A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, DIRECTING THE
CITY MANAGER TO REALLOCATE $65,000 WITHIN THE
CAPITAL IMPROVEMENT PROGRAM FUND, LINE ITEM
301-1790-519-6450, FROM THE "DANTE FASCELL ART IN
THE PARK-SCULPTURE INSTALLATIONS", WITH AN
UNSPENT BALANCE OF $100,000, TO A NEW CATEGORY,
"SOUTH MIAMI PARK IMPROVEMENTS"; PROVIDING
FOR IMPLEMENTATION; CORRECTIONS,
SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, the City of South Miami's (the "City's") adopted Budget for FY 2022/23
includes a Capital Improvement Program (CIP) Fund with Line Item 301-1790-519-6450,
providing for various categories for CIP improvement projects; and
WHEREAS, the CIP Fund includes Line Item 301-1790-519-6450, which provides
various categories for CIP improvements, including a category for "Dante Fascell Art in the Park
-Sculpture Installations" in the amount of $100,000, which amount has been unspent for
this fiscal year; and
WHEREAS, the City Commission wishes to direct the City Manager to reallocate $65,000
within the CIP Fund, Line Item 301-1790-519-6450, from the existing "Dante Fascell Art in the
Park-Sculpture Installation", which has an unspent balance of$ I 00,000, to a new category "South
Miami Park Improvements", as follows:

WHEREAS, a portion of the unspent funds for "Dante Fascell Park -Sculpture
Installations", should be reallocated for improvements to "South Miami Park Improvements"
identified as necessary in this fiscal year; and
WHEREAS, the City Commission finds that directing the City Manager to re-allocate
$65,000 within the Capital Improvement Program Fund, Line Item 301-1790-519-6450, from the
"Dante Fascell Art in the Park -Sculpture Installations", to a new category, "South Miami Park
Improvements", results in a reallocation within the same CIP Fund and Line Item and does not
change or increase the appropriation or budgeted amount for the CIP Fund; and
WHEREAS, the City Commission finds that this Resolution is in the best interest and
welfare of the City and its residents.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. The foregoing recitals are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution upon adoption
hereof.
Section 2. Directing City Manager to Reallocate Funds within the CIP Fund and
Line Item 301-1790-519-6450. The City Manager is hereby directed to re-allocate $65,000 within
the Capital Improvement Program Fund, Line Item 30 l-1790-519-6450, from the "Dante Fascell
Art in the Park -Sculpture Installations", which has an unspent balance of $100,000, to a new
category, "South Miami Park Improvements", as provided for in detail herein above.
Section 3. Implementation. The City Manager is hereby authorized to take any and
all necessary action to implement the purposes of this Resolution.
Section 4. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.
Section 5. Severability. f any section, clause, sentence, or phrase of this Resolution
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this Resolution.
