Res No 152-19-15424RESOLUTION NO. 152-19-15424 A Resolution relating to the review and approval of a Unity of Title request to unify the properties located at 5800 SW 87 Street (folio 09-4036-033-2020 ) and 5820 SW 87 Street (folio 09-4036-033-2050). WHEREAS, Scott Fuhrman, the owner of the properties located at 5800 SW 87th Street (folio 09-4036-033-2020) and 5820 SW 87th Street (folio 09-4036-033-2050), submitted a request for unity of title to combine the two (2) properties together; and WHEREAS, the Unity of Title request is in relation to the future renovation of the single-family residential property; and WHEREAS, the Planning & Zoning Department reviewed the unity of title request and finds it in compliance with the requirements of Section 20-5.16 of the Land Development Code; and . . WHEREAS, the unity of title must be approved by the City Commission and approved by the City Attorney as to form and content, and shall then be recorded in the public records of Miami-Dade County prior to the issuance of any building permits. Tompkins, Planning and Zoning Director Date: November 19, 2019 SUBJECT: A Resolution relating to the review and approval of a Unity of Title request to unify the properties located at 5800 SW 87 Street (folio 09-4036-033-2020 ) and 5820 SW 87 Street (folio 09-4036-033-2050). BACKGROUND: Mr. Scott Fuhrman, the applicant and owner of both 5800 SW 87 th Street and 5820 SW 87th Street is developing plans to make improvements to the properties so that it functions as one (1) single- family home. To accomplish this, the properties should be joined through a Unity of Title so that the improvements will comply with the Land Development Code (LDC). ANALYSIS: The Unity of Title is required for the project to comply with Section 20-5. 16{A)(2) of the LDCwhich states that a Unity of Title shall be required in the following cases: 1. Whenever the building site consists of more than one lot or parcel and the main building is located on one lot or parcel and auxiliary or accessory use buildings are located on the remaining lot or parcel comprising the building site. 2. Whenever the building site consists of more than one lot or parcel and the main building is located on one or more of the lots or parcels and the remaining lots or parcels encompassing the building site are required to meet the minimum zoning requirements. 3. Whenever a unity of title is required by a provision within this Code or is specifically required by an ordinance or resolution passed and adopted by the city commission. The applicant's intent is to make improvements to the properties that allow them to function as one building site. Both properties are currently developed with a single-family residence and customary amenities. Included in the planned improvements are a breezeway connecting the two houses, renovations to the house on 5800 SW 87 th Street (which will then serve as an 2 5800-5820 SW 87 Street -Request for Approval of Unity of Title November 19, 2019 Page 2 of 2 accessory building under the LDC), a redesign of the driveway so it serves both properties, and additional landscaping and wal~ways. If the properties are not joined, these improvements would cross the interior property line and consequently, they could not be permitted as they would not meet the required setbacks. Furthermore, without the Unity of Title, the plans would result in the accessory building and residential structure being on separate lots, as described in paragraph 1, above. For these reasons, the Unity of Title is required to allow the proposed development to proceed. PLANNING BOARD RECOMMENDATION: Not applicable. Unity of title applications are not reviewed by the Planning Board. Term.
