Public Hearing ##79-10 John 0. & Delores Ane. Coleman Request: Variance to permit erecting a. 6' high wood fence in front setback where 5 ' high fence is allowed. Legal Description: Lot 16, Block 1, COCOPLUM TERRACE SUBDIVISION, PB 25/4 . Location: 6337 S. W. 69 Street. Chairman Smith announced Public Hearing ##79-10 was in session and asked if there was any one]present wishing to speak for this request. Mr. John Coleman addressed the Board stating the reasons for his request. He stated the 6' high fence was needed for privacy and security and it was his feeling the architectural detail would enhance the beauty of his home and the neighborhood. Chairman Smith noted the file contained a petition bearing a- sufficient number of signatures of the property owners in a 300' radius of the property stating they do not object to the granting of the variance. There being no one else present caring to speak for or against the request of the applicant, Chairman Smith deemed the public hearing closed. .Discussion was had by the Board and in response to the Board' s question, Mr. Russe stated staff has no objections to granting the variance. MOTION: By Mrs. Masters, seconded by Mr. Price, to approve the request of the applicant to erect a 6' high wood fence in the front setback where a 5 ' high fence is allowed. VOTE IN FAVOR OF MOTION: Yes - 5 MOTION CARRIED UNANIMOUSLY. Public Hearing #79-11 Harry Rosenfeld, M. D. Request: 1. Variance to permit lot coverage of 42. 05% where 300% is allowed. 2 . Variance to permit rear setback of 15 Ft. where 25 Ft. is required. Legal Description': Lots 3, 4, 5, less So. 15 Ft. , Block 2, ROYAL PALM VILLAS, PB 19/17. Location: 6285 Sunset Drive. Chairman Smith announced Public Hearing #k79-11 was in session and asked if there was any one present wishing to speak for this request. Dr. Harry Rosenfeld addressed the Board stating he had appeared before the Board with the same request . on August 29, 1978 at which time the Board voted unanimously to recommend to the City Commission approval of the requested variances subject to the building being built substantially as to the plans shown the Board. Subsequently, on October 17, 1978, the City Commission passed an ordinance No. 36-78-1016 granting the variances. However, he was unaware of City Ordinance #20-71-724, Article XIII, Section 13-4, which states there is a 6 month time period in which to request an extension of a variance. He applied to the City Commission for an extension on May 3, 1979 and was advised his granted variance had lapsed and was instructed to go back to the Planning Board and proceed over again. In response to the question of the Board, Dr. Rosenfeld stated he had made no changes to the plans for the building and expected to be able to obtain financing, and commence construction within three to four months , after granting of the variances by the City Commission. Chairman Smith noted the file contained a petition bearing a ,sufficient number of signatures of the property owners in a 300 ' radius of the property stating they do not object to the granting of the variances. Public Hearing ##79-12 Administration Request: Recommendations of Planning Board regarding proposed changes to the City' s . Zoning Ordinance No. 20-71-724, Section 7-2-1 (Minimum Size) of Article VII (Off-Street Parking Regulations) of Section 1, by adding Subsection .01 which provides for handicapped parking spaces, and by adding Subsection .02 which provides for compact parking spaces, which Section and Subsections read as follows: "7-2-1 Minimum Size The minimum dimensions of an off-street- parking space shall be .nine . (9) feet by twenty (20) feet and have an area of not less than one hundred and eighty (180) square feet, exclusive of driveways, except as provided below. " .01 Handicapped Spaces Parking spaces for wheel chair drivers and the handicapped shall have a. minimum width of twelve (12 ) feet and a length of twenty (20) feet, and be provided in the following amounts: Handicapped Spaces Total Parking Spaces One (1) 0 to 20 Two (2) 21 to 100 One additional space for every fifty (50) spaces or less above one hundred (100) spaces above 100 Page 3 - 6/26/79 jk 'Parking for Handicapped Only' signs are required for each parking space. " 11.02 Compact Spaces "Twenty percent (20%) of the required -standard sized spaces may be seven and one-half (7�) feet in width and seventeen (17) feet in -length, and shall be clearly designated for 'Compact Only' vehicles." Chairman Smith announced Public Hearing #79-12 was in session and asked if there was any one present wishing to speak for or against this request. There being no one, Chairman Smith deemed the Public Hearing closed. Discussion was had by the Board. MOTION: By Mr. Michelson, seconded by Mrs. Masters, to approve the changes to Ordinance No. 20-71-724 as submitted. VOTE IN FAVOR OF MOTION: Yes - 5 MOTION CARRIED UNANIMOUSLY. EXECUTIVE SESSION: MOTION: By Mr. Michelson, seconded by Mrs. Masters, to approve the minutes of the meeting of May 8, 1979 as read. VOTE IN FAVOR OF MOTION: Yes '- 5 MOTION CARRIED UNANIMOUSLY. REMARKS Mr. Russe stated he had been requested by Mr. Coburn to request the recommendations of the Board concerning changing the setback requirements for swimming pools. He stated that during the past three years there have been seven variances granted for swimming pool setbacks. There have been many more requests for the construction . of pools with minor setback variances required. However, when it is learned that a hearing is required that involves both time (6 to 8 weeks) and $125.00 in expense, the project is dropped and a citizen usually leaves in a state of frustration. He suggested the Board make a recommendation of the pool setbacks primarily for relief of persons having 50 foot lots as the Page 4 - 6/26/79 jk owners of larger lots. usually have no difficulty with the present pool setbacks. Discussion was had by the Board. Mr. Michelson stated he would consider a 10' setback from the side lines and a 123-2' setback from the rear line which could accommodate a screen enclosure should one be, requested. Mrs. Masters voiced her concern toward protecting the neighbors from a pool being constructed too close to the lot lines. Chairman Smith stated he favored a 10' side setback and a 10' rear setback from the property lines. MOTION: By Mr. Michelson, seconded by Mrs. Masters, to recommend to the City Commission changing the setbacks for swimming pools to a side setback of 10' to the water line and the rear setback to 12'h' from the rear property line which will accommodate a 30' walkway leaving a side setback of' 7�' and a rear setback of 10' if a screen enclosure is installed. VOTE IN FAVOR OF MOTION: Yes - 4 No - 1 (Smith, for reasons stated above) MOTION CARRIED. There being no further business, the meeting adjourned at 8:25 P. * M.
