EXCERPTED: MINUTES Planning Board June 27,1989 Sylva Martin Building Tuesday, 7:30 PM PB-89-013 Applicant: Lee Park Apartments, Inc. Request: Variance from Section 8-6-2 .01 of the Zoning Ordinance to allow a nine foot fence where six foot is permitted. Location: 6110 SW 68 Street Legal: University Gardens Sub. No. 2 PB 93/3 Tracts A & B Representative L. Beatty for Mrs. Jean Larkin, applicant, signed in and stated reasons for this request. The area which would be affected by the proposed fence is known for narcotic traffic. It is hoped that more fencing would deter this problem to some extent. The proposed change would be to add an additional three feet of concrete block to the existing three foot block fence (replacing the present three feet of wrought iron fencing atop the three foot concrete fence) , adding three feet of chain link fence making a total fence height of nine feet. Staff recommendation: Current Zoning Code does not allow for a "hardship" variance in this instance. Therefore, staff recommends a denial of this application. Chairman Cooper asked Mr. Mackey if this particular problem has been presented to the Safe Neighborhoods Advisory Board for consideration and was advised that it had not. Mr. Cooper felt that the SNAB would be interested in this matter and asked staff to proceed accordingly. Mr. Gutierrez suggested that the applicants consider deleting the top three feet of chain link fencing and adding something which would keep people from sitting on top of the fence. In this way, a variance would not be required. A six foot fence is allowed under Code. Motion to deny: 5-2. PB Minutes 6-27-89 r 2 The City Commission expects specific recommendations which could include physical improvements and law enforcement or other programs or a combination of all these items. Your consideration on this matter at the regular August 14, 1989, meeting of the Safe Neighborhoods Advisory Board would be greatly appreciated. We feel that we have substantial reasons to request to make the above adjustments. Reasons are as follows: 1) Drug transactions being conducted across existing wall. 2) Loitering on inside of wall, which is private property. 3) Cost of repairs to existing wall and wrought iron rail due.to climbing on and over. 4) Use of private parking as Marshall Williamson Park's parking lot. 5) Cost of employment and upkeep to rid ground of litter strewn throughout the area. 6) Cars are stolen and vandalized. 7) Trees in the area are being used as storage places for drugs. Once again, due to the hardship it causes the Co-op and the cost to repair and upkeep after misuse, we ask that you take full consideration and give it your undivided attention in the matter of granting this request.
