Res No 013-24-16118RESOLUTION NO. 013-24-16118 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AUTHORIZING THE WAIVER OF RENTAL FEES IN THE AMOUNT OF $990 FOR YOUTH FLAG FOOTBALL AND BASKETBALL COMPETITIONS BY SOUTH MIAMIMIDDLESCHOOLTOBEHELDATPALMERPARKAND THE GIBSON-BETHEL COMMUNITY CENTER; PROVIDING FOR APPLICABILITY OF OTHER FEES AND CODE REQUIREMENTS; IMPLEMENTATION; CORRECTIONS; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, South Miami Middle School (the "Applicant,,) holds multiple competitive athletic programs under the leadership of Mr. Marcos Acevedo, Physical Education Teacher and Athletic Director; and WHEREAS, the Applicant has requested the use of open green field space at Palmer Park for up to eight (8) regular season home games and four ( 4) playoff home games (the "Application,,); and WHEREAS, the Applicant has also requested the use of the indoor basketball gymnasium at the Gibson-Bethel Community Center for up to eight (8) boys' basketball games including regular season and playoffs; and WHEREAS, the Applicant is requesting a waiver of field and court rental fees in the amount of $990 (the "Fees,,), as follows: APPLICABLE EVENT FEES AMOUNT RENTAL FEES (FLAG FOOTBALL) $270 RENTAL FEES (BASKETBALL) $720 TOTAL S221l REFUNDABLE SECURITY DEPOSIT* $220 ; and WHEREAS, pursuant to Section 1 SB-6(11) of the Code, the City Commission may waive fees and costs related to the use of the City's parks and/or recreational facilities imposed by Section l SB-6 of the Code; and WHEREAS, the City Commission desires to support this request and finds it to be in the best interests of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Recitals Adopted. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. Page 1 of2 Res. No. 013-24-16118 Section 2. Waiver of Fees. Pursuant to Section l SB-6( 11) of the Code, the City Commission hereby waives the Fees associated with the use of the field and court as required under the Code, conditioned upon the City Manager approving the Application for the use of the field and court and the Applicant's compliance with all requirements under Section 15B-6 of the Code and the City's established policies and procedures related to the use of the City's parks and/or recreational facilities for organized activities. Prior to the City Manager approving the Application, the Applicant shall provide the City with the required Certificate of Liability Insurance that complies with the City's standard insurance requirements, including naming the City of South Miami as an additional insure Section 3. Applicability of All Other Fees and Requirements. Except as waived and provided for herein, all other fees and costs and requirements of the Code remain applicable to the Event, and the City Manager shall ensure compliance with all Code requirements. Section 4. Implementation. The City Manager is hereby authorized to take any and all necessary action to implement the purposes of this Resolution. Section 5. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any confonuing amendments to be incorporated into the final resolution for signature. Section 6. Severability. If any section, clause, sentence, or phrase of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Resolution . RECOMMENDATION:Approval of the fee waiver in the amount of $990 for youth football and basketball competitions at Palmer Park and the Gibson-Bethel Community Center, respectively. BACKGROUND:South Miami Middle School (“the applicant”) is comprised of multiple competitive athletic programs and is led by Mr. Marcos Acevedo, PE Teacher and Athletic Director. In previous years, the applicant has used Palmer Park for its home flag football competitions and the Gibson-Bethel Community Center for its home basketball games. The applicant has requested the use of the open green space at Palmer Park for up to eight (8) regular season home games and four (4) playoff home games. The exact number of games—not to exceed 12—will consist of four (4) regular season boy’s games and four (4) girl’s games to be tentatively held between January 30th through February 27th, 2024, between the hours of 4:00 pm –5:30 p.m.The dates for the two (2)playoff flag football games are forthcoming as they are contingent upon regular season standings and seeding. The department is not required to paint fields for this request as the school plans to use field cones. The applicant has also requested the use of the indoor basketball gymnasium at the Gibson-Bethel Community Center for up to eight (8) boys’ basketball games including regular season and playoffs. The exact number of games –not to exceed 8 –shall be played sometime between the months of March and May of 2024. Permits may not be issue d for program s: 5 • Requiring equipm ent to be set up in the park or facility . • With a negative impact on traffic or the public's ability to enjoy the park or facility. • Conside r ed high ri sk having a negative impact on the publ ic's health, safety, and welfare. • Deemed inappropriate by the Pa rks and Recreation Director. • With a negative impact on City property; for example , destruction of trees , turf, or other City "A J _infrastructure. 1. /_VVf __ Facility Permit/Security Deposit • Reservations may be requested up to one year in advance and are based upon availability. • The security deposit and all associated rental fees must be paid at the time of reservation . • The payment can be made in the form of a personal check, money order or certified check. • Failure to adequately clean, damage to or loss of park property or violation of park rules, will result in the !rt A A-loss of all or part of the deposi t . 2. {~Insurance • Prior to the use of the facility or facility, proof of insurance may be required with the policy naming the City of South Miami as an additional insured for the duration of the event. • The coverage for the City shall be primary and non-contributory and written on Florida approved forms by an insuranc e company licensed by the State of Florida to sell insurance. , A A .t).-The company shall not be a surplus lines carrier and the insurance shall includ e contract liability coverage. 3. /J/Jt:!_ Activity • Any unusual equipment and/or activity, as may be defined by the City in its sole and absolute discretion, must be approved by the Director of Parks and Recrea t io n and noted on the facility reservation form. • All equipment must be delivered and removed within the rental period -no storage areas are available. • All delivery vehicles must remain in designated parking areas. Excessive amplified music or other loud noises, as determined by the City in its sole and absolute discretion, which disturb other park patrons or adjacent property owners are prohibited . Rides of any ki nd including pony ride s, mechanical and inflatable rides , petting zoos, etc. are not permitted i n any City pa r k. • Use of rentals, incl uding pavi l ion rentals must be completed by sunset. Use of rentals at Palmer Park and if' J t the Gibson-Bethel Community Center mu st be completed by 10:00 PM. 4. L~W~_! Conduct • Permittee must take all necessary steps to control all of their guests/participants/spectators. Any person(s) violating any of the Rules and Regulations conta i ned herein, any City ordinances or other laws, or who are , in the opinion of the Par ks and Rec reation Department, constituting a public nuisance , potential hazard to the public or park property, or exhibiting disorderly conduct, may be expelled from the facil ity by Par ks and Re creation Department staff or Police Department without a refund for the remainder of the perm it period. • Al l vehicles mu st remain in the designated par ki ng lots. The consumption of alcoholic beverages and gambling of any form is prohibited in all City parks . Set up/Decoration • Decorations may be attached with MASKING TAPE ONLY. The use of staples, nails, tacks , etc. is prohibited . The rental period shou ld incl ude suffic ient time for set -up of facility, conducting the event, and cleanup of the faci l ity to the satisfaction of the Parks and Recreation Departm e nt. 12 • • • 7. NA- • • Rental Application Form Balloons inflated with lighter-than-air gases shall not be released in the City limits. Any balloons filled with gases shall be tied securely to an object heavier than the balloon and a paper tag shall be attached to the string/ribbon attached to the balloon th at states : "Releasing this balloon will harm the environment/Soltando este globo al aire danara la naturaleza ". (see ord. 13-16-2246 amending sec. 13A- 22 of the Code of ordinances) All facilities/furniture/equipment must be returned to its original condition and be placed in its original position if moved . Any cleanup performed by the City will be deducted from the deposit and/or billed to the Permitee . Food Service Cooking of food must be done in presc r ibed areas only. No food or drinks will be allowed in the Gymnasium at the Community Center. The City of South M iami , M iami-Dade County and the State of Florida may require permits/licenses when food is to be sold. It is the responsibility of the permittee to contact these agencies for this information and to obta i n all required permits . Special Requirements Occupancy Limits -30 people per pavilion at Dante Fascell Park ; 15 people at Fuchs Park and 60 people in t he Multipurpose Room . Additional tra sh receptacles, cleanup crews, portable toilets, off-duty police officers, or other special conditions may be required depending on the facility, number of attendees, nature of event or other miscellaneous conditions as determined by the City in its sole and absolute discretion and/or in the public fJiAA interest. The sale of merchandise of any ki nd is prohibited unless otherwise noted on the application form. 8. ___ Pets • With the exception of service animals, animals/pets are not permitted into or upon City parks and facilities .. A,, unless otherwise required by law . 9. 11':f:!J_ Cancellations and Refunds • Cancellations made seven (7) days in advance of the scheduled reservation date are eligible for a refund. No refunds thereafter. Restrictions/Revocation • The City Manager reserves the right to approve or deny any application on a case-by-case basis , including but not limited to, limited capacity of park or facility, impact on surrounding neighborhood, services for faith-based organizations, or such application is not consistent with the Parks and Recreation Vision, M ission and/or Values. • Permits are revocable , without notice at any t ime by the Parks and Recreation Director or their designee fo r a violat ion of the permit conditions, any park rule , ordinance , Federa l or State law or if the Di r ector of Parks and Recreation determines the permitted use is a threat to the health , safety, or welfare of the public . • Should a lapse in the general liability insurance policy occur, the City reserves the right to revoke the user's permit. I agree to pay all losses and expenses of any kind or nature whatsoever, in connection therewith, including the expense or loss of the CITY and/or its affected officers, affiliates, employees, successors and assigns, including their attorney's fees, in the defense of any action in law or equity brought against them. 4) that neither the CITY nor its officers, affiliates, employees, successors and assigns shall be held liable or responsible for any claims, including the costs and expenses of defending such claims which may result from or arise out of actions or omissions of me, the Participant, or any of our contractor or subcontractor, if any, or any of their or our agents, representatives, employees, or assigns, or anyone acting through or on behalf of the them or us, and arising out of or occurring on the CITY's property. In reviewing, approving or rejecting any submissions or acts of me or the Participant, CITY in no way assumes or shares responsibility or liability for the acts or omissions of me or the Participant, our contractor or subcontractor, if any, or any of their or our agents, representatives, employees, or assigns, or anyone acting through or on behalf of them or us. I and the Participant have the duty to provide the CITY with a defense with an attorney or law firm approved by the City of South Miami, which approval will not be unreasonably withheld. I certify, under penalties of perjury, that the above information is correct, that I have read and understand the rules and regulations and that I agree to the terms and conditions set forth above. 4 17 Rental Application Form Permit Rules and Regulations Please initial at each rule indicating you have read and understand the expectations of the City of South Miami. Permits may not be issued for programs: 5 • Requiring equipment to be set up in the park or facility. • With a negative impact on traffic or the public's ability to enjoy the park or facility. • Considered high risk having a negative impact on the public's health, safety, and welfare. • Deemed inappropriate by the Parks and Recreation Director. • With a negative impact on City property; for example, destruction of trees, turf, or other City n.A-4--infrastructure. 1. • Facility Permit/Security Deposit • Reservations may be requested up to one year in advance and are based upon availability. • The security deposit and all associated rental fees must be paid at the time of reservation. • The payment can be made in the form of a personal check, money order or certified check. • Failure to adequately clean, damage to or loss of park property or violation of park rules, will result in the .1 AA--loss of all or part of the deposit. 2. _IV_v_ \ Insurance • Prior to the use of the facility or facility, proof of insurance may be required with the policy naming the City of South Miami as an additional insured for the duration of the event. • The coverage for the City shall be primary and non-contributory and written on Florida approved forms by an insurance company licensed by the State of Florida to sell insurance . .. A ,i_ The company shall not be a surplus lines carrier and the insurance shall include contract liability coverage. 3. _fV_V'\_ Activity • Any unusual equipment and/or activity, as may be defined by the City in its sole and absolute discretion, must be approved by the Director of Parks and Recreation and noted on the facility reservation form. • All equipment must be delivered and removed within the rental period -no storage areas are available. • All delivery vehicles must remain in designated parking areas. Excessive amplified music or other loud noises, as determined by the City in its sole and absolute discretion, which disturb other park patrons or adjacent property owners are prohibited. Rides of any kind including pony rides, mechanical and inflatable rides, petting zoos, etc. are not permitted in any City park. • Use of rentals, including pavilion rentals must be completed by sunset. Use of rentals at Palmer Park and .Al A.--:( the Gibson-Bethel Community Center must be completed by 10:00 PM. 4. f~---Conduct • Permittee must take all necessary steps to control all of their guests/participants/spectators. Any person(s) violating any of the Rules and Regulations contained herein, any City ordinances or other laws, or who are, in the opinion of the Parks and Recreation Department, constituting a public nuisance, potential hazard to the public or park property, or exhibiting disorderly conduct, may be expelled from the facility by Parks and Recreation Department staff or Police Department without a refund for the remainder of the permit period. • All vehicles must remain in the designated parking lots . .. It ,A., The consumption of alcoholic beverages and gambling of any form is prohibited in all City parks. 5. t.lOC1-Set up/Decoration • Decorations may be attached with MASKING TAPE ONLY. The use of staples, nails, tacks, etc. is prohibited. The rental period should include sufficient time for set-up of facility, conducting the event, and cleanup of the facility to the satisfaction of the Parks and Recreation Department. 18 Rental Application Form • Balloons inflated with lighter-than-air gases shall not be released in the City limits. Any balloons filled with gases shall be tied securely to an object heavier than the balloon and a paper tag shall be attached to the string/ribbon attached to the balloon that states: "Re leasing this balloon will harm the environment/Soltando este globo al aire danara la naturaleza". (see ord. 13-16-2246 amending sec. 13A- 22 of the Code of ordinances) • All facilities/furniture/equipment must be returned to its original condition and be placed in its original position if moved. Any cleanup performed by the City will be deducted from the deposit and/or billed to 111 , A the Permitee. 6. ~ Food Service • Cooking of food must be done in prescribed areas only. No food or drinks will be allowed in the Gymnasium at the Community Center. The City of South Miami, Miami-Dade County and the State of Florida may require permits/licenses when food is to be sold . It is the responsibility of the permittee to Ji A J1 contact these agencies for this information and to obtain all required permits. 7. 1--'--VV_,_\_ Special Requirements 8. 9. • Occupancy Limits -30 people per pavilion at Dante Fascell Park; 15 people at Fuchs Park and 60 people in the Multipurpose Room. • Additional trash receptacles, cleanup crews, portable toilets, off-duty police officers, or other special conditions may be required depending on the facility, number of attendees, nature of event or other miscellaneous conditions as determined by the City in its sole and absolute discretion and/or in the public rvi,4--interest. The sale of merchandise of any kind is prohibited unless otherwise noted on the application form. ___ Pets • With the exception of service animals, animals/pets are not permitted into or upon City parks and facilities 1r• A A__ unless otherwise n~quired by law. _f _V_VT _ Cancellations and Refunds • Ca nce lla tions made seven (7) days in advance of the scheduled reservation date are eligible for a refund. Restrictions/Revocation • The City Manager reserves the right to approve or deny any application on a case-by-case basis, including but not limited to, limited capacity of park or facility, impact on surrounding neighborhood, services for faith-based organizations, or such application is not consistent with the Parks and Recreation Vision, Mission and/or Values. • Permits are revocable, without notice at any time by the Parks and Recreation Director or their designee for a violation of the permit conditions, any park rule, ordinance, Federal or State law or if the Director of Parks and Recreation determines the permitted use is a threat to the health, safety, or welfare of the public. • Should a lapse in the general liability insurance policy occur, the City reserves the right to revoke the user's :~i j Applicant Signature: ~~ ~ Date:_O_\_\_o_· ____ _ For Office Use Only Method of Payment: ___________________ _ Application Received by: ________________________ Date: ________ _ 6 To whom it may concern, I am writing the City of South Miami a letter to request a fee waiver from the staff at the Gibson-Bethel Community Center for the use of the field at Palmer Park and the indoor basketball court at the Gibson-Bethel Community Center for athletic games, and potentially for playoffs games. For flag football use at Palmer Park, we are requesting to use the fields between January 30th through February 27th for regular season game, and depending on playoff seeding, the fields may need to be used in the beginning of March. The basketball schedule will be forthcoming after district meetings. The regular season will begin March 18 and run through April 26. The final standing will determine playoffs which will begin April 29-May 2. The playoff schedule will be TBA according to where the team stands at the end of the season. As soon as the official schedule comes out, I will notify the supervisors of reservations to the gym. It would only be a total of no more than 8 events throughout that period.
