LLC, owns the property located at 6165 and 6167 SW 64 Street (Folio Numbers 09-4025-009-0030 and 09-4025-009-0030) (collectively, the "Property") and legally described in Exhibit" A" attached hereto; and WHEREAS, the Property is the subject of a Unity of Title recorded in Official Records Book 33197 at Page 1115 of the Public Records of Miami-Dade County, Florida (the "Unity of Title"); and WHEREAS, Section 20-5.16 of the Land Development Code (the "LDC") and Paragraph 4 of the Unity of Title both allow for the release of the Unity of Title upon approval by the resolution passed by the City Commission after public hearing; and WHEREAS, the Property consists of two platted lots, which platted lots which are recognized as legal nonconforming lots of record pursuant to Section 20-4.S(D) of the LDC; and WHEREAS, the Applicant intends to develop each platted lot with a single family home rather than develop one single f amity home on the Property, and therefore contends that the conditions or criteria which originally required the Unity of Title have ceased, and requests a release of the Unity of Title ("Release"); and WHEREAS, the Mayor and City Commission of the City of South Miami, having held a duly noticed public hearing on June 18, 2024, and considered 20-5.16 of the LDC and Paragraph 4 of the Unity of Title, find the requested Release to be in the best interests of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Recitals and Findings. The recitals set forth in this resolution are true and correct, and are supported by competent substantial evidence, and they are incorporated into this resolution by reference as if set forth in full herein. The City Commission finds that the conditions or criteria which originally required the Unity of Title have ceased as required by 20-5.16 of the LDC and Paragraph 4 of the Unity of Title. Res. No. 077-24-16182 Section 2. Release Approved. The requested Release is hereby approved, and the City Manager is hereby authorized to execute such Release in form and substance as approved by the City Manager and City Attorney, and with such supporting documentation as may be required. Section 3. Conditions of Approval. The Release is hereby approved subject to the following terms and conditions, as well as all applicable City ordinances, codes, rules, and regulations: a. That the applicant provide an updated opinion of title approved in form and substance by the City Attorney; b. That the Release be executed by all parties with an interest in the Property, as supported by the opinion of title; c. The release of Unity of Title must be recorded with Miami-Dade County by the applicant at their expense; d. The release of Unity of Title must be filed with the Miami-Dade Property Appraiser's office so that new folio numbers can be issued; e. The new single-family dwellings must be reviewed and approved by the Environmental Review & Preservation Board; f. A tree removal permit is required prior to the removal of any trees on the property; and g. A building permit will be required prior to the construction of the new single-family dwellings. The Owner of the Property understands and acknowledges that they must comply with these conditions and all other applicable requirements of the LDC and City Code before they may commence construction or occupancy, and that permit reviews may be suspended and pennit issuance may be withheld if the Owner or property is at any time in non-compliance with the LDC, the City Code and/or the conditions of this approval. In addition to the suspension of pem1it review and the withholding of permit issuance, the Owner and property may be subject to code enforcement proceedings as necessary. Section 4. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Res . If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution . A building permit will be required prior to the construction of the new single-family dwellings; BACKGROUND: In 2022, Mr. Jose Mellado, the applicant, purchased two (2) vacant properties (6165 SW 64th Street and 6167 SW 64th Street) with the intent to combine them using the City’s Unity of Title process so that a new single-family residential structure could be built on the property. The applicant is now requesting that the approved unity of title be released, allowing for the lots to be placed back into their original configuration so that two (2) single-family residential structures could be built. 2 THE CITY OF PLEASANT LIVING REQUEST: Pursuant to Section 20-5.16(E) of the Land Development Code (LDC), the applicant is requesting that the City Commission release the Unity of Title for the property located at 6167 SW 64 Street, which is in the City’s Single-Family Residential (RS-4) zoning district. LEGAL DESCRIPTION: Lots 3 and 4, Block 1, of PINES, according to the Plat thereof, recorded in Plat Book 13, Page 2, of the Public Records of Miami -Dade County, Florida, hereinafter referred to as the “Property ANALYSIS: Originally platted as two (2) individual lots as part of the Pines Subdivision in 1925, Lot 3 and Lot 4 were each platted to be 25 feet wide by 80 feet long with a lot size of approximately 2,000 SF. When reviewed against the current dimensional requirements for the RS-4 zoning district, it was found that the two (2) lots did not meet the minimum lot size or frontage requirements for the district and were considered to be legal-nonconforming lots of record. To address this unique situation, the City Commission adopted Ordinance #28-20-2382 on September 15, 2020, which created the following exceptions: Exceptions for One-Story Structures o Except that a lot of record with a depth of ninety (90) feet or less may have a front setback of twenty (20) feet o Except that a lot of record with a depth of eighty (80) feet or less and a lot frontage of thirty-five (35) feet or less may have a rear setback of twenty (20) feet. A lot of record with a depth of sixty- five (65) feet or less may have a rear setback of fifteen (15) feet. o Except that a lot of record with a frontage of forty (40) feet or less may have a side (interior) setback of five (5) feet. o Except that a lot of record with an area two thousand (2,000) square feet or less may have a maximum building coverage of fifty percent (50%). A lot of record with an area of two thousand one (2,001) to three thousand (3,000) square feet may have a maximum building coverage of forty percent (40%). o Except that a lot of record with an area of two thousand (2,000) square feet or less may have a maximum impervious coverage of seventy-five percent (75%). A lot of record with an area of two thousand one (2,001) to three thousand (3,000) square feet may have a maximum impervious coverage of sixty percent (60%). 3 Exceptions for Two-Story Structures o Except that a lot of record with a depth of ninety (90) feet or less may have a front setback of twenty (20) feet. o Except that a lot of record with a depth of eighty (80) feet or less and a lot frontage of thirty-five (35) or less may have a rear setback of twenty (20) feet. o Except that a lot of record with a frontage of forty (40) feet or less may have a side (interior) setback of five (5) feet. o Existing Frontage that is less than 40 feet allows for a First Floor Interior Side Setback of 5 (five) feet and a Second Floor Interior Side Setback of five (5) feet. o Lot Size of up to 2,000 square feet allows for a Building Coverage of 50%, a Maximum Impervious Coverage*of 75%, and a Floor Area Ratio (FAR) of 0.900. o Lot Size of 3,000 square feet allows for a Building Coverage of 40%, a Maximum Impervious Coverage*of 50%, and a Floor Area Ratio (FAR) of 0.650. o Lot Size of 4,000 square feet allows for a Building Coverage of 40%, a Maximum Impervious Coverage*of 50%, and a Floor Area Ratio (FAR) of 0.650. *The Minimum Impervious Coverage requirement for two-story structures was further amended by Ordinance #18-23-2469 on September 5, 2023. Ordinance #28-20-2382 also amended the City’s section on nonconforming lots of record, Section 20- 4.8(D)(1) of the LDC to further clarify their stance on the redevelopment of these smaller lots. Pursuant to Section 20-4.8(D)(1) of the LDC, Notwithstanding limitations imposed by other provisions of this Code, in any district in which single-family dwellings are permitted, a single-family dwelling and customary accessory buildings may be erected on any single lot of record at the effective date of adoption or amendment of this Code. This provision will apply even though such lot fails to meet the requirements for area or width, or both, that are generally applicable in the district, provided that yard dimensions and requirements other than for area or width, or both, of the lot conform to regulations for the district in which the lot is located. Last, the City Commission adopted Ordinance #08-21-2398 on May 18, 2021, which amended the off- street parking space requirements for the RS-4 zoning district. Pursuant to Section 20-4.4(B)(1) of the LDC, Two (2) spaces per dwelling unit except on properties in the RS-4 and RS-5 districts with less than fifty (50) feet of frontage, where one (1) space per dwelling unit must be provided. Because of the adoption of the above-listed regulations, three (3) sites have already been built on, producing 2-story single-family residences with an average purchase price of approximately $792,000. These properties are: 4 6319 SW 60 Avenue 6335 SW 60 Avenue 5 6351 SW 60 Avenue In addition to these three(3)homes, a fourth home is currently under construction, (6333 SW 60 Avenue), and a fifth is in the beginning stages of review by the City (6353 SW 60 Avenue). Once the Unity of Title is released, the lots will be placed back into their original configuration as shown on the Pines Subdivision plat map, allowing for the construction of two (2) single-family dwellings similar to what has already been built. Previous Action:At its June 4, 2024, meeting, the City Commission deferred the item so that the applicant could provide proposed developmental sketches for the site. As requested, the applicant has provided a zoning study of the site that shows the volume of the proposed structures once setbacks have been applied. It is important to note that the study was performed prior to the increase in impervious coverage that was approved by Ordinance #18-23-2469. Because of that, the study lists the maximum Impervious Coverage as 70% (1,400 SF) instead of 75% (1,500 SF). Nothing contained herein may be construed to exempt property from taxation when the property is not tax exempt at the time of the unification of title. 2. City Inspection . It is hereby understood and agreed that any official inspector of the City of South Miami, or its agents duly authorized (Inspector), may have the privilege at any time during normal working hours before the issuance of a certificate of occupancy, certificate completion or certificate of use for the entire structure, whichever is applicable and whichever is issued last, to enter and inspect the Property to determine whether the Property is in compliance with this Unity of Title and the resolution approving it, the City's Land Development Code, the City's Code of Ordinances, the City's Comprehensive Plan, and the Florida Building Code. 3. Covenant Running with the Land. This Unity of Title constitutes a covenant running with and binding the land and must be recorded, at Owner's expense, in the Public Records of Miami-Dade County, Florida. It will remain in full force and effect, and its restrictions are binding upon the current and future owner, including the owner's heirs, successors, personal representatives, assigns, mortgagees and lessees, until such time as it is released . 4. Release. This Unity of Title may not be released except upon approval by resolution passed and adopted by the City Commission, after a public hearing, and approved by the City Attorney, executed by the City Manager and attested to by the City Clerk. The release of this Unity of Title is contingent upon the cessation of the current conditions, as well as the cessation of any future condition, that require the execution and recording of a Unity of Title and provided there is no further reason to maintain this Unity of Title on the public records in order to comply with the City's Land Development Code. S. Term. This Unity of Title is to run with the land and is binding on all persons claiming an interest in the Property for a period of thirty (30) years from the date that this Unity of Title is recorded and after which time its term will be extended automatically for successive periods of ten ( 10) years each, unless it is released. Enforcement. The City, in its sole discretion , may take action against any person who violates, or attempts to violate, any of the terms of this document and the City has the right to injunctive relief for specific performance, in addition to any other remedies available at law, in equity or both. 7. Authorization for the City to Withhold Permits and Inspections. In the event the terms of this Unity of Title are not being complied with, in addition to any other remedies available, the City is authorized to withhold the issuance of any further permits and refuse to make any inspections or grant any approvals, until such time as the Property is in compliance with this Unity of Title. 8. Election of Remedies . All rights, remedies and privileges granted herein are cumulative and the exercise of any one or more may never constitute an election of remedies , nor may it preclude the party exercising the same from exercising such other additional rights , remedies or privileges. 9. Severability. If any section, clause, sentence, or phrase of this Unity of Title is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will not affect the validity of the remaining portions o this docu ent. At the same time, single-family properties must also meet other development standards such as landscaping requirements, limits on impervious area, and driveway setbacks. Compliance with all of these different requirements can be extremely difficult for very small lots such as those seen in the RS-4 district. A first reading of the ordinance was held on February 2, 2021 and the item was unanimously approved by the City Commission. As adoption of the ordinance requires five affirmative votes, a second reading could not be held due to Vice-Mayor Welsh's passing. Since so much time as now passed, the item is presented again for first reading. REQUEST: Amend LDC Section 20-4.4 Off-street parking requirements to reduce the required number of spaces from two to one for properties that are zoned RS-4 or RS-5 and that have a lot frontage less than fifty feet. ANALYSIS: The attached ordinance reduces the number of required parking spaces from two to one for properties in the RS-4 and RS-5 districts with a frontage of less than fifty feet. This change, in conjunction with reductions in the dimensional requirements that were approved in 2020, should make development of these properties more feasible. She then provided the Board with a general area of where the affected lots were which was the former Community Redevelopment Agency (CRA) area. Last, Ms. Tompkins responded that there is on-street parking available in the neighborhoods, but the proposed ordinance presumes that the individuals in the neighborhood will be using alternate means of transportation. Mr. Jacobs stated that he was in support of the ordinance. Ms. Ruiz stated that at times there is a lack of on-street parking in the area around the charter school in the CRA area. Additionally, on-street parking may be difficult once the development of the property across from the charter school begins.
