A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,
FLORIDA, AUTHORIZING A TEMPORARY STREET CLOSURE AND USE OF 59TH
AVENUE FROM 72ND STREET TO 73RD STREET PURSUANT TO SECTION 158-6(2)
OF THE CITY CODE FOR A SPECIAL EVENT KNOWN AS THE "ANNUAL ST. PATTY'S
DAY MUSIC AND FOOD FESTIVAL" PRESENTED BY SUNSET TAVERN TO BE HELD
ON FRIDAY, MARCH 17, 2023 ("EVENT"); APPROVING THE WAIVER OF EVENT-
RELATED FEES AND COSTS REQUESTED PURSUANT TO SECTION 158-6(11) OF THE
CITY CODE; PROVIDING FOR APPLICABILITY OF FEES AND CODE REQUIREMENTS;
IMPLEMENTATION; CORRECTIONS; SEVERABILITY; AND AN EFFECTIVE DATE.
WHEREAS, in observance of St. Patrick's Day, Sunset Tavern ("the Applicant"), located at
7230 SW 59th Avenue, has requested to host its annual St. Patty's Day Music and Food Festival
(the "Event") on Friday, March 17, 2023, from 3:00 p.m. to 11:00 p.m.; and
WHEREAS, the Applicant is requesting a temporary street closure and use of 59th Avenue
from 72nd Street to 73 rd Street and a waiver of certain fees and costs for the Event; and
WHEREAS, pursuant to Section 15B-6 of the City Code, the City Commission may
authorize the temporary street closure and use of the public street; and
WHEREAS, the Applicant is responsible for submitting payment for the following services
rendered by the City ten (10) days prior to the Event date:

WHEREAS, the Applicant is requesting a waiver of fees pursuant to Section 15B-6(11) of
the City Code for the following City service fees, totaling $1,876.50:

WHEREAS, City staff recommends that the requested waiver of fees be approved; and
WHEREAS, the City Commission wishes to approve the temporary street closure and use
of 59 th Avenue from 72 nd Street to 73 rd Street for the Event pursuant to Section 15B-6(2) of the
City Code and the Applicant's request for a waiver of Event-related fees and costs pursuant to
Section 15B-6(11) of the City Code, and finds that such is in the best interests of the City.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SOUTH
MIAMI, FLORIDA:
Section 1. Recitals Adopted. The foregoing recitals are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution upon adoption
hereof.
Section 2. Authorize Temporary Street Closure and Use of Street. Pursuant to Section
15B-6(2) of the City Code, the City Commission hereby authorizes the temporary street closure
and use of 59th Avenue from 72 nd Street to 73 rd Street related to the Event.
Section 3. Approval of Waiver of Fees. Pursuant to Section 15B-6(11) of the City Code,
the City Commission hereby approves the request for waiver of Event-related fees and costs in
the amount of $1,876.50, specifically, the parking revenues associated with fifteen (15) parking
spaces and temporary Street Closure and MOT fees associated with the Event.
Section 4. Applicability of All Fees and Requirements. Except as provided for herein,
all fees and costs and requirements of the Code remain applicable to the Event, and the City
Manager shall ensure compliance with all Code requirements.
Section 5. Implementation. The City Manager is hereby authorized to take any and
all necessary action to implement the purposes of this Resolution.
Section 6. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature.
Section 7. Severability. If any section, clause, sentence, or phrase of this Resolution
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this Resolution.
Section 8. Effective Date. This Resolution shall become effective immediately upon
adoption.

SUBJECT: Sunset Tavern’s request for a street closure and a waiver of certain -event
related fees and costs pursuant to section 15B-6 of the city code.
RECOMMENDATION: Staff recommends the approval of the street closure and waiver of fees as
requested by the applicant.
A better defined policy regarding the waiver of fees is called for and future
requests could result in a recommendation of fee waiver denial; however,
in the interim, said recommendation is being made for consistency
purposes with past events.
BACKGROUND: In observance of St. Patrick’s Day, Sunset Tavern (“the applicant”), located
at 7230 SW 59th Avenue, has requested to host its annual St. Patty’s Day
Music and Food Festival (“the festival”) on Friday, March 17, 2023 from
3:00 p.m. to 11:00 p.m. The applicant is requesting a street closure on 59th
Avenue from 72nd Street to 73rd Street and a waiver of certain event-
related fees.
The festival has an anticipated attendance of 200 persons. There will be a
stage with live music, food, and beverages catered and sold by the
applicant. As per the applicant, a portion of this year’s proceeds and 100%
from a raffle drawing will benefit CureCFMiami, a 501C dedicated to
finding a cure for Cystic Fibrosis. The applicant has specified that all public
property directly surrounding the event including sidewalks, street gutters,
etc. will be cleaned by their staff.
Pursuant to Section 15B-6 (3) of the city code, the applicant has submitted
the necessary notification/petition form signed by businesses that will be
affected by the requested street closure. Upon approval of this event, the
applicant must provide the City with the required Certificate of Liability
Insurance that complies with the City’s standard insurance requirements,
including naming the City of South Miami as an additional insured prior to
the event.

INDEMINIFATION AGREEMENT

Agreement.
RECITALS
WHEREAS, the Applicant has submitted a Special Event Permit Application to the City for (event title)

good consideration the receipt and sufficiency of which is hereby acknowledged, the Parties hereby agree as
follows:
1. The above recitals are true and correct.
2. Applicant agrees to indemnify, defend and hold the City, its officers, affiliates, employees, successors and
assigns ( collectively "lndemnitees") harmless from and against any and all such claims, suits, actions,
damages, or causes of action arising as result of the Special Event, or of the condition of the site on which
the Special Event is held including any personal injury or loss of life, or damage to or loss of property, and
from and against any costs, attorney's fees, expenses or liabilities included in and about the defense or
settlement of any clams, and the investigation thereof, except to the extent caused by indemnitees
negligence of willful misconduct.
3. No Street shall be closed without approval from the City Commission.
4. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami-Dade
County standards and any additional requirements by the City of South Miami Public Works Department
and Police Department.
5. Event areas shall be restored to equal or better condition than they were before the event started.
6. Any damage to private property shall be restored to its original condition or better and as accepted by the
Owner caused by applicant or any of its agents, servants or employees, invitees and onlookers.
7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public
Works Department may restore the event area and charge the applicant for the cost of restoration and
addltional incidental fees.
8. Applicant must pay all fees prior to the date of their event(s).

To the Mayor Fernandez and members of the commission,
My name is Jahn Kirchoff, and I am the owner of Deli lane Cafe and Sunset Tavern, now and since its inception in 1988
with my business partner Mike Maler. When COVID hit in March of 2020 we had to re-invent ourselves once again after
32 years. We were successful to that end and here we are. South Miami is more than where we conduct our business,
we are part of this community.
We have been here for all the Art festivals, Safe Street Halloweens, Santa's Parade of the Elves, various car shows, and
we have had 2 "street parties" asking for Dorn Ave to be closed. The first street closing was to thank all our loyal
customers with a music-festival in November 2020 and the second was St Patrick's Day 2021, you helped us by waiving
some of the fees for those parties. The two parties had been a success in part because the commission has waived some
of the fees for the street dosing. These parties are expensive to pull off, insurance, sound stage, off duty police,
equipment rentals, labor etc. Our undertaking this sort of event is to begin to make it an annual event that the city can
be known as a destination every year for this holiday. This is our 20th St Patrick's day event, the others we just limited to
the Robin's property. Now they have become so popular that closing the street is a way to have enough space to
accommodate all who want to attend and for the overall draw to downtown South Miami.
This year's party will also benefit CureCFMiami a home grown 501C that works tirelessly to help find a cure for Cystic
Fibrosis. We are excited about this partnership and being part of their mission.
We are also including in all our promotional materials the good deal and accessibility of the South Miami parking garage
on SW 73 St.

so I am guessing they will do the same otherwise reduce the total amount by $200
Below are the fees for Rotary Art Festival 2023, per the Fee Schedule:
Rotary Art Festival 2023
Temporary full road closure= $25 ($0.25 x Approx.lOOLF)(Both directions) = 306LF x .25 = $76.5
The MOT fee for roadway= $100 x 1 directions= $100
Temporary Staging Area= $200
Total=$ 376.5
