A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,
FLORIDA, AMENDING THE SCHEDULE OF FEES AND
FINES TO ADD A SPECIAL EVENT PARKING SPACE
RENTAL FEE; PROVIDING FOR IMPLEMENTATION;
CORRECTIONS; AND AN EFFECTIVE DATE.
WHEREAS, the City of South Miami (the "City") maintains a Schedule of Fees and Fines
which the City Commission amends from time to time, including the Parking Division Fee
Schedule; and
WHEREAS, the City currently charges a Daily Parking Space Rental Fee in the amount
of$ 100 for all locations and circumstances, including parking space rentals associated with special
event street closures; and
WHEREAS, the City desire.~ to establish a new parking fee for special events in the
amount of $25; and
WHEREAS, special events attract visitors to the City>s Town Center who shop at local
businesses and help boost the local economy; and
WHEREAS, special events also create economic benefits for the local economy and
community, including providing free marketing and advertising for local businesses as visitors
share their positive experiences by posting comments and photos on social media; and
WHEREAS, the City Commission desires to amend the Schedule of Fees and Fines to add
a Daily Special Event Parking Space Rental Fee as further set fo11h herein; and
WHEREAS, the City Commission finds that this Resolution is in the best interest and
welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Amending the Schedule of Fees and Fines to Include a Special Event
Parking Space Rental Fee. The City Commission hereby amends the Schedule of Fees and Fines
provided below: 1

SUBJECT:Amending the Parking Schedule of Fees to include a Special Event Parking Space
Rental Fee, applying a rate that promotes more Special Events in the City.
RECOMMENDATION:
Adoption of the amendment to the Parking Schedule of Fees to include a Special Event Parking
Space Rental Fee of $25 per space.
BACKGROUND:
The City’s Schedule of Fees, Parking Division Fee Schedule currently includes one Daily Parking
Space Rental Fee of $100 per space.The fee is applied uniformly for renovations, improvements,
and installations as well as for parking space rentals associated with special event street closures.
The presented resolution creates a separate fee to be used for Special Events only.
The City is currently working on helping the City’s Town Center flourish by attracting visitors.
Special Events attract visitors who shop, which boosts the local economy both on and around the
event location.
Special Events also provide free marketing and advertising for local businesses as visitors share
their positive experiences, posting comments and photos on Instagram and/or other social
media.The economic benefits of successful Special Events ripple throughout a local economy and
community.Special Events tend to instill a sense of community pride, teach people new things,
and strengthen relationships.
Lastly, many times having street closures is simply done for the safety of attendees, merchants,
and volunteers.
On March 3, 2020,the City adopted Ordinance 09-20-2363 increasing the daily “Meter Rental
Fee Per Meter Per Day” from $25 to $75. On June 7, 2022,the City adopted Ordinance 14-22-
2435 amending the newly revised titled “Daily Parking Space Rental Fee” from $75 to $100.

It is difficult for the City to perform a financial impact, without specific Special Event applications
available to review. It is critical to note that the City reserves the right to grant or revoke any
special event permits.

An Ordinance relating to the City's Schedule of Fee and Fines; amending
ordinance 05-20-2359 to revise the Parking Division Schedule of Fees.
WHEREAS, the Mayor and City Commission desires to adopt a revised Parking Division
Schedule of Fees, allowing funding which will cover the cost of services provided and to be
consistent with neighboring municipalities; and,
WHEREAS, the proposed changes are set forth in the attached Schedule of Fees and Fines;
and,
WHEREAS, the Mayor and City Commission desire to revise the adopted Fee Schedule as
presented.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, THAT:
Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if
fully set forth herein and as the legislative intent of this Ordinance.
Section 2. The Schedule of Fi nes and Fees, as approved in Ordinance 05-20-2359, is
hereby amended to revise the Parking Division Fees as set forth i n the attached "Proposed
Revisions to the Parking Division Fee Schedule".
Section 3. Any such fees may be waived or reduced by the Mayor and City Commission
by way of resolution.
Section 4. Corrections. Conforming language or technical scrivener-type corrections may
be made by the City Attorney for any conforming amendments to be incorporated into the final
ordinance .
Section 5 . Ordinances in Conflict. All ordinances or parts of ordinances and all sections
and parts of sections of ordinances in direct conflict herewith are hereby repealed .
Section 6. Severability. If any section, clause , sentence, or phrase of this ordinance is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall
not affect the validity of the remaining portions of this ordinance.
Section 7. Effective Date. This ordinance shall become effective upon enactment.

Background:
The Mayor and City Commission desires to adopt a revised Parking Division Schedule of Fees for
occasions when certain parking spaces are rented for an entire day, for instance when events
occur and the roadway needs to be clear of non-event vehicles. Such a change provides funding
which will cover the cost of services provided and to be consistent with neighboring
municipalities.

The proposed Ordinance increases t he amount of two parking fee categories as the income from these
locations is typically substantially higher than the simple rate currently being charged for daily use. The
current rate is based on one vehicle parking in one space for the entire period. The improved and
recommended rate allows for the mo re realistic event that several vehicles pay for and occupy a particular
spo~ several times a day, thereby increasing the revenue per day per parking space. The proposal accounts
for such turnover and its probable consequential increase in revenue to the City.

ORDINANCE NO.14-22-2435
An Ordinance of the Mayor and the City Commission of the City of South Miami, Florida
relating to the fee schedule, amending the Parking Division Fee Schedule, increasing
some parking fees, adding new fees and deleting some fees from the schedule.
WHEREAS, in April of 2022, the City obtained the management rights and operation of
the City of South Miami Parking Garage, which is located at 5829 SW 73 rd Street, right in the
middle of South Miami Downtown. This newly obtained asset has given the City the ability to
better manage the Parking Operation for the entire City; and
WHEREAS, usage of the Garage should increase by the City's charging a lower rate within
the Parking Garage, hence more parking will be available for customers throughout the City and
parking will become more accessible for all. The South Miami Parking Garage will have the lowest
rate in the City, making it the most attractive option for the City's parking patrons; and
WHEREAS, the City of South Miami Parking Division anticipates that raising the street
parking fee from $1.50 per hour to $1.50 per half-hour and charging $1.50 per hour in the City's
Parking Garage will help to manage the parking supply by making parking more convenient and
ensuring that parking is generally available where and when people want it; and
WHEREAS, currently, parking patrons are required to purchase a minimum of GO-minutes,
so that the City can at a minimum cover the cost of the credit card processing charge. The
recommended change would permit the City to allow parking patrons to purchase increments of
30-minutes, while still having the City cover the cost of credit card processing; and
WHEREAS, the City is looking to increase the hourly parking rate, overall, due to inflation
and to help continue to cover the costs of operating the parking division and the required
technology. On July 20 th, 2021, the City adopted Res No 083-21-15703, which provides Miami-
Dade County Clerk of Courts the right to deduct a Cost Recovery Fee from the City equaling one
dollar and twenty-five cents (Sl.25} per each citation issued by the City and processed through
the Miami-Dade County Clerk of Courts System, for the purpose of cost recovery by the Clerk's
Office for administration of the System. This fee was a new fee that is costing the City
approximately, $50,000 per year in parking revenues collected .
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA;
Section 1. The Schedule of Fees and Fines for the Parking Division Fee Schedule is
