A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH
MIAMI, FLORIDA, AUTHORIZING THE WAIVER OF CERTAIN
EVENT-RELATED FEES AND COSTS PURSUANT TO SECTION 15B-6
OF THE CITY CODE FOR A SPECIAL EVENT KNOWN AS "THE
ROT ARY ARTS FESTIVAL" APPROVED PURSUANT TO RESOLUTION
NO. 059-22-15812 ON MAY 17, 2022; PROVIDING FOR APPLICABILITY
OF OTHER FEES AND CODE REQUIREMENTS; IMPLEMENTATION;
CORRECTIONS; SEVERABILITY; AND AN EFFECTIVE DATE.
WHEREAS, on Tuesday, May 17, 2022, the City Commission approved of Resolution
No. 059-22-15812 (the "Authorizing Resolution") authorizing a special event and street closure
for the Rotary Foundation of South Miami, Inc. (the "Applicant") to host its 38 th annual South
Miami Rotary Art Festival on February 25 and 26, 2023 (the "Festival") and the waiver of certain
special event fees and requirements; and
WHEREAS, pursuant to Section 15B-6(11) of the City Code, the City Commission may
waive event-related fees and costs imposed pursuant to Section 15B-6; and
WHEREAS, the Applicant initially requested and received approval for a fee waiver
pertaining to one-hundred six (106) parking meters per Resolution No. 059-22-15812; and
WHEREAS, the Applicant is now requesting a fee waiver for five ( 5) additional paid
parking spaces-423 through 427-on SW 57th Court, totaling $1,000 dollars.

WHEREAS, the City Commission wishes to support the Festival by waiving a portion of
the special event-related fees and costs as set forth herein and finds that such waiver is in the best
interests of the City.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Recitals Adopted. The foregoing recitals are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution upon adoption
hereof.
Section 2. Waiver of Fees. Pursuant to Section 15B-6(11) of the City Code, the City
Commission hereby waives $1,000 in event-related fees and costs, specifically the parking

revenues associated with five (5) parking spaces, associated with the Festival as required under the
Code and as set forth in the Authorizing Resolution.
Section 3. Applicability of All Other Fees and Requirements. Except as waived and
provided for herein, a ll other fees and costs and requirements of the Code remain applicable to the
Festival , and the City Manager shall ensure compli ance with all Code requirements.
Section 4. Implementation. The City Manager is hereby authorized to take any and
all necessary action to implement the purposes of thi s Resolution.
Section 5. Corrections. Conforming language or technical scrivener-type corrections
may be made by the City Attorney for a ny conforming amendments to be incorporated into the
final resolution for signature.
Section 6. Severability. If any section, clause, sentence, or phrase of this Resolution
is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this Resolution.
Section 7. Effective Date. This Resolution s ha ll become effective immediately upon
adoption.

RECOMMENDATION:Staff recommends approval of the request for waiver.
BACKGROUND:On Tuesday, May 17, 2022, the City Commission approved of Resolution #059-
22-15812, authorizing the City Manager to permit Rotary Foundation of South
Miami, Inc. to host its 38th annual South Miami Rotary Art Festival on February
25and 26, 2023 and to waive certain special event fees and requirements.
One of the services requested and approved for fee waiver was one-hundred
six (106) parking meters. Refer to the attached Resolution #059-22-15812.
The applicant is now requesting a fee waiver for five (5) additional paid
parking spaces—423 through 427—on SW 57th Court. According to the
applicant, the bank serves as a base for operations and the volunteer
committee staff would like to use the parking spaces next to the bank as
illustrated below.

WHEREAS, per Resolution #044-21-15664, the City Manager was authorized to reserve
future event dates on behalf of the South Miami Rotary Foundation of South Miami, Inc. for the
following three years: February 25 -26, 2023, February 24 -25, 2024, and February 22 -23,
2025;and
WHEREAS, South Miami Rotary Foundation of South Miami, Inc. ("the applicant"}, a
501(c)(3), has submitted a special event application to host its South Miami Rotary Art Festival
on Saturday, February 25, 2023 from 10:00 a.m. to 6:00 p.m. and Sunday, February 26, 2023 from
10:00 a.m. to 5:00 p.m. on 72 nd street (Sunset Drive} from 57 th avenue to South Dixie Highway;
and

RECITALS
WHEREAS, the Applicant has submitted a Special Event Permit Appllcatlon to the City for (event tltte)

Now, THEREFORE, In consideration of the matters recited above, the mutual covenants set forth herein, and other
good consideration the receipt and sufficiency of which Is hereby acknowledged, the Parties hereby ae,-ee as follows:
1. The above recitals are true and correct.
2. Applicant agrees to Indemnify, defend and nold the City, Its officers, affiliates, employees, successors and
assigns ( collectively "lndemnltees") harmless from and against any and all such claims, suits, actions,
damages, or causes of action arising as result of the Special Event, or of the condition of the site on which
the Special Event Is held Including any personal Injury or loss of life, or damage to or loss of property, and
from and against any costs, attorney's fees, expenses or llabllltles included in and about the defense or
settlement of any clams, and the investlgatlon thereof, except to the extent caused by indemnitees
negligence of willful misconduct.
3. No Street shall be closed without approval from the City Commission.
4. Traffic shall he maintained In acccrdance with Florida Department of Transportation (FOOT}, Miami-Dade
County standards and any additional requirements by the Oty of south Miami Public Worts Department
and Ponce Department.
5. Event areas shall be restored to equal or better condition than they were before the event started.
6. Any damage to private property shafl be restored to its original condltlon or better and as accepted by the
Owner caused by applicant or any of Its agents, servants or employees, Invitees and onlookers.
7 . If all restoration work Is not performed within 30 days of work completion, the City of South Miami Public
Works Department may restore the event area and charge the applicant for the cost of restoration and
additional Incidental fees.
8. Appllcant must pay all fees prior to the date of their event(s).
9. Applicants shall notify the City of south Miami Special Event Coordinator at least forfy-elght (48) hours prior
to start of their event of any cancellations to be considered for any refunds.

accompany your submission in check or money order form.
Application must be signed and notarized.

A site plan must be submitted with the application that must

Dear Ms Kamali,
After a couple of years of necessary dormancy from our normal lives, we look forward to retuming to
more nomudcy in 2022. W'tth this Jetter, I am delivering to the city the application package for the
36th amwal South Miami Rotary Arts Festival for February 26 & 'r1, 2022.
Enclosed are checks in the amount of $160 for the Special Event Application Fee and Administrative
Fee.
We request that in the Resolution drafted for the Commission you please include waivers from the
foDowing sedions of Ordinance 158 if it is still in effect
6.3 Which requires us to obtain signatures of approval from a majority of the business affected
by the stMet closure.
6.4 Those provisions pertaining to road closure costs and parking revenue
6.6 The requirement that costs of police and any other department employment be paid prior to
the permit being issued.
All of the waivers that we request are in keeping with the long standing policy of the Cty of South
M"wni which bas always re.cognized the value to the city of the South Miami Rotary Art Festival. We
bring approximately 24,000 visitors to the city over a two day period, many of whom return
throughout the year to spend money in the downtown area.

Additionally, we request that the following dates be reserved for future Rotary Arts Festivals. The
festival is always the weekend after President's Day:

Feb 22 & 23, 2025
Furthermore, being the weekend after President's Day when the Coconut Grove Art Festival and the
St. Stephen's Art Festival take place. a number of those 8J1ists remain in hotels and motels to
participate in our festival, something they were unable to do when we were always the last weekend in
February. This benefits our local tourist industries.
Profits from our festival are used to fund annual college scholarships with preference to a South
Miami student at the New World School of the Arts. We have been giving scholarships to needy
children in South Miami for at least the past 20 years.
Additionally. we are involved with the South Miami Parks and Recreation Department's after-school
tutoring program, swim program, and children's nutrition program
The city has always recognized the value of our art festival to bring many return visitors to South
Miami raising awareness of all that the city bas to offer.

RECITALS

1. The above recitals are true and correct.
2. Applicant agrees to Indemnify, defend and hold the City, Its officers, affiliates, employees, successors and
assigns { collectively "lndemnitees") harmless from and against any and all such claims, suits, actions,
damages, or causes of action arising as result of the Special Event, or of the condition of the site on which
the Special Event is held including any personal injury or loss of life, or damage to or loss of property, and
from and against any costs, attorney's fees, expenses or Uabllltles included In and about the defense or
settlement of any dams, and the Investigation thereof, except to the extent caused by lndemnitees
negligence of willful misconduct.
3. No Street shall be closed without approval from the City Commission.
4. Traffic shall be maintained In accordance with Florida Department of Transportation (FOOT), Mlaml•Dade
County standards and any additional requirements by the City of South Miami Public Works Department
and Police Department.
s. Event areas shall be restored to equal or better condition than they were before the event started.
6. Any damage to private property shall be restored to its original condition or better and as accepted by the
Owner caused by applicant or any of Its agents, servants or employees, Invitees and onlookers.
7. If all restoration work Is not performed within 30 days of work completion, the City of South Miami Public
Works Department may restore the event area and charge the applicant for the cost .of restoration and
additional Incidental fees.
8. Applicant must pay all fees prior to the date of thelr event(s).

On behalf of the South Miami Rotary Art Festival Chair Committee-
This year marks the 38th Annual South Miami Rotary Art Festival. We are proud and excited each year to
see our event bring in a surge of vitality into the downtown commercial district. In an effort to elevate
the impact of the art festival on our downtown businesses, we will be publishing a complimentary online
directory of local vendors available to festival patrons and visitors to our community. The directory will
be available for a full year.
As you can imagine, an event of this scale requires the collective effort of a dedicated team to manage
the complex logistics. For the past 20 years, our committee staff has been graced with the cooperation
of the City in allowing our use of the street parking spaces adjacent to the First National Bank of South
Miami. The bank serves as our base of operations.
It has come to our attention that we are required to get preapproval for our volunteer committee staff
to use the parking spaces next to the bank. We would l ike to make an amendment to our event
application, requesting usage of parking spaces 424-429. We kindly request the City Commission to
waive fees for said parking spaces for the duration of the event, February 25-26, 2023.
