A Resolution auth orizing a temporary change in the permitted hours of construction

Drive between SW 61stAvenue and South Dixie Highway, and on SW 59th Place between
SW 71st Street and Sunset Drive.
WHEREAS, Pursua nt to Section 7-16(g) of Code of the Ordinances, a ll construction sites shall
comply w ith the city's noise code, and it provides in pertinent part as follows:
All construction sites shall comply with the city's noise code. Co nstru ction activity is limited to the
hours of 7:00 a.m . through 6:00 p.m. on the weekdays of Monday thru through Friday; and
between the hours of 9:00 a.m. through 5:00 p.m. on Saturday. No construction activity is
permitted on Sund ay. Notwithstanding the above, no construct io n activities sha ll take place in, or
within 500 feet of, resid entially zoned districts, other than those in the Hometown District, on
either Saturday or Sunday and, as to construction activiti es in non-residentially zoned districts and
in t he Hometown District, all days of the week and hours of the day may be changed by resolution
of the City Commission upon a find ing of extraord in ary circumstances.
WHEREAS, Solutions Construction, Inc (Subcontractor) wishes to perform Water and Sewer
connections for the proposed Mixed-use project cons isting of one Residential structu re located at
7025 SW 59th Pla ce. The work along the ri ght-of-way will be located West Bound on Sunset Drive
between SW 61st Avenue and South Dixie Hi ghway, and on SW 59th Place between SW 71st Street
and Sunset Drive; an d
WHEREAS, due to He avy traffic during daylight hours work is being proposed during night hours
to complete the work as quick and efficiently as possib le. In addition, Solutions Construction, Inc
(S ubcontractor) op erations at night will cause minimal traffic impact; and
WHEREAS, allowing construction activities at night may be changed by resol ution of the City
Commission upon it s finding of extraordinary circumstances; and
WHEREAS, Solutions Construction, Inc (Subcontractor) is requesting authority to conduct transfer
services during nig ht hours; and
WHEREAS, approva l of this request will not be detrimental or harmful to the surrounding area of
the community at l arge.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF
SOUTH MIAMI, FL O RIDA :
Section 1. The forego ing recitals are hereby ratified and confirmed as be ing true and t hey are
incorporated into t h is resolution by reference as if set forth in full herei n.
Section 2. The con struction hours are hereby changed temporarily for the current construction
activities of Solutions Construction, Inc (Subcontractor) for 10 weeks, from the date of permit

issuance o r until such t ime as the City Commiss ion or the City Manager revokes these exte nded
hours of operation . The te mpo r ary hours of construction operations are limited weekd ays to t he
h o urs of 10:00 PM to 6:00 AM, starting May 9,2022. The contractor sha l l hi re, at thei r own
expense, an off-du t y City of South Miami Polic e officer for these days and during these h o urs to
ensure that Solutions Construction, In c. complies with the City's ordinances and this r esolution .
The extended hours for construction activity authorized by this Resolution may also be red uced or
re vo ked upon determin ation of the City Manager in th e City Manager's so le and abso lute
discretion that a violation of any of the City's ordinance or this Resolution has occurred and has
not been resolved t o the City Manage r 's satisfaction or that, in the City Manager's opinion, the
noise level is excessive. This resolution may be r evoked at any time in the so le and absolute
discretion of the City Commis si o n.
Section 3. Corrections . Conforming language or technica l sc rive ne r-type corrections may be made
by the City Attorney for any con fo rming amendments t o b e incorporated into the final resolution
for signature.
Section 4: Severability. If any section, clause, sentence, or phrase of this reso lution i s fo r any
reason he ld invali d o r unconstitutional by a court of co mpetent ju r is diction, the holding wi l l not
affect the validity of the remaining portions of this resolution.
Section 5: Effective Date: This resolution will become effective immediately upon adoption.

BACKGROUND:Water & Sewer connections are being completed along the Right of Way for
TREO SoMi Station at 7025 SW 59 Place. Ordinance No. 5-15-2212 amends
Section 7-16 (g) of the Code of Ordinances of the City of South Miami and
provides for Commission approved change in construction days and hours of
operations whereby Construction activity is limited to the hours of 7:00 AM
through 6:00 PM on the weekdays of Monday through Friday; and between the
hours of 9:00 AM through 5:00 PM on Saturday. No construction activity is
permitted on Sunday.
Due to Heavy traffic during daylight hours work is being proposed during night
hours to complete the work as quick and efficiently as possible. In addition,
Solutions Construction, Inc (Subcontractor) operations at night will cause
minimal traffic impact and allow the contractor to perform Water and Sewer
connections for the proposed Mixed-use project consisting of one Residential
structure located at 7025 SW 59th Place. The work along the Right-of-way will
be located West Bound on Sunset Drive between SW 61st Avenue and South
Dixie Highway, and on SW 59th Place between SW 71st Street and Sunset Drive.
Workdays are Monday thru Friday and work hours will be night work from 10PM
to 6AM. This MOT will be in place for 10 Weeks or less starting May 9,2022.
Solutions Construction, Inc., is requesting a waiver to allow them to work
weekdays between 10:00 PM to 6:00 AM for Phase 2.
REQUEST:The Resolution attached is to waive the limitation on hours of construction, as
authorized by the Ordinance 5-15-2212

RE: VOX Miami Phase 2 MOT Introduction
Dear Shari Kamali:
This letter is to inform you of all the summary & details of the maintenance of traffic (MOT) plans
submitted by us; Solution Construction Inc, for own work on VOX Miami, a mixed used project
consisting of one residential tower.
Solution Construction’s work will be done following our MOT Plans attached for Vox Miami Phase 2 of
the overall project. We will be performing Water & Sewer connections .
MOT Plan Description
Location: The work area will be one lane going west bound on Sunset Drive between SW 61st
Ave & South Dixie Hwy and on SW 59th PL Street between SW 71st Place & Sunset Dr. A police
officer will also be always present during work hours
Duration: Workdays are Monday thru Friday and work hours will be night work from 10PM
to 6AM. This MOT will be in place for an estimated time of 10 Weeks.
Note: The MOT will be assembled and disassembled daily. Open trenches will be properly
covered with steel road plates to resume vehicular traffic

An Ordinance amending Section 7-16. (g) of the Code of Ordinances of the
City of South Miami in pertinent part to provide for Commission approved
change in construction days and hours of operation.
WHEREAS, from time to time a project that will benefit the City of South Miami may,
due to extraordinary circumstances require work to be performed on Sundays and earlier than
9:00 a.m. on Saturdays and
WHEREAS, the Mayor and the City Commission desire to provide for more flexibility
under extraordinary circumstances for changing the days and hours of permissible work.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Section 7-16. (g) of the Code of Ordinance of the City of South Miami is
hereby amended in pertinent part to read as follows:
Sec. 7-16. -Pre-construction and construction standards for sites.

(g) All construction sites shall comply with the city's noise code. Construction
activity is limited between !Q_the hours from of 7:00 a.m. through-6:00 p.m.,on the
weekdays of Monday thm through Friday; and between the hours of 9:00 a.m. through
5:00 p.m. on Saturday.hours shall be from 9:00 a.m. to 5:00 p.m. No construction activity
is permitted on Sunday. Notwithstanding the above, no construction activities shall take
place in, or within 500 feet of, residentially zoned districts, other than those in the
Hometown District, on either Saturday or Sunday and, as to construction activities in
non-residentially zoned districts and in the Hometown District, all days of the week and
hours of the day may be changed by resolution of the City Commission upon a finding of
extraordinary circumstances.
Section 2. Codification. The provisions of this ordinance shall become and be made
part of the Code of Ordinances of the City of South Miami as amended; that the sections of this
ordinance may be renumbered or re-lettered to accomplish such intention; and that the word
"ordinance" may be changed to "section" or other appropriate word.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances,
that give the appearance of being in conflict when the two ordinances can be harmonized or
when only a portion of the ordinance in conflict needs to be repealed to harmonize the
ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby
amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed
to harmonize the two ordinances shall be repealed.

I listened to the meeting and the following is what I believe the amendment to have been to both ordinances.
Sec. 7-15.2. -Demolition requirement standards.
