Ord No 25-22-2446ORDINANCE NO. 25-22-2446 An Ordinance amending all sections of the City of South Miami Code of Ordinances Chapter 2, Sections 2-2.1, 2-26, 2-26.1 through 2-26.13; Chapter 12, Section 12-43; Chapter 15B, Section 15B-7; and Chapter 16, Sections 16.20 and 16-33 allowing for remote attendance at meetings and providing relevant definitions. WHEREAS the City of South Miami has numerous boards, committees, and task forces (Boards); and WHEREAS it is difficult to find people who have the time to physically attend meetings; and WHEREAS the City has established excellent systems for connecting remote attendance at Board meetings which allows for all members to see and hear, and to be seen and heard, by other members who attended in person or remotely; and WHEREAS some Board member would not be able to attend meetings regularly without having remote access to meetings; and WHEREAS some Board member who are working cannot afford to spend the time driving to and from meetings; and WHEREAS driving to and from meetings contributes to global warming; and WHEREAS the City Commission desires to provide more flexibility for attendance at meetings by amending the sections of the City of South Miami Code of Ordinances that establish Board meeting requirements. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and incorporated by reference as if fully set forth herein and as the legislative intent of this Ordinance. Section 3. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article I, titled "IN GENERAL", Section 2-2.1. -Rules of procedure of City Commission, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-2.1. -Rules of procedure of city commission. The following rules of procedure shall govern all meetings of the city commission, namely: * * * Page 1 of 10 Ord. No. 25-22-2446 (e) Roll call and quorum. Before proceeding with the business of the commission, the city clerk or his deputy shall call the roll of the members and the names of those present shall be entered in the minutes. Four (4) members of the commission shall constitute a quorum whether present physically or through a means of communication that will allow the member to hear the entire proceedings in which he or she participates and to be heard by those in attendance at the meeting. Upon affidavit by the city manager, filed with the city clerk, that an emergency exists which will affect the health, safety or welfare of the citizens of the city, three (3) members shall constitute a quorum for such emergency matters and the meeting shall be limited to only those emergency matters. The minutes of such meeting shall reflect the filing of the affidavit. A quorum for City Commission meetings is four (4) members. Until such time as a court of competent jurisdiction determines that Section 166.041, F .S., does not require the physical presence of a majority of the governing body in order to take action, 3 (three) members must be physically present, and the other members may attend remotely. However, in order for a Commission member to attend remotely, the following conditions must be met: (a) the members attending remotely must be able to be seen and heard by and be able to see and hear every Commission member who attends the meeting, either in person or remotely; (b) all other people who attend the meeting, either in person or remotely, must be able to see and hear Commission members who attend remotely, and (c) the remotely attending Commission members must be able to see and hear all those people who are speakers at the meeting, whether they are physically present or attending remotely. * * * Section 4. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26. -Commission for women, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26. -Commission for women. * * * ( e) Organization of the commission. Members of the commission for women shall elect such officers, in addition to the chairperson and a vice-chairperson, as may be deemed necessary. Six (6) members shall constitute a quorum necessary to hold a meeting to take any action. Members shall serve without compensation but shall be reimbursed for necessary expenses incurred in the performance of their official duties as approved by the city commission. A budget shall be established by the city manager, as soon as possible, for purpose of funding expenses. Regular and special meetings of the commission shall be scheduled, and notice of such meetings shall be given, as provided in this Code for meetings of the city commission; provided, however, that scheduling special meetings shall require the written request of six (6) commission members, Minutes shall be kept by city staff of all meetings. A quorum is six (6) members that attend either in person or remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Page 2 of 10 Ord. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2.26.1. -Junior commission for women, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2.26.1. -Junior commission for women. * * * (d) Change in number of members. The number of persons serving on the commission may be increased or decreased by the city commission based on the level of participation by young women. In the event of a change in members, the number of members that must be present to constitute a quorum for a meeting shall be half (Yl) the total members plus one (1). In the event of any increase in the number of members, the terms of office shall be prescribed by the city commission. A quorum includes those members who are physically present as well as those members who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * (h) Meetings, expenses. Regularly scheduled meetings shall be held monthly at city hall at a convenient time to be decided by the commission members. The members may change the place and time of a particular meeting by motion and a vote of the majority of members present at a regularly scheduled meeting. A majority of the members in good standing shall constitute a quorum necessary to hold meetings and take action. Regular and special meetings shall be scheduled, and notice shall be given, as provided in the city code for meetings of the city commission; provided, however, that scheduling special meetings shall require the written request of a majority of the members in good standing. Minutes shall be kept either by recording or in written form. Members shall serve without compensation but shall be reimbursed for necessary and authorized expenses incurred in the performance of the work of the commission. A budget may be established by the city manager for the purpose of funding expenses. A quorum for meeting of the board shall be three-fifths of the members of the board, and all actions shall require a majority vote of those members in attendance. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.3. -Parks and recreation board, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.3. -Parks and recreation board. * * * (c) QUorum. A quorum for meetings of the board shall be four (4) of the voting members of the board. A quorum includes those members who are physically present as well as those who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 8. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.4. -Public safety advisory board, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.4. -Public safety advisory board. * * * (d) Quorum. A quorum for meetings of the board shall be three-fifths of the members of the board. A quorum includes those members who are physically present as well as those who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 9. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.5. -Capital improvement advisory board, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.5. -Capital improvement advisory board. * * * (d) A quorum for meetings of the board shall be four (4) members of the board, and all actions shall require a majority vote of the members in attendance. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.6. -Community relations board, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.6. -Community relations board. * * * (d) Quorum. A quorum for meeting of the board shall be a majority of the members of the board. A quorum includes those members who are physically present as well as those who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 11. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.7. -Commercial development board, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.7. -Commercial development board. * * * (d) A quorum for meetings of the board shall be seven (7) members of the board, and all action shall require a majority vote of those members in attendance. The words "members in attendance" for the purposes of this paragraph means members who are physically present as well as those members who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 12. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.8. -Budget and finance committee, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: * * * Sec. 2-26.8. -Budget and finance committee. (d) Meetings, quorum. Regularly scheduled meetings shall be held at least quarterly at city hall at a convenient time to be decided by the committee members. The members may change the place and time of a particular meeting by motion and a vote of the majority of members present at a regularly scheduled meeting. A majority of the members present and in good standing shall constitute a quorum necessary to hold meetings and take action. Additional special meetings may be scheduled, and notice shall be given, Page 5 of 10 Ord. No. 25-22-2446 as provided in the city Code for special meetings of the city commission; provided, however, that scheduling special meetings shall require the vote or written request of a majority of the members. The committee shall appoint a chairperson and a vice- chairperson. The chairperson shall conduct all meetings. In the absence of the chairperson, the vice-chairperson shall conduct the meeting. All meetings shall be properly noticed, open to the public and minutes shall be kept by recording and in written form. Members shall serve without compensation. For purposes of properly posting notices, the chairperson shall notify the city clerk at least twenty-four (24) hours in advance about the date of the meetings. The words "members present" for the purposes of this Section means members who are attending in person as well as those members who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 13. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.9. -Commission for senior citizens, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.9. -Commission for senior citizens. * * * (c) Change in number of members. The number of persons serving on the commission may be increased or decreased by the city commission based on the level of participation and need. In the event of a change in members, the number of members that must be present to constitute a quorum for a meeting shall be half the members plus one. In the event of any increase in the number of members, the terms of office shall be prescribed by the city commission. A quorum shall be four (4) members and an affirmative vote ofa majority of the members present shall be required to pass upon any matter the board recommends. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.11. -Affordable housing advisory committee, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.11. -Affordable housing advisory committee. * * * (c) Change in number o/members. The number of persons serving on the committee may be increased or decreased by the city commission. In the event of a change in members, the number of members that must be present to constitute a quorum for a meeting shall be half the total members plus one (1). The words "members that must be present", for the purposes of this Section, means those members who are physically present as well as those who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 16. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.12. -Green task force, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 2-26.12. -Green task force. * * * (f) Quorum. A quorum shall be four (4) members. An affirmative vote of the majority of the members present shall be required to pass upon any matter the committee- recommends. The words "members present", for the purposes of this Section, means those members who are physically present as well as those who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 17. Chapter 2 titled "ADMINISTRATION AND CITY GOVERNMENT", Article III, titled "BOARDS AND COMMITTEES", Section 2-26.13. -Audit committee, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Page 7 of 10 Ord. No. 25-22-2446 Sec. 2-26.13. -Audit committee. * * * (f) Quorum. Two (2) members shall constitute a quorum and all action 'must be taken by an affirmative vote of two (2) members, unless the audit committee is comprised of three (3) or more members and in such event all action must be taken by an affirmative vote of a majority of the members. A quorum includes those members who are physically present as well as those members who attend remotely provided the members attending remotely can be seen and heard by, and the remotely attending member can see and hear, everyone attending the meeting in person and remotely. * * * Section 18. Chapter 12 titled "HEALTH AND SANITATION", Article III, titled "HEAL TH FACILITIES AUTHORITY", Section 12-43. -Creation; membership, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 12-43. -Creation; membership. * * * (d) Organization and meetings. The authority, at its initial meeting and annually thereafter, shall elect one (I) of its members as chairman and one (I) as vice chairman. Three (3) members of the authority shall constitute a quorum, and the affirmative vote of a majority of the members present shall be necessary for any action taken by the authority. No vacancy in the membership of the authority shall impair the right of a quorum to exercise all the rights and to perform all the duties of the authority. Any action taken by the authority under the provisions of this article may be authorized at any regular or special meeting, and each such resolution shall take effect immediately and need not be published or posted. All meetings of the authority, as well as records, books, documents and papers, shall be open and available to the public in accordance with Section 286.011, Florida Statutes, as the same may be amended from time to time. Chapter 15B titled "PARKS AND RECREATION", Section 15B-7. -Parks acquisition, development, operation, and maintenance fund, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 15B-7. -Parks acquisition, development, operation and maintenance fund. * * * (6) Oversight committee. The parks and recreation oversight committee ("committee") is hereby created to review the expenditure of the additional revenue proceeds and resultant interest or investment earnings, to advise upon expenditures and allocations for the following year, and to make recommendations to the city commission on the Page 8 of 10 Ord. No. 25-22-2446 implementation of particular projects and on any reallocations in addition to the other duties and responsibilities granted to them by any other ordinance. The committee shall be comprised of the same members as are on the parks and recreation board who shall have the ex-officio duties of and be members of the parks and recreation oversight committee. The Committee shall conduct its business at the same time, date and place as the parks and recreation board. The parks and recreation oversight committee shall continue in existence through December 31, 2018, and thereafter if so provided by ordinance. Chapter 16 titled "PENSIONS", Article II, titled "CITY PENSION PLAN", Section 16-20. -Board of trustees, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 16-20. -Board of trustees. * * * (b) The board shall hold meetings upon such notice, at city hall, and at such times as its members may from time to time determine but in no event less than once each calendar quarter. A majority of the members present ef the heard at the time ia effiee shall constitute a quorum for the transaction of business. All action taken by the board at any meeting shall be by vote of the majority of its members present at such meeting. Chapter 16 titled "PENSIONS", Article III, titled "POLICE OFFICERS", Section 16-33. -Membership of board; term; officers; meetings; quorum, of the City of South Miami's Code of Ordinances is hereby amended and shall read as follows: Sec. 16-33. -Membership of board; term; officers; meetings; quorum. * * * (b) The board shall annually elect from its membership a chairman and secretary. The chairman, when present, shall preside at all meetings. The secretary shall keep complete minutes of all proceedings of the board and shall comply with requirements of F .S. § 185.06(3).
