PROVIDING FOR IMPLEMENTATION, CORRECTIONS,
AND AN EFFECTIVE DATE.
WHEREAS, on January 5, 2021, the City Commission adopted Resolution No. 005-21-
15625 (the "Prior Resolution") after a public hearing that was noticed in accordance with the
requirements of Section 20-3 of the Miami-Dade County Code of Ordinances; and
WHEREAS, the Prior Resolution formally requested approval of the annexation of the
area generally located between SW 62nd Avenue and SW 67 Avenue and SW 80th Street and the
Snapper Creek Canal, and legally described in the attached Exhibit "A"; and
WHEREAS, the City engaged Calvin Giordano & Associates to complete a study
supporting the proposed annexation and to conduct the analysis of the area and the costs of
providing City services to the neighborhood; and
WHEREAS, City staff also completed the notification process and tabulated the required
minimum 20 percent of voters who supported the annexation; and
WHEREAS, prior to Miami-Dade County's consideration of the City's annexation
application at a public hearing, the item was removed from the agenda due to concerns over
inclusion of the Downtown Kendall Urban Center as depicted below; and

WHEREAS, the C ity Commission wishes to express its intent to suppo11 the annexati on
described in the Prio r Resolution, with amendments to the bo undaries o f the ann exati o n area to
exclude commercial properties w ithin the Downtow n Kendall Urban Center, and to direct the City
Manager to take a ll acti on n ecess aiy to move forwa rd w ith an annexation application and process,
w ith amendments to the boundaries, including a n ew reso lution o r amending the Prior Resolution,
prov iding notice, and preparation of an application package to s uppo1t the annexation, for City
Commiss ion consideration; and
WHEREAS, th e C ity Commission find s tha t thi s Resolution is in the bes t inte rest and
welfare of the C ity.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Recitals. The above-state d recita ls are true a nd correct and are inc orporated
her e in by thi s reference.
Section 2 . Support for Annexation with Amended Boundaries . The C ity
Commission her e by confirms its support of the annexation set fo11h in the Prior R eso lu tion, w ith
amendments to the bounda ri es of the annexation area to exclude th e prope rti es w ithin the

A Resolution of the City of South Miami, Florida, initiating and requesting
annexation of property legally described as the SW ¼ portion of Section 36,
Township 54 South, Range 40 East, in Miami-Dade County, Florida, and more
particularly described herein; requesting approval of the annexation and
appropriate City boundary change from the Board of County Commissioners
and authorizing the Mayor, City Manager, City Clerk and City Attorney to
take all actions necessary.
WHEREAS, pursuant to Section 6.04 of the Miami-Dade County Home Rule Charter and
Section 20-3 of Miami-Dade County Code, the City of South Miami wishes to initiate a proposed
boundary change after public hearing, upon mailed notice to all owners of property within the area
and all property owners within 600 feet of the proposed boundaries and notice provided by
publication; and
WHEREAS, on this date, the City Commission conducted a public hearing that was
properly noticed in accordance with the requirements of Section 20-3 of the Code of Miami-Dade
County; and
WHEREAS, the City Commission has detennined that the annexation of the area legally
described as the SW¼ portion of Section 36, Township 54 South, Range 40 East, in Miami-Dade
County, Florida and further described in Exhibit "A" is necessary, appropriate, and in the best
interests of the City and its citizens-:-
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1: The foregoing recitals are hereby ratified and confirmed as being true and
correct and are hereby made a specific part of this Resolution upon adoption thereof.
Section 2: The City Commission hereby approves the enlargement of the City's
boundaries to the areas legally described as the SW¼ portion of Section 36, Township 54 South,
Range 40 East, in Miami-Dade County, Florida, and as is more fully described in Exhibit ••A", and
authorizes the initiation of municipal boundary change procedures pursuant to Section 6.04 of the
Miami-Dade County Home Rule Charter and Section 20-3 of the Miami-Dade County Code.
Section 3: The City Commission hereby requests that the Board of County
Commissioners of Miami-Dade County, Florida, adopt an appropriate ordinance approving the
request of the City for the annexation of the lands legally described as the SW¼ portion of Section
36, Township 54 South, Range 40 East in Miami-Dade County, Florida, and as described in Exhibit
"A" and authorizing the appropriate boundary change.
Section 4: The Mayor, City Manager, City Clerk and City Attorney are hereby
authorized and directed to perform all actions as may be deemed necessary or desirable to initiate

and continue the boundary change procedure in accordance with Section 20-3 of the Code of
Miami-Dade County and submit the annexation proposed herein to the Board of County
Commissioners of Miami-Dade County for their consideration .
Section S: The Clerk is hereby authorized and directed to transmit three (3) certified
copies of this Resolution, together with proof of compliance with the notice procedures and all
accompanying documentation as set forth in Section 20-3 of the Code of Miami-Dade County to
the appropriate person(s).
Section 6. Corrections. Confonning language or technical scrivener-type corrections
may be made by the City Attorney for any confonning amendments to be incorporated into the
final resolution for signature.
Section 7. Severability. If any section clause , sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will
not affect the validity of the remaining portions of this resolution.
Section 8. Effective Date. This resolution will become effective immediately upon
adoption.

B ACKGROUND:
Together with some of the r esid ents, City st aff have been explori ng the possibility of annexing
th e area between SW 62 nd Aven ue and SW 6 7 Avenue and SW 80 th St reet and the Snapper
Creek Canal. The fi r st step in anne xation, the analysis of the area and the costs of providing city
services, has been completed an d documen t ed in the attached Annexation Application Report.
After the public hearing on Janu ar y 51h, the Commission will decide whether an annexation
application should be subm itted t o Miami-Dade County. Final decisions on annexations rests
w ith the County Board of Commis si oners after an extensive r eview process.
A NALYSIS:
The Report details the costs of providing services to and anticipated revenues from the
annexa ti o n ar ea. The net financi al gain t o the City is appro xi mate ly $199,000.

Dear Mr. Ruvin :
Please accept this correspondence and the attached submittal as indication of the City of South
Miami 's intent to initiate the above -referenced annexation request. The area in question,
consi sting of multiple properties, is bordered by SW 80th Street on the north; SW 62nd Avenue
on the east; the Snapper Creek Canal on the south; and SW 67th Avenue o n the west, as shown
in t he report.
The area pro p osed for annexation consist of approximately 115 acres of land and is zoned for
sing le-fami ly resident ial and mixed commercial uses, which fulfills the City's goals to "maintain
and i mprove the City 's neighborhoods, and the quality of life of existing and future residents "
(FLU 1) and "support the economic viabil ity o f the City through an adequate tax base and
deve lopment that allows for the eff icient provision of City services." (FLU 6)
Pursuant to Section 20-3 of the Miami-Dade County Code, South Miami has completed its due
di ligence to init iate a proposed boundary change and has obtained pe rtinent documents
needed to satisfy the submitta l requirements as outlined in Section 20 -3(A) of the Miami Dade
Cou nty Co d e.
Attached to this letter are three (3) copies of the City's appl ication report, which among other
elements includes the following :

Land area is estimated at 115 gross acres/ 91 .88 net acres (5,009,400 gross square feet/
4,002 ,289.72 net square feet). The proposed annexation area directly adjoins the City of South
Miami at its current southwestern boundary. The area lies sout h and east of the intersection of
South Di xi e Highway (U S-1) and SW 67 t h Avenue , two major roadways in Miami Dade County.
Existing development within the proposed annexation area (which is practically built out)
consists both of residentia l and commercial uses , complementing and enhancing South Miami 's
envisi oned c hara cte r, as described in the City's 2018 Comprehensive Plan . The adjacency and
character of the area wou ld allow the City to grow in a manner fully consistent and compatib le
with its planning policies, while retaining its small-town scale . For these reasons, the City sees
this annexation as a natural extension of the City 's boundaries to the sout hwest.

The proposed area is very modest in size, nearly built out, and -w ith approximately 1,137 people

4. Statement of Rationale for Boundary Changes
The City o f Sou th M iami is a sma ll munic ip ality of app rox i mate ly 2.3 square mi le s in land area .
The City d o es not have a h istory of geographical expansion, even after subsequent size
reductions during the 1930s led to the current irregu lar boundaries in the north section of the
community. The proposed annexation area is very modest -equivalent to approximately 0.18
square miles, or 115 gross acres of l and-and directly adjoins the City of South Miami at its
current southwestern mun icipal boundary (refe r to Map #1).
The existing and potential development with i n the proposed annexation area consists both of
residential and commercia l uses , complementing and enhancing South Miami 's envisioned
character, as described in the City's 2018 Comprehensive Plan . It would al low the City to grow in
a manner fu ll y consistent with its planning po l ic ies, while retaining its sma ll -town scale.
The proposed annexation fulfills Co m prehensive Plan FLU Goal 1 to "maintain and improve the
City 's neighborhoods, and the qual ity of life of existing and future residents " as well as FLU Goal
6 to "support the economic viability of the City through an adequate tax base and development
t ha t all ows for the efficient provision of City se rvices." Under Goal 6, the Comprehensive Plan
f urther states:
FLU OBJECTIVE 6 7 Increase the City's tax base through appropriate deL1e/opment
Continue to increase the Ci t y 's tax base and fiscal health through new development and
redevelopment, increased property values, annexations, impact fees, grants, and other
strategies as appropriate .
As the Florida Plann i ng and Zoning Associat ion has po i nted out, "annexation is a means for
fi tting the city line to the area that has become the city or is becoming the city ... " Many property
owners in the annexation area like ly frequent Downtown South Miami as thei r business district;
City parks such as the adjoining Fuchs Park and t he nearby Van Smith Park, South Miami Dog
Park and Dante Fascel l Par k (all of w h ich are w ith i n easy walk i ng and biking distance) li ke ly serve
as their o w n parks. The area is serv ed by the same Fi re Rescue stat ion located within the City.
Therefore, this annexation would all ow for a seamless expansion of South Miami 's boundaries.
In addition, the City of South Miam i has determined that the proposed annexation will reinforce
t he City's already solid fiscal res i lie nce by expanding the resident ial and commercial
components of its ta x base into a co ntiguous area of similar development character. For 2020 ,
t he City is estimated to have a posi t ive overall taxable value change of approximate ly 4.3% over
the estimated 2019 taxable value. The estimated tax value per gross acre within the current City
boundary is approximate ly $1.4. m i llion. The est i mated tax value per acre within the proposed
annexation area is above $1 .S mil l io n per acre . The City can offer improved, predictable level of
service to property owners within t he area .

Because South Miami is fiscal ly sound , the City wi ll be able to service the anne xed area w ithout
negative ly impacting residents, businesses , and visitors within the current municipal boundaries .
In fact , w ith this annexation , the City will be able to sustain and reinforce the high quality of life
that is offered to the community.
The development quality, pattern an d character of the area is very similar and therefore compatible w ith
the City.

5. Land Use Plan and Zoning
The following table, based on the Inventory of Existing Land Uses provided by the Miami-Dade
County Department of Regulatory and Economic Resources, details the major categories of land
use found w ith i n the proposed ann exation area by number of acres and percentage of tota l. See
Fi gure 2 fo r a map of existing land uses.
A s shown , the proposed annexation area encompasse s 11 5.0 acres (or approximately 0.18
square miles) and is largely developed. In addition, more than 50 percent of the area is
developed residential.

Th e existing de v elopment mix consists primarily of sing l e-family homes but also includes a few
duplex properties along the south side of SW 84 th St. between Ludlam Road and SW 64 111 Ave.,
as well as a multifamily residential complex north of this location. In addition, the area include s
two retail centers and a pub l ic storage complex. There are no public parks and recreation
fac ilities w ith in the area; the acreage of land iden t ified as parks and recreation in the tab le
above is an amenity that belongs to the multifami ly residential complex.

• Single -Family Residential: The Single-Family land use catego ry is intended to provide for
one resi dential dwelling unit on each parcel of land. New parc els should ha ve a
min im um area equal to or larger than the median of the existing building sites in the
surround i ng area. In areas where existing platting is characteriz ed by parcels lar g er than
10,000 square feet, zoning regu lations shou l d be consistent with surrounding parcel
sizes . Sites large enough to be subdivided into parce ls of 10,000 square feet or larger
cou ld be zoned accordingly, but on ly if such zoning would be compatible with
surrounding development.
• Duplex Re sidentia l: The Duplex Residential category is intended to provide for two
residential dwel l ing units per parcel of land. Each dwell ing unit should have its own
direct access from the out-of-doors. Two-family structures should be developed at
densities that do not exceed two dwelling units per 10,000 square feet.
• To wnho use Residentia l: The Townho use Residential category is in tended to limit
deve lopment to townhouse type dwe l l ing units on parcels of lan d not l ess than 10,000
square feet in area. Each dwell i ng unit should ha ve its own direct access from the out-
of-doors, Townhouse dwelling units should be developed at densities that do not
exceed one dwelling unit per 7,260 square feet of site area . Individual parcels which
meet the minimum site size of 10,000 square feet in area could b e deve loped for use as
sing le-fami ly resi dential dwel l ing units.
• Mu lti -F amily Residential: The Multiple-Family Residentia l la nd use category is intended
to provide for resi dential densit ies of up to a maximum of 24 dwe lling un its per net acre.
Mu ltiple-fami ly residential development sha l l be designed in order to create
environmentally sens it ive and wel l landscap ed settings with pedestrian and multi-modal,
transit -oriented amenities. Zoning regulations shall be implem ented to preserve the
existing densities of developed properties w ithin established d istricts. Designers should

be encouraged to produce uniqu e, flexible, multi-level projects, such as mixed-use
developments, including retail and office uses on ground floor levels .
• Commercial Retail and Office : The Commercial Retail and Office land use category is
intended to provide for reta il and retail service office use and office services that are
characteristic of commercia l development. Adopted zoning regulations shall reinforce
the "n o widenings" policy as set forth in the Transportation Element by encouraging the
containment of development along existing State and County high-design roadway
facilities. The City recognizes the sanctity of the residential neighborhoods and desires
to protect them from poten t ially adverse uses . Consequently, no amendments to the
Future Land Use Map shall be made which develops or expands a Commercial Retail and
Office district into an area designated for res identia l development.
• Mixed-Use Commerc ial/Res idential : The Mixed-Use Commercial/Residential land use
category is intended to prov ide for different levels of retail uses, office uses , retail and
office services, and resident ial dwelling units with an emphasis on mixed-use
development that is characteristic of traditional downtowns. Permitted he ights and
intensities shall be set forth in the Land Development Code . Regulations regarding the
permitted height, density and intensity in zoning districts for areas designated as Mixed-
Use Commercial/Residentia l shall provide incentives for transit-oriented development
and mixed-use development. Zoning regu lat ions shall reinforce "no widenings" policy
set forth in the Transportation Element by encouraging use of the MetroRail system . The
City adopts a FAR. of 1.6 for this land use category which is the existing FAR. in the
Land Development Code fo r the corresponding zon in g district. In addition, the City
adopts a maximum residen t ial density of 24 dwelling units per acre for this district. In
order to ensure a mix of uses , the City requires that a minimum of two of the above uses
must be developed within t his category . For residential projects, at a minimum, at least
one floor must allow retail or office. For retail projects , at a minimum, at least one floor
must contain residential or office . For office projects, at a minimum, at least one floor
must contain residential or retail.
• Transit-Ori ented Development District (TODD ): The Transit-Oriented Development
District is intended to provide for the development of office uses, office services, office -
related retail, retail, retail services , and residential uses in multi-story and mixed-use
projects that are characteristic of transit-oriented developments . Permitted heights and
intensities shall be set forth in the Land Development Code, inc luding design standards.
Zoning regulations shall encourage development within the TODD in conjunction with
limiting new development w ithin the Special Flood Hazard Area and other
environmentally sensitive areas. The City shall pursue incentive programs for
redevelopment including h igher densities, flexible building heights and design
standards to ensure that re sponsible, effective and aesthetically pleasing projects result.

6. List of Services to be Provided
A. Police: The South Miami Police Department (SMPD) is a full-service law enforcement
agency w ith 50 sworn positions and nine civilian staff. The city is divided up into six (6)
patrol zones. Eac h staff member is responsible for overseeing an area and for reaching
out to the community through citizen contacts. The Depa 11ment is headquartered in a
bui ld ing connec te d to Ci ty Hall at 6130 Sunset Drive .
Upon completion of the annexation process and munic ipal boundary change the City
would provide immediate coverage to the area without degradation of pol ice service. If
the annexation is successful an increase of 4 officers will be contemplated .
B. Fire Protectio n: Fire Rescue Services for the annexation area and for the City of South
Miami are provi ded by Miami-Dade County Station 14, which is located at 5860 S.W.
70th Street within South M ia mi boundaries. Units on sit e are Rescue, Engine, and
Battal i on 8. There w ill be no change in this se rvice if the annexat ion occurs.
C. Wate r Supply and Distribution: The Miami-Dade County Water and Sewer Department
(MDWASD ) currently services the proposed anne xa tion area through its water supp ly
and dist ribut ion system.
Since M DWASD is also respons ib le for water supp ly, treatment and transmission to the
City of South Miami, there will be no change if the annexation occurs . The City is served
in its entirety by public water lines , although a few individual areas have yet to connect
to the system . City of South Miami maintains a 20 -Year Water Supply Facilities Work
Plan in comp liance with Chapte r 163, Part 11 , F.S .
D. Facilities for Collection and Treatment of Sewage: MDWASD has jurisdic tion over the
proposed annexation area , but apart from the commercial sites and approximate ly a
dozen scatte red residential properties, most of the lots throughout the area appear to
be served by onsite sewage treatment and disposal systems (O STDS , aka septic tanks).
About two -thirds of the City of South Miami (mos tly the City's residential areas) are
served by OSTDS as well. These systems work well given the current soil conditions in
South Miami. Nevertheless, the City has prepared a Sanitar y Sewer Master Plan to
evaluate areas within the City limits that are currently not serviced by a public sanitary
sewer system and to make recommendat ions for improvements and upgrades to the
County facilit ies in order to serve these areas properly in the face of sea leve l rise due to
climate change .

For those areas of the City that are already served by sanitary sewer , MDWASD is
responsible for the collection system as well as the ultimate treatment of effluent. The
Centra l District Wastewater Treat ment Plant which serves South Miami has an annua l
average permitted capacity of 143 mgd, with adequate treatment capacity for a ten-year
planning period. The County has the capacity to accommodate i ncreased use .
E. Garbage and Refuse Collection and Disposal: The City of South Miami operates solid
waste pickup throughout the City. There is no commercial pickup provided by the City .
The Public Works Departme nt 's Solid Waste Division trucks transport all refuse
collections to a transfer stat ion located at 2900 S.W . 72nd Avenue and operated by the
Miami-Dade Public Works Depa,tment. The capacity of this transfer station is adequate
to meet South Miami's futu re needs, including with the potential annexation . The

annexation area: Fu chs Park-a 5-acre neighborhood park at 6445 SW 81 s1 Stre et which

I. Buil d ing Inspe ct ion: The City's Building Depariment enforces the State of Florida
Build ing Code within the boundaries of the City of South Miami and co llaborates with
other City Departments in the enforcement of local codes. The Department also certifies
bui lding s upon completion and at pre -stated p eriods afterwards . The Bui lding
Department will be responsib le for the same functions within the annexation area, if the
annexation is successful.
J. Zo ning Administ ra ti on: The City 's Plann ing and Zoning Depariment is responsible for
the oversi g ht of all inqu i ries pertaining to the City 's adopted land use and zoning

Code Enforcement Office will undertake these respons i bilities wi thin the annexed area.

N. Gen eral Gove rnm ent: The City of South Miami follows a Commission-City Manager form
of government. The City Manag er serves as the Chief Executive Officer of the City and is

undertake policing in the annexed area . The area w ill be either added into an existing
patrol zone or made into a new patrol zone .
B. Fire Protection: No Ch ange. Miami-Dade County Fire Rescue w ill continue to provide
service to the annexed area from Station 14 lo cated at 5860 S.W . 70th Street.
C. Water Supply and Distribution : No Change . Miami-Dade County Water and Sewer
Department already supplies potable water through its water supply and distribution
system .
D. Facilities for Collection and Treatment of Sewage : No Change . Miam i -Dade County

8. Financ in g of Services
The Genera l Fund is the major operat ing fund of the City of South Miami . This fund is used
to account for all financial resources except those requ i red to be accounted for in another
fund.
A. Police: The City wi ll fund this serv ice through its General Fund v ia tax col lections .
B. Fire Protection : Fi re and Rescue services will continue to be provided by Miami -Dade
County Fi re Rescue Department. Services are financed through Fire Rescue Taxing
District revenues and fi nanc i ng procee ds. There is no cost t o the City of South Miam i for

C. Water Supply and Distrib ut ion: The area is close to bu i ld -ou t and currently served by
MDWASD. Potential costs assoc iated w ith any new development or redevelopment

usage charges w il l provide the revenues fo r t he cont i nued operation and maintenance
of the water supply and distri bution system .
D. Facilit ies for Collection and Treatment of Se w age: The area is primar i ly served by OSTDS
(sept ic t anks ). Improvemen t s and upg rades assoc iat ed with new development would be
paid by the deve loping entity .
E. Garbage and Refuse Collection and Disposal : The Cit y wi ll fund th is serv ice through its
General Fund via ta x collections . The Cit y also receives re v enues from residents who
have trash in excess of t he allo w ab le amount per cu bic y ard and annual charge for those
hav ing an extra garbage container. Revenues are also gene rated by franchise fees from

9. Tax Load on Annexation Area
The gross revenue ca lculations are based on the 2020 Taxable Real Estate and Personal
Property Rolls . Property tax revenue is ca lculated using the following formula provided by
M iami -Dade County, which applies the adopted millage rates and certified roll figures at 95
percent:
Revenue = Taxable Property X Millage X 0.95 /1 000
The current Miami-Dade County m i llage rate is 1.9283 which yields estimated revenue of
$324,728.
The est i mated cost of providin g se rv ices to the annexation area (i.e., expenditures) is based
on costs the City expects it will inc ur, inc ludi ng police protection, solid waste pickup and
disposal, paying for street lighting, etc . The City of South M iami FY2020-2021 Budg et

This serves to certify that in accordance with Sec. 20-9 {a) of the Code of Miami-Dade County, I have

• The proposed annexation area described below is more than 50 percent developed
residential. According to the July 2020 land use records as shown in the attached table
and map, there are 78.1 acres of land in residential use (67 .9 percent) within the proposed
annexation area. The land area of the proposed annexation i s approximately 115 acres.
• The proposed annexation area shown is the attached map. It is generally defined by SW

HOURS OF OPERATION," OF CHAPTER 4, "ALCOHOLIC BEVERAGES,"
OF THE CITY CODE OF ORDINANCES TO AMEND THE PERMITTED
HOURS OF SALE FOR ALCOHOLIC BEVERAGES CONSUMED
ON -PREMISES; PROVID ING FOR CORRECTIONS; SEVERABILITY;
CONFLICTS; IMPLEMENTATION ; AND AN EFFECTIVE DATE.
The hearing will be held at c· Hall Commission Chambers 6130 Sunset
Drive South Miami Florida 33143. Commission members will participate
in Chambers or by video conferencing through the Zoom platform and members
