A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH
MIAMI, FLORIDA GRANTING APPROVAL OF A REQUEST TO
RELEASE A UNITY OF TITLE PURSUANT TO SECTION 20-5.16 OF THE
LAND DEVELOPMENT CODE FOR THE PROPERTY LOCATED AT
6167 SW 64TH STREET, SOUTH MIAMI, FLORIDA; PROVIDING FOR
CONDITIONS; CORRECTIONS; SEVERABILITY; AND AN EFFECTIVE
DATE.
WHEREAS, Los Andes Development, LLC, owns the property located at 6165 and 6167
SW 64 Street (Folio Numbers 09-4025-009-0030 and 09-4025-009-0030) (collectively, the
"Property") and legally described in Exhibit" A" attached hereto; and
WHEREAS, the Property is the subject of a Unity of Title recorded in Official Records
Book 33197 at Page 1115 of the Public Records of Miami-Dade County, Florida (the "Unity of
Title"); and
WHEREAS, Section 20-5.16 of the Land Development Code (the "LDC") and Paragraph
4 of the Unity of Title both allow for the release of the Unity of Title upon approval by the
resolution passed by the City Commission after public hearing; and
WHEREAS, the Property consists of two platted lots, which platted lots which are
recognized as legal nonconforming lots of record pursuant to Section 20-4.S(D) of the LDC; and
WHEREAS, the Applicant intends to develop each platted lot with a single family home
rather than develop one single f amity home on the Property, and therefore contends that the
conditions or criteria which originally required the Unity of Title have ceased, and requests a
release of the Unity of Title ("Release"); and
WHEREAS, the Mayor and City Commission of the City of South Miami, having held a
duly noticed public hearing on June 18, 2024, and considered 20-5.16 of the LDC and Paragraph
4 of the Unity of Title, find the requested Release to be in the best interests of the City and its
citizens.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Recitals and Findings. The recitals set forth in this resolution are true and
correct, and are supported by competent substantial evidence, and they are incorporated into this
resolution by reference as if set forth in full herein. The City Commission finds that the conditions
or criteria which originally required the Unity of Title have ceased as required by 20-5.16 of the
LDC and Paragraph 4 of the Unity of Title.

Section 2. Release Approved. The requested Release is hereby approved, and the City
Manager is hereby authorized to execute such Release in form and substance as approved by the
City Manager and City Attorney, and with such supporting documentation as may be required.
Section 3. Conditions of Approval. The Release is hereby approved subject to the
following terms and conditions, as well as all applicable City ordinances, codes, rules, and
regulations:
a. That the applicant provide an updated opinion of title approved in form and substance
by the City Attorney;
b. That the Release be executed by all parties with an interest in the Property, as supported
by the opinion of title;
c. The release of Unity of Title must be recorded with Miami-Dade County by the
applicant at their expense;
d. The release of Unity of Title must be filed with the Miami-Dade Property Appraiser's
office so that new folio numbers can be issued;
e. The new single-family dwellings must be reviewed and approved by the Environmental
Review & Preservation Board;
f. A tree removal permit is required prior to the removal of any trees on the property; and
g. A building permit will be required prior to the construction of the new single-family
dwellings.
The Owner of the Property understands and acknowledges that they must comply with these
conditions and all other applicable requirements of the LDC and City Code before they may
commence construction or occupancy, and that permit reviews may be suspended and pennit
issuance may be withheld if the Owner or property is at any time in non-compliance with the
LDC, the City Code and/or the conditions of this approval. In addition to the suspension of
pem1it review and the withholding of permit issuance, the Owner and property may be subject
to code enforcement proceedings as necessary.
Section 4. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.

Section 5. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution .
Section 6. Effective Date. This resolution shall become effective immediately upon
adoption by vote of the City Commission .

RECOMMENDATION:
Approval ofthe request to release the Unity of Title for the property located at 6167 SW 67th Street subject
to the following terms and conditions as well as all applicable City ordinances, codes, rules, and

BACKGROUND:
In 2022, Mr. Jose Mellado, the applicant, purchased two (2) vacant properties (6165 SW 64th Street and
6167 SW 64th Street) with the intent to combine them using the City’s Unity of Title process so that a new
single-family residential structure could be built on the property. The applicant is now requesting that the
approved unity of title be released, allowing for the lots to be placed back into their original configuration
so that two (2) single-family residential structures could be built.

THE CITY OF PLEASANT LIVING
REQUEST:
Pursuant to Section 20-5.16(E) of the Land Development Code (LDC), the applicant is requesting that the
City Commission release the Unity of Title for the property located at 6167 SW 64 Street, which is in the
City’s Single-Family Residential (RS-4) zoning district.
LEGAL DESCRIPTION:
Lots 3 and 4, Block 1, of PINES, according to the Plat thereof, recorded in Plat Book 13, Page 2, of the
Public Records of Miami -Dade County, Florida, hereinafter referred to as the “Property
ANALYSIS:
Originally platted as two (2) individual lots as part of the Pines Subdivision in 1925, Lot 3 and Lot 4 were
each platted to be 25 feet wide by 80 feet long with a lot size of approximately 2,000 SF. When reviewed
against the current dimensional requirements for the RS-4 zoning district, it was found that the two (2)
lots did not meet the minimum lot size or frontage requirements for the district and were considered to
be legal-nonconforming lots of record. Once combined, the new lot had a frontage of 50 feet and a lot
size of 4,000 square feet which did not comply either.

When reviewing the City’s zoning map, it was found that there are several lots with similar frontages and
lot sizes in the vicinity of the subject property. To address this unique situation, the City Commission
adopted Ordinance #28-20-2382 on September 15, 2020, which created the following exceptions:
Exceptions for One-Story Structures
o Except that a lot of record with a depth of ninety (90) feet or less may have a front setback of
twenty (20) feet
o Except that a lot of record with a depth of eighty (80) feet or less and a lot frontage of thirty-five
(35) feet or less may have a rear setback of twenty (20) feet. A lot of record with a depth of sixty-
five (65) feet or less may have a rear setback of fifteen (15) feet.
o Except that a lot of record with a frontage of forty (40) feet or less may have a side (interior)
setback of five (5) feet.
o Except that a lot of record with an area two thousand (2,000) square feet or less may have a
maximum building coverage of fifty percent (50%). A lot of record with an area of two thousand
one (2,001) to three thousand (3,000) square feet may have a maximum building coverage of
forty percent (40%).
o Except that a lot of record with an area of two thousand (2,000) square feet or less may have a
maximum impervious coverage of seventy-five percent (75%). A lot of record with an area of two
thousand one (2,001) to three thousand (3,000) square feet may have a maximum impervious
coverage of sixty percent (60%).

Exceptions for Two-Story Structures
o Except that a lot of record with a depth of ninety (90) feet or less may have a front setback of
twenty (20) feet.
o Except that a lot of record with a depth of eighty (80) feet or less and a lot frontage of thirty-five
(35) or less may have a rear setback of twenty (20) feet.
o Except that a lot of record with a frontage of forty (40) feet or less may have a side (interior)
setback of five (5) feet.
o Existing Frontage that is less than 40 feet allows for a First Floor Interior Side Setback of 5 (five)
feet and a Second Floor Interior Side Setback of five (5) feet.
o Lot Size of up to 2,000 square feet allows for a Building Coverage of 50%, a Maximum Impervious
Coverage*of 75%, and a Floor Area Ratio (FAR) of 0.900.
o Lot Size of 3,000 square feet allows for a Building Coverage of 40%, a Maximum Impervious
Coverage*of 50%, and a Floor Area Ratio (FAR) of 0.650.
o Lot Size of 4,000 square feet allows for a Building Coverage of 40%, a Maximum Impervious
Coverage*of 50%, and a Floor Area Ratio (FAR) of 0.650.
*The Minimum Impervious Coverage requirement for two-story structures was further amended by
Ordinance #18-23-2469 on September 5, 2023.
Ordinance #28-20-2382 also amended the City’s section on nonconforming lots of record, Section 20-
4.8(D)(1) of the LDC to further clarify their stance on the redevelopment of these smaller lots. Pursuant
to Section 20-4.8(D)(1) of the LDC,
Notwithstanding limitations imposed by other provisions of this Code, in any district in
which single-family dwellings are permitted, a single-family dwelling and customary
accessory buildings may be erected on any single lot of record at the effective date of
adoption or amendment of this Code. This provision will apply even though such lot fails
to meet the requirements for area or width, or both, that are generally applicable in the
district, provided that yard dimensions and requirements other than for area or width,
or both, of the lot conform to regulations for the district in which the lot is located.
Last, the City Commission adopted Ordinance #08-21-2398 on May 18, 2021, which amended the off-
street parking space requirements for the RS-4 zoning district. Pursuant to Section 20-4.4(B)(1) of the LDC,
Two (2) spaces per dwelling unit except on properties in the RS-4 and RS-5 districts with
less than fifty (50) feet of frontage, where one (1) space per dwelling unit must be
provided.
Because of the adoption of the above-listed regulations, three (3) sites have already been built on,
producing 2-story single-family residences with an average purchase price of approximately $792,000.

In addition to these three(3)homes, a fourth home is currently under construction, (6333 SW 60 Avenue),
and a fifth is in the beginning stages of review by the City (6353 SW 60 Avenue).
Once the Unity of Title is released, the lots will be placed back into their original configuration as shown
on the Pines Subdivision plat map, allowing for the construction of two (2) single-family dwellings similar
to what has already been built.
Previous Action:At its June 4, 2024, meeting, the City Commission deferred the item so that the applicant
could provide proposed developmental sketches for the site. As requested, the applicant has provided a
zoning study of the site that shows the volume of the proposed structures once setbacks have been
applied. It is important to note that the study was performed prior to the increase in impervious coverage
that was approved by Ordinance #18-23-2469. Because of that, the study lists the maximum Impervious
Coverage as 70% (1,400 SF) instead of 75% (1,500 SF).

1. Unified Parcel. The Property is hereby unified as one parcel of land and no
portion of said parcel of land may be conveyed, sold, transferred, devised , assigned,
mortgaged , or leased separate and apart from each other and they must be held together as
one tract with the following exceptions :
a. If there are multiple offices , apartments, townhomes , or condominium
units, this Unity of Title does not prohibit the leasing of individual offices ,

provided the conveying or leasing document is approved as to form and substance
by the City Attorney and that it is subject to and bound by this Unity of Title and
that this Unity of Title talces precedence and governs any ambiguity or conflict
between the two (2) documents; and
b. This Unity of Title does not prohibit the sale, lease, sublease,
encumbrance or mortgage of one or more of the unified parcels or any portion of
the Property provided the applicable conveyance, lease, sublease, encumbrance,
or mortgage document, approved as to form and substance by the City Attorney,
contains the same terms, conditions, restrictions, and understandings as this Unity
of Title. Nothing contained herein may be construed to exempt property from
taxation when the property is not tax exempt at the time of the unification of title.
2. City Inspection . It is hereby understood and agreed that any official inspector
of the City of South Miami, or its agents duly authorized (Inspector), may have the
privilege at any time during normal working hours before the issuance of a certificate of
occupancy, certificate completion or certificate of use for the entire structure, whichever is
applicable and whichever is issued last, to enter and inspect the Property to determine
whether the Property is in compliance with this Unity of Title and the resolution approving
it, the City's Land Development Code, the City's Code of Ordinances, the City's
Comprehensive Plan, and the Florida Building Code.
3. Covenant Running with the Land. This Unity of Title constitutes a covenant
running with and binding the land and must be recorded, at Owner's expense, in the Public
Records of Miami-Dade County, Florida. It will remain in full force and effect, and its
restrictions are binding upon the current and future owner, including the owner's heirs,
successors, personal representatives, assigns, mortgagees and lessees, until such time as it
is released .
4. Release. This Unity of Title may not be released except upon approval by
resolution passed and adopted by the City Commission, after a public hearing, and approved by
the City Attorney, executed by the City Manager and attested to by the City Clerk. The release
of this Unity of Title is contingent upon the cessation of the current conditions, as well as the
cessation of any future condition, that require the execution and recording of a Unity of Title and
provided there is no further reason to maintain this Unity of Title on the public records in
order to comply with the City's Land Development Code.
S. Term. This Unity of Title is to run with the land and is binding on all persons
claiming an interest in the Property for a period of thirty (30) years from the date that this
Unity of Title is recorded and after which time its term will be extended automatically for
successive periods of ten ( 10) years each, unless it is released. The City has the right to re-
record this Unity of Title from time to time, at the City's own expense, in the City's sole
discretion and the Owner or the Owner's successor in title agrees to sign an original of this
Covenant when and if required for its regarding-recording.

6. Enforcement. The City, in its sole discretion , may take action against any
person who violates, or attempts to violate, any of the terms of this document and the City
has the right to injunctive relief for specific performance, in addition to any other remedies
available at law, in equity or both.
7. Authorization for the City to Withhold Permits and Inspections. In the event
the terms of this Unity of Title are not being complied with, in addition to any other
remedies available, the City is authorized to withhold the issuance of any further permits
and refuse to make any inspections or grant any approvals, until such time as the Property
is in compliance with this Unity of Title.
8. Election of Remedies . All rights, remedies and privileges granted herein are
cumulative and the exercise of any one or more may never constitute an election of
remedies , nor may it preclude the party exercising the same from exercising such other
additional rights , remedies or privileges.
9. Severability. If any section, clause, sentence, or phrase of this Unity of Title is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, the
holding will not affect the validity of the remaining portions o this docu ent.

ORDINANCE NO. 08-21-2398
An Ordinance amending Section 20-4.4 of the City of South Miami's Land
Development Code to amend the parking standards.
WHEREAS, the City Commission adopted Ordinance 28-20-2382 which amended the setback
and coverage standards for nonconforming RS-4 properties; and
WHEREAS, the purpose of the ordinance was to make feasible development of single-family
homes on small, nonconforming lots; and
WHEREAS, Section 20-4.4 of the Land Development Code (LDC} requires that single-family
properties provide two off-street parking spaces; and
WHEREAS, development of two parking spaces may be difficult on small, nonconforming lots;
and
WHEREAS, after a public hearing on January 12, 2021, the Planning Board voted unanimously to
recommend approval of the proposed ordinance; and
WHEREAS, the City Commission desires to make it more feasible to develop single-family homes
on small, nonconforming lots.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The foregoing recitals are hereby ratified and incorporated by reference
as if fully set forth herein and as the legislative intent of this Ordinance.
Section 2. Section 20-4.4 Definitions of the City's Land Development Code is hereby amended to
read as follows:
20-4.4 -Off-street parking requirements.

{B) Space Requirements. The minimum number of off-street parking spaces required for each
permitted or special use listed in Section 20-3.30 shall 0e as i.§. as set forth in the numbered

Section 5. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed .
Section 6. Severability. If any section , clause , sent ence , or phrase of this ordinance is
for any reason held invalid or unconst itutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance .
Section 7. Effective Date. This ordinance shal l become effective upon enactment.

An Ordinance amending Section 20-4.4 of the City of South Miami's Land Development Code

BACKGROUND:
The Land Development Code (LDC) requires that single-family residences provide two off-street
parking spaces. The minimum size of a parking space is nine feet by eighteen feet. The spaces
may either be enclosed or on a driveway. At the same time, single-family properties must also
meet other development standards such as landscaping requirements, limits on impervious
area, and driveway setbacks. Compliance with all of these different requirements can be
extremely difficult for very small lots such as those seen in the RS-4 district.
A first reading of the ordinance was held on February 2, 2021 and the item was unanimously
approved by the City Commission. As adoption of the ordinance requires five affirmative votes,
a second reading could not be held due to Vice-Mayor Welsh's passing. Since so much time as
now passed, the item is presented again for first reading.
REQUEST:
Amend LDC Section 20-4.4 Off-street parking requirements to reduce the required number of
spaces from two to one for properties that are zoned RS-4 or RS-5 and that have a lot frontage
less than fifty feet.
ANALYSIS:
The attached ordinance reduces the number of required parking spaces from two to one for
properties in the RS-4 and RS-5 districts with a frontage of less than fifty feet. This change, in
conjunction with reductions in the dimensional requirements that were approved in 2020,
should make development of these properties more feasible. Two spaces will still be required
for all other residentially zoned properties.

The City of South Miami Code of Ordinances, Section BA-5, requires that all lobbyists, as defined in that section,
must register with the City Clerk before engaging in any lobbying activities and in most cases pay an annual fee of
$500.00 and an additional $100 for each additional issue. This applies to all persons who are retained with or
without compensation to influence any action, decision, recommendation of someone with the city, including the
city manager, city attorney, department heads, city personnel, or members of the city commission or members of
any city board, concerning a matter that could foreseeab/y be address by the city commission or a city
board. There are some exceptions and exemptions. The following are not considered to be lobbyist: a
representative of a principal at a quasi-judicial hearing, experts who present scientific or technical information at
public meetings, representatives of a neighborhood association without compensation and representatives of a
not-for-profit community based organization for the purpose of requesting a grant who seek to influence without
special compensation.

Mr. Pepe provided the Board with an explanation as to why the elections were on the agenda.
Ms. Ruiz then stated that she was appointed chair at the after the City elections that were held in
February 2020. Mr. Pepe then asked Staff if they had any competent and substantial evidence to
support the election being held at the meeting. Ms. Tompkins responded that she did not have
any competent or substantial evidence. She then added that it has been the past practice to hold
the elections in January. In the past, the Board has waited to discuss the item until all of the
members are present. Ms. Ruiz stated that it was a good idea to wait since not all of the Board
members were present. She then asked the Board if they agreed, to which the members of the
Board agreed.
Ms. Ruiz informed the Board that all future Planning Board meetings will continue via Zoom until
further notice.
IV. Public Hearings:

Applicant: The City of South Miami
An Ordinance amending Section 20-4.4 of the City of South Miami's Land Development Code to
amend the parking standards.
Applicant: The City of South Miami, represented by Ms. Jane Tompkins, AICP (Planning Director)
Ms. Ruiz read PB-21-002 into the record.
Ms. Tompkins presented the staff report to the Board.
The Chairperson opened the floor to public comments on PB-21-002.

Mr. Miller asked for a recap on what the RS-4 and RS-5 zoning district were and what the number
of affected properties was. He then asked if this amendment presumes that there is on-street
parking available. Ms. Tompkins provided the Board with the dimensional requirements for both
the RS-4 and RS-5 zoning district. She then provided the Board with a general area of where the
affected lots were which was the former Community Redevelopment Agency (CRA) area. Last, Ms.
Tompkins responded that there is on-street parking available in the neighborhoods, but the
proposed ordinance presumes that the individuals in the neighborhood will be using alternate
means of transportation.
Mr. Jacobs stated that he was in support of the ordinance.
Ms. Ruiz stated that at times there is a lack of on-street parking in the area around the charter
school in the CRA area. Additionally, on-street parking may be difficult once the development of
the property across from the charter school begins. She then stated that she is in support of the
ordinance.

An Ordinance amending the Land Development Code to support
development of legally nonconforming lots of record, including
amendment to Sections 20-3.5 Dimensional Requirements and 20-4.8
Nonconforming uses and structures.
WHEREAS, the Land Development Code (LDC) regulates residential development
through standards for minimum lot size, lot frontage, and building setbacks, and maximum
building coverage and impervious coverage ( described as "dimensional requirements"); and
WHEREAS, many legally platted residential lots do not comply with the dimensional
requirements for size or frontage either because the platting occurred before the adoption
of dimensional requirements or the dimensional requirements changed after platting
occurred; and
WHEREAS, the LDC also controls new development on nonconforming lots; and
WHEREAS, given the dimensional requirements and the provisions for
nonconforming lots, many legally platted lots are difficult if not impossible to develop; and
WHEREAS, the nonconforming lots, if developed, could yield increased housing
diversity, more affordable units, and complete the urban fabric of the neighborhoods; and
WHEREAS, the City's Comprehensive Plan includes policies about encouraging more
diversity in housing types and prices; and
WHEREAS, after a public hearing on July 14, 2020, the Planning Board voted
unanimously to recommend approval of the proposed ordinance; and
WHEREAS, the City Commission desires to make feasible development of single-
family homes on small, nonconforming lots.

Section S, Corrections. Conforming language or technical scrivener-type
corrections may be made by the City Attorney for any conforming amendments to be

Section 6, Codification. The provisions of this ordinance are to become and be
made part of the City of South Miami Code of Ordinances as amended; the sections of this
ordinance may be renumbered or re-lettered to accomplish such intention; and the word
uordinance" may be changed to "section" or other appropriate word.
Section 7, Severability. If any section, clause, sentence, or phrase of this
ordinance is for any reason held invalid or unconstitutional by a court of competent
jurisdiction, this holding wil1 not affect the validity of the remaining portions of this
ordinance.
Section 8, Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.

WHEREAS, the City of South Miami (the "City") has adopted a Land Development Code
(the "LDC") to promote th e health safety, community acceptable sta ndard of morals and general
welfare of the residents of the City of South Miami through the stated regulations of this LDC ; and
WHEREAS, Section 20-3 .5, 'Dim ensional requirements" of the LDC contains references
to "landsc aped open space," "g re en space,'' and "impe rvious coverage," nei ther of which terms
are presently defined in Section 20-2.3 "Definitions" of the LDC; and
WHEREAS, Seclion 12-8.1 of the City's Code of Ordfoances (the "Code") references
artificial turf, but neither the Code nor the LDC define "artificial tu rf' or provide regulations
governing its use· and
WHEREAS, the City Commission finds it periodically nece ssary to amend the LDC in
order to update regulations and procedur es to implement plannin g goals and objectives; and
WHEREAS, based upon input of residents, City board members, design professionals,
and properly owners within th e City , the City Co mmission finds that the current limitations on

impervious coverage for residential lots are too restrictive for customary residential development
that values an indoor and outdoor lifestyle, and should thus be revised; and
WHEREAS, the City Commission finds that the LDC is in need of additional definitions
to ensure consistency of regulations and that an increase to the impervious coverage permitted for
residential lots is in the best interest of the City and its residents; and
WHEREAS, on August 8, 2023, the Planning Board, sitting in its capacity as the Local
Planning Agency, reviewed this Ordinance and recommended its approval by the City Commission
with comments to clarify the applicable definitions; and
WHEREAS, this Ordinance was duly noticed and presented to the City Commission in
two readings, with second reading conducted as the required public hearing on September 19,
2023;and
WHEREAS, the City Commission finds that this Ordinance is in the best interest and
welfare of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: 1
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Amending Article II, Section 20-2.3 of the Code. That Section 20-2.3,
"Definitions," of Article II is hereby amended to read as follows:

Artificial turf. Shall mean a surface intended to imitate grass and composed of natural or
recyclable materials and installed as a pervious system that exceeds a minimum permeability
rate of the greater of 0.8 inches per hour or as set by Miami-Dade County in Chapter 24 of the
Miami-Dade County Code. as may be amended from time to time. All artificial turf shall
resemble the natural color of grass and be installed and maintained in accordance with all of the
following:
i. Artificial turf may be utilized in open joints of pavement in any location and shall provide
a buffer to separate the artificial turf from other landscaping;
ii. Plant-based and natural infill materials shall be utilized to the greatest extent possible,
such as soybean oil in the backing, sugarcane in the thatch. and crushed walnut shell for
the infill;
iii. Synthetic materials. such as polypropylene. polyethylene. latex, and polyurethane. shall
be minimized. lead free. and flame resistant;
iv. Subgrade shall be equipped to provide proper water drainage with an evenly graded,
permeable aggregate base that is at least three inches in depth with sufficient space for
tree root growth provided: and
v. Areas containing any pits. tears, marks, discoloration. seam. separations. uplifted
surfaces or edges. heat degradation, and excessive wear are prohibited.
lmpe11'ious Coverage. Shall mean the portion of the lot area improved with an impervious
surface that does not meet the minimum permeability rate for pervious material of the greater of
0.8 inches per hour or as set by Miami-Dade County in Chapter 24 of the Miami-Dade County
Code. as may be amended from time to time. This term is intended to include all portions of the
lot that are not landscaped open space. Impervious area also includes artificial turf in the front
yard. or artificial turf in the rear yard that covers or is covered by any impervious material or
structure.

Open spt1ce. Shall mean that part of a lot, including courts and yards and areas improved with
artificial turf, which is open and unobstructed from its lowest level upward, and accessible to all
residents on the lot without restrictions except as may be required for safety. Not more than ten
(1 O) percent of any required open space shall be water area.
Open space, active. Shall mean an area intended for rigorous recreational activities such as
tennis. baseball, badminton and other games requiring physical exertion. Structures and off-
street parking areas related exclusively to such activities shall also be included in the definition.
Open space, landscaped. Shall mean those portions of a lot's open space that are devoid of any
impervious material and have vegetation in those areas. including the portion of tree canopy that
does not cover any impervious material or structure irrespective of whether such undercanopy area
is vegetated. Also referred to as "green space."

Section 4. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final Ordinance for signature .
Section 5. Severability. If any section, clause, sentence, or phrase of this Ordinance
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this Ordinance.
Section 6. Conflicts. That all ordinances or parts of ordinances, resolutions or parts
of resolutions, in conflict herewith, are repealed to the extent of such conflict.
Section 7. Implementation. The City Manager is hereby authorized to take any and
all necessary action to implement the purposes of this Ordinance. Any temporary sign permit that
was previously issued shall be allowed to remain through its current expiration date and shall not
be extended.
Section 8. Effective Date. This Ordinance shall become effective immediately upon
adoption.
