Please be informed that I am the owner of the property
located in the Townsite of Larkins, Lots 10, 11 and 12 ;
Block 8, PB 2/105 . This is at the corner of South West
68th Street and 58th Place and is 'vacant land.
At the Planning Board meeting on September 24, 1974, Mr.
Ralph Coker, Jr. and Mr. T. R. Crockett, my two immediate
neighbors, requested a change of zoning from RS-4 (single
family) to C-3 (arterial commercial) ; the Planning Board
approved both requests and is recommending C-3 zoning to
the City Council on both pieces of property.
In 1973 Mr. LaPlante, whose property is at the other end
. .._ of the block from me, next to Mr. Crockett, had his property
reinstated to the C-3 zoning that the entire block had been
when we bought it in 1966.
Mr. James Duncan, the attorney for the Council, suggested
at that time that this whole strip on 68th Street be re-
instated back to C-3 but it was not done . My property on
the corner is next to a plumbing company and across the
street from warehouses, a junk yard and an air conditioning
company.
I would like to -do something with the property that would
both provide me with some income and the City with some
tax revenue.
Please consider my request to re-zone the whole strip, includ-
ing my property back to C-3.

frontage property with the rear building setback non-conforming
and set closer to the street than our present code permits.
She further requested that City Administration work out some

Mr. Monroe Dixon, President of Fidelity National Bank of South Miami, and
Messrs. Ferguson and Schuster, Architects, presented the request to the
Board.
Mr. Russe stated that Administration would object unless assurance is given
that the main wall structure of the building will continue at the 14.34 '
setback this structure now has. Mr. Dixon assured Mr. Russe and the Board
members that this would be done.
Mr. Russe stated that Mr. Robert F. Cook, Director of Dade County Building
and Zoning Department had telephoned him and stated that he would withdraw
his objections to the applicant's request if the 14.34 ' front setback
was adhered to.

Mr. Russe stated that Administration would require a Unity of Title on
the subject property.
Mr. Dixon presented, to the Board a copy of a Certificate of Corporate
Resolution and a. proposed Unity of Title.
Vice Chairman Masters asked if there was anyone present who wished to
speak for or against granting the request of the applicant and there was
_ not. Vice Chairman Masters declared the public hearing closed, and a
discussion was had by the Board.

Mr. Harris N. Steinberg, C.P.A. , of 8520 S. W. 89th Avenue, presented the
request to the Board. He stated that Mrs. Herman had previously requested
a change of zoning to C-3 and at the meeting of January 14, 1975 was
advised by the Board that the lot was undersized for C-3 zoning and that
C-1 zoning would be considered. Therefore she amended her application to
request C-1 zoning.
Vice Chairman Masters read into the record the Minutes of the meeting
of January 14, 1975 pertaining to the motion to defer the hearing to the
next meeting and the reasons for so doing.
MOTION: By Mr. Coburn, seconded by Mr. Fleischer, to recommend granting
the request of the applicant.

EXECUTIVE SESSION:
A discussion was had by the Board concerning the possible rezoning of the
city block bordered by S. W. 40th Street, S. W. 41st Street and S. W. 59th
Avenue and S. E. 58th Avenue. It was noted that this block presently
consists of three different zonings, namely C-3, C-2 and RS-4. The parcels
owned by the Fidelity National Bank of South Miami are zoned C-3 and C-2
while the parcels adjoining both sides are zoned RS-4.
Mr. Russe' suggested that the 15 ' grassy strip presently existing on the
east block of S. W. 41st Street be extended through to S. W. 59th Avenue.
MOTION: By Mr. Fleischer, seconded by Mr. Coburn, that paragraph
5-14-3.08L of the Code of Ordinances be deleted and that
paragraph 5-14-4 shall be amended substituting a. new .03
as follows: "Wherever. the use abuts or faces a. residential
district there shall be provided a 15 ' wide landscaped area
beginning at the property line and running the length of that
side' and then a 5 ' high unbroken wall be provided and providing
no ingress or egress to parking", and renumbering .04 to .05
and .05 to .06
VOTE IN FAVOR OF MOTION: Yes - (5)
MOTION CARRIED.
MOTION: By Mrs. Masters, seconded by Mr. Fleischer, that the City
Manager obtain a recommendation from the Zoning Consultant

said recommendation will be provided to the Planning Board
by its last meeting in April.

neighbors, requested a change of zoning from RS-4 (single
family) to C-3 (arterial commercial) ; the Planning Board
approved both requests and is recommending C-3 zoning to
the City Council on both pieces of property.
In 1973, Mr. LaPlante, whose property is at the other end
- of the block from me, next to Mr. Crockett, had his property
reinstated to the C=3 zoning that the entire block had been
when we bought it in 1966.
Mr. James Duncan, the attorney for the Council, suggested
at that time that this whole strip on 68th Street be re-
instated back to C-3 but it was not done. My property on
the corner is next to a plumbing company and across the
street from warehouses, a junk yard and an air conditioning
company.
I would like to -do something with the property that would
both provide me with some income and the City with some
tax revenue.
Please consider my request to re-zone the whole strip, includ-
ing my property back to C-3.

the property showing what the bank will look like when completed. Mr. Dixon
stated that there will be no changes- to the front of the building as it
exists today, that there will be adequate parking facilities, all proposed
additional floors will be used for the bank's purposes and that the total
square footage of the bank with the proposed addition would be approximately
37,000.
Chairman Pierce read into the Minutes a letter from Mr. Robert F. Cook,
Director of the Dade County Building and Zoning Department, dated December 10,
1974 and addressed to the City of South Miami Planning Board, stating that
the Bird Road area has been developed basically with low profile buildings
(mainly one or two stories, with a few at three stories) and that the County
feels that this height should not be exceeded and further that they are
aware of no legal zoning hardship which would warrant the granting of a
variance to permit a four story building.
After a discussion by the Board, Chairman Pierce asked if there was anyone
present who wished to speak either for or against the applicant and there
was not. Chairman Pierce then declared the public hearing closed.
MOTION: By Mr. Fleischer, seconded by Eva Longbrake to recommend to
the City Council that the application be denied due to lack
of hardship.

Request: Approval of Tentative Plat of DAVIS DRIVE SUBDIVISION.
Legal Description: Sz, S2, SEh, NE4, Section 35-54-40, less the East
1013 .42 ' , less the South 35 ' , less the West 251 .
Location: 69th Avenue and 80th Street.
Mr. Compare presented his request to the Board stating that this request
conforms to the zoning in the area, there is city water available and
there are no sewers in the area and septic tanks will be used. The tentative
plat has been approved by Dade County Building and Zoning Department subject
to the City of South Miami's building requirements, and also approved by
Pollution Control.
Mr. Russe stated that the lots are all 15, 000 Sq. Ft. or better.
Chairman Pierce read into the record a letter received from Mr. Antonio
Gonzales, of J. B. Ford Company, Engineers-Surveyors, requesting the waiver
of the concrete sidewalk requirement for the reasons that (1) The construction
of concrete sidewalks in this subdivision will be irrelevant because they
will only serve a. very small portion of area surrounded by residences
without any sidewalks; (2) The pedestrian traffic by these concrete side-
walks will only serve 7 new residences which are assumed to be small
contributors to pedestrian traffic; and (3) The existing asphalt sidewalk
located on SW 80th Street should be preserved in order to obtain a, better
harmony with the surroundings, giving the area of forest like or wood like
appearance of natural beauty.
Chairman Pierce asked if there was anyone present who wished to speak in
favor of the applicant.
Mr. Carl H. Snyder of 6890 S. W. 78th Terrace and Mr. Robert W. Gordon of
7871 S. W. 69th Avenue spoke in favor of granting the request of the applicant
stating that, in their opinion, this was the highest and best use of the
property, a fine development for the neighborhood and also requested that
the requirement for concrete sidewalks be waived.
Chairman Pierce asked if there was anyone present who wished to speak against
the request of the applicant and there was not. Chairman Pierce then declared
the public hearing closed.
MOTION: By Mr. Fleischer, seconded by Mr. Pierce, to recommend to the
City Council that the Tentative Plat of DAVIS DRIVE SUBDIVISION
be approved and further recommending to the City Council that
it be approved without the sidewalk requirement, if it can be
done, the fence should be retained, the landscaping should be

this parcel to be used as C-3 it would have to have 100' x 1001 . Since it
does not, granting this request would cause a. self-imposed hardship on the
applicant.
Chairman Pierce asked if there was anyone present who wished to speak either
in favor of or against the request of the applicant and there was not.
Chairman Pierce declared the public hearing closed.

Request: ' Home Occupational License in a RS-3 (Single Family Residence)
use, within a RO (Residential Office) zoned district.
Legal Description: The East 80.30 feet of Lot 1, Block 4, FAIRGLADE PARK,
PB 45/80.
Location: 7700 Red Road.
Dr. William D. Glenn presented the request to the Board explaining that the
purpose of the request was to allow two sisters to live in the property and
to allow one of them to carry on a part time job .as an employment consultant
and that the major use of the property would be residential. He stated that
she works alone with no assistants or secretary and does not .advertise in
the newspapers.
Chairman Pierce noted that the address of 7700 Red Road, as appears in the
application and Notice of Public Hearing, is incorrect and that the correct
address is 5700 S. W. 77th Terrace.
Chairman Pierce asked if there was anyone present who wished to speak in
favor of the applicant and there was not.

Ms. Ernestine Hyde Jordan spoke against granting the request of the applicant
stating that she operates an employment agency (South Miami Employment
Services, Inc. ) at 7600 Red Road, Suite 302 . Mrs. Jordan said that she is
licensed by the Secretary of State and is a professional; that there is` no
way to have an employment office without having people coming and going and
in order to get people to come into the office one has to advertise in the
newspapers.
Mr. Ed Corley of 5764 S. W. 77th Terrace spoke against granting the request
of the applicant stating that although Dr. Glenn had stated that Ms.
McDonald would not advertise, there was at one time a large sign on the
subject property stating the name of the employment agency and that said
sign had been removed upon the request of the Code Enforcement Officer.
Mr. Edward Sties addressed the Board stating that he lives in the house
directly opposite the one occupied by Ms. McDonald and her sister and that
for some time his family has been inconvenienced by the fact that the sisters
have a number of dogs which bark and keep the family awake at night. He
stated that he would not object to having a. professional building at the
address in question.

Dr. Glenn spoke on rebuttal stating that the use requested would be a less
commercial use, that Ms. McDonald would get rid of two of the dogs and would
restrain the ones they keep from barking but they needed the dogs for
protection.
Ms. McDonald addressed the Board and stated that she would not be competing
with the South Miami Employment Service, Inc. since her type of operation
is entirely different in that she interviews only executives such as bank
vice-presidents and the like. She further stated that within 15 days she
would be merging with a large employment company from New York who will be
operating from a suite of offices on Brickell Avenue.
MOTION: By Mrs. Masters that the hearing be deferred until the next
regular meeting so that Dr. Glenn may have an opportunity to
file a corrected application inasmuch as Dr. Glenn has given
a valid reason for the incorrect address on his application.
MOTION DIED FOR LACK OF SECOND.
MOTION: By Mr. Pierce to deny the request of the applicant since, as
Ms. McDonald has stated that she will merge with an organization
having offices on Brickell Avenue within 15 days, there is no
need for a Home Occupational License to be issued for a residence
since she will be capable of carrying on her business out of the
offices on Brickell Avenue which she says she will be merging
with. Motion seconded by Mr. Fleischer and in seconding the
motion further wished to include in the motion the fact that
ordinarily Home Occupational Licenses are issued to people
with limited mobility, generally by reason of dissability, a.nd
there is non apparent.
VOTE NOT CALLED FOR.
A discussion was had by the Board and it was the general opinion that during
the previous year an Ordinance had been passed by the City Council governing
the issuance of Home Occupational Licenses. Since none of the members had
a copy of this Ordinance it was felt that a. recess should be had in order
to research this matter.
Chairman Pierce withdrew his motion and Mr. Fleischer withdrew his second.
Chairman Pierce called a recess in order for the Board to research any action
which may have been taken by the City Council with regard to the issuance of
Home Occupational Licenses. Meeting recessed at 9:00 P. M.
Chairman Pierce called the meeting back to order at 9:15 P. M.
MOTION: By Mr. Pierce, seconded by Mr. Coburn, to recommend denial of
the request for Home Occupational License because it was
improperly filed in that the address noted on the application
and Notice of Hearing is incorrect and that the applicant is
Dr. Glenn and not Ms. McDonald, the party actually requesting
the Home Occupational License, and if the request is granted

EXECUTIVE SESSION:
MOTION: By Mrs. Masters to amend the Minutes of the Meeting of the .
Planning Board of December 10, 1974 by amending the last
sentence of the second motion on page 1 to read
all possible avenues of alleviating the existing parking
problems had not been exhausted. "
MOTION: By Mrs. Masters, seconded by Mr. Fleischer t0 approve the
Minutes as amended.

MOTION CARRIED.
MOTION: By Mrs. Masters that the Planning Board make a recommendation
to the City Council that there be a slight revision in the
Zoning Ordinance that employment offices be permitted in RO
zoning.
After a discussion by the Board Mrs. Masters withdrew her motion.
A discussion was h.-.d by the Board with regard to the Financial Disclosure Law.
MOTION: By Mr. Pierce, seconded by Mrs. Masters, to recommend that
the Planning Board Members be reimbursed by the City for any
filing fees incurred with regard to filing their forms under
the Financial Disclosure Law.

A discussion was had by the Board with regard to tennis court requirements.
Mrs. Masters asked Mr. Russe if he had received any applications for a
tennis court and Mr. Russe stated that he had received none. It was agreed
by all members to defer this item of business to the next regular meeting.

REMARKS
Mrs. Masters stated that the City is remiss is seeing that the empty lots
are mowed. Mr. Godwin stated that these lots are being taken care of.
Mrs. Masters stated that there are two houses and possibly more, one on
79th Street east of 62nd Avenue, sewer lines are in but people have not
connected. She stated that it was her understanding that when sewer lines
are in the people are required to hook up. Further, she stated that in
the area on 78th Street zoned for townhouses, several of the houses there
are not tied in to the sewer. She suggested that someone from the City
check to see why these houses are not tied in as this is a health hazard.
Mrs. Masters stated that required paving on 59th Avenue and 74th Street has
not been completed.
Mrs. Masters stated that required curbs and gutters for the duplex in front
of the Elks Lodge ha.s not been completed. Mr. Godwin stated that for this
reason the building has not been issued a. CO and that no CO will be issued
for the building until the curbs and gutters are installed.
Mr. Fleischer requested that at the next regular meeting of the Planning
Board each member be furnished with a copy of Ordinance No. 17-73-788
which pertains to Occupational Licenses.
Mr. Fleischer requested that each Board member be furnished a. copy of the
book of Code of Ordinances.
MOTION: By Mr.. Pierce, seconded by Mrs. Masters, that the Board recommend
to the City Council that Zoning-In-Progress Ordinance be applied
against C-2 and C-3 zoning, due to the fact that the Zoning Task
Force and the City Attorney, at the present time, are drawing
up new ordinances pertaining to these two districts.
After considerable discussion concerning commercial district zoning regulations
and the changes being made by the Zoning Task Force, Mr. Pierce withdrew his
motion.
MOTION: By Mr. Fleischer, seconded by Mr. Coburn, that the secretary
transcribe from the tape that portion of the Minutes pertaining
to the motions made in the hearing on ##75-2 (Mrs. Herman) for
presentation to the Board.

PROCEDURE ON APPLICATION FOR HEARING BEFORE THE PLANNING BOARD
1. SECURE APPLICATION FORMS FROM THE ZONING DIRECTOR'S OFFICE.
2. HAVE SKETCH OR PLANS WITH SUFFICIENT DETAILS INDICATING THE VARIANCES OR EXCEPTIONS
REQUESTED. FOR CHANGE OF ZONING, PLANS MAY NOT BE REQUIRED. THE APPLICANT IS INSTRUCT-
ED THAT A SEPARATE APPLICATION WILL BE REQUIRED FOR VARIANCES AND EXCEPTIONS AFTER THE
CHANGE OF ZONING HAS BEEN GRANTED BY COUNCIL.
3. FILL OUT THE APPLICATION COMPLETELY AND ACCURATELY WITH SURVEYS, PHOTOS, PLANS9 ETC.
AS NEEDED BEFORE SUBMITTING TO THE ZONING DIRECTOR.
4. SUBMIT THE APPLICATION TO THE ZONING DIRECTOR AT LEAST THREE (3) WEEKS PRIOR TO THE
PLANNING BOARD MEETING. A FEE OF $50.00 IS REQUIRED AT THE TIME THE APPLICATION IS FILED.
5. REGULAR PLANNING BOARD MEETINGS ARE HELD TWICE PER MONTHS ON TUESDAY PRECEDING THE
REGULAR COUNCIL MEETING. (COUNCIL MEETS ON THE FIRST AND THIRD TUESDAY OF EACH MONTH).
THE MEETINGS ARE HELD IN THE COUNCIL CHAMBERS9 CITY HALL AND BEGIN AT 88 00 O'CLOCK P. M.
6. THE APPLICANT (OR HIS AGENT) SHOULD REPRESENT HIMSELF AT THE PLANNING BOARD MEETING.
THE APPLICANT WILL BE EXPECTED TO PRESENT HIS CASE WITH PLANS PETITIONS, AFFIDAVITS
OR ANY OTHER DATA WHICH HE FEELS WILL HELP IN HIS PRESENTATION. THE PLANNING BOARD
WILL ACT ON THE APPLICATION BASED ON THE INFORMATION AVAILABLE IF NO ONE IS PRESENT TO
SPEAK ON BEHALF OF THE APPLICANT.
7. THE PLANNING BOARD WILL MAKE ITS RECOMMENDATIONS TO THE COUNCIL WHICH WILL THEN ACT
ON THEM.
8. THE APPLICANT SHOULD BE PRESENT AT THE COUNCIL MEETING TO PRESENT HIS CASE AT WHICH
TIME THE COUNCIL WILL PASS A RESOLUTION OR ORDINANCE, APPROVING OR DENYING THE REQUEST
MADE BY THE APPLICANT.
9. A CHANGE OF ZONING, VARIANCE OR EXCEPTION REQUIRES AN ORDINANCE BE ADOPTED BY COUNCIL.
THIS BECOMES EFFECTIVE AFTER COUNCIL HAS TAKEN ACTION AT TWO CONSEQUENT MEETINGS.
THE ORDINANCE BECOMES EFFECTIVE UPON ADOPTION AFTER THIRD READING.
