AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,
FLORIDA, AMENDING ARTICLE III "ZONING
REGULATIONS'', SECTION 20-3.6 "SUPPLEMENTAL
REGULATIONS" OF THE LAND DEVELOPMENT CODE,
RELATING TO BOAT STORAGE IN SINGLE FAMILY
RESIDENTIAL PROPERTIES; PROVIDING FOR
CORRECTIONS; SEVERABILITY; CONFLICTS;
IMPLEMENTATION; AND AN EFFECTIVE DATE.
WHEREAS, Article VIII, Section 2 of the Florida Constitution, and Chapter 166, Florida
Statutes, provides municipalities with the authority to exercise any power for municipal purposes,
except where prohibited by law, and to adopt ordinances in furtherance of such authority; and
WHEREAS, the City Commission of the City of South Miami ("City'') finds it
periodically necessruy to amend its Land Development Code (the "LDC") to update regulations
and procedures to maintain consistency with state law, implement municipal goals and objectives,
clarify regulations, and address specific issues and needs that may arise; and
WHEREAS, pursuant to Ordinance No. 19-23-2470 (the "Boat Storage Ordinance"),
adopted October 17, 2023, Section 20-3.6(L) was amended to prohibit storage of boats within
single family residential front and side street yards; and
WHEREAS, the Boat Storage Ordinance provides for a one-time exemption to allow
existing boats to be stored within a front or side-street yard for the life of a boat; and
WHEREAS, since adoption of the Boat Storage Ordinance, the Commission has heard
from residents who have expressed concern regarding an adverse impact on the ability to replace
their boat if they have limited options to store the new boat outside of a street yard; and
WHEREAS, the City Commission finds it in the best interest of the City and its residents
to fw1her amend Section 3. 6(L) of the LDC to extend the exemption for homeowners of an existing
boat; and
WHEREAS, on May 14, 2024, the Planning Board, sitting in its capacity as the Local
Planning Agency, reviewed this Ordinance and voted 7-0 to recommend approval to the City
Commission; and
WHEREAS, on May 21, 2024, the City Commission approved the ordinance on first
reading; and
WHEREAS, on June 4, 2024, the City Commission conducted a duly noticed public
hearing as required by law and approved the ordinance on second reading; and

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:1
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Amending Section 20-3.6 of the LDC. Article III "Zoning Regulation,
Section 20-3.6, "Supplemental Regulations ," of the LDC, is hereby amended to read as follows:
Sec. 20-3.6. Supplemental regulations.

(L) Boats and Trailers.
***
(I) Storage of Boats. A boat stored in the RS z oning district must be stored on a trailer that
is in good condition, operable and capable of moving the boat (hereinafter referred to as a
"Trailered Boal"). A Trailered Boat shall be stored only in accordance with the follo\\~ng
definitions and requirements :
(a) Definitions:
(i) A "Boat" includes motorboats, sailboats, personal watercraft or any other
vessel intended for use on or within water.
(ii) Storage of a boat is defined for this subsection as a Trailered Boat that has
been parked in one position for more than twelve (12) hours.
(iii) An Existing Boat is a Trailered Boat owned by a Current Property Owner that
lli timely registered \\~th the City in accordance with this Section (L) in
connection with storage on a specific parcel of real property.
(iv) The Life of a Boat shall mean the period of time in 1Nhieh an E~dsting Boat is
in operable condition and is stored on the properly that it is registered for.
Current Property Owner shall mean an individual, group, or entity that
currently holds legal ownership of a specific parcel ofreal property and that
registers an Existing Boat with the City in the manner provided in this
Section.

(v) A Replacement Boat. shall be any replacement vessel purchased and
owned by a Current Property Owner to replace an Existing Boat or a
previous Replacement Boat. A Replacement Boat shall be registered
with the City as the replacement for an Existing Boat or a previous
Replacement Boat within 30 days of the owner acquiring it,
.(yil Street Yard shall mean the area of private property between the portion of the
building wall closest to a primary or secondary (i.e. comer) right-of-way and
the right-of-way.
(b) A Trailered Boat, existing and located within the City, as of October 17, 2023,
shall be registered with the City within 90 days of October 17, 2023 in order to
be exempted from these regulations to the extent provided in subsection
(L)(l)(d). If properly registered, the boat will be considered an Existing Boat
under this Section (L).
(c) A Trailered Boat shall not be stored within the right-of-way or a Street Yard.
(d) Exception. An Existing Boat or a Replacement Boat may be stored in a Street
Yard for the Life ef the Boat duration of the time the Current Property
Owner owns the registered property subject to the following:
(i) An Existing Boat or a Replacement Boat shall not be stored closer than five
feet from any property line.
(ii) Where an Existing Boat or a Replacement Boat is stored in a side, or
secondary, Street Yard, the Existing Boat shall be visually buffered by trees
and/ or shrubs maintained to a minimum height of six feet.
(e) No major repairs or overhaul work may be made or performed on a Trailered
Boat.
Section 3. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final Ordinance for signature.
Section 4. Severability. If any section, clause, sentence, or phrase of this Ordinance
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this Ordinance.

Section 5. Conflicts. That all ordinances or parts of ordinances, resolutions or parts
of resolutions, in conflict herewith, are repealed to the extent of such conflict.
Section 6. Implementation. That the City Manager and City Attorney are authorized
to take any and all actions necessary to impl ement this ordinance.
Section 7.

SUBJECT:Amendment of the boat storage regulations (Sec. 20-3.6(L))to allow certain
exceptions for residential property owners that own an existing boat.
RECOMMENDATION:Approval of a code amendment pertaining to Sec. 20-3.6(L),
amending the storage requirements for existing boats.
BACKGROUND:Originally adopted on October 17, 2023, via Ordinance #19-23-
2470, Section 20-3.6(L), “Boats and Trailers,” of Article III,
“Zoning Regulations,” of the City’s Land Development Code
(“LDC”), amended the regulations pertaining to the storage of boats.
As part of the amendment, it was required that the owner of an
existing boat register it with the City in a timely manner so that it
could be grandfathered in, allowing it to utilize certain exceptions
listed in the LDC for existing boats. The regulations, however, did
not address situations where the existing boat was replaced. That
said, the proposed legislation is intended to further amend the City’s
boat regulations to address situations when those boats that are
existing are replaced.
ANALYSIS:Currently, Section 20-3.6(L) of the LDC provides exceptions for
existing boats in the City. This includes the exception that an
existing boat or trailered boat shall not exceed thirty-two (32) feet
in length and that it is permitted to be placed in a street yard for the
life of the boat subject to certain setback and landscaping
requirements. The exception was originally adopted to apply only to
the life of the specific registered vessel. The proposed amendment
modifies the exception to apply it to the property owner who has
registered the existing boat, enabling the property owner to replace
the boat for so long as he/she owns the property without losing the
exception that allows for storage in the front or street side yard.
PREVIOUS ACTION:On May 14, 2024, the Planning Board (PB) held a Public Hearing
on the item and voted 7 to 0 to unanimously recommend approval
of the proposed legislation.
