Change of Zone Classification from C-1 to C-2
Gentlemen:
As attorney for the applicant, JOHN T. PARKER, I wish
to amend our application to drop the variance to per-
mit an existing building to be used as a coin laundry,
as the proposed tenant no longer desires to use the
building.
We are proceeding with our application inasmuch as this
building has not been rented since September of 1966,
other than an occasional storage operation at a figure
that did not, even cover the expenses of the building.
Economically� Mr. Parker is being deprived of the use of
his property as he cannot get a C-1 tenant. He has had
offers to lease it for a lawn mower shop, which is C-2,
a coin laundry, which is C-2, an indoor machine shop
operation, which would be C-2 , and has spent over $160
in advertising with the Herald and the Guide, and has
not had a C-1 taker.
It is economically confiscatory to allow Mr. Parker to
use his property in a use which is compatible to the area
and to the development of the area. Mr. Parker, in effect,
is being deprived of his right to use and rent his proper-
ty because of the changes in the area. For this reason we
feel that the change of zoning from C-1 to C-2 would be
justifiable.

I would also like to point out that Mr. Parker could
certainly never use this property as a service station
as (1) the property is too small, and (2) the exist-
ing building is not intended nor could it be used for
this type operation.
I trust you will give this matter consideration and
afford this tax payer and property owner relief.

Procedure on Application for Hearing Before the Planning Board
1, Secure application forms from the Zoning Director's Office,
2, Have sketch, or plans with sufficient •details indicating the variances or exceptions
requested. For change of zoning, plans may not be required, . .The applicant is
instructed that a separate application will be required for variances and exceptions
after the change of zoning has been granted by Council,
3. Fill out the application completely and accurately with surveys, photos, plans, etc,
as needed before submitting to the Zoning Director.
4. • 'Submit the application to the Zoning Director at least fourteen (14) days prior to
the meeting: 'A fee of $30.00 is required at the time the application is filed.
5. Regular Planning Board meetings are held twice per month, on Tuesday preceding the
regular Council Meeting, (Council meets on the first and third Tuesday of each
month). The meetings are held in the Council Chambers, City Hall and begin at
8:00 o'clock P.M.
6, The applicant (or his agent) should •represent•himself at the Planning Board meeting,
The applicant will be expected to present-his case with plans, petitions, affidavits
or any other data which he feels will help in his presentation. The Planning
t Board will act on the application based on the information available if no one is
present to speak on behalf of the applicant,
7, The Planning Board will make its recommendations to the Council which will then
act on them.
8. The applicant should be present at the Council Meeting to present his case at which
time the Council will pass a resolution or ordinance, approving or denying the
request made by the applicant,
9. A change of zoning requires that a resolution be adopted by Council. This becomes
effective immediately if adopted. A variance or exception requires an ordinance be
adopted by Council. This becomes effective after Council has taken action at two
consequent meetings. The ordinance becomes effective upon adoption after third
reading,
10. This procedure takes approximately thirty(30) days from the filing of an
application,
