The Pledge of Allegiance to the Flag of the United States was followed by the roll call. PRESENT: James Bowman Edward Coburn Jacques Fleischer Eva, Longbrake Pat Masters Harvey Pierce Robert Regan { Mr. William Godwin, .Public Works Director, Mr. Gilbert Russe, Building Official, and Lt. Cochran and Mr. Tarrant of the Metropolitan Dade County Fire Department were also present. The first item to come before the Board was approval of the Minutes of the Meeting of September 10, 1974. MOTION: By Mr. Fleischer, seconded by Mr. Coburn, to approve the Minutes of the Meeting of September 10, 1974. Mrs. Masters suggested that approval of the Minutes be deferred until after the Public Hearings and discussion with Lt. Cochran and Mr. Tarrant. Mr. Fleischer withdrew his motion to approve and Mr. Coburn withdrew his second to the motion. MOTION: By Mrs. Masters, seconded by Mr. Bowman, to defer approval of the Minutes of the Meeting of September 10, 1974 until after the Public Hearings and discussion with Lt. Cochran. Ft. (10,000 Sq. Ft. required) . Legal Description: Lot 12, Block 1, SEAVIEW PARK, PB 17/80. Location: 5751 S. W. 84 Street. Robert M. Brake, Attorney for the applicant, requested that both hearings be heard at the same time. Mr. Ben Hendricks, Jr. , Attorney representing Mrs. Margaret Shaw who owns property adjacent to the properties at Lot 12, Block 1 and Lot 16, Block 2, SEAVIEW PARK, requested that the hearings be heard separately. Mr. Brake presented the request of the applicant to the Board and offered into evidence four photographs of houses which have been built on 40 foot lots (two of which are located in Coral Gables) ; Affidavit of John G. De War and Ruth A. De War, his wife, stating that they are the owners of Lot 12, Block 1 and Lot 16, Block 2 of SEAVIEW PARK, PB 14/34, that said lots were obtained by Warranty Deed dated September 15, 1962 from Agnes T. Beatty as Grantor, and John G. De War and Ruth A. De War, his wife, Grantees, that the said Grantor, Agnes T. Beatty, now deceased, was the mother of Ruth A. De War, and said property was deeded by Agnes T. Beatty to John G. De War and Ruth A. De War as part of the distribution of the Estate of Agnes T. Beatty and at no time did either Agnes T. Beatty or John G. De War and Ruth A. De War ever own any of the lots which are immediately adjacent to the two lots in question; Warranty Deed between Agnes T. Beatty and John G. De War and Ruth A. De War dated September 15, 1962 ; and Warranty Deed No. E16551 of Clifford Country Estates, Inc. These documents were accepted by the Chairman and made a permanent part of the file. Mr. Hendricks spoke in opposition to granting the request of the applicant stating that a 40 foot lot is too narrow to provide for the necessity of an aesthetically appealing residence. He stated that granting of these variances would create a hardship to his client, Mrs. Shaw, who owns the adjacent properties . Mr. Hendricks questioned the validity of the original application inasmuch as Shirley Homes, Inc. is not the owner. Chairman Pierce stated that Power of Attorney had been given by Mr. and Mrs. De War to Shirley Homes, Inc. and Robert M. Brake to act in their behalf in this application. Chairman Pierce asked if there was anyone present who wished to speak in favor of or against granting the request of the applicant and there was not. The question was raised as to whether or not the property was contracted for with the knowledge that. the lots do not conform. It was further felt that houses on 40 foot lots consisting of 4, 800 Sq. Ft. would be detrimental to the health and welfare of the City because of problems with parking and septic tank placement. It was the opinion of the Board that while the owner of a property is entitled to the highest and best use of his property, its use must be in accordance with the laws designed to protect the interest of the majority. Cochran and Mr. Greenwald of the Metropolitan Dade County Fire Department and they had been present and waiting for some time. REMARKS A discussion was had with Lt. Cochran and Mr. Tarrant (Mr. Tarrant in place of Mr. Greenwald who could not attend) regarding the fire code, fire prevention and fire protection in the City of South Miami. Various questions were raised by the Board members concerning the adequacy of the water supply in the City, inspection of high rise buildings and the require- ment of redevelopers to bring water systems up-to-date. A discussion was had by the Board concerning the number of fire hydrants in the City and it was the general consensus of the Board that the number of fire hydrants within the City limits needs to be increased. The Board merrbers were also in agreement that a. general survey of the City' s water supply and availability should be made. A discussion was had concerning overgrown lots within the City and in particular the lot at 80th Street a.nd 67th Avenue and also overgrown lots along the south side of Sunset Drive. The question was raised as to whether our Ordinance governing overgrown and unkept lots was adequate and that it should be reviewed and revised, if necessary. A discussion was had about Planning Board procedure in hearing applications and improving communications with the City Council. A discussion was had about Melaleuca trees being replaced, not just removed.
