Res No 025-22-15778RESOLUTION NO. 025-22-15778 A Resolution approving a special event and authorizing the City Manager to permit Power House MKT GRP, LLC to host its first annual SOMI Spring Jazz & Music Festival at Palmer Park on Sunday, May 1, 2022 and to waive certain special event fees. WHEREAS, Power House MKT GRP, LLC ("the applicant"), has submitted a Special Event Application to host its first annual SCMI Spring Jazz & Music Festival (lithe Festival") at Palmer Park on Sunday, May 1, 2022 from 12:30 p.m. to 9:00 p.m.; and WHEREAS, event set-up and clean-up is scheduled from 7:00 a.m. to 12:00 p.m. and 9:30 p.m. to midnight, respectively; and WHEREAS, the proposed Festival will consist of a variety of live musical genres, including jazz, rock, salsa, and R&B. There will be a DJ, arts and crafts vendors, inflatables for children, food trucks, and apparel sales at the event; and WHEREAS, according to the applicant, ticket sale prices will range between $25.00 and $35.00 per person, and the anticipated attendance is 1,500 to 2,500 guests. The applicant is planning to sell general tickets online as well as on the day of the event at the park entrance; and WHEREAS, due to the scale of the proposed event and potential impact that it may have on general traffic flow as well as area residents, the following recommendations are strongly suggested for adoption should this event be approved: 1. applicant must hire an experienced, licensed, and insured security firm; and 2. applicant must hire Fire Rescue; and 3. no ticket sales on the day of the event or at park entrance; and 4. cap attendance/ticket sales at 1,500 guests max; and 5. applicant to provide a minimum of two (2) portable restrooms; and 6. applicant must obtain parking approval from SM K-S Center, SM Middle Community School, and Girl Scout South Miami Little House; and 7. at a minimum, applicant must show proof of notification (signatures) about the event to neighbors who reside on SW 59th St., 60th St., 6pt St., 61st Ter., 62nd Ter., 63 rd Ter., and along 67 th Ave/Ludlam Rd.; and S. maximum of four (4) food truck vendors are permissible. Vehicles, including food trucks are not allowed on the infields, nor in the park during inclement weather; and 9. the City is not responsible for theft or damage to applicant or his/her sub-contractor's property, etc. All equipment must be picked up by 12:00 PM on the following day, May 2, 2022; and 10. no fee waivers for city facilities and/or services; and 11. increase the refundable security deposit from $500 to $7,000; and Page lof3 Res. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. Section 2. The City Manager is hereby authorized to permit Power House MKT GRP, LLC (lithe applicant"), to host its first annual SOMI Spring Jazz & Music Festival ("the Festival") at Palmer Park on Sunday, May 1, 2022 from 12:30 p.m. to 9:00 p.m.; provided the applicant agrees to all of the conditions set forth in the recitals. The applicant is also in contact and plans to hire a security firm to assist with running the event safely. Due to the scale and impact of an event of this magnitude, City staff recommends increasing the refundable security deposit from $500 to $7,000 for immediate field or property damage caused by event operations. No Street shall be closed without approval from the City Commission. 4. Traffic shall be maintained in accordance with Florida Department of Transportation (FOOT), Miami·Dade County standards and any additional requirements by the City of South Miami Public Works Department and Police Department. S. EVent areas shall be restored to equal or better condition than they were before the event started. 6. 'Any damage to private property shall be restored to its original condition or better and as accepted by the Owner caused by applicant or any of its agents, servants or employees, invitees and onlookers. 7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public Works Department may restore the event area and charge the applicant for the cost of restoration and additional incidental fees. 8. Applicant must pay all fees prior to the date of their event(s). 9. Applicants shall notify the City of South Miami Special Event Coordinator at least forty-eight (48) hours prior to start of their event of any cancellations to be considered for any refunds.
