SUBJECT:Resolution related to variance for impervious coverage to allow a swimming pool on
the property located at 6770 SW 63rd Steet
RECOMMENDATION:
Staff has reviewed the request and determined that it does not meet the Standards of Review for the
issuance of a Variance. No specific hardship can be identified that would allow for the proposed variance.
Staff is recommending that the City Commission deny the request for relief from the Impervious Coverage
requirement. If the Commission should Approve the request, staff recommends the following Conditions
of Approval:
1.A Building Permit from the City must be issued prior to the construction of the swimming pool or equipment
pad;
2.A Tree Removal Permit must be issued prior to the removal, relocation, or trimming of any trees on the
property; and
3.The Variance Approval shall lapse after one (1) year if no building permit has been applied for in accordance
with the request for such variance and if the City Commission has not specified a longer approval period for
good cause shown.
4.If the Impervious Coverage Ordinance is not modified to allow for an increase in impervious area the turf
will need to be removed before Final Inspection of the building permit. (Planning Board)
BACKGROUND:
Carlos Santisteban, Jr., the property owner and applicant, would like to install a swimming pool at the rear
of his property located at 6770 SW 63 Street, which is located in the City’s Low Density Single-Family (RS-
3) Residential Zoning District. Due to the configuration of the impervious surfaces that are already on the
site, he is unable to build the size of swimming pool that he desires. To rectify this, he has submitted an
Application for a Variance, requesting approval to increase the maximum impervious coverage allowed
for his property.

REQUEST:
At this time, the applicant is requesting a Variance to allow a maximum impervious coverage of
approximately 43.15% (5,414 SF) where a maximum of 40% (5,019 SF) is permitted in the RS-3 Zoning
District.
ANALYSIS:
When reviewing the project, the following items are noted:
The subject property is surrounded by the following Zoning Districts:
o North: Low Density Single-Family Residential (RS-3)
o South: Low Density Single-Family Residential (RS-3)
o East: Low Density Single-Family Residential (RS-3)
o West: Low Density Single-Family Residential (RS-3)
The subject property is part of the Tranquility Estates Subdivision, which was platted in 1964 and
has a lot size of 12,548 SF and a frontage of 112.50 Feet, which exceeds both the minimum lot
size (10,000 SF) and minimum frontage (75 Feet) required by the RS-3 Zoning District.
Per the site plan provided, there are approximately 4,873 SF of existing impervious surfaces on
the site that consists of the following components:
o Building Area: 2,680 SF
o Walkway: 164 SF
o Driveway: 1,092 SF
o Entry Porch: 160 SF
o Rear Terrace: 432 SF
o Turf: 327 SF
o A/C Pad: 18 SF
The applicant is requesting an increase of 395 SF (3.15%) in impervious coverage so that he can
build a swimming pool and equipment pad at the rear of the property. Per the site plan provided,
the swimming pool and equipment pad will consist of the following square footages:
o Swimming Pool: 525 SF
o Pool Equipment Pad: 16 SF

The aerial for the property shown on the Miami-Dade Property Appraiser’s website shows trees
that are in the rear of the property. If approved, the applicant will be required to obtain a tree
removal permit from the City prior to the removal, relocation, or trimming of any trees on the
property that will be affected by the installation of the swimming pool or equipment pad.
Review Criteria:
Section 20-5.9 of the Land Development Code (LDC), Variance approvals,provides the standards against
which Variance applications must be reviewed. More specifically, Section 20-5.9(H) of the LDC provides
that Variance approvals shall be based on an affirmative finding as to each of five (5) criteria.The applicant
has provided his opinion of how the criteria are satisfied in the Letter of Intent included in the Application
Package. The following is staff’s analysis of the request:
Variance Request: Impervious Coverage
Currently the RS-3 Zoning District permits a maximum impervious coverage of 40% of the lot. This can be
found in Section 20-3.5(E) of the LDC. Included in this coverage calculation typically are the structure,
driveway, swimming pool, concrete slabs, and any other impervious surfaces onthe site. Per the site plan
provided, the applicant is proposing to install a swimming pool that is 525 SF as well as a 16 SF pool
equipment pad. Based on the table below, the maximum impervious coverage for the site is as follows:

Based on the table above, the proposed renovation will cause the property to exceed the maximum
allowed by 3.15% (395 SF). Because of the increase in impervious coverage, the applicant has requested
a variance for impervious coverage. Pursuant to Section 20-5.9(H) of the LDC, all variance decisions shall
be based on an affirmative finding as to each of the following criterion:
1.The variance is necessary to relieve particular extraordinary conditions relating to a specific
property;
The subject property has been platted and is12,548 SF in size with a frontage of 112.50 feet. Both
exceed the minimum lot size (10,000 SF) and minimum frontage (75 Feet) required by the RS-3
Zoning District. Based on these requirements, the lot complies with the dimensional requirements
with the result being that there are no particular extraordinary conditions related to the property
as it is larger than a standard lot in the RS-3 Zoning District.
2.Denial of the variance would result in hardship to the owner. Hardship results if the restriction
of the zoning ordinance, when applied to a particular property, becomes arbitrary, confiscatory
or unduly oppressive because of conditions of the property that distinguish it from other
properties under similar zoning restrictions;
After reviewing the site plan and survey provided, it was determined that there currently is 4,873
SF of impervious surfaces on the site. Because the RS-3 Zoning Districthas a maximum impervious
coverage of 40%, the applicant could only pave an additional 146 SF before reaching the maximum

allowed for the district. The applicant is requesting approval to exceed the maximum permitted
by 395 SF. If the variance request were denied, the applicant would still be permitted to build a
swimming pool on the site by either reducing its size or the size of the other impervious surfaces
that are already on the site. Because of this reason, a denial of the variance would not cause a
hardship to the owner.
3.The extraordinary conditions and circumstances do not result from the actions of the applicant;
While the residence was not built by the applicant as it was built in 1966, he pulled a building
permit in 2019 to install a new driveway on the property that would have factored into the
impervious coverage for the site. This combined with the installation of a turf area at the rear of
the driveway would have maximized the full potential of his property, but it also increased the
impervious coverage on the site to its maximum in the process. Instead of choosing to reduce or
remove impervious surfaces on the site to accommodate the new swimming pool and pad, the
applicant chose to maintain the current level of impermeability on the site and request an
increase through the variance process. Because of these factors, it was determined that any
extraordinary conditions and circumstances have resulted from the actions of the applicant.
4.The requested variance is the minimum variance necessary to make possible the reasonable
use of the land, building or structure;
Currently, a swimming pool is permitted on residentially zoned properties as long as it complies
with both the swimming pool setback regulations and the impervious coverage requirements for
the zoning district. The pool as proposed meets the minimum setback requirements listed in
Section 20-3.6(J) of the LDC but will cause the property to exceed the maximum impervious
coverage permitted by the zoning district. While the request is small, it is not the minimum
variance necessary to allow for the reasonable use of the land, building or structure. Because a
swimming pool is already permitted, it could be built without the need for a variance if the
applicant were to reduce its size, reconfigure some of the existing impervious surfaces to
accommodate the pool, or a combination of both.
5.That the approval of the variance will be inconsistent with the general intent and purpose of
the Land Development Code and will not be injurious to the neighborhood or otherwise
detrimental to the public welfare.
Impervious coverage regulations were established in the LDC to aid in the prevention of recurrent
ponding and water runoff to both the neighboring properties and the right-of-way. A smaller
amount of green space would result in a lower chance of water being absorbed into the ground
which in turn could cause ponding in areas until it can be either absorbed or evaporated. While
approval of the variance request may not be injurious to the neighborhood or detrimental to the
public welfare, it would not be consistent with the general intent of the LDC.
Previous Action
On June 13, 2023, the Planning Board (PB) held a Public Hearing on the item and voted 6 to 0 to
recommend Approval of the request, subject to the Conditions of Approval recommended by Staff, as well
as the following additional condition:

THE EXTRAORDINARY CONDITIONS AND CIRCUMSTANCES DO NOT RESULT FROM THE ACTIONS OF THE APPLICANT. The Santisteban Family cannot be said to have created a condition or circumstance that have placed them in the position to now require a variance. 4. THE REQUESTED VARIANCE IS A MINIMUM VARIANCE NECESSARY TO MAKE POSSIBLE THE REASONABLE USE OF THE LAND, BUILDING OR STRUCTURE. The requested \'ariance consists of increasing the ma\imum allowed impmfous area from 40% to 43.66%.
135. THAT THE APPROVAL OF THE VARIANCE WILL BE CONSISTENT WITH THE GENERAL INTENT AND PURPOSE OF THE LAND DEVELOPMENT CODE AND NOT BE INJURIOUS TO THE NEIGHBORHOOD OR OTHERWISE DETRIMENTAL TO THE PUBLIC WELFARE. The City of South Miami Code of Ordinances, Section 8A -5, requires that all lobbyists, as defined in that section,
must register with the City Clerk before engaging in any lobbying activities and in most cases pay an annual fee of
$500.00 and an additional $100 for each additional issue. This applies to all persons who are retained with or
without compensation to influence any action, decision, recommendation of someone with the city, including the
city manager, city attorney, department heads, city personnel, or members of the city commission or members of
any city board, concerning a matter that could foresee ably be address by the city commission or a city
board. There are some exceptions and exemptions. The following are not considered to be lobbyist: a
representative of a principal at a quasi-judicial hearing, experts who present scientific or technical in formation at
public meetings, representatives of a neighborhood association without compensation and representatives of a
not-for-profit community based organization for the purpose of requesting a grant who seek to influence without
special compensation.

Vice Chair Elections: Mr. Miller stated that the Board was informed that Ms. Dodard will not be
reappointed. He then asked if Mayor Fernandez was working on her replacement, to which Mr.
Lightfoot stated yes. Ms. Dodard’s replacement will be Ms. Michelle Readon. Mr. Miler then

informed the Board that Ms. Readon was the Vice Chair and requested that the elections be held
until the next meeting when Ms. Readon is back on the Board, to which the Board agreed.
IV. Public Hearings:
1. PB-23-005
Applicant: Carlos Santisteban, Jr.
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA [GRANTING
APPROVAL OF/DENYING] A VARIANCE REQUEST PURSUANT TO 20-5.9 OF THE LAND
DEVELOPMENT CODE TO PERMIT AN INCREASE IN THE MAXIMUM IMPERVIOUS COVERAGE
REQUIREMENT SET FORTH IN SECTION 20-3.5(E) FOR A PROPERTY WITHIN THE LOW DENSITY
SINGLE-FAMILY RESIDENTIAL (RS-3) ZONING DISTRICT LOCATED AT 6770 SW 63 STREET;
PROVIDING FOR CONDITIONS; ENFORCEMENT OF CONDITIONS; CORRECTIONS; SEVERABILITY;
AND AN EFFECTIVE DATE.
Applicant: Mr. Carlos Santisteban, Jr.
Mr. Lightfoot read PB‐23-005 into the record. Mr. Lightfoot then presented the staff report on
the item to the Board.
Mr. Martos swore in the applicant, City Staff, and the public.
Mr. Santisteban presented his request to the Board.
Mr. Miller opened the floor to questions from the Board.
Mr. Miller asked Staff if the applicant had a hardship, to which Mr. Lightfoot stated no. Mr. Miller
then asked if that was the reason why Staff was recommending denial for the application, to
which Mr. Lightfoot stated yes. Mr. Miller then informed the applicant that while he answered
the hardship questions that are in the Land Development Code (LDC), his responses did not
answer the question of hardship. Mr. Santisteban responded that he understood that he did not
meet the requirements of a hardship.
Mr. Miller asked if the turf area could be replaced with natural grass or another pervious
material, to which Mr. Santisteban stated yes. The area can be returned to natural grass. Mr.
Santisteban then stated that it was his belief that the turf area was pervious. Mr. Lightfoot
responded that because the applicant counted it towards their impervious coverage calculation,
Staff counted it as well. Mr. Miller then stated that it was fair since there are different types of
turf.
Mr. Martos explained to the Board and the applicant how the City defines a hardship.
Ms. Ortega stated that the turf is a material that can be rolled up and replaced with natural grass.
If it were removed, there would still be an issue of approximately 68 square feet. Mr. Miller then
stated that if the turf were removed, he wouldn’t have an issue with approving the request for
the reduced amount of impervious coverage.

Mr. Barrera informed the Board that the topic of impervious coverage has been discussed by the
Environmental Review & Preservation Board (ERPB) who requested that Staff provide them with
the regulations for other municipalities so that the Board could make recommendations to the
City Commission. Because of that, Mr. Barrera stated that the applicant does have a hardship
and that he would be supportive of a motion to approve the request. Mr. Guerra responded that
as someone who serves on the ERPB as well, the topic has been an on-going discussion where
information is being gathered. Staff and the Commission are working on how to address the
ordinance. Mr. Guerra then stated that the LDC defines all materials that would be pervious in
other municipalities as impervious in the City.
Ms. Ortega stated that if the turf were removed, she would consider approving the request.
Mr. Basu stated that his impression is that the applicant should make an effort to adjust the
impervious coverage to accommodate the pool and that removing the turf would be a good
accommodation. Mr. Basu then stated that as we’re rewriting the code, the lot coverage ratio
should be looked at. Mr. Martos responded that there is legislation being prepared that would
modify the impervious coverage requirements. The proposed legislation would need to be
reviewed by the Planning Board and approved by the City Commission. If approved, that
legislation would negate the applicant’s need for a variance.
Mr. Santisteban requested that if the legislation is approved, could he keep the turf. Mr. Miller
responded that the condition for approval would be the removal of the turf. Mr. Guerra asked if
there were a way that the Board could approve the request in such a way that the turf could
remain. Mr. Martos responded that the request before the Board is only a recommendation. The
Commission could agree with that recommendation or make changes to the conditions. Mr.
Martos then stated that it is a strong possibility that the legislation could be in place by the time
the swimming pool permit is pulled.

condition that if the impervious coverage ordinance is not modified, the turf would need to be

Mr. Basu asked Staff what the lot coverage would be on a typical lot in the RS-3 zoning district. Mr.
Lightfoot responded that a typical 10,000 square foot lot with a one-story home would have a
maximum lot coverage of 30% and a maximum impervious coverage of 40%. Mr. Basu then
responded that 45% impervious coverage is still on the low side. Mr. Guerra responded that different
types of pervious materials that could be used should be included in the discussion. Mr. Basu stated
that with different materials comes different types of installations that could factor into its
permeability. The Board then held a brief discussion on the topic of impervious coverage.
Mr. Basu requested an update on the Downtown Study, to which Mr. Flores provided an update.
Mr. Lightfoot thanked Ms. Dodard for the time that she served on the Board.
The Chairperson closed the floor for public comments and any new business.

Will hold a public hearing on the following zoning applications
on July 26, 2023, at 6:30p.m. at South Dade Regional

THIS IS AN IN-PERSON MEETING
APPLICANT: SAN SEBASTIAN LUXURY HOMES, LLC. 22022000322
The application is to rezone the subject property from RU-1 (minimum of 7,500
square foot lots) to RU-3M (multi-family residential, maximum 12 .9-units per
acre) which will allow the property to be developed with more residential
units than currently permitted. Additionally, the application seeks to allow the
deletion of a prior declaration of restrictions that tied the subject property to a
site plan, in order to be able to build under the proposed zoning district.

District to RU-3M, Minimum Apartment House District.
(2) DELETION of a Declaration of Restrictions recorded in Official Records
