Ord No 07-23-2458ORDINANCE NO. 07-23-2458 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA AMENDING CHAPTER 7 "BUILDING," SECTION 7-17 "ART IN PUBLIC PLACES," OF THE CODE OF ORDINANCES TO MODIFY THE "ART IN PUBLIC PLACES" PROGRAM INCLUDING APPLICABLE PROCEDURES, CONTRIBUTIONS, AND WAIVERS; PROVIDING FOR CORRECTIONS; CODIFICATION; SEVERABILITY; CONFLICTS; AND AN EFFECTIVE DATE. WHEREAS, Article VIII, Section 2 of the Florida Constitution, and Chapter 166, Florida Statutes, provide municipalities with the authority to exercise any power for municipal purposes, except where prohibited by law, and to adopt ordinances in furtherance of such authority; and WHEREAS, the City Commission of the City of South Miami (the "Commission") finds it periodically necessary to amend its Code of Ordinances ("Code") in order to update regulations and procedures to maintain consistency with state law and to implement municipal goals and objectives; and WHEREAS, Section 7-17 of the Code provides for art in public places for public construction projects and private construction projects that have components open to the public (the "Program"); and WHEREAS, the Commission finds that the Program is unnecessarily cumbersome and desires to implement changes to streamline the Program's procedures, provide alternatives to developers, and adjust the waiver process, in order to ensure compliance and participation by the City and the private developers; and WHEREAS, the City Commission held its first public hearing on the proposed Code amendments on April 18, 2023, and, having complied with the notice requirements in the Florida Statutes, approved the proposed amendments on first reading with modifications; and WHEREAS, the City Commission has conducted a second duly noticed public hearing on the proposed Code amendments as required by law on May 2, 2023 and further finds the proposed changes to the Code are necessary and in the best interest of the City and the community. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Recitals Adopted.
