A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, AMENDING THE SCHEDULE OF
FEES AND FINES TO SET PLANNING AND ZONING FEES; PROVIDING
FOR IMPLEME~TATION; CORRECTIONS; AND AN EFFECTIVE DATE.
WHEREAS, the City maintains a Schedule of Fees and Fines that the City of South Miami
("City") Commission may amend from time to time; and
WHEREAS, the City collects application fees to offset the costs of processing planning
and zoning applications and conducting hearings; and
WHEREAS, in addition to application fees pursuant to Section 2-7 of the City's Code of
Ordinances (the "Code"), the City conducts a cost recovery program for services of non-City staff,
such as planning, legal services, engineering, surveying, and the like; and
WHEREAS, the Schedule of Fees and Fines sets forth application fees for several types
of applications that are not commonly processed in the City, and provides for some fees that are
out of proportion with the time spent by staff in processing certain applications; and
WHEREAS, currently, amounts for cost recovery deposits are dete1mined on a per-
application basis and are not set forth in any document that allows applicants to more properly
plan for the costs of their applications; and
WHEREAS, staff recently conducted an assessment of Planning and Zoning Fees based
on the work required to service the applications, including staff time and outside consultants, and
proposes amending the fees to (a) update the types of applications serviced by the Town, (b) set
fees for such applications, and ( c) set cost recovery deposits for supporting services pursuant to
Section 2-7 of the Code (collectively, the "Amended Planning and Zoning Fees"), as set forth in
Exhibit "A"; and
WHEREAS, the City Commission finds that amending the Schedule of Fees and Fines to
provide for the Amended Planning and Zoning Fees is in the best interest and welfare of the City;
and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Recitals Adopted. The above-stated recitals are tme and correct and are
incorporated herein by this reference.
Section 2. Amending the Schedule of Fees and Fines to 1·eflect Amended Planning
and Zoning Fees. The City Commission hereby amends the Schedule of Fees and Fines to replace
the Planning and Zoning Fee Schedule set forth in the Schedule of Fees and Fines with the new
Planning and Zoning Fees set forth in Exhibit "A".

Section 3. Implementation. The City Manager is hereby authorized to take any and
all action necessary to implement the Schedule of Fees and Fines and the purposes of thi s
Resolution.
Section 4. Corrections. Conforming language or technical scrive ner-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.
Section 5.

SUBJECT: Resolution Amending Planning and Zoning Department Fees
RECOMMENDATION: Approval of the attached Resolution amending the fees for the Planning and
Zoning Department.
BACKGROUND:Currently, the City collects application fees to offset the costs associated with
the processing of various planning and zoning applications as well as
conducting hearings. In addition to the fees collected, the City created a Cost
Recovery program that is utilized when non-City staff, such as planning
consultants, attorneys, etc. are needed during the course of the review of an
application.
Recently, Planning Department Staff assessed its fees and found that the
City’s Schedule of Fees contains application fees for several types of
applications that are not commonly processed in the City as well as provides
for some fees that are out of proportion with the time spent by staff in
processing certain applications. Additionally, it was found that the amounts
for cost recovery deposits that are determined on a per-application basis were
not set forth in any document that allowed applicant to more properly plan
for the costs of their application. This assessment was based on the work
required to service the applications, including staff time and outside
consultants, and proposes amendments to the fees.
ANALYSIS:The accompanying ordinance proposes to amend the Schedule of Fees for the
Planning and Zoning Department so that the following can be accomplished:
a.Update the types of applications serviced by the City,
b.Set fees for such applications, and
c.Set cost recovery deposits for supporting services pursuant to Section
2-7 of the Code (collectively, the “Amended Planning and Zoning Fees”)
By making these changes, applicants would be able to better determine all the
fees needed for future applications so that they can prepare accordingly.
