Clifford Parker, who owns a CBS building at 5949 SW 68th St, to rent his building, The building is now a grocery store and the zoning is Bu-2 . } x . I wish to open a publishing business in the# same location at which I would publish and print a weekly newspaper for Sputh Miami , and also do some commercial printing. The law is not very specific , apparently, although in the Miami code it specifies that Bu-2 allows printing establishments. I have spoken with' the buildinging commissioner, Mr, Green, and the city clerk , and they -seem to be of the opinion that Bu--2 would allow a printing business, However , they said it was up to the zoning board, I urgently request that you consider this and allow me to establish this business trere. MINUTES OF A REGULAR MEETING OF THE SOUTH MI MI ADVISORY ZONING AND PLAN- NING BOARD HELD ON DECEMBER 21st, 1956 AT THE SOUTH MIAMI CITY HALL, AT 3:00 Fe M. Present: William E. Adams, Chairman R. Go Garber Thomas To Foster Marion M. Byers Ex Officio: Sylva Go Martine, City Clerk Jo L. Greene, Building Inspector Absent: H. Long William A. Daniel R. L. Overman Chairman Adams called the meeting to order at 3:00 P. H. The first item of business taken under consideration was the approval of the minutes of the regular meeting of December 7th, 1956, . Mr. Foster: I move that the minutes of the meeting of December 7th be adopted as individually read, ' Mrs. Byers: I second that. Motion carried. The next item taken under consideration was the matter of Herbert S. Pablo, Jr, , request for side set-back variance to permit addition to his hone at 7320 SW 58th Avenue. Mr. Pablo came forward and dis- cussed this matter with the members of the Zoning Board, The next item taken under consideration was hearing on Steve Hessen Construction Company, Incorporated to rezone the E. 330 ft, of Sk of NEk of NA of NFA, less E. 35 ft. and So 25 ft. for RIW, Sec, 35-54-40 to provide six homesites, Chairman Adam turned over the gavel to Ira Foster, who took the presiding seat in this smatter, Mr. George Brewer addressed the Board in behalf of the Hessen Construction Company. A petition of some 53 names was presented in opposition to this proposal. Mr, Thomas W. Johnson of 6750 SW 74th Street stated that he was in objection to this proposal. He stated that he was spokesman for the group that had signed the petition and that he stood behind the objections. Rev, Roy A. Johnston, minister for the University Christian Church, was present and he stated that it was the first time that his group had heard of this proposed rezoning. Mr, C. R. Shepard of 6795 SW 74th Street spoke against the proposal. Mr. Vernon Galloway spoke against the proposed rezoning. Much dis- cussion was held and at 9:15 P.M. a five minute recess was held with the Hoard reconvening for further business that might be- brought before it. The next items taken under consideration was application of Mary Opsahl and Orange State Oil Company for variance to permit service (1) i station on Lots 8 to 16 POINCIANA Pte, PB 41-41, This was a .matter"for a public hewing and the Chairman called for an area of notification, Mr.' Foster: I will move that on the application of Mary Opsahl and Orange State Oil Company for variance to permit a service station since the Board is in receipt Of an application for a public hearing that the public hearing be set up by the City Clerk, giving an area of notification of six hundred feet and the date to be set by the City Clerk. Firs, Byers: I second that. Motion carried, The next item taken under consideration was A. G. Gresham re- quest for pewit for "special use01 of portion of Tract A, SO€3THGATE CENTRES PB 51. 62 for storage of necked and dismantled vehicles, Mr. Gresham addressed the Board in his own behalf. Mr. Gresham cited his need for more space to store these wrecked automobiles. A copy of a sales agreement was presented to the Board, Mr. Pullman sent a wire stating his objection to this proposal. Mr. Brewer arose and stated that the people in the area should be consulted in this matter as certain comitments were made to them. The next item taken under consideration was at the request of Inspector Greene on the matter of Edgar F. Seney, Jr. re print shop on Clifford Parker property, 5949 SW 68th Street, hots 16, 178 Block 7, TOWNSITE OF LARKINS, PB 2-105. Mr. Seney addressed the Board in his own behalf. Inspector Green's request was for the Board's interpretation and clarification as to classification for a printing shop. The next item taken under consideration was the matter of the William Segal properties, (Lots 18 2, Blk 3 WESTERFIELD MANOR, for parking lot,) which was again referred to the Board from the City . Council, It was stated that this gutter would be discussed further in executive session. The next item taken under consideration was revised plat of proposed TEDON HCHESITES, (Wk ®. Wk- &-NEk, less No 6 acres,35-54=40) , Pairs, Byers: I would like to wove that we accept the revised tentative plat dated December 8, 19568 of the proposed. TEDON HOME- SITES ® e and also the variance on lot 4, on which there is a resi- dence. Mr, Foster: I will second than Lotion carried., The Board then went into executive session, after a short recess.. STEVE HESSEN CONSTRUCTION COMPANY: (E.330 ft of S 2-M-NEk-NEk less E.35 ft and S. 25 ft for R/W, 35054®40) 2k acres, Mr. Foster: I will move that on the application of Steve Hessen Construction Company to rezone to permit six homesites, that the Zoning Board finds no case of hardship in this application either by the applicant or the present owner;)2) that the surrounding neighbors R were almost unanimous in their sound arguments against the degrading of their property by such a proposed change and that the property can be very easily developed in accordance with the present ED-1 zoning. Mrs a; Byers- I will second that. Mr. Foster - and that therefore the application be denied, Mrs. Byers- Second. Lotion carried, WILL 'I SEGAL PROPERTIES- (Lots 18 2 Blk 3 WESTERFIELD MANOR FB 18-47) Mr. Foster: I move that the request for the William Segal properties relative to use of Lots I and 2.. Block 3, WESTERFIELD FOR for parking lot ®- that the Council be informed that when this matter first came before the Zoning Board it eras tabled for further informa- tion from the applicant. At the next regular meeting again there was no representative of the applicant at the meeting, however, a second letter reiterating the first was received. Since these are two lots in a block that is more than half in the County, and that the entire block to the west is County area, to the South is in the County, the - Zoning Board felt that the County Zoning Board's opinion in this . matter should cagy sonie importance. Our Zoning Board is in receipt of a letter from the Diode County Zoning Board dated December 18th, 1956 where they state they believe that the proposed use would be a definite conflict with the balance of this area. It is the . opinion of the Zonini, Board of South Miami that these two lots should remain for re3idegntiab use. Mr. Garber- Se=d. Mr. Foster- ;take Zoning Board further feels that if this property were used as a cafinercial parking lot that before a variance could be granted a public hearing would in fairness to the adjoining residents be required. Mr, Garber- I second the end of it. Motion carried. HERBERT S. PABLQ JR. request for side set-back variance to a mit addition to his home at 7320 S. W, 58th Ave. (S. 110® of No 20' of E-SW-NE®NE, 36-54-40)- Discussion centered on (1) whether or not it would be a hardship to require conformance with the Code, and (2) interpretation of the code re 10% lot- width as minimum side set-back on each side vs. minimum 7.5 on one site and total balance -on other. This was to be checked with Attorney Proby. Mro Foster- I aras going .to move that the application of Herbert S, Pablo, Jro be tabled until the next regular meeting of the Zoning Board and that the pertinent information be turned over to Mr. Greene for study. Mrs. Byers- I second that. Motion carried. A. G. GRESHAM, request for permit for B°special uses® of portion of Tr, A SOUTHGATE CENTRE for storage of wrecked and dismantled vehicles (area south of So Dade Gas & Tic Polka Inc. Mr. Foster- I will move on the matter of A. G. Gresham request for permit for special use m- that Mr. Gresham be advised that the- (3) i 4 Zoning Board feels that a ublic hearing is warranted in this case and that if he so desires. ge may submit an application for a public hearing and that the City Clerk will set a date; that the area of notification be Blocks 4, 59 6, and 9 of OAK HEIGHTS, Tracts A and Tract B of SOUTHGATE CEMR and the acreage west of Tract A north of Davis Road and southeast of Dixie Highway. (Lots 16,17,, Blk 7 TOWNSITE INS, 5949 S.Wa68th St,) Mrs. Byers: On the request of Edgar Seney, Jr, , to establish a publishing business at 5949 Southwest" 68th Street, that within the interpretation of the Zoning Board this is allowable wader the C-2 Code of the Ordinance and the Board hereby recommends that he be granted permission to establish said publishing business,, subject to off-street parking limitations set up by the Zoning Ordinance.
