WHEREAS, th e app li cant, Legacy 7709, LLC, subm itted Application No. PB -23-006 (the '·Application"), requesting a pproval of a Tentative P lat to subdivide the parce l identified a s 7709 SW 67 Avenue (Foli o Number 09-4036-000-0440) (th e "Property"), pursu ant to Section 20-4.2 of the Land Development Code (t he "LDC"); and WHEREAS , t he T entative Plat app li cation requ ests a s ubdivis ion of the Prope1ty into three (3) lots in the Low-De ns ity S ingle Family Res idential (RS-3) zoning di s trict; and WHEREAS, t he three (3) buildab le s ing le fam il y lots can each be developed with a new single-family residence; and WHEREAS, the lots created by the proposed Tentative Plat meet a ll of the requirements of Section 20-4.2(B) of the LDC, except Section 20-4.2(B)(2)(a)(i) of t he LDC, w hi c h prov ides that "the bui ld in g s ite[s] created by t he proposed [p lat] s hou ld be equal to or larger t han the median of the ex ist in g buil ding sites in t he Surrounding Area ... "; a nd WHEREAS, a lt hough th e frontage s of all three (3) proposed buildab le s ites are smaller than the median frontage of the su1Tounding area, their respective lot areas are larger than the median lot area of the lots in the SUITOunding area and the three proposed lots a ll a re in compl iance with the dimensional requirements for both the minimum lot s ize and frontage for the RS-3 zoning district; and WHEREAS, p ursu ant to Section 20-4.2(B)(2)(a)(ii) of the Land Development Code, The City Commission may, in its discretion, approve a subdivision of land into lots that are included as part of a wa iver of plat, tentative or final plat and that have lot frontage or lot area that is less than th e Surrounding area median, provided it is approved by four votes of the Ci ty Commission and provided that at le ast the minimum requirements of the Land De velopm ent Code are satisfied. WHEREAS , the owner has s ubmitted a conceptual s it e pl an , conceptual tree d ispos ition plan, and conceptual la ndscape plan for the proj ect whi c h ha ve been rev iewed by th e Plann ing Board; and Page 1 of 3 Res. No. 106-23-16039 WHEREAS, at a Public Hearing on August 8, 2023, the Planning Board voted five (5) to one ( 1) to recommend approval of the Tentative Plat application, subject to the Conditions of Approval; and WHEREAS, the Mayor and City Commission of the City of South Miami, having considered each of the guidelines listed in Section 20-4.2(8) of the LDC and having found that those conditions have been met, desire to approve the Tentative Plat application. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Recitals and Findings. The recitals set forth in this resolution are true and correct, and are supported by competent substantial evidence, and they are incorporated into this resolution by reference as if set forth in full herein. The City Commission finds that the Tentative Plat requested in the Application meets the requirements of Section 20-4.2(8) of the LDC. Section 2. Approval. The application submitted by Legacy 7709, LLC, requesting approval of a proposed Tentative Plat to subdivide the property located at 7709 SW 67 A venue into three (3) lots, pursuant to the Land Subdivision Regulations outlined in LDC Section 20-4.2 is hereby Approved. Section 3. Conditions. The Tentative Plat is hereby approved subject to the following terms and conditions, as well as all applicable City ordinances, codes, rules, and regulations: a. Submittal of an affidavit from the owner that there are no documents that provide restrictions, reservations and/or covenants applicable to the parcel of land being considered and that the parcel is free of any declarations of restrictive covenants, unity of title, easements, or the like, which would prevent the separation of the site; and b. No tree may be removed until after the final plat approval is issued (Tree Removal Moratorium). The applicant may appeal to the City Commission to waive the Tree Removal Moratorium for good cause; c. Revise the Tree Disposition Plan, sheet L-1.0 to show that Tree #12 will either remain or be relocated, and that Trees #77, #78 and #79 will be removed; d. Once approved by Miami-Dade County, it will be required that the project be reviewed by the City Commission for Final Plat approval; e. Compliance with Section 20-3.6(J)(2)(a) of the LDC for swimming pools by the time Building Permits are submitted; f. BACKGROUND: On May 5, 2023, an application for Tentative Plat was filed by the applicant/property owner, Legacy 7709, LLC, in order to subdivide the existing vacant parcel located at 7709 SW 67 Avenue into three (3) single family parcels so that new single-family homes can be built. The vacant property is a corner lot sitting at the northeast corner of SW 67th Avenue and SW 77th Terrace. 2 THE CITY OF PLEASANT LIVING Legacy 7709, LLC – Tentative Plat 7709 SW 67 Avenue September 5, 2023 Page 2 of 9 REQUEST: The applicant is requesting approval through the Tentative Plat process as provided in Section 20-4.2 of the City’s Land Development Code (LDC), to subdivide the existing parcel into three (3) separate parcels of land with the intent of constructing three (3) new single-family residences. Surrounding area is defined as all lots within the same zoning district and within five hundred (500) feet from the exterior boundaries of the subject property. As required by the LDC section listed above, a review of the lot sizes and frontages of the surrounding area was performed. As such, the outcome of that review can be found in the table below. However, the lots did not meet or exceed the median frontage of the surrounding area. Pursuant to Section 20-4.2(b)(2)(ii) of the LDC, The City Commission may, in its discretion, approve a subdivision of land into lots that are included as part of a waiver of plat, tentative or final plat and that have lot frontage or lot area that is less than the Surrounding area median, provided it is approved by four votes of the City Commission and provided that at least the minimum requirements of the Land Development Code are satisfied. That said, as long as the project meets the minimum requirements of the RS-3 zoning district, the City Commission may approve the project even though it does not meet the surrounding area median. For more information on the median buildable site/lot size and the median frontage for the surrounding area, please refer to the attached exhibit, Tentative Plat Median Analysis for 7709 SW 67th Avenue. Pursuant to Section 20-4.2(B)(2)(b) of the LDC, The building site created by the proposed waiver of plat, tentative or final plat, will not result in existing structures becoming nonconforming as they relate to setbacks, lot area, 4 Legacy 7709, LLC – Tentative Plat 7709 SW 67 Avenue September 5, 2023 Page 4 of 9 lot width and depth, ground coverage and other applicable regulations of the City's Land Development Code and/or City's Code of Ordinances, except as permitted by this ordinance. Compliance with this provision may occur by demolition or relocation of existing structures. A single-family residence was previously located on the property but was demolished in 2012 via Building Permit #12-1269 and is currently vacant. That said, Section 20-4.2(B)(2)(b) would not apply to this property. it is the intent of the property owner to redevelop the site and build three (3) new two-story single-family residences that will all include driveways, walkways, and swimming pools. Pursuant to Section 20-4.2(B)(4) of the LDC, the applicant has provided a conceptual site plan, sheet A-1.0, that details the building footprints, setbacks, yard requirements, and any easements. Staff has reviewed the conceptual site plan against the dimensional requirements for the RS-3 zoning district that are listed in Section 20-3.5(H) of the LDC. For reference, the dimensional requirements for the RS-3 zoning district can be found in Section 20-3.5(H) of the LDC. When reviewing the conceptual site plan, it was found that there were no safeguards shown for the proposed swimming pools. Pursuant to Section 20-3.6(J)(2)(a) of the LDC, unless the pools are screened, they shall be surrounded by a protective wall or fence of at least four (4) feet in height. If approved, the swimming pools will need to be secured prior to permitting. The applicant has supplied staff with proposed landscape plans for the project. This includes the Tree Disposition Plan, sheet LA-1.0 and the Preliminary Planting Plan, sheet LA-2.0. which have both been signed and sealed by Orlando Comas, ASLA. As part of the Tree Disposition plan, the Tree Disposition Legend shows the existing trees that will be affected by the redevelopment of the site. Regarding tree protection, Section 20-4.2(B)(3)(a) of the LDC states the following, Ensure the retention of specimen trees for six (6) years and permanently maintain fifty (50) percent of existing protected tree canopy, but in no event shall the condition be less restrictive than what is required by the City's and County's tree ordinance. As required by Section 20-4.2(B)(4)(c) the LDC, the applicant was required to provide a certified tree survey overlaid directly upon the site plan. The Tree Disposition Plan, sheet L-1.0 details all existing trees on the property and has been overlaid on top of the conceptual site plan for the project. The Tree Disposition Chart details all of the tree species and measurements for the trees on the site. It’s important to note that the applicant is proposing to relocate a number of the specimen sized trees throughout the site which is in conformance with Section 20-4.2(B)(3)(a). However, Tree #12 is a specimen sized tree that is listed for removal and must be kept on the site. Because of that, the landscape plan will need to be revised to show that Tree #12 will either remain on the site or be relocated to another location on the site. Additionally, the LDC considers Trees #77, #78 and #79 to be a prohibited plant species and must be removed. Last, pursuant to Section 20-4.2(B)(4)(c) of the LDC, a moratorium has been placed on the removal of any trees on the property until after final plat approval has been issued. Pursuant to Section 20-4.2(C)(1) of the LDC, Sidewalks, curbs, gutters, drainage and paving shall be installed by the owner or developer of the abutting parcel in accordance with Chapter 28 of the County Code and other applicable city requirements, unless such can be and are waived or deferred by the city commission. To comply with the subsection listed above, the conceptual site plan was reviewed by representatives of the Public Works Department. As indicated in the email dated July 6, 2023, from Mr. Nelson Gomez, representatives from the Public Works Department visited the site and have elected to wait to provide any comments on the project until it comes back to the City for Final Plat approval. That way they can also review any comments that Miami-Dade County may have regarding the right-of-way area. Additionally, Mr. Aurelio Carmenates, in a follow-up email also dated July 6, 2023, stated that there is an existing 9 Legacy 7709, LLC – Tentative Plat 7709 SW 67 Avenue September 5, 2023 Page 9 of 9 sidewalk along SW 67th Ave that ends at SW 77th Terrace. Each property must retain stormwater within the property line but drainage onthe right-of-way may be required and is pending an engineering analysis. Also, the paving limits are edge to edge from property line to property line. They will also need a water and sewer permit from WASD, as well as traffic approval for the driveways.
