A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, APPROVING THE
WAIVER OF ALL EVENT-RELATED FEES AND COSTS
PURSUANT TO SECTION lSB-6 OF THE CITY CODE FOR
A SPECIAL EVENT KNOWN AS THE "JUNETEENTH
CELEBRATION" PRESENTED BY SOUTH MIAMI BLACK
CULTURAL AFFAIRS FOUNDATION, INC., TO BE HELD
ON SATURDAY, JUNE 17, 2023, AT MURRAY PARK;
PROVIDING FOR APPLICABILITY OF OTHER CODE
REQUIREMENTS, IMPLEMENTATION, CORRECTIONS,
SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, the South Miami Black Cultural Affairs Foundation, Inc. ("the
Applicant"), a not-for-profit corporation, has requested to host its annual Juneteenth
Celebration ("the Event") on Saturday, June 17, 2023, from 11 :00 a.m. to 6:00 p.m. at Murray
Park; and
WHEREAS, the application for the Event is under review and subject to approval by the
City Manager pursuant to Section 15B-6 of the City Code; and
WHEREAS, provided the application for the Event is approved, the Applicant is
requesting a full fee waiver in the amount of $2,489 for the following City services:

WHEREAS, upon approval of this Event, the Applicant and its vendors must provide the
City with the required Certificate of Liability Insurance that complies with the City's standard
insurance requirements, including naming the City of South Miami as an additional insured prior
to the Event; and
WHEREAS, the City Commission wishes to support the Event by waiving the special
event-related fees and costs as set forth herein and finds that such waiver is in the best interests of
the City.

Section 6. Severability. If a n y section , c lause, sen tence, o r phrase of t hi s R esolu t ion
is fo r a n y reason h e ld invalid or uncon stitutiona l b y a court of compete n t ju ri sd iction, t he ho lding
s ha ll not affect the validi ty of t he re maining porti o ns of this R eso luti on.

SUBJECT: The South Miami Black Cultural Affairs Foundationrequeststo host a Juneteenth
Celebration event and to waive fees.
RECOMMENDATION:Staff recommends the approval of the subject item.
A better, more defined policy regarding the waiver of fees is currently
being prepared and discussed by staff, which may possibly result in a
future recommendation of fee waiver denial; however, in the interim, said
recommendation is being made for consistency purposes with past events.
BACKGROUND:In observance of Juneteenth, the South Miami Black Cultural Affairs
Foundation, Inc. (‘the applicant’), a not-for-profit corporation, has
requested to host its annual Juneteenth Celebration (“the Celebration”) on
Saturday, June 17, 2023, from 11:00 a.m. to 6:00 p.m. at Murray Park.
Historically, the City has waived all fees for this event.
The Celebration is a free public event that will consists of live music,
community speakers, and performances. According to the applicant, there
will be tents on the perimeter of the main multipurpose field showcasing
arts & crafts vendors, food vendors, and other special exhibits/vendors.
As done in previous years, parks and recreation staff will be on-site for
monitoring and general maintenance. Additionally, based on the
anticipated attendance—200 to 300 persons per the applicant—police
officers will be required to be on-site during the duration of the event.
Upon approval of this event, the applicant must provide the City with the
required Certificate of Liability Insurance that complies with the City’s
standard insurance requirements, including naming the City of South
Miami as an additional insured prior to the event.
