AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, AMENDING
ARTICLE IV, "OTHER REGULATIONS," SECTION 20-4.3,
"SIGN REGULATIONS," OF THE CITY'S LAND
DEVELOPMENT CODE, TO MODIFY THE
REGULATIONS FOR TEMPORARY SIGNS AND TO
PROVIDE FOR TEMPORARY CONSTRUCTION FENCE
SIGNS FOR ALL ZONING DISTRICTS EXCEPT RS-
SINGLE FAMILY RESIDENTIAL DISTRICTS, RT-
TOWNHOUSE DISTRICTS, AND RM-MULTI-FAMILY
RESIDENTIAL DISTRICTS; PROVIDING FOR
CORRECTIONS; SEVERABILITY; CONFLICTS;
IMPLEMENTATION; AND AN EFFECTIVE DATE.
WHEREAS, the City of South Miami (the "City") has adopted a Land Development Code
to promote the health, safety, community acceptable standard of morals and general welfare of the
residents of the City of South Miami through the stated regulations of this Code; and
WHEREAS, Section 20-4.3, "Sign regulations," of the Land Development Code currently
imposes regulations affecting the design, erection, and maintenance of signs for the purpose of
ensuring equitable means of graphic communication, while maintaining a harmonious and
aesthetically pleasing visual environment within the City; and
WHEREAS, the City Commission finds it periodically necessary to amend the Land
Development Code in order to update regulations and procedures to implement planning goals and
objectives; and
WHEREAS, the City Commission finds that temporary construction fence signs can
enhance the aesthetics of the community during construction of a project; and
WHEREAS, the City Commission finds that temporary signs, defined in Section 20-
4.3(B) as "lightweight fabric or similar material that is mounted to a pole or a building at two or
more edges," are only permitted in commercial zoning districts, but can negatively impact the
aesthetics of the community when permitted to proliferate or be overused; and

WHEREAS, the City Commission desires to amend the Code to create a definition for
temporary construction fence signs and to permit such signs in the RO-Residential Office Districts
and All Other Zoning Districts; and
WHEREAS, the City Commission further desires to limit temporary signs in all zoning
districts except RS-Single Family Residential Districts , RT-Townhouse Districts , and RM-Multi-
Family Residential Districts to limit their use to promote new businesses and special events only
and to limit their duration for those purposes; and
WHEREAS, on March 14, 2023, the Planning Board, sitting in its capacity as the Local
Planning Agency, reviewed this Ordinance and recommended approval with amendments ; and
WHEREAS, this Ordinance was duly noticed and presented to the City Commission in
two readings, with second reading conducted as the required public hearing on April 4 , 2023; and
WHEREAS, the City Commission finds that this Ordinance is in the best interest and
welfare of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: I
Section 1. Recitals. The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2. Amending Article IV, Section 20-4.3 of the Code. That Section 20-4.3,
"Sign regulations," of Article IV of the City of South Miami Land Development Code is hereby
amended to read as follows:

(B) Applicability and Definitions.

Sign, temporary construction fence, shall mean a vinyl. nylon, or other durable opaque material
screening an approved and permitted construction fence containing a combination of graphics
and text. Graphics shall be designed to enhance the aesthetics of the fence and to identify the
project to be constructed. Graphics may cover the entirety of a construction fence area. Text
shall be limited to no more than 50% of the total area of the construction fence and shall be
limited to the name of the project. developer, general contractor, and architect, project contact
information, anticipated completion date, and any text related to the project and marketing of the
project. The sign shall be securely affixed to the fence and maintained in good repair at all times.

Section 4. Severabilitv. If any secti o n, clause, se nt e nce, or phra se of this Ordinance
is for any reason held in va lid or uncon st itutional by a co urt of competent jurisdiction, the holding
s hall not affect the va lidi ty of the re mainin g p ort ions of thi s Ordinance.
Section 5. Conflicts. That all ordinances or parts of ordinances, r eso lu t ion s or parts
of reso lution s , in conflict he rcw ith , arc repea le d to the extent of s uc h co nfli ct.
Section 6. Implementation. The C ity Manager is h e reby a uth o ri zed to take any and
all nec essa r y action to implemen t the purposes of thi s Ordinance. Any tem porary s ign pe nnit that
was previo us ly iss ued s hall be allowed to rema in through it s current exp ir atio n date and s hall not
be extended.
Section 7 . Effective Date. This Ord in a nce sha ll become effe ctiv e immediately upon
adoption.

Pursuant to the request of Commissioner liebman, the above referenced ordinance is submitted for
consideration by the Mayor and City Commission for approval of the proposed Ordinance amending
certain sign regulations.
BACKGROUND:
The LDC contains regulations for Temporary and Permanent Signs. The proposed ordinance revises and
enhances the language pertaining to Temporary Construction Fence Signs, Temporary Signs for a New
Business, and Temporary Signs for an Existing Business in the Residential Office (RO) Zoning District, and
all zoning districts. Temporary Construction Fence Signs would not be allowed in Single Family Residential
(SR) Districts, Townhouse (RT) Districts, or Multi-Family Residential (RM) Districts.
The ordinance changes the scheme for temporary signs to allow banners only in connection with new
businesses (through construction and first 30 days) and for special events (allows them for 10 days,
maximum twice per year). The ordinance also allows for temporary construction fence signage and
provides for regulations.
ANALYSIS:
The proposed modifications to the LDC are contained in the attached Draft Ordinance as follows:

On March 14, 2023, the Planning Board held a Public Hearing and voted seven (7) to zero (0) to
recommend Approval of the item with revisions to the City Commission.
On March 21, 2023, the City Commission held the First Reading of the proposed Ordinance and voted five
(5) to zero (0) to approve the item on First Reading and schedule the item for Second Reading.
RECOMMENDATION:
It is recommended that the City Commission Adopt on Second Reading the proposed Ordinance amending
Article IV, "Other Regulations," Section 20-4.3, "Sign Regulations," of the city's land Development Code,
to modify the regulations for Temporary Signs and to provide for Temporary Construction Fence Signs for
all zoning districts except RS-Single Family Residential Districts, RT-Townhouse Districts, and RM-Multi-
Family Residential Districts changing the requirements for temporary signs and allowing for Temporary
Construction Fence Signage.
