The applicant responded that it would be a reduction in the amount of trees. Mrs. Morales-Fernandez questioned if the seven Live Oaks being relocated are included in the total number of Live Oaks being relocated. The applicant replied that,the Live Oaks are in addition to the sixteen. Mrs. Morales-Fernandez questioned why the Live Oaks along the property line are going to be removed. The applicant responded that the trees are under power lines and when cut they looked as if they are "hat racked"and it does.not look appealing. Mr. Bedell questioned how close was the fence in relation to the property line. The applicant replied that the fence is four feet inside the property line. The applicant provided the Board with a current photograph of the Live Oaks that will be removed since they are under the power line. Mr: Bedell commented that when Florida Power and Light comes to trim the trees they do not look so pleasant and FPL only comes once or twice a year to trim the trees under the power line. He recommended trees that do not grow as tall as the present ones, to be planted in that area. Mr. Trautman questioned if the Live Oaks are located on the west side of the property and does FP&L trim trees that are located on the west side of a property. The applicant responded yes. Mr. Bedell responded that FPL does trim trees which are under a power line. Motion: Mr. Bedell moved and Mrs. Mark seconded to approve the application as presented. The applicant responded that the material is a green FinLink material that will cover the wood fence which is surrounded by a chain link fence. Mr. Trautman questioned if the purpose of the generator is as an emergency back up. Mrs. Cabrera-Hernandez responded that the Land Development Code says that the requirement is if less than five (5) parking spaces; the applicant is exempt. However, one parking space out of . the total of four parking spaces proposed should be a handicap space, in order to comply with Florida Building Code. Mr. Trautman commented that this application might set a precedent on not needing a handicap space in parking. Mr. Rivera questioned if the applicant is willing to place a handicap space. The applicant responded that the recommendation will be taken into consideration and there is room for it and the parking will include three parking spaces 'and one handicap space. Mr. gall recommended the handicap space being the parking space closest to the building., Mr. Trautman commented that a handicap space dimension includes 17'by 12' with an access space of 5 feet. Mr. Bedell recommended for the applicant to include (3) cluster Solitaire Palms with a minimum of 12' height, a row of ten (10) Cocoplum shrubs that are 24" high and two feet on center along the property line. STAFF ANALYSIS: On June 2, 2009 the City Commission adopted ordinance No. 08-09-2000, changing the screening requirements for rooftop and ground mounted mechanical equipment that is being replaced. Therefore, when the applicant submitted -a building permit for the installation of a new permanent generator, it was necessary that the Board review the item before the permit could be approved. Pursuant to 20-3.6(Q)(2) of the Land Development Code, Air-cooled condensing (excluding window and wall units), and/or compressor equipment, water cooling towers, liquid propane gas tanks, irrigation pumps, pool equipment, and any other similar mechanical or service equipment or apparatus installed or replaced on the ground or .on a building (other than on its rood shall be screened from view, at ground level outside the subject property, by the use of landscaping or such other screening device as shall be approved by the environmental review and preservation board. The requirement of approval by the environmental review and preservation board shall not apply to replacement equipment if existing screening is in place and found sufficient by the Planning Director. The generator will be installed along the southeastern portion of the building and will be eleven (11) feet away from the eastern property line. Even though the permitted use for the building is a daycare center, it is important to note that to the east of the property is the newly constructed Somerset Charter School, and to the north are multifamily residential homes. Because of this, noise from the generator or any a/c equipment must be kept to a minimum level. Section 20-3.6(Q)(3) of the Land Development Code provides the following for maximum permitted sound level in decibels (dBA): It shall be unlawful to operate mechanical equipment including air- cooled condensing, and/or compressor equipment, and any other noise producing equipment in an all residential, institutional, commercial and industrial zoned property, when such equipment emits noise which exceeds the following noise levels, measured at the receiving property line nearest to the source; such sound levels shall be measured by City of South Miami staff or other representatives designated by the City Manager with a sound level meter manufactured according to standards prescribed by the American National Standards Institute: Maximum Permitted Sound Level in Decibels dBA At Property Line or At Property Line or Receiving Land Use Beyond Between 10:00 Beyond Between 7:00 PM--7:00 AM AM--10:00 PM Multifamily, Institutional, Parks and Noise - Sensitive Zones (Hospitals, Schools, 60 dBA 65 dBA Nursing Homes, Church, Court or Public Libra To achieve the desired decibel rating listed above as well as provide screening for the equipment, the applicant is proposing the installation of a standard, four (4) foot high chain link fence that will surround the generator, and will have green decorative slats that will shield the unit from view. The applicant will also use this type of screening to block the view of the two (2) proposed 100 gallon LP tanks that will be located along the eastern side of the property.
