Z2022000118 Fll,ED BY GARCIA CARRILLO 56 STREET REVOCABLE TRUST FOR THE REZONING OF THE PROPERTY LOCATED AT 5979 SW 56 STREET, MIAMI-DADE COUNTY, FLORIDA, PARTICULARLY OPPOSING RECOMMENDED CONDITION NO. 3 WHICH SEEKS DEDICATIONS TO ESTABLISH A NEW STREET CONNECTION BETWEEN SW 54m TERRACE/60m PLACE AND SW 60m COURT; URGING THE MIAMI-DADE BOARD OF COUNTY COMMISSIONERS TO DENY THE APPEAL OF ZONING APPLICATION #Z2022000118; PROVIDING FOR TRANSMITTAL; PROVIDING FOR IMPLEMENTATION, CORRECTIONS, AND AN EFFECTIVE DATE. WHEREAS, on May 24, 2022, Garcia Carrillo 56 Street Revocable Trust (the "Applicant,,) submitted a zoning application to Miami-Dade County requesting the approval of (1) a district boundary change for the property located at 5957 SW 56 th Street, Miami-Dade County, Florida (the "Property,,), from BU-1, Single-Family One Acre Estate District, to EU-M, Estate Modified District, and (2) a non-use variance of zoning and subdivision regulations requiring five-acre fractional lines to be 60 feet in width and to wave same to permit O feet of dedication for the eastern portion of SW 60 Place (the "Application"); and WHEREAS, the parcels to the south of the Property are located within the jurisdiction of the City of South Miami (the "City") and consist of walled-in single-family residences zoned RS-3 with lots that range from 9,986 to 15,092 square foot in size with access to Miller Drive limited to SW 60th Avenue; and WHEREAS, on September 13, 2023, the Miami-Dade County Community Zoning Appeals Board ("CZAB") held a public hearing on the Application and denied the application with prejudice, as detailed in Resolution No. CZAB12-17-23 attached hereto as Exhibit "A;" and WHEREAS, the Applicant filed an appeal to the Board of County Commissioners (the "BCC") and the Application was noticed for the BCC Zoning hearing on January 24; 2024, however the item was deferred to the March 21, 2024; and WHEREAS, the Staff Reports for both the CZAB and the BCC recommend approval of the Application under Section 33-311(A)(4)(b) of the County Code, with certain conditions, including condition no. 3 that the Applicant dedicate 35 feet along the northwest side of the Property to allow for connectivity between SW 54 Terrace/SW 60th Place to SW 60th Court; and WHEREAS, the City Commission finds that the dedication of the 35 foot portion along the northwest side of the Property would have an adverse impact on the City's residents who reside in the neighborhood, because it would enable connectivity that would encourage additional cut-through traffic through the established RS-3 neighborhood further south from SW 62nd Avenue via SW 60th Avenue; and WHEREAS, the City Commission desires to oppose the Application and any condition of approval which would require or result in additional roadways for connectivity to SW 54 Terrace/SW 60th Place to SW 60th Court; and Res. No. 006-24-16111 WlillREAS, the City Commission finds that this Resolution is in the best interest and welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. by this reference . Recitals. The above-stated recitals are trne and correct and are incorporated herein Section 2. Opposition. The City Commission hereby opposes the Application, particularly condition no. 3 which requires a dedication of 35 feet to establish connectivity between SW 54 Terrace/SW 60th Place to SW 60th Court. The City opposes any new connectivity between SW 54 Terrace/SW 60 th Place to SW 60t11 Court. Section 3 . Urging Board of County Commissioners to Deny Application. The City Commission hereby urges the Miami-Dade County Board of County Commissioners to deny the Application. Section 4. Transmittal. That the City Commission hereby directs the City Clerk to transmit a copy of this Resolution to the Miami-Dade Board of County Commissioners, Planning and Zoning Staff, the County Clerk, and the County Attorney's Office. Section 5. Implementation. The City Manager is authorized to take any and all actions necessary to implement the Agreement and the purposes of this Resolution. Section 6. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 7.
