Res No 164-23-16097RESOLUTION NO. 164-23-16097 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, APPROVING AND AUTHORIZING AN EXTENSION AGREEMENT FOR CURBSIDE RECYCLING PROGRAM SERVICES WITH MIAMI-DADE COUNTY DEPARTMENT OF SOLID WASTE MANAGEMENT (DSWM) FOR THE PURCHASE OF CURBSIDE RECYCLING SERVICES IN AN AMOUNT NOT TO EXCEED $256,000 FOR FISCAL YEAR 2023-2024; AUTHORIZING THE CITY MANAGER TO TRANSFER AND EXPEND FUNDS FOR THE PAYMENT OF THE SERVICES; PROVIDING FOR IMPLEMENTATION, CORRECTIONS, AND AN EFFECTIVE DATE. WHEREAS, the City of South Miami (the "City") forecasts the expenditure of up to $256,000 to the Miami-Dade County Department of Solid Waste Management ("DSWM") for curbside recycling services (the "Services") for the Fiscal Year 2023-2024; and WHEREAS, in 2008, the City and Miami-Dade County (the "County") entered into an interlocal agreement for curbside recycling services (the "lnterlocal Agreement"); and WHEREAS, on March 7, 2023, the Board of County Commissioners approved Resolution R-199-23 to extend the Interlocal Agreement until March 31, 2025, to ensure the continuity of recycling services for County residents and participating municipalities, and to retroactively increase the new monthly charge for Services to $6.99 per household per weekly service for the period May 2023 through September 30, 2023, and to the rate of $7 .20 per household per weekly service for the period commencing October 1, 2023 and extending through September 30, 2024, with an increase each year after that based on the Consumer Price Index but not to exceed 3% (the "Extension Agreement") WHEREAS, Article Ill, Section 5 of the City Charter provides that all purchases more than $5,000 shall be approved by the City Commission after competitive conditions have been Page 1 of3 Res. No. 164-23-16097 maintained and competitive bids sought from at least three different sources of supply, if available, with such detennination to be made by the City Commission; and WHEREAS, the City has detenuined that DSWM is the sole provider of the Services within the City; and WHEREAS, the City Commission desires to approve the Extension Agreement, attached hereto as Exhibit "A", for the purchase of the Se1vices and authorize the City Manager to purchase the Services from DSWM in an amount not to exceed $256,000 for Fiscal Year 2023-2024, WHEREAS, in order to fund the purchase of the Services, the Solid Waste (Interlocal Agreement Recycling) account no. 001-1720-534-34 70 which has $240,000 before this request, will be augmented by the transfer of$16,000 from 001-1720-534-4340 -Refuse Disposal Fee to 001-l 720-534-3470 to Solid Waste -Interlocal Agreement-Recycling; and WHEREAS, the expenditure will thereafter be charged to the 001-1720-534-34 70 -Solid Waste -Interlocal Agreement-Recycling, which will have an account balance of$256,000 before payments for the Services commence; and WHEREAS, the City Commission finds that this Resolution is in the best interest and welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. Recitals. The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2. Autho.-ization of Transfer. The City Commission hereby approves the transfer of $16,000 from 001-1720-534-4340 -Refuse Disposal Fee to 001-1720-534-3470 - Interlocal Agreement -Recycling. Page 2 of3 Res. The City Commission hereby approves the Extension Agreement attached hereto as Exhibit "A" and authorizes the purchase of the Services from DSWM and the expenditure of funds in an amount not to exceed $256,000 for Fiscal Year 2023-2024. The expenditure will be charged to Solid Waste -lnterlocal Agreement -Recycling line-item no. 00 l.l 720.534.3470, which had a n account balance of $240,000 before thi s request and transfer of $16,000. Section 4. Implementation. The City Manager is hereby authori z ed to take all actions necessary to implement the purposes and intent of thi s Resolution. Section 5. Corrections. Confonning language or technical s crive ner-type corrections m ay be made by the City Attorney for any confimning amendments lo be incorporated into the final resolution for s ignature. Section 6. Per Section XXVII, of the Interlocal Agreement for Inclusion in the Miami-Dade County Curbside Recycling Program, between Miami-Dade County and the C ity of South Miami ("Municipality") (the "ILA"), th e County he reby grants the Municipality an extension until March 31, 2025, or such time as a successor recycling processing agreem ent is approved by the Board. The Cou nty and the Municipality hereby agree to thi s Extension in accordance with the terms of the original ILA, as well as the additional terms provided herein. The Municipality agrees to the new monthly charges for service, including process in g r etroactive to May 2023 through September 30, 2023, the end of the fi scal year ("FY"), with the total charge per household per month for weekly automated collection a nd processing servi ce at $6.99 and an in crease to $7.20 at the s tart of FY October l , 2023, based on a Consumer Price Index (CPI) increase of three (3 % ) percent. All invoices iss ued for service from October I , 2023, through September 30, 2024, w ill reflect this rate.
