A Resolution relating to a Final Plat application to allow a replat of a 0.954-
acre property, comprised of three contiguous, vacant parcels bound by SW
64th Terrace to the north and SW 61st Court to the west of the three parcels,
and as legally described herein.
WHEREAS, the City of South Miami, owner of the three parcels identified as folio
numbers 09-4025-000-0850, 09-4025-065-0090, and 09-4025-000-0852, which are generally
located south of SW 64th Terrace and between SW 60 th Avenue and SW 6I51 Court/aka SW 6I51
Drive Court, submitted Application No. PB-22-015 requesting approval of a final plat; and
WHEREAS, the proposed final plat will combine the three parcels into one parcel and
remove a restriction that prohibits one of the parcels from being used as a building site; and
WHEREAS, the lot created by the proposed plat complies with the requirements of
Section 20-4.2(8) of the Land Development Code; and
WHEREAS, at a public hearing on November 16, 2022, the Planning Board voted four
( 4) to zero (0) to recommend approval of the proposed final plat with the recommendation that the
City Commission consider the site as a passive park; and
WHEREAS, the City Commission desires to approve the final plat.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The recitals set forth in this resolution are true and they are supported by
competent substantial evidence and they are incorporated into this resolution by reference as if set
forth in full herein.
Section 2: The subject application, No. PB-22-015, submitted by the City of South Miami
requesting approval of a proposed final plat for the property legally described in Section 3 below,
pursuant to the Land Subdivision Regulations outlined in Land Development Code Section 20-4.2
is hereby approved subject to the following terms and conditions as well as all applicable City
ordinances, codes, rules, and regulations:
Compliance with the July I, 2022, Miami-Dade County Plat Committee Notice of Action.

61st Court to the west of the three parcels, and as legally described herein.
BACKGROUND:
In 1975, the subject parcels along SW 61st Court were created during a previous platting process
that conveyed the property subject to a restriction that it is not used as a building site. In an effort
to resolve this issue, the City initiated the process of removing this restriction through a replatting
application which would have also include an application to record a Unity of Title that would
join the properties. On July 1, 2022, the project completed the first phase of the process and was
granted Tentative Plat (T-Plat) approval from Miami-Dade County with conditions. Prior to that
approval, the City Commission reviewed and approved the T-Plat request on January 4, 2022, via
Resolution #006-22-15759. To complete the process, the project must receive Final Plat approval
from Miami-Dade County. Once completed, the lots will have a combined, total area of 41,554
square feet (0.954 acres +/-). Currently, there are no plans to develop the property. Approval of
any future plans to develop the site, whether by the City or a new owner, will follow the
appropriate procedures.
REQUEST:
The City of South Miami, the applicant, is requesting Final Plat approval to replat the parcels of
land that are located between SW 60th Avenue, SW 64th Terrace, and SW 61st Court which is in
the City’s Two-Family/Townhouse Residential (RT-9) zoning district. The subject parcels are
shown in the location map below. As required by Section 20-4.2 of the Land Development Code
(LDC), Final Plat applications shall be referred to the Planning Board for review and
recommendation followed by review and approval by the City Commission.

ANALYSIS:
Section 20-4.2(B)(2) of the LDC provides the seven specific guidelines the City Commission shall
use in evaluating a Final Plat application. Each guideline is described below along with Staff’s
analysis of how the application satisfies them.
1.Section 20-4.2(B)(2)(a)(i): The building site created by the proposed tentative plat should
be equal to or larger than the median of the existing building sites in the Surrounding
area…surrounding area is defined as all lots within the same zoning district and within five
hundred (500) feet from the exterior boundaries of the subject property.
Staff Response:Not applicable as there are no other properties with the RT-9 zoning
designation that are within 500 feet.
2.Section 20-4.2(B)(2)(b):The building site created by the proposed waiver of plat, tentative
or final plat, will not result in existing structures becoming nonconforming as they relate
to setbacks, lot area, lot width and depth, ground coverage and other applicable
regulations of the City's Land Development Code and/or City's Code of Ordinances, except
as permitted by this ordinance. Compliance with this provision may occur by demolition or
relocation of existing structures.
Staff Response: Not applicable as there are no existing structures on the site.

3.Section 20-4.2(B)(2)(c):The building site created by the proposed waiver of plat, tentative
or final plat, will be free of encroachments from abutting building sites.
Staff Response:Complies; there will be no encroachments from abutting building sites.
4.Section 20-4.2(B)(2)(d):The building site created by the proposed waiver of plat, tentative
or final plat, is free of any declarations of restrictive covenants, unity of title, easements,
or the like, which would prevent the separation of the site. However, this provision may
be satisfied if existing covenants, unity of title, easements, or similar instruments, which
conflict with the proposed subdivision, are released or modified to accommodate the
proposed building site.
Staff Response:Once replatted, the building site will be free of any declarations of
restrictive covenants, unity of title, easements, or the like, which would prevent the
separation of the site.
5.Section 20-4.2(B)(2)(e):The scale of any proposed new construction shall be compatible
with the as-built character of the surrounding area and shall not create adverse impacts
on the surrounding area; but if so, the applicant shall provide satisfactory commitments
as to how the adverse impacts will be mitigated. An example of an adverse impact includes
visual impacts arising from a proposed two-story structure in an area built out with single-
story homes; mitigation could include adding a condition to the approval of the waiver of
plat, tentative plat, or final plat, for landscape buffers, or adjusting second-story setbacks
or building facades to reduce the visual impact.
Staff Response: Not applicable as new construction is not proposed at this time. It is
important to note that any future construction will be required to be reviewed and
approved by the Environmental Review and Preservation Board prior to a building permit
being issued.
6.Section 20-4.2(B)(2)(f):The building site(s), lot(s) or parcel(s) of land that would be
created are divided in such a manner that they are in compliance with the regulations of
the City's Land Development Code. Lot area and street frontage calculations shall exclude
abutting public rights-of-way.
Staff Response: Complies. The site that will be created will comply with both the
minimum lot size and minimum frontage requirement for the RT-9 zoning district. The RT-
9 district requires a minimum lot size of 10,000 square feet and a minimum frontage of
100 feet. Once joined, the property will consist of 41,554 square feet and will have two
frontages, on SW 64th Terrace and SW 61st Court, that will exceed the 100-foot minimum.

7.Section 20-4.2(B)(2)(g): The building site(s) created cannot constitute an irregular parcel
(one that has more than four (4) corners) unless the City Commission determines by a
4/5th vote that the irregularity arises from irregularity in the original parcel and cannot
be corrected, or that the irregularity is compatible with the surrounding area.
Staff Response: The site will be irregular, but the irregularity arises from the original
parcel and cannot be corrected. Because of that, a 4/5th vote will be required to approve
the application.
In addition to the conditions listed in Section 20-4.2, the Miami-Dade County Plat Committee
imposed conditions on the approval of the Tentative Plat. These conditions can be found on the
attached Miami-Dade County Plat Committee Notice of Action (NOA) that is dated July 1, 2022.
Of the conditions noted, the following condition requires approval from the City prior to final plat
review and prior to the issuance of a building permit:
Condition:Traffic concurrency approval by the municipality is required prior to final plat
review and prior to the issuance of a building permit. Municipality concurrency review to
include all City, State and County roads.
After reviewing the City’s Comprehensive Plan, the following transportation policy is listed:
TRA Policy 1.1.1
The City of South Miami, in its entirety, is located within the Miami-Dade County's
Urban lnfill Area, which is designated as a Transportation Concurrency Exception
Area by Miami-Dade County. Miami-Dade County controls the roadway design and
traffic pattern including signage and direction of all roads within the City. To a
great extent, the City is not in control of its ability to manage the Level of Service
(please refer to the Data, Inventory, and Analysis for a description of the Level of
Service classification system). The City's level-of-service standards for roadways
are as follows:
Principal Arterials "F"
Minor Arterials "F"
Miller Drive "F"
1. The peak hour level-of-service standard shall be 150 percent of level of service
D capacity for US-1.
2. The peak hour level-of-service standard for Bird Road shall be 120 percent of
level of service E capacity.
Based on the above listed Comprehensive Plan policy, the City is exempt from providing
transportation concurrency because it is in Miami-Dade County’s Urban Infill Area. In an effort to

address the above referenced plat condition, an email detailing the above listed Comprehensive
Plan policy was forwarded to both Mr. Jorge Ubieta and Ms. Annette Lewis, representatives of
Miami-Dade County on November 30, 2022. All of the remaining conditions listed in the NOA will
be addressed prior to final review and approval by the Miami-Dade County Plat Committee.
PLANNING BOARD RECOMMENDATION:
After a public hearing on November 16, 2022, the Planning Board unanimously recommended
approval of the Final Plat application as presented with the recommendation that the City
Commission consider the site as a passive park.
RECOMMENDATION:
Staff recommends approval of the Final Plat application. This approval should be subject to the
following terms and conditions as well as all applicable City ordinances, codes, rules, and
regulations:
Compliance with the July 1, 2022, Miami-Dade County Plat Committee Notice of Action.

My name is Marcus Lightfoot, and I am a Senior Planner with the City of South Miami. Recently, the City received
Tentative Plat approval to plat a tract of land that it owns which will become the Sarni Sixty First Subdivision (Plat No. T -
24803 -

CORR). As part of that process, our consultant provided me with the Notice of Action (NOA) for the project
which is attached. As part of the NOA, the following requirement for final approval was listed :
Traffic concurrency approval by the Municipality is required prior to final plat review and prior to the issuance of
a building permit. Municipality concurrency review to include all City, State and County roads.
In response to this requirement, the City's Comprehensive Plan states the following:
TRA Policy 1 .1.1
The City of South Miami, in its entirety, is located within the Miami-Dade County's Urban Infill Area, which is
designated as a Transportation Concurrency Exception Area by Miami-Dade County. Miami-Dade County controls
the roadway design and traffic pattern including signage and direction of all roads within the City. To a great
extent, the City is not in control of its ability to manage the Level of Service (please refer to the Data, Inventory,
and Analysis for a description of the Level of Service classification system). The City's level-of-service standards
for roadways are as follows:
Principal Arterials "F"
Minor Arterials "F"
Miller Drive "F"
1. The peak hour level-of-service standard shall be 150 percent of level of service D capacity for US-1.
2. The peak hour level-of-service standard for Bird Road shall be 120 percent of level of service E capacity.
While researching how to address this requirement, it was recommended that I reach out to you and Ms. Lewis to
inform you of the above listed Comprehensive Plan policy. Please let me know if any additional information is needed .

The City of South Miami Code of Ordinances, Section 8A -5, requires that all lobbyists, as defined in that section,
must register with the City Clerk before engaging in any lobbying activities and in most cases pay an annual fee of
$500.00 and an additional $100 for each additional issue. This applies to all persons who are retained with or
without compensation to influence any action, decision, recommendation of someone with the city, including the
city manager, city attorney, department heads, city personnel, or members of the city commission or members of
any city board, concerning a matter that could foresee ably be address by the city commission or a city
board. There are some exceptions and exemptions. The following are not considered to be lobbyist: a
representative of a principal at a quasi-judicial hearing, experts who present scientific or technical in formation at
public meetings, representatives of a neighborhood association without compensation and representatives of a
not-for-profit community based organization for the purpose of requesting a grant who seek to influence without
special compensation.

Action: Mr. Miller called the meeting to order at 7:00 P.M.
Mr. Pepe provided the Board and public with the rules for the meeting.

Mr. Lightfoot introduced Mr. Henry Flores as the new Planning Director to the Board.

Mr. Miller asked if vice chair elections will be held at the next meeting, to which Mr. Lightfoot
stated yes.
IV. Public Hearings:
1. PB-22-015
Applicant: City of South Miami
A Resolution relating to a Final Plat application to allow a replat of a 0.954-acre property,
comprised of three contiguous, vacant parcels bound by SW 64th Terrace to the north and SW
61st Court to the west of the three parcels, and as legally described herein.
Applicant: The City of South Miami, represented by Aurelio Carmenates, PE (Capital
Improvement Program Project Manager)
Mr. Lightfoot read PB‐22-015 into the record and then presented the staff report for the item to
the Board.
Mr. Miller asked if this item was a second review of the item that the Board reviewed in 2021, to
which Mr. Lightfoot stated yes. Mr. Miller then asked if anything has changed since it was last
reviewed, to which Mr. Lightfoot stated no.
Mr. Miller asked staff how S. Dixie Highway received a Level of Service (LOS) of “D” rating. Mr.
Lightfoot responded that because he wasn’t a transportation expert, he could not answer the
question.
Mr. Jacobs asked if this parcel was the only property in the area that was zoned RT-9, to which
Mr. Lightfoot stated yes. Mr. Jacobs then asked how it was able to be the only RT-9 district in the
area, to which Mr. Lightfoot stated that he was unable to answer the question. Mrs. Readon then
provided the Board with a brief history on the subject property.
Mr. Jacobs asked questions regarding the building restriction on Parcel K. Mr. Lightfoot responded
that the reason for the plat is to remove the building restriction that was placed on Parcel K.
Mr. Miller asked if the purpose of this item is to combine the properties and to remove the
restriction. This property isn’t being subdivided. Mr. Lightfoot stated that he was correct. Mr.
Miller then asked if there was any intent to build on the parcel, to which Mr. Lightfoot stated no.
There is no intent to build. Depending on what is proposed in the future, if any, may not come
before the Planning Board. At the least, any future development will need to be reviewed by the
Environmental Review & Preservation Board.
Mr. Miller asked what uses would be permitted by right on the subject property. Mr. Lightfoot
then read the uses listed as “Permitted by Right” in the City’s Permitted Use Schedule, Section 20-
3.3(D) of the Land Development Code (LDC) into the record.
Mr. Jacobs asked if the City was considering using the property as park, to which Mr. Lightfoot
responded that he was not aware of what the City’s intent for the parcel was. Mr. Jacobs then

asked how the City decides where to put parks, to which Mr. Lightfoot responded that the City
Commission decides on where parks should be placed with the aid of a park master plan that is
prepared by the City’s Parks & Recreation Director.
Mr. Basu asked if the City was going through the plat process to combine three (3) parcels of land
into one (1) parcel, to which Mr. Lightfoot responded yes. Mr. Basu then asked if someone would
need to go through the subdivision process if they were to buy the property in the future and
wanted to divide it up. Mr. Lightfoot confirmed that they would need to go through the
subdivision process. Mr. Lightfoot then added that if the lot were subdivided, it would need to
comply with the dimensional requirements for the RT-9 zoning district. Mr. Basu then asked why
the restriction was put into place and who placed it. Mr. Pepe responded that he believes that it
was tied to the J.R.E. Lee school. Mr. Pepe then added that Miami-Dade County has already
approved the tentative plat application which led him to believe that Miami-Dade Public Schools
was fine with the replat as well.
Mr. Jacobs stated that he would like to see the property designated as a park.
The Chairperson opened the floor to public comments on both PB‐22-015.
• Mr. Lightfoot read an email of objection into the record from Ms. Lashawnda Williams.
The email was sent to the Planning Board members on November 16, 2022.
• Antoinette B. Fischer – Ms. Fischer stated her objections with the project. She also stated
that the property should be used as a passive park for everyone in the community to
enjoy.
The Chairperson closed the floor to public comments on both PB‐22-015.
The Chair opened the floor to Board discussion.
Mr. Miller stated that the item was a request for second review of the plat. The item does not
approve any redevelopment of the site. By combining the property, it makes a more compelling
case for designating it as park space.
Mr. Jacobs stated that because of the TRA Policy 1.1.1, the City is in the transportation
concurrency exemption area which implies that the City doesn’t have the ability to manage LOS
in the City. He then stated that it wasn’t true, especially with the subject property. The City owns
it and can choose whether to build on it or not. Because all of the roads are a LOS F, the City
should be careful how the property is developed.
Mrs. Readon stated that the area is a historic area, and that the property should stay the way that
it is as an undeveloped property.
Motion: Mr. Basu moved to approve PB-22-015 as presented with the recommendation that the
City Commission consider the site as a passive park.
The motion was seconded by Mr. Jacobs.

NOTICE OF PUBLIC HEARINGS
In order to balance the need for the City of South Miami to function and
conduct vital business during the COVID 19 pandemic and, at the same time ,
to protect the health , safety and welfare of its citizens, officers, officials
and admin istrative staff, and pursuant City of South Miam i Code , Chapter
286 .011 , Fla. Stat, the City's Home Rule Powers, and City Manager's
declaration of a state of emergency due to the Coronavirus, the City will be
holding its City Commission Meeti ng live in chambers and VIRTUALLY
through communicat ions med ia technology (CMl) until the state of emergency
has ended or social distancing is no longer requ ired by any relevant Executive
Orders. All Commission members will participate in Chambers or by video
conferencing through the Zoom platform and members of the public may join
the meeting via Zoom at (htt s:/ zoom.usr/3056636338 and participate.
At a minimum, at least three members of the City Commission will be
physical ly present in the City Commission Chambers 1 and they will be
broadcast on the Zoom platform along with all other members of the
Commission, City Staff and the public who may attend remotely from the
Commission Chambers and from other locations .

the north 5 feet of the right of way described as the South 10
feet of Lot 37 W. A. Larkins Subdivision as recorded at Plat

months prior to appointment, and for at least three (3) years
as a resident elector of Miami-Dade County. An appointment
to the vacancy will expire upon the certification of the 2024
