Res No 039-22-15792RESOLUTION NO. 039-22-15792 A Resolution authorizing the City Attorney to hire a legal expert in condominium conversion, to provide the City of South Miami with legal representation for the purposes of converting the ownership in the parking garage and related City retail space to a Condominium form of ownership. WHEREAS, the City Commission is in the process of approving the purchase of Mark Richmond Properties leasehold interest in the City's parking garage; and WHEREAS, the City's parking garage is integrated with the City's retail space; and WHEREAS, the City's retail space is being leased to MRP for a term of 50 years; and WHEREAS, the Miami-Dade County Property Appraiser considers all municipal property that is being leased in whole or in part to a non-governmental entity, such as MRP, to be taxable; and WHEREAS, the Miami-Dade County Property Appraiser will tax the City's retail space separately from the City parking garage if the two properties are owned as separate condominium units; and WHEREAS, in 2016 the South Miami Community Redevelopment Agency (CRA) hire George Lott to convert the "Mobley" building to a condominium form of ownership; and WHEREAS, in 2016 the CRA receive three legal service estimates received ranging between $10,000 and $18,300 to complete the condominium conversion of the Mobley building; and WHEREAS, the CRA authorize its General Counsel to select professional legal services for an amount not to exceed $18,300 to complete a condominium conversion of CRA owned commercial property at 5825 SW 68 th Street for the purpose of achieving tax exempt status for some of the units: and WHEREAS, since time is of the essence in converting the ownership to the City retail space and the parking garage to a condominium form of government, the City Commission desires to authorize the City Attorney to select and hire an attorney licensed to practice law in the State of Florida and who has experience in condominium conversion. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. Section 2. The City Attorney is authorized to select and hire an attorney licensed to practice law in the State of Florida and who has experience in condominium conversion for an Page I of2 Res. Severability. lf a ny section clause , se ntence, or phrase of this resolution is for any reaso n held invalid o r uncon st itutiona l by a cou1t of competent jurisd iction, the holding w ill not affect th e va lidity of the rema ining portions of this resolution.
