PROJECTS; PROVIDING FOR CORRECTIONS; SEVERABILITY;
CONFLICTS; AND AN EFFECTIVE DATE.
WHEREAS, on September 21, 2022, the City of South Miami (the "City") adopted
Ordinance No. 24-22-2445, approving the Adopted Budget for the Fiscal Year 2022-2023 (the
"Budget"); and
WHEREAS, the Budget did not allocate funds from the Parks & Recreation Facilities
Impact Fee Fund or the Stormwater Drain Trust Fund for certain capital improvement projects;
and
WHEREAS, upon the periodic review of current budgetary commitments and obligations
based upon the projected needs of the City, and upon the recommendations of the City Manager,
it is deemed necessary to appropriate unrestricted, unreserved funds from the Parks & Recreation
Facilities Impact Fee Fund and the Stormwater Drain Trust Fund for projects previously allocated
to the American Rescue Plan Act (ARPA); and
WHEREAS, the City desires to appropriate unrestricted, unreserved funds from the Parks
and Recreation Facilities Impact Fee Fund and allocate such funds to expenditure line item 117-
2000-572-6440 Capital Improvement in the amount of$470,000; and
WHEREAS, the City further desires to appropriate unrestricted, unreserved funds from
the Stormwater Drain Trust Fund and allocate such funds to expenditure line item 111-1730-541-
6490 Construction Projects in the amount of $360,000; and
WHEREAS, the Mayor and City Commission held its first public hearing on February 21,
2023, and, having complied with the notice requirements in the Florida Statutes, approved the
proposed budget amendments on first reading; and
WHEREAS, on March 7, 2023, the Mayor and City Commission conducted a second duly
noticed public hearing as required by law and approved the proposed budget amendments on
second reading.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Recitals. T he above-stated recitals are true and correct and are incorporated
herein by thi s reference.
Section 2. Amending Ordinance No. 24-22-2445. The C ity Commission hereby amends
Ordinance No. 24-22-2445 and approves the Budget amendment and authorizes the (1)
appropriation of unre stricted, unreserved funds in t he amount of $470,000 fro m the Parks and
Recreation Faci lities Impact Fee Fund and allocation of such fund s to expenditure line item l l 7-
2000-5 72-6440 Capital Improvement, and (2) appropriation of unrestricted, unreserved funds in
the amount of $360,000 from the Stormwater Drain Trust Fund and allocation of such funds to
expenditure line item l l l-1730-541-6490 Construction Projects.
Section 3. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conform in g amendments to be incorporated into the
final Ordinance for signature.
Section 4. Severability. If any section , clause, sentence, or phrase of this Ordinance is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
s hall not affect the validity of the remaining portions of this Ordinance.
Section 5. Conflicts. That all ordinances or parts of o rdinances, resolutions or parts of
resolution s , in conflict herew ith, are repealed to the extent of such conflict.
Section 6. Effective Date. This Ordinance s hall become effective immediately upon
adoption on second readin g.

BACKGROUND:On September 21st, 2022, the City adopted Ordinance No. 24-22-2445, approving
the Adopted Budget for the fiscal year 2022-2023, including Capital
Improvement, in a total amount of $29,091,857 as generally presented below.

At the time of adoption of the City’s 2022-2023 fiscal year budget, no appropriation amount was
allocated for the use of capital improvement projects, based on the proposed Capital and
Operating Budget,for the Parks & Recreation Facilities Impact Fee Fund or the Stormwater Drain
Trust Fund.
We are proposing an increase in appropriation for both funds mentioned previously, based on
the current balance of those funds, to transfer projects previously allocated to the American
Rescue Plan Act (ARPA). This will be done to free up funds from the ARPA for other projects that
will benefit the City that may not have other available funding sources.
FUNDING:117-2000-572-6440 appropriation to be increased by $470,000

The Parks and Recreation Facilities Impact Fee Fund was established with the adoption of
Ordinance 14-14-2192. As a condition of the issuance of a building permit for new development,
the person, firm or corporation who or which has applied for the building permit for residential
construction shall pay to the City, the parks impact fees as set forth in the provisions of the
Ordinance.
There is assessed, charged, imposed, and enacted parks impact fees on all new residential
development occurring within the municipal boundaries of the City of South Miami. These fees
are assessed, charged, or imposed in accordance with the fee schedule provided below and may
be amended from time to time by the City's Fee Schedule ordinance based upon the most recent
and localized data.
The impact fees are paid to the City at the time of the issuance of the building permit.
All such fees collected, and any interest earned on them, shall be deposited into a special and
separate trust account to be designated, "parks and recreation facilities impact fees account"
other than the allowable administrative cost for collection. Funds from this account may be
expended for:
− land acquisition for parks;
− maintaining (not including routine maintenance), furnishing, equipping, repairing,
remodeling, or enlarging of both existing and future facilities;
− construction of new parks facilities;
− any architectural, engineering, legal and other professional fees and expenses related to
any such improvements; and
− any administrative costs not incurred by the fee collection process
− retirement of loans and/or bonds that may be, or have been, issued to finance the capital
improvements contemplated in the Ordinance.
The City of South Miami's Finance Director shall keep an accurate accounting and reporting of
impact fee collections and expenditures within the City. The City shall retain up to 5% of the
impact fees collected to offset the administrative costs of collecting the impact fees (which shall
be limited to the actual collection costs incurred) and the cost of administering the provisions of
this Ordinance.

STORMWATER DRAIN TRUST FUND BACKGROUND
On September 19, 2000, the City of South Miami Commission adopted Ordinance 21-00-1723
providing for the creation of a City of South Miami Stormwater Utility. In 1987, the United States
Congress amended the Clean Water Act to require the Environmental Protection Agency to
develop regulations for the permitting of stormwater discharges into the waters of the United
States of America. In addition, under the provisions of the “Florida Air and Water Pollution
Control Act,” (Chapter 403, Florida Statutes, at section 403.0891), local governments are required
to develop stormwater management programs.
As provided in the City of South Miami Ordinance and in accordance with a transfer approved by
the County, the City took operational control over the stormwater utility function within the
City’s boundaries. As such, the stormwater related revenues paid by the City of South Miami
residents on their County water bill will flow through to the City, after deduction of County
administrative costs, and be used to pay the expenses to carry out the stormwater related
activities.
STORMWATER FEES
The stormwater user fees were previously assessed through the water billing system managed by
the Miami-Dade County Water and Sewer Department (WASD). Customers with private water
wells and septic tanks were billed directly by the City of South Miami Finance Department. Now
stormwater user fees are collected as part of the property tax bill for all residents.
To determine the amount of runoff that will be generated (as measured by impervious
surfaces) an “ERU” (Equivalent Runoff Unit) is calculated. The ERU (Equivalent Residential Usage
Unit) is the estimated average of impervious area of developed residential properties for each
dwelling unit within the City of South Miami. The estimated average is calculated by dividing the
total estimated impervious area of developed residential properties by the estimated total
number of dwelling units. The square foot estimated average of impervious area of developed
residential properties shall be one (1) ERU for the purposes of fee calculation. In the City of South
Miami, an ERU was calculated to equal 1,865 square feet. Each single-family homeowner will
pay the cost for one (1) ERU. All other types of properties will pay for multiple ERUs based
upon the amount of their actual impervious area. Undeveloped property will pay no
stormwater utility fee until the land is developed. Ordinance 10-02-1778 set the ERU at $4.50
per month.

The money collected by South Miami from the Stormwater Utility Fee goes into a separate
Stormwater Drain Trust Fund for maintenance of existing catch basins, stormwater drains and
canal system and future construction of new facilities as may be recommended upon the
development of the Stormwater Master Plan.

An Ordinance of the City of South Miami ("City"), located in Miami-
Dade County, Florida, approving a proposed budget for the City for
the fiscal year commencing October 1, 2022, through September 30,
2023, including the salaries and expenses of the City's officers, and
which budgeted amount may be amended at the f"ust or second
reading of this Ordinance, and approving and enacting the final
budget on second reading.
WHEREAS, the City Manager has submitted a proposed Capital and
Operating Budget together with a budget message and supporting schedule in
accordance with the provisions of the City's Charter; and
WHEREAS, the positions flowchart included within each Department
budget enumerates all authorized budgeted employee positions for appointment
by the City Manager. All personnel filling said authorized positions shall be paid
pursuant to the City's Budget, Personnel Policies and/ or collective bargaining
agreements; and
WHEREAS, pursuant to Chapter 200, Florida Statutes, the Mayor and City
Commission are required to adopt a tentative budget, and, thereafter, a final
budget for the City prior to the commencement of each fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. The foregoing recitals are hereby ratified and confirmed as
being true and correct and are made a part hereof by reference as if set forth
herein.
Section 2. The Budget for the fiscal year, as submitted by the City
Manager and as filed in the City Clerk's Office, in an amount of $29,141,857, is
hereby approved, as summarized by fund below:

Section 3. Any amount encumbered during Fiscal Year 2021-2022, but
paid in Fiscal Year 2022-2023, shall be transferred in accordance with GAAP
and reflected in the Fiscal Year 2022-2023 as an expense.
Section 4. Any money received by the City of South Miami from any non-
revenue generating source, such as a grant, gift or donation, whether from any
person or governmental agency, may be added to any line item or items in the
adopted budget without legislative action, provided, however, that if the gifting
person or agency places any condition on the use of said money, the money shall
only be disbursed and/ or applied toward the purposes for which the money was
given. All monies received under a condition regarding its use or expenditure
shall be segregated and accounted for based upon generally accepted accounting
principles and, where appropriate, placed into separate and individual trust
and/or escrow accounts. Any money drawn from those accounts may only be
disbursed and/or applied in accordance with the limitations placed upon those
monies by the gifting person or agency.
Section 5. The salaries and expenses of the City Officers, as reflected in
the attached budget, all of which is in accordance with the budget summary
found in Section 1 of this ordinance, are hereby approved and adopted as part
of this ordinance. The attached Budget is made a part hereof by reference as if
fully set forth herein.
Section 6. Corrections. Conforming language or technical scrivener-
type corrections may be made by the City Attorney for any conforming
amendments to be incorporated into the final ordinance for signature.

But the park’s natural
ecosystem has been under
assault.For the last two
years,volunteers have
spent weekends clearing
many of the park’s numer-
ous walking paths and
playgrounds of invasive
plants such as arrowhead
and air potato.With only
one full-time employee,
the park has had to rely on
plant lovers much of the
maintenance and eradica-
tion of the invaders.
Lola Heasley has been
working in the park for
over 26 years.The En-
chanted Forest’s manager
and naturalist has dedicat-
ed her life to the preserva-
tion and management of
the NE 135th Street facil-
ity.She is currently the
only full-time employee at
the park,where she runs
educational programs and
oversees the removal of
invasive plants.
“When you get these
invasive plants that come
in,they displace the na-
tives,and they choke
everything out,”said
Heasley.“And they dis-
place the animals that are
used to living there be-
cause they kind of crowd
them out and take their
food source.”
According to a study by
the University of Florida,
the state currently has tens
of thousands non-native
plant species and ranks at
number four in the nation
among areas most at risk
due to invasive species.
“Invasive plants are one
of the main causes of ex-
tinction for native plants
and animals,”said Heas-
ley.
One such species is the
dioscorea bulbifera,more
commonly referred to as
an air potato.Originating
in Asia and Africa,the
plant was introduced to
Florida over 100 years ago
for medicinal purposes
after seeds were leaked
from a lab.Since then,it
has spread rapidly
throughout the state.The
plant grows up to eight
inches a day and thrives in
warm climates.
Enchanted Forest Park
today is filled with air
potatoes.The exotic vine
produces heart-shaped
leaves that wrap around
the native plants and
weigh them down.Then it
produces potato-shaped
balls that eventually fall to
the ground sprouting more
leafy vines.
“So even though it goes
dormant in the winter,and
the potatoes are easy to
pick up,it will completely
consume the park over the
summer and everything
will be covered in air pota-
toes,”said Heasley.
Then there is the arrow-
head plant,also called
syngonium,an invasive
species that is coveted as a
decorative.This common
indoor plant has made its

“If you go to Home
Depot,almost all of the
things that we’re eradicat-
ing,they actually sell
there for people to plant in
their yards,”said Heasley.
“If developers had to use
at least 75%native plants,
the world would be a bet-
ter place.”
Arrowhead can be terrif-
ic house plants as the
bright leaves add color to
indoor spaces,and make
for a great natural air
purifier.But out in Flor-
ida’s wilderness,they are
a menacing threat.
“Because even though it
[syngonium]grows very
slowly,it has tendrils that
come out of the side of the
vine,”said Heasley.“You
have to remove all the
tendrils out of the ground.
If you leave pieces of it,
then it can grow back.”
Despite the volunteers’
massive efforts,the park is
in desperate need of daily
eradication,and many
invasive plants,like the
syngonium,must be re-
moved by hand.
This past Super Bowl
Sunday,Burzycki and the
other volunteers showed
up at 9 a.m.to spend their
day pulling out vines,
getting their hands dirty,
and sweating under the
Florida sun.It was a
mixed crowd that includ-
ed families spending the
day together and teenag-
ers looking to connect
with nature.
Heasley and the volun-
teers are hoping for more
funding and grants to
further the eradication
efforts,as well as to edu-
cate the public and get
more volunteers.
They also hope to pre-
serve the butterfly garden,
which they will work on
again on March 25,when
a native plant day festival
will be held at the park.
“I wish people would
pay a little more atten-
tion,”said Burzycki.“I
once saw an art exhibit
that photographs our nat-
ural areas and when I
looked closer,I saw they
were all invasive plants.
Only 10%of the pictures
were actually Florida na-
tive plants.”

At the Herald and el Nuevo Herald,

investigative journalists,two climate
journalists,and a multimedia arts jour-
nalist.Philanthropy also late last year
supported a special project examining
disinformation in local Spanish-lan-

called to a violent domes-
tic dispute at a home in

west 248th Street in Re-
dland,police told the
Herald.
Officers found an in-
jured husband and wife
who said they were at-
tacked with a blunt object
in the home by their son,
police said.He fled after
the assault but was arrest-
ed near the home and
later charged.
The couple was taken to
Jackson Memorial South,
where the wife was in
critical condition after
being airlifted,police said.
