Ord No 29-22-2450ORDINANCE NO. 29-22-2450 An Ordinance amending the City of South Miami Code of Ordinances, Chapter 2, Article III, and repealing Section 2-26. 7 -Commercial development board and amending Section 2-26.10. by converting the Parking Board into the "Hometown Districts Advisory Board." WHEREAS, the City of South Miami is uniquely blessed to have a historic commercial district with South Miami-Dade's best main street and located proximate to a mass transit station; and WHEREAS, the City's downtown area is home to a variety of quality restaurants and small business, the deterioration of Sunset Place has reduced the vitality that was once the hallmark of the Hometown District; and WHEREAS, the City Commission is committed to the renewal of the downtown area and sustained success and wishes to enlist local residents and property & business owners to solicit ideas and marshal resources to revitalize the district; and WHEREAS, the City desires to create an advisory board for these purposes by repealing Section 2-26. 7 and amending Section 2-26.10 of the Code of Ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set forth herein and as the legislative intent of this Ordinance. Section 2. Chapter 2, Article III, Section 2-26.7. -Commercial Development Board is hereby repealed and Section 2-26.10. -Parking Board, of the Code of Ordinances, City of South Miami, Florida, are hereby amended and shall read as follows: Sec. 2-26. 7. Sec. 2-26.10. Downtown District AdvisoryParl~ieg Board. (a) Created. There is hereby created a parking Downtown District Advisory Board for the City's downtown area comprised of the Hometown District Overlay and the Downtown SoMi District. Said board shall consist of seven (7) members. The seven (7) members shall include two (2) commercial landowners, two (2) business owners and/or merchants, and three (3) residents of the City. (b) Appointment and terms of members. Board members shall be appointed in accordance with Article II, Section 8 of the City Charter ey the ma~'OF with the ad 1t'ioe and consent of the eity eommission to two-year terms or until removed theiF s1:1eeessor is appointed. (c) Chair, vice-chair, and staff. The members shall elect the chair and vice-chair of the board. The City Manager or designee shall serve as the executive secretary of this board. (d) Quorum. A quorum shall be four (4) members and an affirmative vote of the majority of the members present shall be required to pass upon any matter the board recommends. The words "members present", for the purposes of this Section, means those members who are physically present as well as those who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending members can see and hear, everyone attending the meeting in person and remotely. (e) Duties. Parking in the City must be developed and managed both as an element of infrastructure critical to enhancing the City's tax base through economic success ofthe City, and as an important amenity enhancing and protecting the quality of life within the City. To that end, the duties of the board shall be as follows: (I) Meet at least once eve~· three (3) months monthly to discharge its work. The board shall report to the eity eomm ission no less than annually on the state of parking in the eity and shall ffom time to time make reeommenaations to the eit)' eommission for the ehanges in the parking S)'Stem, for the fees paid into the parking infFastrueture trust funa, ana fer the alloeation of the trust funa ordinanee (3) Plan and propose to the City Commission public improvements, including but not limited to renovation, remodeling, repair, reconstruction or other changes in existing buildings and streetscapes which in the opinion of the committee would aid economic growth in the area. ( 4) Recommend to the City Commission the acquisition, by purchase or otherwise, of any land and any other property, real or personal, or any rights or interests therein, which it may determine is reasonably necessary for any project or purpose of this Section. (5) Review special event applications in the downtown area and recommend their approval or rejection to the City Manager. (6) Recommend certain activities and related expenditure of City funds to the City commission to promote the downtown area. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final ordinance for signature. Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 5. Codification. The provisions of this ordinance will become and be made a part of the Code of Ordinances of the City of South Miami as amended. Section 6. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding will not affect the validity of the remaining portions of this ordinance.
