RESOLUTION NO. 027-22-15780 A Resolution appointing Javier Baena to serve on the Environmental Review and Preservation Board as a Florida Registered Architect for a two- year term ending March 1, 2024. WHEREAS, the Mayor and Commission recognize the important contributions made by those who serve on the various city boards and committees, and wish to appoint a full complement to each of the active boards and committees; and WHEREAS, pursuant to Article VI, section 20-6.1 (C)(l )(a)(iii) of the Land Development Code, board membership shall include two (2), but no more than four (4), architects licensed to practice in the State of Florida; and WHEREAS, the City Commission desires to appoint Javier Baena to serve for a two- year term· on the Environmental Review and Preservation Board. Appointment shall expire March 1, 2024 or until a successor is duly appointed and qualified, or until removed; and WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2) consecutive two-year terms of membership on a specific commission, board, or committee. After serving a maximum of two (2) consecutive year terms, an appointee shall not be reappointed to the same commission, board or committee unless at least one year has elapsed between the term limited position and the effective date of commencement of the proposed appointment for a new term; and WHEREAS, pursuant to Sec. 2-22 "Term Limits" of the Code of Ordinances, this will be Mr. Baena's first two-year term. NOW, THEREFORE, 'BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and they are incorporated into this resolution by reference as if set forth in full herein. Section 2. The City Commission hereby appoints Javier Baena to the Environmental Review and Preservation Board. Section 3. The expiration date of this appointment shall be March 1, 2024, or until a successor is duly appointed and qualified, or until removed. Section 4. Corrections. Conforming language or technical ~crivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 5. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding will not affect the validity of the remaining portions of this resolution.
