discuss placing a morat orium o n, or re pealing, Sect ion 2 0 -3.G(W) concerning Solar
Requi r ements.
WHEREAS, o n Ju ly 6, 2021, t he Comm iss ion passed Ord i nance No.11-2 1-2401, am ending
Sect ion 20.3.6(W) of the City of South Miami's Land Development Code co ncerning Solar
Requ i reme nts; and
WHEREAS, t he Or dinance r equires t hat all new construct ion of single-fam i ly residences w it h
liv i ng area g r eater t han one thousand one hundred (1,100 ) square feet, townhouses, and mu lt i-story
res idential buildings where a section of the roof can be r easonably allocated to a separately metered
dwel l ing u nit, an d al l alterations o r add itions made to ex i st ing residential str uctures that eithe r
incr eases by seventy-fi ve pe r ce n t or m ore t he air-con d itioned square footage of t he stru ctu re, or that
replaces seventy-five (75) percen t or m ore of the existing sub-roof must either instal l solar collect ors
pay a fee to the City of Sou th Miami So lar Trust Fund ; and
WHEREAS, the r equirem ent to eithe r in sta ll so lar collectors or pay a f ee t o the City's So l ar
Trust Fu n d is b u r densome for t h ose required to im plemen t it, d issuades ind iv idua ls from bu i lding
within t h e City, and may make it difficu lt for property owners to obta in homeowners insurance1; and
WHEREAS, o n May 11, 20 21, after a pu bli c heari ng, the Plann in g Board co nside r ed t he
amendments and voted fi ve (5) t o one (1) to recom mend de n ia l of the proposed text changes; and
WHEREAS, the Mayor and Commission do not seek to impose unnecessary, burdensome,
requi reme nts that wo ul d i m pede b ui ldi ng w ithin our City and rely o n t h e recommendatio ns of t he
members of th e Planni ng Board and seek to d iscuss whether to place a moratori um on enforcing the
Ordinance until further notice or to repeal Sect ion 20-3.6(W).
NOW THEREFORE , BE IT RESOLVED BY TH E MAYOR AND CITY COMMISSIONERS O F T HE CI TY
OF SOUTH MIAMI, FLORIDA :
Se ction 1. The for ego i ng recit als are hereby ratified and confirmed as being true and they are
inco r po rated in to t his reso lu t ion by refere nce as if set forth in fu ll he re i n.
Se ction 2 . Th e City Commission will have a workshop regard ing the Solar Ordi nance. The City
/\ttorney is instructed to draft an ordinance p lacing a moratorium on enforcement of t he Section 20
3.6(W) co ncern in g Sol ar Requirements and also an a lternati>.•e ordinance repeal ing Section 20 3.6(W).

Section 5 . Effective Date. Thi s resol ution will become effective immed iat e ly u p o n ad opt ion .
