I am in the process of purchasing a property at 5858 SW 68th Street in South Miami. The tax folio
number is 09-4025-028-1240. The property tax information shows that it is zoned heavy industrial
and/or lumber yard. I would like to clarify the actual zoning category for this property and would
appreciate if you could email me the permitted uses for this property.

Pursuant to your request, the property located a -585.8-SW 68F Street-South Miami, is within the TODD
L14 zoning district, which allows"Medical Office"as a perm�itted� use. The term "surgical center'would be
permissible for out-patient procedures only. A medical office is not specifically defined in the City's
Land Development Code; however this Department in the past has always considered out-patient surgical
procedures, MRI procedures, X-rays, etc., and clinic type services performed by licensed professionals to
be within the definition of medical office. This interpretation does not include overnight stays. In-patient
medical or surgical procedures and care is not a permitted use within the TODD LI4 district.
With regards to your question about a variance process to change the designation; variance requests are
limited to issues relating to structures, lots, parking, landscaping, etc. [Section 20-5.9(G)of the City's
Land development Code]; variances to use are not permitted. If it is your intention to utilize this
property for in-patient surgical procedures and care, you would need to petition the City's Planning Board
and the City Commission for a text amendment to the City's Land Development Code to allow the use
within this district.
Please note that you are required to submit plans to the Planning Department and obtain all necessary
approvals, permits and business tax licenses prior to commencing operations. Please do not hesitate to
contact the Department if you need additional information or clarification on the stated items. Thank you.

We spoke on the phone today about the property located at 5858 SW 68th street. The code for the
property is TODD-1_I4 the permitted use schedule is listed as medical offices, with a parking space
requirement of 1 space for every 200sq ft. I need to know if the term"Surgical Center" is a permitted use
for the property, and if any requirements attach to that designation. If it is not designated at a"Surgical
Center", is there a variance process to change the designation? If so, please detail the necessary steps.
