Ord No 29-23-2480ORDINANCE NO. 29-23-2480 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING ARTICLE III "ZONING REGULATIONS", SECTION 20- 3.6(1) OF THE LAND DEVELOPMENT CODE, ADDRESSING PERMISSIBLE HEIGHT OF AN ACCESSORY STRUCTURE; PROVIDING FOR CORRECTIONS; SEVERABILITY; CONFLICTS; IMPLEMENTATION; AND AN EFFECTIVE DATE. WHEREAS, the City of South Miami (the "City") has adopted a Land Development Code (the "LDC") to promote the health, safety, community acceptable standard of morals and general welfare of the residents of the City of South Miami through the stated regulations of this LDC; and WHEREAS, the City Commission finds it periodically necessary to amend the LDC in order to update regulations and procedures to implement planning goals and objectives; and WHEREAS, Section 20-3.6(0 of the LDC lists restrictions and permissible development criteria for accessory structures, including a height limitation of twelve (12) feet from grade for accessory structures constructed within the rear setback; and WHEREAS, modem homes, which are often constructed at a higher floor elevations that maximize the height allowed under the applicable zoning district, may benefit from compatible accessory structures with similar floor elevations; and WHEREAS, because height of accessory structures is measured from grade, higher floor elevations compress floor to roof/ceiling height; and WHEREAS, the City Commission finds the maximum height of accessory structures should apply to all accessory structures itTespective of where on the lot they are located and should be increased from twelve (12) feet to fifteen (15) feet to allow for more flexibility in providing greater elevations without foregoing usable or de.4tirable floor to roof/ceiling heights; and Page 1 of4 Ord. No. 29-23-2480 WHEREAS, on October 10, 2023, the Planning Board, sitting in its capacity as the Local Planning Agency, reviewed this Ordinance and recommended approval by a vote of six ( 6) to zero (O); and WHEREAS, this Ordinance was duly noticed and presented to the City Commission in two readings, with second reading conducted as the required public hearing on December S, 2023; and WHEREAS, the City Commission finds that this Ordinance is in the best interest and welfare of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:1 Section 1. Recitals. The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2. Amending Article III of the Code. If any section, clause, sentence, or phrase of this Ordinance is for any reason held invalid or unconstit11tional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. Conflicts. That all ordinances or parts of ordinances, resolutions or parts of resolutions , in conflict herewith, are repealed to the extent of such conflict. Section 6. Implementation. The City Manager is hereby authorized to take any and all necessary action to implement the purposes of thi s Ordinance. Section 7. Effective Date. BACKGROUND: The City’s current regulations limit the height for accessory structures to 12 feet from grade. Accessory structures are subordinate buildings such as garages, gazebos, sheds, outdoor kitchens, and the like. Floor elevations of new homes have increased over the years, and the intent of this ordinance is to allow for increased floor elevations of accessory structures by providing sufficient height to accommodate reasonable and usable floor-to-ceiling height despite a higher floor elevation. REQUEST: The City is requesting approval to update the accessory structure regulations found in Section 20- 3.6(I) of the Land Development Code (“LDC”). ANALYSIS: Currently, Section 20-3.6(I)(4) of the LDC states that the maximum height of accessory structures is twelve (12) feet. The proposed amendment would increase the maximum height to fifteen (15) feet. For comparison, accessory structures are allowed up to 35 feet in height in Miami-Dade County for single-family residential districts. See Section 33-52 of the County Code. Accessory structures in City of Miami single-family districts are permitted to be 25 feet in height. See Illustration 5.3, Miami 21 Zoning Ordinance.
